Avant de donner la parole au commissaire, vous pouvez constater, chers collègues, qu'il nous reste seulement une vingtaine de minutes pour le débat avant notre Heure des votes. Vous comprendrez bien que, dans ces conditions, nous ne pourrons pas terminer le débat. Je préfère vous le dire tout de suite: je serai obligé de suspendre le débat.

  Markos Kyprianou, Member of the Commission. Mr President, first of all I would like to thank the rapporteur, Mrs Thyssen, and the Members of Parliament and the members of the Committee on the Internal Market and Consumer Protection for their excellent and close cooperation and the support they have expressed for the consumer programme.

I would like to apologise in advance for repeating some things I have already said regarding the health part of the programme. However, given that we are having separate debates, it is important to make some statements again in relation to the consumer programme.

The problem of the budget is again a similar one: a reduced budget means reduced policies and, again, it means less money for the Union of 27 – 25 plus 2 – than we had for the 15.

In the age of consumer protection, where we have to take strong initiatives, especially in the new Member States and the acceding Member States, this will cause serious problems and will of course affect the assistance we offer to consumer organisations, especially as regards funding of projects and training of staff.

On the same issue, I would like to remind you again of the letter sent by President Barroso to President Borrell raising these concerns, explaining that if the compromise stays in place it would mean less money than we had in 2006 and asking for additional efforts in this area. Again, as in the health area, if eventually we are left with such a major cut or reduction in our funding, it will mean that we cannot spread it thinly over many actions. Limited funds mean we have to re-evaluate and prioritise and decide where we actually want to concentrate, where we can achieve the greatest benefit. I hope that this can be corrected, that eventually the funding will be provided and that we will be able to cover the programme as it was proposed.

On splitting the programmes, I have to repeat that I fully understand the position of the Committee on the Internal Market and Consumer Protection in this respect. I understand why it would prefer to have two separate programmes. As I said earlier, we believe that there would be some added value if we adhered to a merged programme, where we clearly distinguish between actions in health and in consumer protection; but we can benefit from having common areas and achieve better economies of scale.

Nevertheless, given that the financial perspectives negotiations are still ongoing, this would and will affect the Commission’s position on the splitting of the programme. At this point, therefore, we cannot take a final decision regarding splitting and have to reject the amendments relating to splitting. On the conclusion of the debate on the financial perspectives, the Commission will review this issue again. I repeat that Parliament has made its wishes very clear and I have taken note of the very strong – almost unanimous – position of Parliament.

I shall not comment on the amendments separately. A full list of the Commission’s position on each of the amendments is being made available to Parliament and I should be obliged if it could be included in the Verbatim Report of this sitting⁽¹⁾.

The amendments we are rejecting relate mostly to the splitting, and we are doing so either for the reason I explained earlier or because they go beyond the scope of Community consumer policy. It is not that we disagree with the substance of these proposals, but that we feel they go a bit further than the scope of Community consumer policy and – given the existing situation – we would not be able to finance some of them.

We agree on the other issues, especially as regards the need to integrate consumer interests into other policies. I count on Parliament’s support to ensure that consumer interests are given proper attention in many other key consumer policy initiatives.

That is a brief overview of the Commission’s position on this issue. I look forward to a very interesting debate.

  Marianne Thyssen (PPE-DE), Rapporteur. – Voorzitter, mijnheer de commissaris, collega's, als rapporteur van de IMCO wil ik expliciet bevestigen wat eigenlijk in het vorige debat al duidelijk is geworden; ook de Commissie interne markt is tegen een geïntegreerd programma volksgezondheid en consumentenbescherming en met de steun van de Conferentie van de voorzitters vragen we een eigen meerjarenprogramma voor consumentenbescherming. Omdat de commissaris toch nog niet helemaal overtuigd lijkt, som ik de redenen daarvoor nog even op.

