Answer given by Mr Arias Cañete on behalf of the European Commission

As clearly set out in the Commission Communication ‘Protection of Intra-EU Investment’ of 19 July 2018 (COM(2018) 547 final), the Commission is of the opinion that the reasoning of the Court of Justice of the European Union (Court of Justice) in Case C-284/16 Achmea also applies to arbitration proceedings brought by an investor from one Member State against another Member State under the Energy Charter Treaty, such as in Vattenfall v. Germany.

No opinion on the applicability of the Achmea ruling to the Vattenfall arbitration in the International Centre for Settlement of Investment Disputes (ICSID) can be sought by the Commission from the Court (Article 218(11) of the Treaty on the Functioning of the European Union (TFEU)).

However, the question could be referred to the Court of Justice under the preliminary reference procedure (Article 267 of the TFEU) by a competent national court ruling on the dispute (or on a particular aspect of it) and entitled to make a preliminary reference to the Court of Justice.

The Commission is, however, monitoring closely this and other arbitration proceedings and systematically intervenes in such proceedings in order to explain its point of view. It might also consider further action, including infringement procedures.
