E-001234/2019(ASW)
Answer given by Ms Jourová on behalf of the European Commission
Question reference: E-001234/2019

The Commission has taken several actions aimed at raising awareness of legal professionals of the European Small Claims Procedure with a view to facilitating access to justice in cross-border civil and commercial disputes.

These actions include a Practice Guide, which explains the operation of the procedure, the provision of multilingual interactive forms for use in the proceedings, teaching modules for training purposes and support to judicial training through European funding(1).

In the summer of 2019, the Commission will carry out an information campaign directed to legal practitioners and users to promote updated guides on the European Small Claims Procedure.

The recent revision of the regulation, which entered into application in 2017, facilitates enforcement of judgments by obliging the competent courts handing down judgments to issue certificates necessary for the enforcement of the forms in other languages than their own.

However, the enforcement of judgments is carried out pursuant to national law and, therefore, there may be differences between Member States in the actual enforcement procedure. To facilitate enforcement, the Commission provides information on Member States’ national enforcement procedures through the European e-Justice Portal(2).
