  Joe Borg, Member of the Commission. Mr President, I am very pleased to refer today to the Commission proposal for a Council regulation concerning the new Fisheries Partnership Agreement between the Community and Morocco. Before outlining the Commission’s position on this file, let me first thank the Committee on Fisheries and especially its chairman, Mr Morillon, for his excellent work, and the rapporteur, Mr Varela Suanzes-Carpegna, for his report.

As Members know, this agreement marks the renewal of our relations with the Kingdom of Morocco in the fisheries sector after the previous agreement came to an end in November 1999. The agreement also marks an important step forward towards strengthening our overall relations with Morocco. The agreement marks a new era in fisheries relations between the Union and Morocco. For the first time the Commission has negotiated a fisheries partnership with Morocco, following the principles laid down in the Council conclusions of July 2004. It prepares the ground for fruitful cooperation between the two parties with a view to achieving sustainable fishing and it will foster a favourable climate for further cooperation in all segments of the fisheries sector.

The new Fisheries Partnership Agreement establishes the basis for a political dialogue between the Community and Morocco in order to identify areas of common interest, thereby taking into account also the particular objectives, needs and opportunities of the Moroccan fishing sector. On this basis, the agreement will contribute to the development of a reasonable fisheries policy in the waters concerned. At the same time, I am convinced that the agreement with Morocco is a very balanced one, which responds to the interests of the Community fleet and in particular the small-scale fleet that was most affected by the terms of the previous agreement.

Six categories of fishing possibilities are covered by the agreement. Four of them are small-scale fisheries, small pelagic vessels in the north, bottom long-liners, small-scale vessels in the south, and pole-and-line tuna vessels. A category of demersal fisheries is also included, as well as industrial pelagic fisheries, which is limited to a quota of 60 000 tonnes of catches per year.

The protocol sets the financial contribution at EUR 36.1 million per year. A substantial part of this amount – EUR 13.5 million – is earmarked for support measures in view of the implementation of a sustainable and reasonable fisheries policy.

The agreement has been concluded for a period of four years and contains a number of elements on which the partnership approach is based. They include, amongst other things, an exclusivity clause which prohibits the existence of private licences or other private arrangements outside the scope of the agreement; scientific cooperation in order to promote responsible fishing in Moroccan fishing zones; the possibility of a review of the fishing opportunities on the basis of scientific evidence and within the limits required by the sustainable management of Morocco’s resources; vessel monitoring system requirements to reinforce checks on vessels operating in Moroccan fishing zones; and the social clause applicable to local seamen signed on by Community vessels.

I am confident that this agreement will be implemented in the best possible way and in the spirit of partnership, dialogue and remarkable mutual respect that has characterised our relations with the Kingdom of Morocco since the beginning of the negotiations.

At this point allow me to turn briefly to the amendments. Although the Commission can agree with the spirit of certain amendments, such as Amendments 2, 5, 7, 10 and 13, it does not consider them necessary. Similarly it does not consider Amendment 4 necessary, and it cannot accept Amendments 1, 3, 6, 8, 9, 11 or 12.

On Amendments 14 to 18, the question of the EC-Morocco Fisheries Partnership Agreement and the related question of Western Sahara have been discussed at great length, in the European Parliament’s Fisheries Committee, as well as in the Committee on Development and the Committee on Budgets.

I would like to emphasise again that the agreement is fully in conformity with international law. This has also been confirmed by the opinion of the European Parliament’s Legal Service, and the legal services of the Commission and the Council. The content of the agreement does not contain any provision dealing with the legal status of the maritime waters pertaining to Western Sahara. It defines the Moroccan fishing zone as the waters falling within the sovereignty or jurisdiction of the Kingdom of Morocco. This neither defines nor prejudges the legal status of the waters concerned. According to the provisions of the agreement, it is up to the Moroccan authorities as the contracting party concerned to define the fishing zones on the basis of which fishing licences will be issued.

  Daniel Varela Suanzes-Carpegna (PPE-DE), ponente. – Señor Presidente, señor Comisario, queridos colegas, como prometimos, aquí estamos hoy, tan sólo un periodo parcial de sesiones después, en condiciones de ofrecer al Pleno un informe de nuestra Comisión de Pesca sobre el Acuerdo entre la Unión Europea y Marruecos.

