1) On 19 December 2016, prior to the provisional order by the General Court, the regular monthly capacity auction took place for the OPAL pipeline, applying the new regulatory framework based on the revised exemption decision. The capacities allocated at this auction can be used during the month of January 2017, which can explain an increase in flows.

The Commission was informed by the Polish authorities that certain auctions for daily capacity products have taken place after the provisional order. To the Commission's knowledge, no further auctions have taken place since 10 January 2017, including the monthly capacity auction foreseen for 16 January 2017.

2) The Commission has informed the German Regulator, Bundesnetzagentur, on 25 December 2016 of the provisional orders issued by the General Court, ordering the suspension of the implementation of COM decision C (2016)6950 final of 28 October 2016. The Commission did draw the attention of the German Regulator to the legal effects of this order.

3) If the provisional order remains in force on 6 March 2017 or should an order of the General Court putting an end to the interim measures procedure suspend the COM decision, no auction of yearly capacity products may take place for the OPAL pipeline.
