Paragraph (6) of the annex to the recommendation(1) for a Council decision authorising the opening of negotiations for an agreement between the European Union and the State of Israel on the exchange of personal data between the European Union Agency for Law Enforcement Cooperation (Europol) and the Israeli competent authorities for fighting serious crime and terrorism clearly states that the agreement shall not apply to the geographic areas that came under the administration of the State of Israel after 5 June 1967.

This is in line with the EU position on the Middle East Peace Process, as stated in the Council Conclusions of 10 December 2012(2).

The Commission has also proposed to the Council that the agreement should contain the provisions necessary to ensure effective monitoring and evaluation of the agreement, including the implementation of the provisions related to the non-application of the agreement to the geographic areas that came under the administration of the State of Israel after 5 June 1967.
