 Subject: Poland’s non-compliance with the PCB Directive (96/59/EC)

According to the information at our disposal, the Polish environmental authorities currently identify capacitors potentially containing PCBs on the basis of an incomplete list, resulting in incorrect identification and potential emissions of large amounts of PCBs into the environment.

Given the risk of the erroneous negative identification of capacitors when using the list contained in the decree of 26 September 2002 issued by the Polish Government (1) , can the Commission definitely exclude that the Polish regional environmental authorities (RDOS) are using the list in the decree as a positive list to identify whether capacitors contain PCBs (the authorities do not carry out the analysis of all capacitors prescribed in the law of 24 June (2) , but instead identify only the capacitors mentioned in the list as positively containing PCBs, and all others as not containing PCBs)?

– If this cannot be excluded, what ecological impact does the Commission predict as a result of such incorrect implementation?

– Does the Commission recognise that the de facto implementation by Poland in the form of a positive list is actually in breach of the PCB directive?

– What steps does the Commission envisage taking to guarantee full implementation, and what would the timetable for any such steps be?
