Slovenia - Electoral Law
(Election to the European Parliament : 13 June 2004)

1. LEGAL BASIS

2. ELECTORAL SYSTEM
Proportional representation with preference voting.
3. REGISTRATION OF CANDIDATES
Deadline for registration: The List of the Candidates must be submitted to the Republic Electoral Commission at least 30 days prior to the day of ballot.
Deposit:

Nomination of the candidates: Candidates may be nominated by political parties (according to their rules) and by voters. A political party can submit a list of candidates if it is supported by signatures of at least 4 members of the National Assembly or at least 1000 voters. If nominated by voters, the list of candidates must be supported by signatures of at least 3000 voters.

For the candidates who are not Slovenian citizens a declaration of the candidate must be attached to the list, which, states his/her citizenship and address of his/her permanent residence in Slovenia and that he/she does not stand as a candidate in elections to the EP in any other member state of the EU; other statements or guarantees are not required.

Incompatibilities: The deputy of the EP must not be a member of the National Assembly and must not carry out executive functions in the local community. Further, the deputy must not carry out functions and activities, which must not be carried out by a member of the National Assembly.

5. VOTING / STANDING FOR ELECTION
Right to vote: Each citizen of RS and citizen of EU with permanent residence in RS, who has attained the age of 18 years by the day of the election and is not suffering from mental disorder have the right to vote pursuant to the universal and equal suffrage by secret ballot.
Right to stand for election: Each Slovenian citizen and citizen of EU with permanent residence in RS, who has attained the age of 18 years by the day of the election and is not suffering from mental disorder, have the right to stand as candidate;
6. ELECTION CAMPAIGN
Funding: Election campaign shall be financed according to the regulations on financing political parties. The organiser of the campaign shall open a transaction account “for the election campaign” at least 45 days prior to the elections. The organiser shall deposit all funds intended or donated by legal entities or private individuals to finance the election campaign to this account. All costs of the campaign shall be covered exclusively from this account. Account shall be closed at least within 3 months after Election Day. The organiser of the campaign shall submit a full report on all expenses pertaining to the campaign to the National Assembly at least within 3 months after Election Day. If organiser is not a political party, the report shall include information on all assets collected for the election campaign, and other information, which a political party must, according to the law, give in its annual financial report. An organiser who is not a political party shall donate any surplus in the collected funds to charitable causes.
Reimbursement of the expenses: Organiser of the campaign may spend a maximum of 60 tolars per voter. Organiser of campaigns whose candidates were given mandates as deputies shall hold the right to reimbursement of election costs at 60 tolars per vote received, these costs shall not exceed the amounts of the funds used. The right to the reimbursement of part of the expenses shall also be held by the organiser whose list gained alt least 2%of total number of votes cast in the state – amounting 30 tolars per vote gained. Revised amounts shall be determined by the National Assembly each time elections are called.
Official campaign starting date: An election campaign may begin no more than 30 days before the Election Day and shall end at least 24 hours before the election.

Media access:

  • Public media shall determine and make public their rules (size, conditions and publicity methods) for use of programme time or newspaper space for presenting the candidates, political parties and their programmes, at least 45 day prior to the Election Day.
  • These rules shall ensure the equal rights of candidates and political parties and others to present themselves.
  • Public media shall not publish political propaganda information without giving the name of the client. All propaganda material (bulletins, pamphlets, posters,….), in addition to the name of the publisher, also must have (give) the name of the client. Gluing and positioning posters with an election propaganda messages shall be allowed at sites determined by municipality, which shall ensures all organisers equality at these sites.
Opinion polls: No public opinion polls on candidates, lists of candidates or parties shall be published in the seven day prior to elections. If the survey is published during the campaign, the analysts involved, their polling methods and the name of the person whom commissioned the poll shall be given.

Law on election campaign also regulates penalties if the law is violated (from gluing posters, publishing information during the prohibited time, publishing propaganda messages without stating the name of the client, not submitting the financial report,...).
