Introduction
The Baltic Sea is one of the worlds most polluted seas. In 2009, the European Council adopted a macro-regional strategy aiming to foster environmental protection, reduction of nutrient loads and promoting increased cooperation between countries.
In the 2007-2013 period, the EU contribution to waste water collection and treatment projects in the five Member States bordering the Baltic Sea benefiting from EU support was 4.6 billion EUR: Poland, 3.4 billion euro; Latvia, 0.6 billion euro; Lithuania, 0.4 billion euro; Estonia, 0. 2 b i l l i o n e u r o a n d G e r m a n y , 0 . 0 4 b i l l i o n e u r o . T h e E C A v i s i t e d t h r e e M e m b e r S t a t e s w i t h B a l t i c c o a s t s ( F i n l a n d , L a t v i a a n d P o l a n d ) a n d c o n d u c t e d a s u r v e y i n a l l o f t h e o t h e r M e m b e r S t a t e s b o r d e r i n g t h e B a l t i c S e a . E U - s u p p o r t e d p r o j e c t s i n Russia and Belarus were checked through documents at the European Commission. The audit examined whether EU action had been effective in helping Member States to reduce nutrient pollution in the Baltic.
ECA findings
The ECA arrived at the conclusion that:
there has been limited progress towards nutrient reduction in the Baltic Sea; recent data on total annual inputs into the Baltic Sea during the 1995-2012 period showed a downward trend in nitrogen (9%) and phosphorus (14%) inputs; three countries show a downward trend for both nutrients (Denmark, Poland, Sweden), while two have increased their inputs for both nutrients (Latvia and Russia). For the other countries (Germany, Estonia, Finland, Lithuania), a downward trend was observed for only one of the nutrients;
Member States high-level nutrient reduction plans have not been effectively realised into quantified reduction targets broken down by type of pollution source, by activity and by geographical area;
the three Member States the Court visited take only partially into account HELCOM recommendations in their plans or legal frameworks in regard to urban waste water treatment and requirements for fertilisers and pesticides;
nutrient input monitoring data is not necessarily reliable as the Court found inconsistencies between Member States data and HELCOM data; for example in Poland the assessment for the purpose of the river basin management plans of the status of coastal and transitional waters in the 2010-2013 period shows no improvement as regards nutrient concentrations, whereas data submitted to HELCOM shows a continuous decrease in nutrient load;
most Member States are not yet compliant with the Urban Waste Water Treatment Directive; the two Member States that the Court visited, still in the transitional period for compliance, had either not complied with their intermediate targets (Latvia) or not yet communicated complete and reliable data (Poland); the Court also found that the Commissions follow-up of Member States implementation of the directive was not timely;
EU support to Russia and Belarus was potentially cost-efficient, but very limited in scope compared to what is needed and projects implementation took a long time;
nitrate vulnerable zones are not effectively designated in Member States; the Commission has questioned the adequacy of the designation of vulnerable areas in certain Member States (Estonia, 7 %; Latvia, 13 %; Poland, 4.5 % and Sweden, 22 %); on the other hand, other Member States (Germany, Denmark, Finland, Lithuania) have not designated specific vulnerable zones but apply the action programmes across their entire territories, which leads to better acceptance of the rules, but might also lead to too strict rules in certain areas and insufficient action in others;
since 2010 the Commission has maintained a dialogue with all Baltic Sea Member States, which has helped to bring changes in fertilisation laws in general;
there is a high rate of non-compliance in the countries audited as regards their application of requirements in the nitrate vulnerable zones, ranging from 17% to 32% of the farmers checked in 2013;
EU co-financed rural development measures in the 2007-2013 period have had little effect on reducing nutrient pollution in water bodies of the Member States.
ECA recommendations
In light of its findings, the ECA recommended that the Commission should:
require that Member States define programmes of measures which enable them to reach measurable targets for reducing nutrient loads in order to achieve the objectives of the marine strategy framework and the water framework directives;
require that Member States reliably and consistently assess and monitor nutrient loads in their river basins and nutrient inputs into the Baltic Sea;
encourage Member States to lay down and enforce legal obligations for households to connect to existing sewage networks;
require that Member States implement a sustainable waste water tariff policy in order to enable the correct maintenance and renewal of assets. This policy should take into account the polluter pays principle and the affordability of water services;
decrease the time needed to assess compliance with the urban waste water treatment directive;
continue to promote projects aimed at reducing the nutrient loads into the Baltic Sea from Russia and Belarus by focusing more closely on key polluters identified by HELCOM (such as the Kaliningrad area);
require that the Member States designate appropriate nitrate vulnerable zones. In doing so, Member States should take into account information on agricultural nutrients pollution pressures gathered in river basin management plans of the water framework directive.
