Answer given by Mr Andriukaitis on behalf of the Commission

1. Foie gras production is covered by Directive 98/58/EC(1) concerning the protection of animals kept for farming purposes. This directive reflects, within Union legislation, the approval by the Union(2) of the European Convention for the Protection of Animals kept for Farming Purposes(3) of 1976 (‘the Convention’). Two Recommendations relevant to the production of foie gras, concerning Muscovy ducks and their hybrids(4) and domestic geese(5) respectively, were adopted under the Convention on 22 June 1999. The recommendations, while not prohibiting the production of foie gras, explicitly acknowledge the legality of this production under certain conditions.

2. The Commission has no plans to prohibit this activity. The Commission is of the opinion that its efforts should be concentrated to ensuring enforcement of the existing EU animal welfare legislation in the Member States.

3. No contribution has been granted in the last three years for promotion measures of foie gras in the framework of the promotion policy under Regulation (EC) 3/2008.
