Conditions for use of additives in food

Annex II to Regulation (EC) No 1333/2008 of the European Parliament and of the Council of 16 December 2008 sets out an EU list of conditions on the use of food additives.

The products are set out in the list according to categories (Part D of the regulation), and food additives can only be used in accordance with these categories. Dehydrated milk, as defined in Directive 2001/114/EC, constitutes a separate category of products.

However, it is unclear to which category dehydrated milk products containing vegetable fats should belong, and which food additives may be used in their production.

According to the Codex Stan 207-1999 food standard, several types of emulsifiers may be used as food additives in the manufacture of milk and cream powder. In this connection: could the same emulsifiers be used in the manufacture of condensed milk (condensed milk is an intermediate product in the manufacture of milk powder)?

A number of food additives are permitted in foods for particular nutritional uses, such as infant formulas, follow-on formulas and other foods for young children. In this connection: why is the use of these additives restricted in the manufacture of dehydrated products?

Can Regulation (EC) No 1333/2008 be amended by supplementing it with a separate product category for dehydrated milk products with vegetable fat (canned milk, milk powder), thereby permitting the use of food additives from groups I and II in their production, and the use of emulsifiers and food additives in the production of condensed milk, as well as in the production of other categories of dairy products?