Creímos que no había que hurtar a nuestra Comisión el debate de este Acuerdo sensible, por lo que debía debatirse y aprobarse previamente en ella. Creo que este tiempo ha sido de gran utilidad: lo ha sido para el ponente, que dispone ahora de mayor información que la que tenía entonces, y lo ha sido porque nos ha permitido conocer en profundidad lo acordado y lo que todavía no está acordado, nos ha permitido ayudar a la Comisión a favorecer un Acuerdo que tiene todavía cuestiones muy importantes sometidas a negociación, arrojando luz y taquígrafos, como corresponde a un Parlamento.

Así pues, hoy estamos en condiciones de pedir a la Cámara el voto favorable para este Acuerdo, pero con las cautelas, matices, garantías y mejoras que hemos introducido en la Comisión de Pesca y que se incluyen en el informe.

Con él creo que hemos mejorado el Acuerdo y la posición institucional del Parlamento y hemos ejercido plena y responsablemente las funciones para las que hemos sido elegidos. Nuestro auténtico objetivo era y es mejorar las garantías del sector pesquero, beneficiario del Acuerdo, velar por el cumplimiento de sus cláusulas y hacerlo operativo y rentable. No entendíamos entonces y tampoco ahora por qué algunos se oponían a este ejercicio de responsabilidad y transparencia.

Junto con las cuestiones técnico-pesqueras a las que ahora me referiré, el Acuerdo era sensible políticamente, por la espinosa cuestión del Sáhara Occidental, que no podíamos soslayar pero en la que tampoco debíamos ahondar o interferir.

He pretendido ser neutral en esta cuestión, reconociendo el problema, pero sin manifestarme por ninguna de las partes, para no inclinar la balanza desde el Parlamento por una de ellas, aunque, eso sí, respetando siempre el Derecho internacional y el contencioso en curso, sin ignorarlo, e incluyendo la doctrina de las Naciones Unidas en relación con los territorios no autónomos.

El dictamen del Servicio Jurídico del Parlamento ha sido de gran utilidad y queda incorporado al informe, así como las enmiendas de nuestra colega la señora Attwooll, a quien agradezco su sensibilidad y comprensión, y la única enmienda que aprobó la Comisión de Desarrollo en relación con el Sáhara.

Aprovecho para agradecer, asimismo, al señor Kindermann, coordinador del Grupo Socialista, la atención que me ha prestado y su lucha por mantener a su Grupo unido –aunque no lo haya conseguido plenamente, me consta el esfuerzo que ha realizado–.

En definitiva, creo, como ponente, que el informe es equilibrado y razonable, aunque los compromisos implican cesiones y nunca satisfacen a todos al cien por cien.

Quisiera ahora manifestar mi punto de vista sobre los aspectos estrictamente pesqueros del informe. El Parlamento Europeo da su conformidad al Acuerdo pero se reserva para sí, como he dicho, el seguimiento escrupuloso de su aplicación, lo que es plenamente acorde con nuestras funciones de control de la Comisión, solicitando un informe exhaustivo anual de su aplicación y exigiendo en particular que nos mantenga informados de todas y cada una de las modificaciones que se introduzcan en el texto; en especial, reclamamos conocer los dictámenes que la Comisión emita en relación con la posible modificación de la cláusula de exclusividad del Acuerdo. Queremos conocer el grado de evolución de los recursos pesqueros, en especial de aquellas especies excluidas del Acuerdo y de alto valor comercial, como los cefalópodos y crustáceos, ya que, con su actual exclusión, se margina a la flota gallega. Queremos ser informados también de las medidas que se adopten para permitir a la flota andaluza faenar con luces, como lo venía haciendo, así como para que no se produzcan discriminaciones ni en esta pesquería ni en las medidas tendentes a asegurar los desembarcos en los puertos locales. Queremos estar informados también de las medidas técnicas aún no aclaradas en relación con la pesca de palangre y conocer los acuerdos de la comisión mixta que hagan referencia a la forma en que se invertirá la contrapartida financiera de la Unión Europea.

