Answer given by Ms Jourová on behalf of the Commission

On 22 March 2018, the Commission addressed to the Slovak Republic and to 13 other Member States a letter of formal notice on the basis of Article 258 of the Treaty on the Functioning of the European Union for failure to transpose Directive (EU) 2015/2302 of the European Parliament and of the Council on package travel and linked travel arrangements(1) by 1 January 2018 which is a breach of Article 28(1) of that directive.

The Commission expects that the Slovak Republic will now take all necessary measures in order to transpose the directive so that the national transposition measures can be applied from 1 July 2018 as provided by Article 28(2) of the directive.

In this context, the Commission would like to refer to its 2017 Communication on EC law: Better results through better application(2). In particular, the Commission explains under Section 3, sub-section titled ‘sanctions for non-communication of transposition measures’ that it attaches high importance to the timely transposition of Directives.

Every year, the Commission provides in its Annual reports comprehensive information on monitoring the implementation of EU legislation, including the transposition of EU Directives by Member States(3). In addition, since 2014, the Commission offers a centralised platform for disseminating infringement related information on its Europa website. This provides detailed information on Commission's decisions on infringement procedures, including on infringement cases concerning late transposition of EU Directives per Member State(4).
