In view of the agreement reached between the Council and the European Parliament on 19 December 2018 to ban oxo-degradable plastics under the directive on the reduction of the impact of certain plastic products on the environment(1), Member States are to prohibit the placing on the Union market of any product made from oxo-degradable plastics two years after the directive enters into force.

The concerns leading to the Commission’s request to the European Chemicals Agency to prepare an Annex XV dossier in accordance with Article 69(1) of Regulation (EC) No 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH)(2) have therefore been superseded by the marketing ban agreed by the co-legislators.

Consequently, the Commission considers that further action on a Union-wide restriction under the REACH Regulation is no longer necessary.

Therefore, on 30 April 2019 the Commission asked the European Chemicals Agency to close the preparations of the Annex XV dossier on oxo-degradable plastics.
