  Przewodniczący. Kolejnym punktem porządku dziennego jest sprawozdanie sporządzone przez Jules'a Maatena w imieniu Delegacji Parlamentu Europejskiego i Rady w Komitecie porozumiewawczym w sprawie wspólnego wniosku, zatwierdzonego przez komitet pojednawczy, dotyczącego dyrektywy Parlamentu Europejskiego i Rady w sprawie jakości wód w kąpieliskach i uchylającego dyrektywę 76/160/EWG (PE-CONS 3659/2005 - C6-0373/2005 - 2002/0254(COD)) (A6-0415/2005).

  Jules Maaten (ALDE), Rapporteur. – Voorzitter, in de afgelopen dagen en trouwens in het algemeen tijdens de behandeling van deze richtlijn, is toch wel regelmatig de vraag op me afgekomen; is het eigenlijk wel noodzakelijk om op Europees niveau voor zwemwater normen vast te leggen? Is dit nu niet typisch een voorbeeld van een zaak die lidstaten zelf wel kunnen doen. Ik weet dat mijn collega's van de Nederlandse sociaal-democraten, die er nu echter niet zijn, het in een verslag zelfs hebben gehad over de schandelijke richtlijn voor zwembadwater. Nu is het geen richtlijn voor zwembaden, en nog minder een richtlijn voor gewoon badwater, het gaat natuurlijk over water langs stranden en meren.

De vraag of Europees optreden op dit punt een meerwaarde oplevert, is hier gesteld. Hierover hebben we ook terecht gediscussieerd in dit Parlement in eerste lezing en het Europees Parlement deelde toen die twijfel niet. Maar belangrijker nog, ook de lidstaten en vóóral de lidstaten vonden dat er een richtlijn moest komen. Nu ja, als ze dat vinden, dan moet die er ook komen, maar dan vind ik wel dat het een serieuze richtlijn moet zijn en niet een richtlijn die er wel is, maar waar hoofdzakelijk uitzonderingen in gecreëerd worden.

In ieder geval is nu dus na meer dan 12 jaar discussie een toch moeizaam tussen Raad en Parlement tot stand gekomen compromis afgerond dat morgen, naar ik aanneem, in wetgeving wordt omgezet. De nieuwe richtlijn zorgt voor schoner zwemwater aan stranden en in meren in Europa, voor betere informatie voor zwemmers en voor minder bureaucratische rompslomp voor de lokale autoriteiten.

In de hele Europese Unie voldoet momenteel al meer dan 80% van de zwemwaterlocaties aan de strengere normen en in een aantal lidstaten voldoet zelfs al meer dan 90% van de zwemlocaties hieraan. Op dit moment krijgt jaarlijks nog zo'n 12% van de zwemmers last van misselijkheid, buikgriep, huiduitslag, benauwdheid of een oog- of oorontsteking. In de nieuwe richtlijn worden dus gezondheidsnormen verhoogd, waardoor in 2015 naar schatting nog maar 8% van de zwemmers ziek wordt.

De zwemmer zal vanaf 2015 ook op de zwemplek zelf over de actuele zwemwaterkwaliteit geïnformeerd worden met symbolen die in heel Europa identiek zullen zijn. Nu kun je als zwemconsument slechts van het voorgaande jaar de kwaliteit zien en dan nog met wat moeite en ook alleen maar op het internet. Mij spreekt aan dat ik straks ook ter plekke kan zien wat de kwaliteit van het water is, want ik weet niet hoe het met u gaat, maar ik neem zelden mijn laptop mee naar het strand. In plaats van 19 parameters, zullen lidstaten 2 parameters moeten gaan meten en dat is een voorbeeld van hoeveel minder bureaucratie er zal worden toegepast bij het meten van het water.

