Part E of Annex II to Regulation (EC) No 1333/2008(1) lists provisions for food additives based on the categories of food to which they may be added. Foods in individual food categories have different characteristics and needs for the use of additives. When requested, the conditions for use may be amended following an application in line with the Common Authorisation Procedure(2).

Dehydrated or condensed products containing milk and vegetable fats do not meet the definitions laid down in Annex I to Directive 2001/114/EC(3), thus they do not fall in the food Category c.5 ‘Dehydrated milk as defined by Directive 2001/114/EC’ of Annex II to Regulation (EC) No 1333/2008. Instead, they fall in the Category c.8 ‘Dairy analogues, including beverage whiteners’ and the food additive provisions of that category apply to them.
