New minimum wage rules in Germany

On 1 January 2015, a law adopted on 11 August 2014 came into force in Germany laying down a single minimum wage which is universally binding on all entities operating in Germany. The obligation extends to all employees and all sectors, including the transport of people and goods, freight forwarding and logistics. In response to a question from the Trade and Investment Promotion section at the Polish embassy in Berlin, the German finance ministry has said that it does not differentiate between ‘posted’ or ‘loaned’ workers and those travelling on business, and that the obligation to pay drivers the minimum wage in Germany applies not only to international journeys to a destination in Germany, but also in the case of cabotage or transit.

1. Does the Commission consider the new minimum wage regulations in Germany to be in compliance with EU regulations?

2. Does the Commission believe that Germany has the right, under EU regulations, to require the minimum wage to be paid to drivers transporting people and goods and those involved in freight forwarding and logistics, whether posted or travelling on business, in the case international journeys to a destination in Germany, cabotage or transit?

3. Is the Commission considering referring the issue of Germany’s new minimum wage regulations to the Court of Justice?