Het Europees Parlement en de regeringen hadden lange tijd een conflict over de vraag hoe streng de normen moesten zijn en hoe hoog de daaraan verbonden kosten voor de lidstaten zijn. Wij hebben een compromis bereikt waar we allemaal tevreden mee kunnen zijn en ik denk dat, wat dat betreft, het Britse voorzitterschap een compliment past, maar zeker ook de Europese Commissie en uzelf, commissaris, hebben een belangrijke rol gespeeld bij het totstandkomen van het compromis en ook veel van de schaduwrapporteurs zou ik hier willen danken voor de samenwerking in dezen.

Het zwemwater wordt niet alleen schoner, het wordt veel schoner, de kosten zijn beheersbaar en er wordt gedereguleerd. Ik ben, en daarmee rond ik dan af, Voorzitter, wel benieuwd naar het commentaar van de Commissie op het binnenkort in het wetenschappelijk tijdschrift "Environmental Health Perspectives" te verschijnen artikel van Wiedenmann waarin die het heeft over in ingewikkeld Engels: concentration responsive effects with no observed adverse effect levels, afgekort NOAELS.

Ik kan de term zelf niet precies omschrijven maar wellicht lukt u dat; in ieder geval ben ik benieuwd of de Commissie dat onderzoek ook zal betrekken bij haar evaluatieverslag in 2008, want er staan nogal wat pregnante opmerkingen in over de richtlijn, zoals we die nu aannemen. Alleen, denk ik, dat we het er qua tijd nu echt niet meer bij kunnen betrekken. Ik zal zeer verheugd zijn, als de richtlijn morgen daadwerkelijk wordt aangenomen. Ik denk dat het een succes is voor ons allemaal, ook voor mij, terwijl ik absoluut geen enthousiast zwemmer ben. Ik ga slechts het water in als het echt niet anders kan. Ik zal nu toch in ieder geval na 2015 toch met een wat geruster hart het zwemwater betreden. Ik hoop, commissaris, dat ik dat dan ook met veel plezier in uw lidstaat zal kunnen doen.

  Σταύρος Δήμας, Μέλος της Επιτροπής. Κύριε Πρόεδρε, εμένα μου αρέσει πολύ η θάλασσα και το κολύμπι, και επομένως ενδιαφέρομαι για προσωπικούς λόγους οι θάλασσες και τα νερά της Ευρώπης να είναι όσο το δυνατόν ακόμη πιο καθαρά.

Θα ήθελα να ευχαριστήσω την αντιπροσωπεία του Κοινοβουλίου που έλαβε μέρος στη συνεδρίαση συνδιαλλαγής με το Συμβούλιο στις 12 Οκτωβρίου 2005, και ιδιαίτερα τον Αντιπρόεδρο κύριο Τρακατέλλη και τον εισηγητή κύριο Maaten, και να τους συγχαρώ για το εξαίρετο έργο τους καθώς και για το αποτέλεσμα που επετεύχθη.

Οι συζητήσεις στην επιτροπή συνδιαλλαγής ήταν πολύπλοκες. Αλλά, τουλάχιστον, όσον αφορά το καίριο ζήτημα της θέσπισης φιλόδοξων προτύπων για την κατηγορία ταξινόμησης επαρκούς ποιότητας, θεωρώ ότι το Κοινοβούλιο πέτυχε αξιοσημείωτα αποτελέσματα και σημαντική βελτίωση σε σχέση με την αρχική θέση του Συμβουλίου.

Μπορεί τελικά τα πρότυπα ποιότητας να μην είναι τόσο αυστηρά όσο θα επιθυμούσαν ορισμένοι - και πράγματι τα ελάχιστα πρότυπα ποιότητας δεν είναι τόσο αυστηρά όσο εκείνα που είχε προτείνει αρχικά η Επιτροπή. Ωστόσο, ενισχύθηκαν σημαντικά κατά τη συζήτηση στην επιτροπή συνδιαλλαγής, με αποτέλεσμα το τελικό κείμενο να είναι σημαντικά βελτιωμένο σε σχέση με τις διατάξεις που ισχύουν σήμερα και οι οποίες χρονολογούνται από την εποχή της έκδοσης της οδηγίας το 1975 και ως εκ τούτου έχουν ξεπεραστεί από τα σύγχρονα επιστημονικά δεδομένα.