De communautaire bevoegdheden op elk van deze twee terreinen zijn onderling te verschillend. Hetzelfde geldt voor de maatschappelijke doelstellingen van de betrokken middenveldorganisaties; de interne bevoegdheidsverdeling, ook in de lidstaten, staat veelal haaks op een geïntegreerde aanpak. Een patiënt is iets anders dan een consument en niet in het minst, wij willen zekerheid inzake de omvang van het voor consumentenzaken beschikbare budget en wij willen voorkomen dat, wanneer er een crisis is op het vlak van volksgezondheid, het consumentenbeleid het budgettaire slachtoffer zou worden van een dringende volksgezondheidsbehoefte die normaliter via een flexibiliteitsinstrument moet kunnen worden opgelost.

Collega's, eigenlijk voel ik mij bij de behandeling van dit verslag vandaag, bij gebrek aan financiële perspectieven, wat ongemakkelijk. Ongemakkelijk omdat we geen zicht hebben op het budget terwijl ik heel goed aanvoel dat de omvang van het budget en de inhoudelijke invulling van het programma twee keerzijden van eenzelfde medaille zijn. Maar onze ambities op het terrein van het consumentenbeleid kunnen we moeilijk drukken. Alle Europese instellingen gebruiken het communautair consumentenbeleid al jaren om te illustreren dat Europa echt wel bekommerd is om de zorg van de gewone mensen. En in tijden van uitbreiding, wanneer de behoefte des te groter is om de interne markt een consumentendimensie te geven, wanneer we ook de Europese Unie haar menselijk gelaat moeten kunnen laten bewaren, in zulke tijden kunnen wij de ambities op het vlak van consumentenbescherming niet ongestraft terugschroeven.

En alleen al omwille van de aanwezigheid van de drie instellingen - ik ga er dan vanuit dat het Oostenrijks raadsvoorzitterschap hier behoorlijk vertegenwoordigd is - alleen al daarvoor dacht ik dat het toch wel nuttig was vandaag te pleiten voor het bewaren van het in het Commissievoorstel opgesomde budget. Ik denk dat we het daar echt wel bij moeten houden.

Voorzitter, wij hebben in overleg met professor Trakatellis van de Milieucommissie het budget netjes opgesplitst volgens de door de Commissie gehanteerde verdeelsleutel. Wij komen zo voor consumentenbescherming tot een bedrag van 233 miljoen euro over 7 jaar. In afspraak met onze financiële perspectievenonderhandelaar, onze collega Böge, hebben wij er in de IMCO niets aan toegevoegd, maar laten we dit niet verkeerd begrijpen: dit wil absoluut niet zeggen dat we later met minder genoegen zullen nemen. De drie begrotingsautoriteiten wordt verzocht deze boodschap letterlijk op te nemen. Met minder zijn we niet tevreden omwille van het belang van de materie, het door de uitbreiding toegenomen werkveld en het noodzakelijke vertrouwen van de consument in de interne markt.

Voorzitter, ik wil mijn collega's van de IMCO danken, omdat zij zich pal achter deze lijn geschaard hebben en ook omdat wij ons hebben kunnen beperken tot slechts twee grote aanvullende aandachtspunten op het voorstel van de Europese Commissie dat door mijnheer de commissaris overigens meer dan behoorlijk was geconstrueerd.

1. Wij willen dat de programmatie meer oog heeft voor het erbij betrekken van de lidstaten met een minder lange traditie op het vlak van consumentenbescherming, op het vlak van de consumentenbeweging, de capaciteitsopbouw van consumentenbonden en hun participatie aan de beleidsvoorbereiding.

2. Er moet bijzondere aandacht gaan naar de veroudering van de bevolking en ook naar andere kwetsbare consumentengroepen. Mensen met ervaring in consumentenrecht weten dat wij die kwetsbare groepen niet op een afdoende wijze kunnen meenemen in wetgeving, die per definitie een algemene draagwijdte heeft, maar in een consumentenprogramma kunnen we ons op doelgroepen richten en kunnen we die kwetsbare consument wel meepakken en dat moeten we doen, als we willen gaan naar een warme menselijke maatschappij.

Beste collega's, dit is het eerste verslag van de Commissie consumentenbescherming in meer dan 10 jaar waarbij onze betreurde IMCO-voorzitter, Phillip Whitehead, niet het woord neemt. Wij blijven hem missen en mijn jarenlange vriendschappelijke collegiale samenwerking met Phillip brengt me ertoe dit verslag aan hem op te dragen. Collega's, ik vraag uw steun voor dit alles, ik vraag ook de steun van de Commissie en de Raad voor ons voorstel. Ik dank u voor de samenwerking, ik dank u voor uw respect voor Phillip Whitehead, want dat zijn we hem verschuldigd en ik dank ook de mensen van het IMCO-secretariaat, die dit dossier heel professioneel hebben begeleid.

