The session suspended Thursday 30 November 2017 was resumed.

The sitting opened at 17.00.


3. Approval of the minutes of the previous sittings

The following spoke: Peter Lundgren who requested the President of Parliament not to sign the Joint Declaration on the EU's legislative priorities for 2018 and 2019 (the President took note).

The minutes of the sittings of 29 and 30 November 2017 were approved.


4. Composition of Parliament

The competent French authorities had given notice of the election of Constance Le Grip to the French Parliament with effect from 1 December 2017.

This function being, pursuant to Article 7, paragraph 2 of the Act of 20 September 1976 concerning the election of the representatives of the European Parliament by direct universal suffrage, incompatible with occupying a post as a Member of the European Parliament, Parliament established the vacancy of the seat, on the basis of Rule 4(4) of its Rules of Procedure, with effect from 1 December 2017 and would inform the Member State concerned accordingly.


5. Order of business

The final draft agenda for the December 2017 plenary sittings (614.777/OJMA) had been distributed and the following changes had been proposed (Rule 149a):

- Request from the PPE Group to include on the agenda a debate on the objection to the Commission proposal on the use of phosphoric acid, phosphates – di – tri – and polyphosphates (E 338-452) in frozen vertical meat spits (B8-0666/2017) (item 66 of final draft agenda).

Wednesday

After consulting with the political groups, the President proposed the following change:

The debate on the Corazza Bildt report on the implementation of Directive 2011/93/EU of the European Parliament and of the Council on combating the sexual abuse and sexual exploitation of children and child pornography (A8-0368/2017) (item 55 of the final draft agenda) was to be entered as the last item on the agenda.

Parliament approved the proposal.

Thursday

- Request from the PPE Group to postpone until the January 2018 part-session the debate on the major interpellation on the EU-Norway dispute on snow crab fisheries in Svalbard (B8-0612/2017) (item 29 of the final draft agenda).

Parliament approved the request.

6. Composition of Parliament

The Austrian, French and German competent authorities had given notice that Lukas Mandl, Geoffroy Didier and Michael Detjen had been elected to the European Parliament with effect from 30 November 2017, 1 December 2017, and 1 January 2018 respectively, to replace Elisabeth Köstinger, Constance Le Grip, and Jutta Steinruck respectively.

Parliament noted their election.

Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made a written declaration stating that they did not hold any office incompatible with that of Member of the European Parliament, Lukas Mandl, Geoffroy Didier and Michael Detjen would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.


7. Verification of credentials

On a proposal from the JURI Committee, Parliament decided to validate the mandates of Wolf Klinz, Nadja Hirsch, Martin Schirdewan, Thomas Waitz and Caroline Nagtegaal, with effect from 6 November, 8 November, 8 November, 10 November and 14 November 2017, respectively.


8. Composition of committees and delegations

The President had received the following requests for appointments from the PPE Group:

9. Negotiations ahead of Parliament's first reading (Rule 69c)

The President announced that he had received a request from the Verts/ALE Group and a number of Members reaching the medium threshold to put to the vote the decision by the JURI Committee to enter into interinstitutional negotiations announced in the minutes of 29 November 2017 (minutes of 29.11.2017, item 8).

The vote would take place the following day in accordance with Rule 69(2).

The President announced that no request had been received on behalf of a number of Members or a political group or groups reaching at least the medium threshold concerning the other decisions to enter into interinstitutional negotiations announced in the Minutes of Wednesday 29 November 2017 (minutes of 29.11.2017, item 8).

The CULT, AFCO and IMCO/JURI Committees had therefore been able to start the negotiations following the expiry of the deadline laid down in Rule 69c(2).

The President announced the decisions by several committees to enter into interinstitutional negotiations pursuant to Rule 69c (1):

- IMCO Committee, on the basis of the report on the proposal for Directive of the European Parliament and of the Council on the enforcement of the Directive 2006/123/EC on services in the internal market, laying down a notification procedure for authorisation schemes and requirements related to services, and amending Directive 2006/123/EC and Regulation (EU) No 1024/2012 on administrative cooperation through the Internal Market Information System (COM(2016)0821 – C8-0011/2017 – 2016/0398(COD)). Rapporteur: Sergio Gutiérrez Prieto (A8-0396/2017)

- IMCO Committee, on the basis of the report on proposal for a Directive of the European Parliament and of the Council on a proportionality test before adoption of new regulation of professions (COM(2016)0822 – C8-0012/2017 – 2016/0404(COD)). Rapporteur: Andreas Schwab (A8-0395/2017)

- ECON Committee and LIBE, on the basis of the report on the proposal for a Proposal for a regulation of the European Parliament and of the Council on controls on cash entering or leaving the Union and repealing Regulation (EC) No 1889/2005 (COM(2016)0825 – C8-0001/2017 – 2016/0413(COD)). In accordance with Rule 69c (2), Members or political group(s) reaching at least the medium threshold may request in writing, before midnight the following day, Tuesday 12 December, that decisions to enter into negotiations be put to the vote.

Negotiations may start at any time after that deadline has expired if no request for a vote in Parliament on the decision to enter into negotiations has been made.


10. Delegated acts (Rule 105(6))

In accordance with Rule 105(6), the Chair of the Conference of Committee Chairs had informed the President of Parliament that no objections had been raised with regard to:

- Recommendation of the ECON Committee to raise no objections to the Commission delegated regulation of 17 November 2017 supplementing Regulation (EU) No 600/2014 of the European Parliament and of the Council on markets in financial instruments with regard to regulatory technical standards on the trading obligation for certain derivatives (C(2017)07684 - 2017/2979(DEA)) (B8-0667/2017).

If no objections to this recommendation are raised by a political group or by a number of Members corresponding at least to the threshold within 24 hours, it shall be deemed to have been approved. If this is not the case, it shall be put to the vote.

The recommendation is available on Europarl for the duration of the current part-session.


11. Signature of acts adopted under the ordinary legislative procedure (Rule 78)