Η Επιτροπή με ιδιαίτερη ικανοποίηση στηρίζει το κείμενο της συνδιαλλαγής, και ως εκ τούτου θα ήθελα να ελπίζω ότι το Κοινοβούλιο θα επικυρώσει το θετικό αποτέλεσμα που πέτυχε η διαπραγματευτική του ομάδα.

Έτσι, απόψε, ολοκληρώνουμε τη συζήτηση για δύο πολύ σημαντικές οδηγίες που αναμφίβολα θα βελτιώσουν το περιβάλλον και θα προστατεύσουν την υγεία των ευρωπαίων πολιτών.

  Richard Seeber, im Namen der PPE-DE-Fraktion. – Herr Präsident! Ich möchte mich beim Berichterstatter für die sehr gute Arbeit, die er geleistet hat, und bei der Kommission insbesondere für den Vorschlag für diese Richtlinie bedanken.

Ich muss offen sagen, ich war ein wenig enttäuscht von der Kommission, als sie ihre Meinung zum Gemeinsamen Standpunkt des Rates abgegeben hat. Da hätte ich mir eigentlich mehr Unterstützung für eine stärkere und schärfere Linie bei der Badegewässerqualität gewünscht, weil wir doch die vom Kommissar angegebenen Standards wesentlich aufgeweicht haben. Mit Unterstützung der Kommission hätten wir eine schärfere Richtlinie zusammengebracht, die die Mitgliedstaaten verpflichtet hätte, höhere Standards einzuführen, ohne dass das viel zitierte große "Geldausgeben" auf die Staaten zugekommen wäre.

Bedenken wir doch, dass heute das Hauptproblem für die Verschmutzung der Badegewässer nicht die Punktverschmutzungen sind, sondern diese diffusen Verschmutzungsquellen, insbesondere natürlich aus der Landwirtschaft. Mit relativ geringen Geldmitteln hätten wir hier eine wesentliche Verbesserung erzielen können. Aber wir haben einen Kompromiss geschlossen, und zu Kompromissen soll man auch stehen. Darum plädiere ich auch dafür, dass der Richtlinienvorschlag morgen im Parlament angenommen wird.

Wir haben doch einen Schritt in die richtige Richtung gemacht. Ich setze meine Hoffnungen jetzt auf das Jahr 2008, in dem die Überprüfung durch die Kommission ansteht und die Kommission die derzeitige Situation bewerten wird. Herr Kommissar, darf ich Sie daher jetzt schon bitten – da Sie ja gerne schwimmen –, Ihr Augenmerk darauf zu legen, dass Ihre Dienste diese Bewertung dementsprechend vornehmen und vielleicht die Gesundheitsstandards doch auf das OECD-Niveau hinaufsetzen, das eigentlich alle Staaten miteinander beschlossen haben, damit wir hier bei den Gesundheitsstandards nicht versuchen, nach unten zu nivellieren. Aber die Badegewässer haben in Ihnen sicher einen starken Verbündeten!

  Gyula Hegyi, on behalf of the PSE Group. – Mr President, as a Hungarian Member of the Socialist Group I am satisfied with the outcome of conciliation on the Bathing Water Directive. We have had extensive debates both in the Committee on the Environment, Public Health and Food Safety and later in the Conciliation Committee. It was not easy to make clear that we cannot apply the same criteria to inland and coastal waters and lakes – such as Lake Balaton in Hungary – as we apply to the Atlantic Ocean. That does not mean that we do not want to have strict rules as regards our inland waterways. However, lakes and oceans are obviously different.

Landlocked countries such as Hungary and Austria should have a right to their own bathing water as well. The area around Hungary’s bathing lakes is subject to a ban on certain industrial and agricultural activities, and the sewage system covers almost 100% of households. We can improve many things, but we cannot turn a lake into an ocean.

