The ongoing infringement procedure concerns the transposition into Spanish law of Directives 2009/72/EC(1) and 2009/73/EC(2) on the internal electricity and gas market (part of the ‘Third Energy Package’), which set out rights and requirements as regards, inter alia, the tasks and independence of the national regulatory authorities, including on tariff setting.

The Commission is aware that the Spanish authorities are considering adopting legislative amendments, with a view to addressing the issues raised. The Commission recalls that it may decide to refer the case to the Court of Justice of the EU if sufficient progress towards amending the existing legislation is not made. When taking such a decision, the Commission is not bound by a set deadline.
