In reply to the Honourable Member's question regarding the availability of a recent report regarding Article 16 and 17 of the Audiovisual Media Services Directive (AVMSD), the Commission would like to indicate the report published as an Annex of the ‘Ex-post Regulatory Fitness and Performance Programme (REFIT) evaluation of the AVMSD 2010/13/EU(1)’. This contains the second report on the application of Articles 16 and 17 of Directive 2010/13/EU for the period 2011-2012. The report shows that the provisions of Articles 16 and 17 of AVMSD have been overall correctly implemented by Member States.

The Commission would like to indicate that, in view of the data collection by Member States and the necessary aggregation and analysis by the Commission, these reports are not published immediately after the reporting period for which they are due. As the last exercise overlapped with the preparatory work of the AVMSD proposal, the Commission has decided to publish the 2011-2012 report together with the data accompanying the AVMSD proposal. This resulted in a slight delay in the reporting process.

In parallel to the work on the revision of the AVMSD, the Commission is currently running a study on the promotion of European works in audiovisual media services which will be published in the coming months. This study will be the basis of the report on Articles 16 and 17 of AVMSD for the period 2013-2014.

The Commission hopes for a fast progress on the adoption process, which will permit to align the period of reporting at every two years for both linear and nonlinear audiovisual media services in the EU.