The present compromise is acceptable to us but means a lot of work for my country: some beaches will be closed and many others should be improved, but that is the cost of a clean and healthy environment. The compromise on a stricter version of the category ‘sufficient’ is to be welcomed. Public information on water quality at bathing sites is also very important. Indeed, on all beaches around Lake Balaton there are huge information signs written in Hungarian, English, German and Russian. Of course, we could add French, hoping that more tourists will come from France and other French-speaking countries.

In my last speech, at second reading, I had a rather tough tone, due to the one-minute limit and the speed of a heavy debate. Now I should like to thank Mr Maaten for his report and readiness for constructive compromise. He did a good job.

I hope, when I welcome him to Hungary, that he will be able to see how clean and sweet our Lake Balaton is.

  Marios Matsakis, on behalf of the ALDE Group. – Mr President, hundreds of thousands of European citizens fall ill every year as a result of entering contaminated bathing waters. The diseases acquired in this way range widely in severity. Most are clinically benign to moderate, but some are serious and a few are fatal. As expected, children, the elderly and the immunosuppressed are the most vulnerable. It is thus imperative for the legislative bodies of the EU to be greatly concerned with the quality of bathing waters.

They have indeed been working on this issue for many years, and one would expect the parameters used to monitor the quality of bathing water to be as strict as possible. Unfortunately this is not quite the case, and the reason for that is simple. It is that vast amounts of money are involved in the recreational and tourist industries associated with bathing waters, and if an area is pronounced to be of low bathing water quality then this has a serious economic impact on that region and that country. So the doctor’s opinion is no longer paramount, and ‘political compromises’ are the order of the day. Thus it is that after many years of talking, discussion and arguing – mainly about things that, if seen purely from a common sense point of view, are crystal clear – we end up in a conciliatory position in which we reduce the possible economic damage to countries with unhygienic bathing waters and increase the collateral risk of causing ill health among our citizens.

Many colleagues will disagree strongly with what I say, but how else can it be explained when, for example, we have invented a distinction, as far as health risks are concerned, between inland and coastal bathing waters, and we are prepared to accept that inland waters can be almost twice as unhealthy as coastal waters yet still be of sufficient quality for bathing in. And how else can it be explained when we are prepared to label bathing waters as being of good quality when the risk of falling ill after swimming in them is of the order of 5% – i.e. 1 in 20 swimmers. Although I will support this directive, it does not go far enough to make our bathing waters really safe. It just makes them less hazardous.

In conclusion, many thanks are due to everyone who has worked so hard to produce this directive, and especially to my colleague Mr Maaten – although he is not a swimmer he has still worked extremely hard! – to the Commission and, of course, to the members of the Conciliation Committee.

  Caroline Lucas, on behalf of the Verts/ALE Group. – Mr President, on behalf of my group, I wish to say that, in spite of the good offices of the rapporteur, we believe the compromise in front of us is unacceptably weak. That is why my group will be abstaining in tomorrow’s vote.

With that abstention, we intend to indicate the following. First, that the values agreed on fresh water protection are completely unclear: the parameters have been so tampered with by statistical changes that the degree of protection they will provide is extremely dubious. According to the peer-reviewed article about to appear in the scientific journal Environmental Health Perspectives, which was mentioned by Mr Maaten, these values will bring no improvement for the quality of fresh water at all.

Second, the real opportunity we had to extend this directive to cover recreational uses has been completely lost in the compromise.

Third, after a strong fight for higher standards, Parliament’s delegation suddenly dropped all of its demands after the Council offered a minimal increase of one of the two standards of the sufficient category.

Finally, the process by which this final agreement was reached was highly unsatisfactory, with last-minute technical proposals being introduced – verbally, not in writing – and with no time to properly study their implications.

This is a disappointing result, but, in spite of that, I should like to thank everyone involved. I appreciate that it is not an easy business, but we will be abstaining tomorrow.

  Johannes Blokland, namens de IND/DEM-Fractie. – Voorzitter, allereerst wil ik collega Maaten feliciteren met het bereikte resultaat. Mede dankzij zijn inspanningen kunnen we morgen de herziening van de zwemwaterrichtlijn aannemen. Ook de Europese Commissie wil ik bedanken voor haar medewerking, want zonder het ambitieuze voorstel dat zij gedaan heeft, zou het niet mogelijk zijn geweest om de aanscherping van de criteria te bereiken.

