 Subject:  Implementation of the European Union Solidarity Fund

In a ruling handed down on 4 July 2019, Leiria’s Administrative and Tax Court cancelled the notice of invitation to tender for the implementation of the European Union Solidarity Fund.

The notice had been issued by the Portuguese Government with a view to replacing the facilities and equipment damaged by the 2017 fires in Portugal. In its ruling, the Court held that the notice had not been drawn up correctly in that it failed to specify the criteria governing the selection of beneficiaries or explain why those criteria had been arrived at.

The ruling also confirmed that the Portuguese Government was in breach of the principle of equal treatment, as the municipalities affected by the 2017 fires were treated differently before the law.

Given that the Solidarity Fund Regulation lays down deadlines by which the amounts received must be spent:
1. Is the Commission aware of the decision of the Leiria Court and of how the Solidarity Fund monies received by Portugal have been spent?
2. What is Portugal’s deadline for spending the money it received?
