 Subject:  Commission monitoring of activities hindering the formation of the European area of freedom, justice and security
 Answer in writing 

In its judgment of 19 July 2018, which was published on 21 August 2018, the German Federal Court of Justice (BGH) in Karlsruhe abused the public policy clause and refused to recognise the judgment of the Polish court ordering the ZDF television station to apologise to Karol Tendera, a 98-year-old former inmate of Auschwitz-Birkenau, for using the term ‘Polish extermination camp’.

In the interest of the mutual recognition of judgments of the courts, which, within the meaning of the Treaties, are also the courts of the EU, the Court of Justice of the EU does not agree with free interpretation of the public policy clause to the detriment of cooperation among the judicial bodies of the Member States and the construction of a European area of law and freedom.

Will the Commission take action to assess and monitor this kind of practice, which is certain to hinder the creation of a European area of freedom, justice and security?
