 Subject:  Equal treatment of operators in tendering procedures in Croatia
 Answer in writing 

On 10 December 2018, a Polish company sent a notification to the Secretariat of the OLAF Supervisory Committee concerning an infringement of the provisions of Directive 2014/24/EU of the European Parliament and of the Council of 24 February 2014 on public procurement by the contracting authority EKO d.o.o. and the decision of the Croatian Board of Appeal (DKOM) No 354-01/18-8.

This notification shows that significant infringements of the aforementioned directive were committed during the selection of the contractor in the procedure ‘Design and execution of works on the construction site of the BILJANE DOJ Waste Management Centre’.

It should be noted that the aforementioned procedure has a value of about EUR 70 million and benefited from 70% co-financing from EU funds.

In view of the above, and in particular the alert regarding the infringement of the provisions of Directive 2014/24/EU of the European Parliament and of the Council of 24 February 2014 on public procurement, could the Commission please answer the following questions:
1. Has the OLAF Supervisory Committee taken note of the information set out in the notification?
2. Has the OLAF Supervisory Committee taken action to investigate the infringement of Directive 2014/24/EU of the European Parliament and of the Council of 24 February 2014 on public procurement in the abovementioned procedure?
3. What action does the OLAF Supervisory Committee plan to take to ensure equal treatment of economic operators in the aforementioned procedure?
