1. The Commission is aware of the issues referred to by the Honourable Member and recalls that structural problems in operations have to be handled by the competent national licencing authorities under Regulation (EC) No 1008/2008 on common rules for the operation of air services.

2. There is no legal base for the Commission to acquire the information of the kind requested. Under Regulation (EC) No 261/2004 it is for the Member States and national enforcement bodies designated by them to ensure in the first instance that the rights of passengers are respected.

3. Commission services are in contact with the Spanish enforcement body and will request specific information on cases where the airline invokes extraordinary circumstances.
