Priority question for written answer
to the Commission
Rule 138
Martina Dlabajová
Subject: Austrian regulation on the indexation of child benefits and family tax credits – Commission’s infringement procedure

What legal arguments did Austria give in its reply to the Commission regarding its law on the indexation of child benefits and family tax credits for parents whose children live abroad, and what was the Commission’s assessment of those arguments?

If Austria is in breach of EU law, when will the Commission decide if it should refer the case to the Court of Justice? Otherwise, at what stage are the Commission’s negotiations with Austria to bring it in line with EU law?
