 Subject:  Incident in the implementation in Spain of Regulation (EC) No 300/2008 and Regulation (EU) No 185/2010
 Answer in writing 

The Spanish police authorities issued a report, pursuant to Regulation (EC) No 300/2008 and Regulation (EU) No 185/2010, which contradicted another one drawn up 11 days previously and claimed that an Iberia employee in Navarre, who has no police or criminal record and no complaints in his personnel file, was not suitable for work in restricted areas critical to aviation security. The so-called ‘report’ — a cursory e-mail two lines long — alleged that the person concerned ‘has close links to circles that are potential dangerous for air safety’. As a result, this person was dismissed from his post after 31 years of service.

Legislation in force states that assessments of this kind may not be arbitrary and that the persons assessed are entitled to see the information the assessment is based on so they may refute it, particularly if, as in this case, the outcome is very serious. As the victim in this case has an active role in a consumer organisation that has been a thorn in the side of certain official bodies, suspicions of arbitrary behaviour are even greater.

1. Does the Commission believe these EU Regulations permit situations in which victims are powerless to defend themselves?

2. Will the Commission look into the instructions issued in putting these Regulations into effect in Spain?
