Article 8(2) of Directive 92/100/EEC(1) provides artists with a claim to receive equitable remuneration for the broadcast of their sound recordings. There is, however, no obligation to collect these payments. If an artist does not want to participate in the collection of equitable remuneration for the broadcast of his performance, he does not need to join the relevant performers' collecting society for collecting such payments.
