 Subject:  France is returning migrants to Italy without authorisation
 Answer in writing 

According to reports from the Italian Ministry of the Interior, on 12 October, a French police van was identified in Claviere (Turin), at the border with France. Two men were made to get out of the van near a forested area, presumably African migrants, without prior authorisation from the Italian police.

The unlawful nature of this operation was first reflected in the launching of an investigation by the Public Prosecutor’s Office in Turin, after receiving photographs from the Digos (General Investigations and Special Operations Division) containing the image of the French van during the operation.

In addition to the fact that crossing the border was, in itself, an illegal act, the French operation appears a clear infringement of the provisions laid down in both international agreements and the Community acquis, as regards the readmission of migrants.

In view of this, can the Commission say:
1. Whether it intends to formally reprimand France for failure to respect international and European laws in terms of the readmission of migrants.
2. Whether it finds it credible that a State may claim the right to make decisions that affect other Member States, on a unilateral basis and jeopardising security, while the political and legislative debate seems to advocate full interoperability between information systems, to ensure permanent and immediate exchanges between EU Members States.
