Danish RUT register and Poland's approach to the Commission

The Register of Foreign Service Providers (RUT) is the Danish state’s official register for recording Foreign Service providers. The objective of the RUT is to make it easier for the authorities to ensure that the rules that apply to Foreign Service providers and workers operating in Denmark are enforced.

Article 9 of the Posting of Workers Enforcement Directive lays down that it is for the Member States themselves to determine what control measures they wish to use. The directive also requires the Member States to introduce chain liability in the construction sector. However, it also states that the Member States may lay down rules whereby a contractor (typically the main contractor) cannot be held liable if it has undertaken due diligence obligations, which is precisely the aim and object of the RUT register and its mode of operation.

On 21 August 2014, however, the Danish newspaper Information reported that ‘Janusz Piechociński, the Polish Deputy Prime Minister, has written to the Commission expressing his “concern” at the “scope” and “mode of operation” of the Danish register.’[1] Information also stated that the Commission had replied to his letter.[2]

It is most important to achieve the greatest possible transparency in this matter. I should therefore ask the Commission to disclose the content of the Polish Deputy Prime Minister's letter to the Commission and the Commission's reply.

I should also like to ask the Commission for its view on whether the RUT register may be regarded as a natural control measure within the meaning of the Posting of Workers Enforcement Directive.
