Answer given by Mr Barroso on behalf of the Commission

The principles of subsidiarity and proportionality govern the use of Union competences (Article 5 TEU). The question whether, and, if so, to what extent, these principles also govern the internal polticial organisation of a Member State is a matter of national constitutional law. Further, as laid down in Article 4(2) of the Treaty on European Union (TEU), the Union must respect the Member States’ ‘national identities, inherent in their fundamental structures, political and constitutional, inclusive of regional and local self-government’. It is therefore not for the Commission to comment on the internal structures of a Member State.