Voorzitter, nog een woord. Waarschijnlijk zullen niet alle collega's kunnen spreken voor de lunch; we zullen dan ook een afspraak moeten maken over de stemming, want dit is een codecisieverslag; mocht niet iedereen kunnen spreken voor de lunch, dan zou ik ervoor willen pleiten om de stemming te verschuiven naar de zitting van volgende week in Brussel; ik denk namelijk dat we dat niet van toevalligheden kunnen laten afhangen en dat we niet met een heel kleine aanwezigheid over zo'n thema, dat zoveel mensen aangaat, kunnen stemmen. Dat is mijn suggestie als rapporteur.

  Le Président. – Madame Thyssen, votre demande de report du vote sera soumise à notre Assemblée tout à l'heure, au tout début de la séance des votes, par le vice-président qui me remplacera.

  Reinhard Rack (PPE-DE). – Herr Präsident! Es betrifft genau die Situation, die auch die Kollegin Thyssen zu Recht angesprochen hat. Wir haben gestern kritisiert – völlig zu Recht kritisiert –, dass wir, während die Kollegen hereingekommen sind, Rednerbeiträge hatten und Kommissare sprechen ließen, denen niemand wirklich zuhören konnte. Jetzt haben wir genau dieselbe Situation wieder.

Wenn es in diesem Haus nicht möglich ist, die Debatten entweder so knapp zu organisieren, dass die Zeiten eingehalten werden, oder sonst tatsächlich einen Zeitraum zwischen der Abstimmung und dem Ende der Debatte vorzusehen, dann sollte man sich hier wirklich andere Wege überlegen. Das, was die Kollegin Thyssen vorgeschlagen hat, ist jedenfalls in einem Punkt voll und ganz zu unterstützen: Die Abstimmung sollte auf einen Zeitpunkt verschoben werden, an dem die Kollegen tatsächlich hier sein können.

  Le Président. – Je vous comprends très bien, Monsieur Rack, mais je tiens à préciser que c'est à la demande du rapporteur elle-même, qui, si j'ai bien compris, ne pourra être là cet après-midi, que nous avons décidé de commencer le débat sur ce rapport ce matin.

Nous allons à présent entendre les rapporteurs pour avis.

  Brigitte Douay (PSE), rapporteur pour avis de la commission des budgets. – Monsieur le Président, tout comme leur santé, dont on vient de débattre, les quatre cent soixante millions d'Européens souhaitent qu'on protège de mieux en mieux leur consommation. Dans le contexte des crises sanitaires, passées et actuelles, ou dans celui de la mondialisation, qui ne garantit plus la traçabilité de tous les produits, la politique européenne de protection des consommateurs prend donc tout son sens. Le marché intérieur ne peut d'ailleurs fonctionner correctement sans la confiance des consommateurs. En montrant aux citoyens qu'elle se préoccupe réellement de leur santé et de leur sécurité et qu'elle se donne vraiment les moyens d'agir, l'Union européenne renforce la lisibilité politique à leur égard.

Merci donc à Mme Thyssen pour la qualité de son rapport. La commission IMCO a proposé un budget de deux cent trente-trois millions d'euros, étalé sur sept ans, pour l'action spécifique "protection des consommateurs"; ce budget, qui est en augmentation par rapport au programme actuel, est indispensable si on veut en réaliser les objectifs, ambitieux compte tenu des nouveaux besoins liés à l'élargissement. Espérons que des coupes sombres ne viendront pas en altérer les actions, en cas de perspectives financières a minima, car ce dont ont besoin les consommateurs européens, c'est d'un budget qui soit à la hauteur des politiques qu'ils attendent en réponse à leurs inquiétudes. Ce que ne permettrait pas une Union européenne à la diète budgétaire!

