Answer given by Ms Jourová on behalf of the Commission

The Commission is committed to make full use of its powers to continue fighting discrimination on any grounds, as this is incompatible with the values and principles upon which the EU is founded.

The issues raised by the Honourable Members are not covered by Directive 2000/43/EC. This directive has a limited scope(1) and is without prejudice to provisions and conditions relating to the entry into and residence of third-country nationals and stateless persons on the territory of the Member States.(2) In addition, Article 10 of the Treaty on the Functioning of the European Union is a general provision, which provides that the EU shall aim to combat discrimination in defining and implementing its policies and activities but it does not have any direct effect for individuals. Finally, the Commission reminds the Honourable Members that the European Convention on Human Rights is not a part of EC law.

Member States, including their national courts, must ensure that applicable national laws are interpreted and applied in accordance with their obligations regarding fundamental rights, in line with national constitutions and international human rights instruments to which they are parties.

The Commission works together with the Member States through its High Level Group on combating racism to better understand and recognise the problem of Afrophobia in Europe and has made available funding under the Rights, Equality and Citizenship Programme to support civil society and Member States authorities in their efforts to prevent and combat Afrophobia.
