Dohoda upravuje právní podmínky předávání a týká se zejména doby uchovávání dat, účelu jejich využití, záruk jejich ochrany a správní a soudní nápravy. Nová pravidla mají nahradit současnou dohodu, která je v platnosti prozatímně od roku 2007.
