The Commission would like to inform the Honourable Member that according to Article 196 paragraph 4 of Law 4389/2016, inter alia, archaeological sites are exempted from transfer to ETAD (Public Properties Company)/HCAP (Hellenic Corporation for Assets and Participations Fund).

The list for the transfer was compiled based on data provided by the National Cadastre through the General Secretariat of Public Property. In this list the real estate assets were identified only with the unique Registration Number at the Greek Cadastral Office (KAEK).

These data provided and kept by the National Cadastre did not include any information or description about the kind or the usage of assets (i.e. forest land, archaeological monument, etc.). For this reason the Ministerial Decision included the reservation that the transfer of property will not be made for assets that fall under specific exceptions provided in Greek Law.

The Greek authorities are responsible to decide about the assets that fall under the scope of Article 196 paragraph 4 of Law 4389/2016.

In all cases where the Ministry of Culture has legal rights over assets that are by law excluded from transfer of ownership, such rights are not affected by the abovementioned Ministerial Decision.