Je déplore toutefois que les amendements sur l'information et la lutte contre la contrefaçon adoptés en COBU, n'aient pas été repris par la commission IMCO. Or, du point de vue économique, la contrefaçon est un véritable fléau, tant pour la santé que pour les consommateurs. Elle touche les grandes marques, les PME et tous les secteurs de l'activité économique et humaine: médicaments frelatés, appareils ménagers défectueux, pièces détachées non conformes, jouets dangereux, cosmétiques empoisonnés, pour ne donner que quelques exemples.

Il me semble important, dans le cadre d'une politique de protection des consommateurs, de mieux informer les clients potentiels des contrefacteurs des dangers qu'ils courent; c'est pourquoi, même si la lutte contre la contrefaçon est incluse dans d'autres actions de ce programme, je tiens à insister une nouvelle fois sur cet aspect de la protection des consommateurs.

  Aloyzas Sakalas (PSE), Teisės reikalų komiteto nuomonės pranešėjas. – Sveikinu M. Thyssen, parengusią puikią Europos Komisijos dokumento analizę. Reikia pasidžiaugti ir tuo, kad Europos Parlamento vadovybė nusprendė atskirti vartotojų teisių apsaugos dokumentą nuo sveikatos apsaugos dokumento. To nepadarius vartotojų apsauga ir toliau liktų sveikatos apsaugos šešėlyje. Tačiau dokumento atskyrimas dar nereiškia faktinio šių problemų atskyrimo. Jei nebus atskirtas šių abiejų sistemų valdymas, abi tas sritis valdys ta pati agentūra. Teisės reikalų komitetas mano, kad vartotojų teisių apsaugos pagerinimui iš esmės būtina integruoti vartotojų apsaugą į civilinę teisę. O Komisijos Sveikatos ir vartotojų teisių apsaugos generalinis direktoratas turi artimai bendradarbiauti su Teisingumo ir Vidaus rinkos generaliniais direktoratais, kadangi vartotojų apsauga yra ir šių direktoratų dalinė funkcija. Visiškai aišku, kad plečiantis vidaus rinkai, vartotojų teisių apsauga tampa praktiškai neįvykdoma atskiroje valstybėje, be artimo bendradarbiavimo su kitomis ES valstybėmis narėmis. Todėl ES Vartotojų teisių apsaugos agentūra turi glaudžiai bendradarbiauti ir su nacionalinėmis agentūromis ir ypač su visuomeninėmis organizacijomis, nes jos valdo visą informaciją apie vartotojų teisių pažeidimus. Mes turime žinoti, kad labiausiai pažeidžiami vartotojai yra vaikai ir pagyvenę žmonės, nes jie nesugeba efektyviai apginti savo teisių. Šiai žmonių kategorijai ir turi būti skirtas ypatingas agentūrų dėmesys. Teisės reikalų komitetas yra pateikęs pataisas, kuriose yra įtvirtinti aukščiau išvardinti teiginiai. Kviečiu visus pritarti M. Thyssen pranešimui, o tuo pačiu ir Teisės reikalų komiteto pataisoms.

  Le Président. – Chers collègues, je suis confronté à un petit problème que je vais vous exposer très rapidement. Nous venons d'entendre les rapporteurs pour avis des différentes commissions concernées. Je suis censé arrêter le débat à ce stade, avant le bloc des orateurs s'exprimant au nom des groupes. Cela dit, l'orateur s'exprimant au nom du PPE, notre excellent collègue, M. Stubb, ne pouvant pas être là cet après-midi, il a demandé à s'exprimer dès à présent, son temps de parole étant de trois minutes. Mr President, there is an old Swahili saying: ‘Never stand between a river and a hippopotamus’. I feel a bit like that right now!

I should like to thank Mrs Thyssen for an excellent report. On behalf of my group and myself, I support each and every line. I should like to make three points.

Firstly, I do not believe that we need a separate consumer programme for new Member States. We are one big family. Let us stick to that basic line.

Secondly, we must improve cooperation, but we do not need a new agency to do that, so I would call upon the Commission not to create another agency.

Thirdly, let us try to activate the consumers and remember that the money we are allocating for consumer policy is really not that much: EUR 40 million per year, which is 0.03% of the total budget.

I should again like to congratulate Mrs Thyssen on her excellent work.