In light of its findings, the ECA recommended that the Member States should:
collect information on the cost-effectiveness of nutrient load reduction measures in order to have a robust analysis for establishing future programmes of measures;
plan and construct their waste water infrastructure as efficiently as possible and, if necessary, consider granting financial support to households which could not otherwise afford to connect to the sewage network;
set stricter nutrient standards for effluents than those laid down in the urban waste water treatment directive for areas that drain into waters failing to reach nutrient conditions consistent with water framework directive and marine strategy framework directive good status;
set appropriate limits for the use of phosphorus in agriculture where it puts at risk the good water status;
establish their nitrates action programme rules based on the most recent scientific evidence;
establish compulsory actions which go beyond the existing requirements for polluting farms in catchment areas draining into eutrophic waters;
apply the most relevant agri-environmental schemes in relation to reducing nutrient pollution of water and target these schemes and afforestation measures at the areas where their impact on nutrient load reduction is highest.

1. begrt den Sonderbericht des Rechnungshofs mit dem Titel Bekmpfung der Eutrophierung der Ostsee: Es sind noch weitere und wirksamere Manahmen notwendig und schliet sich den darin enthaltenen Empfehlungen an;
2. bedauert zutiefst, dass trotz der Tatsache, dass die EU im Zeitraum 20072013 14,5Mrd.EUR zu Abwasserbehandlungs- und Gewsserschutzmanahmen in EU-Mitgliedstaaten im Ostseeraum sowie im Zeitraum 20012014 44Mio. EUR zur Verbesserung der Wasserqualitt in Russland und Belarus beigesteuert hat, bei der Reduzierung der Nhrstoffbelastung bislang lediglich geringe Fortschritte verzeichnet werden konnten; fordert die Kommission auf, der Kosteneffizienz der vorgenannten Manahmen besondere Aufmerksamkeit zu widmen;
3. betont, dass die Eutrophierung eine der grten Bedrohungen ist, wenn es darum geht, die Ostsee in einen guten kologischen Zustand zu versetzen, und betont, dass gegen die Eutrophierung eines der am strksten verschmutzten Meere der Welt vorgegangen werden muss; unterstreicht daher, dass die Wirksamkeit der makroregionalen Strategie der EU fr den Ostseeraum zur Reduzierung der Nhrstoffeintrge schwierig zu beurteilen ist, und bedauert, dass bei der Reduzierung der Nhrstoffbelastung bislang nur geringe Fortschritte erzielt worden sind; bedauert ferner, dass die EU-Richtlinie von einigen Mitgliedstaaten bislang nur teilweise angewandt worden ist;
4. betont, dass die Mitgliedstaaten die Manahmen im Rahmen ihrer Nitrataktionsprogramme auf der Grundlage der neuesten wissenschaftlichen Erkenntnisse und Empfehlungen festlegen sollten;
5. fordert die Kommission auf, die Mitgliedstaaten zu ersuchen, Informationen ber die Kosteneffizienz von Manahmen zur Reduzierung der Nhrstoffbelastung zu sammeln, damit im Hinblick auf die Festlegung knftiger Manahmenprogramme eine tragfhige Analyse erstellt werden kann;
6. fordert die Kommission nachdrcklich auf, die Zuverlssigkeit der berwachungsdaten zu den Nhrstoffeintrgen in die Ostsee zu verbessern, da diese Zuverlssigkeit nicht gewhrleistet ist;
7. fordert die Kommission nachdrcklich auf, die wirksame Ausweisung von nitratgefhrdeten Gebieten gegenber den Mitgliedstaaten voranzutreiben, damit in stark gefhrdeten Gebieten ausreichend Manahmen getroffen werden knnen und auf der anderen Seite verhindert wird, dass den in nicht nitratgefhrdeten Gebieten ttigen Landwirten unntige Lasten auferlegt werden; betont, dass die Mitgliedstaaten im Ostseeraum ihre Ausweisung nitratgefhrdeter Gebiete neu bewerten sollten;
8. stellt mit Besorgnis fest, dass es den Manahmen zur Reduzierung der Nhrstoffbelastung kommunaler Abwsser an Wirksamkeit mangelt; fordert die Kommission auf, fr eine wirksame Nachverfolgung bezglich der Umsetzung der Richtlinie ber die Behandlung von kommunalem Abwasser zu sorgen und sicherzustellen, dass die Mitgliedstaaten die Richtlinie uneingeschrnkt einhalten;
9. bedauert, dass die HELCOM-Empfehlungen bei bestimmten Ttigkeiten nur zum Teil verwirklicht und im Rahmen der EU-Richtlinie umgesetzt wurden;
10. stellt fest, dass die Hebelwirkung bei der Finanzierung der Projekte in Russland und Belarus gro ist; ist jedoch besorgt ber die Projektverzgerungen, die betrchtliche Ressourcenverluste zur Folge haben knnten; fordert die Kommission auf, ihre diesbezglichen Anstrengungen fortzusetzen und einen strkeren Schwerpunkt auf die durch die HELCOM festgestellten wichtigsten Verursacher zu legen; vertritt ferner die Auffassung, dass hinsichtlich der Zusammenarbeit zwischen EU-Mitgliedstaaten und Drittlndern bewhrte Verfahren ermittelt und weitflchig umgesetzt werden sollten.
