Slovakia - Electoral Law
(Election European Parliament 2004: 13 June 2004)

1. LEGAL BASIS
The European Parliament Elections Act was adopted on the 10 July 2003 and entered into force on 5 August 2003.
2. ELECTORAL SYSTEM
Allocation of seats: The territory of the Slovak Republic constitutes for the purposes of this law 1 electoral constituency, in which 14 MEPs are elected.

The electoral system is called Droop Method; proportional electoral system. The Political Parties have to overpass 5% threshold.

Voter has one preferential vote that he may attribute to the candidate on the list of the political party.

3. REGISTRATION OF CANDIDATES
Deadline for registration: The Lists of the Candidates have to be delivered to the Central Electoral Committee at least 65 days before elections, i.e. 9 April 2003. The political parties may form a coalition.
Deposit: The Electoral fee is 50 000 Sk (1.200 EUR).

Conditions:

Incompatibilities: The law on the incompatibilities will be amended. It will require also amendments to the Constitution of the Slovak Republic.
4. POLLING DAY : 13 JUNE 2004
Other elections on the same day:
Polling hours: from 7.00 to 22.00
The count begins: Immediately after the polling stations are closed.

5. VOTING / STANDING FOR ELECTION
Right to vote: The right to vote for the European Parliament on the territory of the Slovak Republic is recognised to the citizens of the Slovak Republic, who are at the least in the day of the election 18 years old and are domiciliated in the Slovak Republic. Citizens of other Member States of the European Union, who are at least in the day of the election 18 years old and are domiciled in the Slovak Republic.
Right to stand for election: The right to stand in the election is attributed to Slovak citizens, who are at the least in the day of the election 21 years old and are domiciled in the Slovak Republic. Citizens of the Member State of the European Union, who are at the least in the day of the election 21 years old and are domiciled in the Slovak Republic.
6. ELECTION CAMPAIGN

Funding:

  • Reimbursement of expenses: the details about reimbursement are not known yet. Reimbursement will be cover by the special decree of the Ministry of the Interior after consultation with the Ministry of Finance.
  • Ceiling on election expenses: none
Official campaign starting date: 23 May 2004, Broadcasting of the political advertisement begins 21 days before the elections, i.e. 23 May 2004.

Media access: Should be equal for all political parties standing for Elections. Slovak Television (STV) or Slovak Radio (SR) shall reserve and other licensed broadcasters may reserve 30 minutes of their broadcasting time for the political advertisement of the political parties or coalitions, which stand for the elections. The reserved time can not exceed five hours of broadcasting time. Broadcasting or publishing information about political parties standing in the elections in the 48 hours time before the elections, is prohibited.

Opinion polls: It shall be prohibited to publish the opinion polls on the day of the Election.