Voorzitter, ik kan u meedelen dat ik morgen dus zal instemmen met het resultaat van de bemiddeling, ook al ben ik niet geheel tevreden over het bereikte resultaat. De categorie "aanvaardbaar" die gecreëerd is, is niet meer dan een schaamblad voor het ontbreken van een serieuze aanscherping van de normen. Ook de scheiding die is aangebracht tussen zoet en zout water is gebaseerd op zeer beperkte informatie, en dat alles leidt ertoe dat de bescherming van zwemmers veel minder verbetert dan mogelijk was.

Graag zou ik de Commissie en de Raad willen wijzen op het artikel dat ook al door Jules Maaten genoemd is en dat volgende maand verschijnt. In dat artikel wordt duidelijk gemaakt welke normen we nodig hebben om zwemmers echt te beschermen. Ik hoop, commissaris Dimas, dat u die gegevens zult willen gebruiken bij de volgende herziening, die naar ik hoop niet zo lang op zich zal laten wachten.

  James Hugh Allister (NI). – Mr President, clean and safe bathing water is an obvious necessity, and an essential aid to a prosperous tourist industry.

In my region of Northern Ireland there are many beautiful beaches, several of which proudly boast blue flag status. We have others yet to attain that accolade. I trust that this directive will assist in their achievement of that status. Equally relevant is compliance with the Urban Waste Water Treatment Directive. This has been easier for countries eligible for cohesion funding, which makes available grants precisely for such projects. However, regions like mine, which have not and still do not qualify for cohesion funding, have greater difficulty in bringing their water treatment infrastructure up to acceptable standards. Extra national funding is, therefore, the only resort and has to be found. It is important to realise that the Bathing Water Directive should be considered in that wider context.

  Cristina Gutiérrez-Cortines (PPE-DE). – Señor Presidente, quisiera recordar que los diez años de esfuerzo empleados para redactar el documento han sido diez años de pacto permanente y de colaboración. Ello demuestra hasta qué punto puede ser eficaz la política de la Unión Europea, porque desde su inicio comenzaron a trabajar los ayuntamientos, las autoridades locales y los Estados para mejorar las condiciones de las playas y del agua de baño, tanto en el interior como en la costa.

Me parece importante resaltar –en un futuro siempre que imparta mis cursos lo explicaré a mis alumnos– que esto es una verdadera muestra de hasta qué punto la política medioambiental es un valor añadido para el sistema económico, para el bienestar de los ciudadanos e incluso para la plusvalía y aumento de valor del suelo.

Una playa con agua limpia es una zona turística acogedora y de buena calidad. De lo contrario, sabemos que el público no irá y cada vez estará más mentalizado. Y esto es el resultado de una política de cooperación y el resultado de un esfuerzo mutuo. Por eso considero que es satisfactoria e incluso me parece muy realista la introducción de la calificación de suficiente del agua, porque creo que no podemos forzar la realidad.

Conseguir que las aguas estén limpias cuesta muchísimo dinero y muchísimo esfuerzo de gestión, muchas penalizaciones a los vertidos a lo largo de las riberas de los ríos y una política integral. Los políticos hemos de ser conscientes de que ese esfuerzo sale del bolsillo de los ciudadanos y de una política científica de control de vertidos muy importante y de que todo eso no es fácil de conseguir. Por tanto, yo me congratulo y afirmo que esto demuestra hasta qué punto la calidad del medio ambiente añade valor al sistema económico, a las industrias e incluso al beneficio social.

  Thomas Ulmer (PPE-DE). – Herr Präsident, meine sehr verehrten Kolleginnen und Kollegen! Zunächst gilt mein herzlicher Dank Herrn Maaten für seine gute Arbeit und die Verhandlungen mit der EP-Delegation bis in die dritte Lesung.

