1. The Commission monitors the Public Prosecutor’s Office in Bulgaria through the Cooperation and Verification Mechanism (CVM). The technical report accompanying the latest report on progress of Bulgaria under the mechanism adopted on 22 October 2019(1) describes the situation since 2016 when an independent analysis has been carried out over the prosecution service in Bulgaria. A number of suggestions for follow-up have been reflected in an interinstitutional roadmap established in cooperation between the government and the prosecution service in 2017. Several of the recommendations had been followed up with concrete actions in 2018.

2. As regards the particular issue concerning the accountability of the position of the Prosecutor General, on 24 September 2019 the Bulgarian government submitted a request for an opinion of the Venice Commission with the aim to prepare relevant safeguards and guarantee the independence of the judiciary. This opinion was published on 6 December 2019, and was followed by a revised draft law submitted to the Bulgarian Parliament on 9 December 2019. The Commission will continue to closely monitor the ongoing reform, as well as the other commitments undertaken by the Bulgarian authorities.
