EU institutions hold kick-off meeting on joint criteria on delegation of powers

Discussions to develop guidance for legislators on what kind of powers should be delegated began in Strasbourg between the Parliament, Council and Commission.

Political representatives from the European Parliament, Council and the Commission, met on 12 September to begin discussing the question of "non-binding delineation criteria" on delegated acts and implementing acts, as foreseen in paragraph 28 of the Better Law Making inter-institutional agreement.

The three EU institutions agreed on the political importance of this issue in order to facilitate future legislative discussions, and underlined their commitment to find an agreement “with a view to supplementing the Common Understanding by providing for non-binding criteria for the application of Articles 290 and 291 of the Treaty on the Functioning of the European Union.”

The Parliament, the Estonian Presidency of the Council and the Commission welcomed the meeting as a first step indicating their readiness to start negotiations as soon as possible.

József Szájer, EP co-negotiator (EPP, HU) welcomes the willingness of the other two Institutions to re-launch the negotiations and expresses his hope that the Council will use its best endeavours to come with a mandate as soon as possible  on this issue and that the concessions recently made towards the Council will assist in that regard and enable this exercise to be brought to a positive conclusion.

Richard Corbett, EP co-negotiator (S&D, UK) said: “The EP is ready and willing to find practical solutions in this area.  The aim is to find criteria that will help legislators during their negotiations and avoid protracted discussions on delegated and implementing acts.”

Paragraph 28 of the IIA on BLM: The three Institutions will enter into negotiations without undue delay after the entry into force of this Agreement, with a view to supplementing the Common Understanding by providing for non-binding criteria for the application of Articles 290 and 291 of the Treaty on the Functioning of the European Union.

Parliament's mandate for the negotiations is outlined in its 2014 resolution,  which sets out a list of criteria to guide EP rapporteurs during legislative negotiations. In July 2016, the Parliament appointed Mr József Szájer (EPP, HU) and Mr Richard Corbett (S&D, UK) as its co-negotiators on this issue.
