 Subject:  Railway renationalisation
 Answer in writing 

Under EU railway legislation (including the railway directives and regulations) and state aid rules, would a Member State be allowed to renationalise the franchises of service operators once they have expired as a general policy approach, in contrast to an emergency situation in which, for example, a private company operating a main line is put into administration or insolvency?

Is it permissible under EU state aid, railway and procurement rules for a company, either partially or fully owned by a Member State, to bid for a franchise once the end of the franchise period is reached?

If so, would this bid have to be in equal competition with private company bids?

Is it permissible at the end of a franchise (especially if the previous franchise was granted to a wholly private company) to automatically grant a franchise to a partially or wholly state-owned company?
