In its judgment of 13 December 2018, which the Honourable Member refers to, the General Court partially annulled the 2015 Commission decision concerning the Fehmarn Belt fixed link project. The Commission decision was confirmed with respect to the hinterland connections and essentially annulled for the other measures in so far as the Commission did not open the formal investigation procedure as regards the necessity and proportionality of the aid.

Following the General Court’s judgment, the Commission services intend to propose the initiation of a formal investigation procedure to the College of Commissioners shortly.

Once Denmark and interested stakeholders have had the opportunity to provide observations on the opening decision, the Commission will examine all information available in detail and take a final decision on all the issues raised in the opening decision, including a refined assessment of the existence of aid and its compatibility. The issue of potential recovery of incompatible aid illegally granted would arise in case of a final negative decision.

In anticipation of these steps and the comments that stakeholders may express in the course of the formal investigation procedure, the Commission cannot speculate further at this stage on the outcome of this case.