Ich will mich auf einige medizinische Aspekte der Richtlinie beschränken. Badegewässer sind nicht keimfrei sondern keimarm. Badegewässer sollten prinzipiell Trinkwasserqualität haben, da letzten Endes von vielen Badenden und Schwimmern auch Badewasser getrunken wird. Wir haben in Süddeutschland z. B. mit dem Bodensee eines der größten Trinkwasserreservoirs Gesamteuropas. Erwähnt werden muss allerdings, dass auch Trinkwasser nicht absolut keimfrei, sondern nur keimarm ist und dass unser gesamtes menschliches Leben täglich von vielen Keimen begleitet wird, die allerdings eine unterschiedliche Pathogenität haben.

Der Grad des Schutzes, den wir jetzt mit dieser Richtlinie erreichen, ist sicher nicht vollkommen, aber er ist ein erster Schritt in die richtige Richtung. Die jetzt vereinbarten Grenzwerte von 330 Darmenterokokken für Binnengewässer und 185 für Küstengewässer – für die Kategorie "ausreichend" – reduzieren immerhin das Risiko einer Gesundheitsgefährdung der Badenden von 12 auf 8 Prozent, und Gesundheitsgefährdung heißt nicht automatisch Erkrankung. Gleiches gilt für die E.-Coli-Bakterien mit einer Zahl von 900 bzw. 500. Standardisierte Labormethoden sind für mich genauso selbstredend wie eine einheitliche Qualität der Probenahme. Zentrales Anliegen ist es für mich, die Bürger rechtzeitig und ausreichend zu informieren und überall in unseren Gewässern die Qualität „ausgezeichnet“ zu erreichen.

Weiteres Ziel muss es sein, zunächst unter streng wissenschaftlichen Kautelen die Viruslast der Gewässer zu kontrollieren, die zunehmend an Bedeutung gewinnt. So nimmt in Europa die Zahl der Erkrankungen mit Enteroviren und Noroviren rasch zu. Schon aus diesem Grund ist die erneute Revision der Richtlinie in nicht allzu ferner Zeit zu erwarten. Ich stimme der Richtlinie zu.

  Andreas Schwab (PPE-DE). – Herr Präsident, Herr Kommissar, meine sehr verehrten Kolleginnen und Kollegen! Die Badegewässer-Richtlinie stellt – und da schließe ich nahtlos an das an, was der Kollege Ulmer gerade gesagt hat – für meinen Wahlkreis, der direkt am Bodensee liegt, einen schwierigen Spagat zwischen Verbraucherschutz – den Badenden – auf der einen Seite und Naturschutz und Tourismus auf der anderen Seite dar. Der Kompromiss, den wir bei den Verschmutzungsbedingungen und Qualitätsstandards in der Kategorie „ausreichend“ gefunden haben, so wie dies der Kollege Ulmer genannt hat, ist ein fairer Kompromiss zwischen allen drei Interessen, die dort aufeinander treffen. Deshalb habe ich bei mir zu Hause sehr viel Akzeptanz für diesen Kompromiss gefunden. Dafür bin ich allen Kollegen, auch dem Berichterstatter, sehr dankbar.

Man muss aber auch darauf hinweisen, dass wir mit der Reduzierung von 19 auf nur noch 2 Kategorien von Verursachern eine Lösung gefunden haben, die auch dem Ziel einer verbesserten Rechtsetzung und einer weniger bürokratischen Regelung dient. Dies ist ein guter Beweis dafür, dass wir alle bemüht sind, die allzu zahlreichen Regelungen, die es in der Vergangenheit an vielen Stellen gab, auf die wirklich wichtigen Punkte zu reduzieren. Auch dafür möchte ich allen Beteiligten sehr herzlich danken.

Der Geltungsbereich der Richtlinie insgesamt ist aus unserer Sicht sehr zufrieden stellend. Es ist sehr erfreulich, dass das Europäische Parlament nicht an seiner ursprünglichen Absicht, den Geltungsbereich der Badegewässer-Richtlinie auch auf andere wassergebundenen Freizeitaktivitäten auszudehnen, festgehalten hat. Dafür danke ich auch allen Kollegen.