El reparto final de las posibilidades de pesca debe ser transmitido al Parlamento, pues en estos momentos se siguen produciendo reajustes en las mismas. Para ello, hemos aprobado las enmiendas de nuestra colega la señora Fraga, para que los repartos respeten la estabilidad relativa y que el sector y el propio Parlamento puedan ser observadores en la aplicación de estas cuestiones cruciales.

Si pudiera ser irresponsable alargar indefinidamente la tramitación parlamentaria de este Acuerdo, más lo habría sido, a nuestro juicio, aprobarlo con los ojos cerrados y, por tanto, sin estas exigencias y garantías.

Hemos querido asegurar a todas las partes implicadas que el Acuerdo se aplicará con todo rigor y seriedad y de acuerdo con las normas internacionales. Ése fue nuestro difícil compromiso y va a seguir siéndolo en el futuro, para hacer el seguimiento puntual desde el Parlamento Europeo de su aplicación, tras su entrada en vigor, de acuerdo con las enmiendas aprobadas por la Comisión de Pesca y si, como espero y deseo, la Cámara ratifica mañana el informe en el Pleno.

  Carmen Fraga Estévez, en nombre del Grupo PPE-DE. – Señor Presidente, evidentemente es una satisfacción contar de nuevo con un acuerdo de pesca con Marruecos, aunque todavía, por desgracia —como ha dicho el ponente—, no conozcamos exactamente sus términos.

Sí sabemos, sin embargo, que, tras seis años sin acuerdo, en los que no han cesado los contactos, al final se han quedado fuera justamente las dos flotas que otorgaban a las relaciones pesqueras con ese país su verdadero peso: la de cefalópodos y la de crustáceos. Es una de las razones por las que esta celebración tiene un sabor agridulce. Pero, desgraciadamente, hay más problemas.

Son de lamentar las presiones que hemos sufrido por parte de otras instituciones, incluso para violar los procedimientos establecidos, que han complicado mucho los trabajos de nuestra Comisión y del ponente, cuando sólo pretendemos que este nuevo Acuerdo no dé la misma cantidad de problemas que el anterior, así como obtener garantías jurídicas de que el contenido enviado al Parlamento corresponde realmente a lo que se va a encontrar nuestra flota.

Es de lamentar que sobre esto aún persistan dudas, ya que lo que la Comisión llama «errores técnicos de negociación de menor importancia» pueden suponer, por ejemplo, que la flota de cerco no pueda llegar a faenar.

Asimismo, la posibilidad de modificar las fichas técnicas queda demasiado abierta y, por ello, pedimos que se nos transmita toda la información posible y que miembros de este Parlamento puedan asistir como observadores a las comisiones mixtas.

Por último, hay que agradecer al ponente el equilibrio que ha logrado en cuanto a las cuestiones políticas surgidas. Pensamos, como él, que la Comisión de Pesca no es lugar para resolver problemas de política internacional de gran calado y complejidad. Su informe es escrupuloso con la legalidad internacional y sigue —como se ha dicho— el criterio de los informes jurídicos de las instituciones comunitarias, por lo que, de nuevo, solicitamos el rechazo a las enmiendas nuevas presentadas y, en cambio, pedimos el apoyo de todos los grupos para el informe del ponente.

Y, por último, me gustaría preguntarle al Comisario en qué etapa se encuentra la aprobación de esta propuesta por parte de la Cámara marroquí, que, como se nos dijo, se iba a reunir el 15 de abril, siendo éste uno de los primeros temas de debate. Queremos saber si ya está en trámite de ser aprobado por el Parlamento de Marruecos.

  María Isabel Salinas García, en nombre del Grupo PSE. – Señor Presidente, creo que el Acuerdo de asociación CE/Marruecos en el sector pesquero reviste una importancia transcendental en un doble sentido: por un lado, desde un punto de vista social y económico, son y han sido muchos los pescadores que han estado esperando durante seis años, con los barcos amarrados, a que hubiera una voluntad política firme que se marcara como prioridad la firma de un acuerdo de pesca con Marruecos.

Por otro lado, este Acuerdo tiene también una gran importancia política porque contribuye a la normalización de las relaciones entre la Unión Europea y el país vecino que es Marruecos.

No es un acuerdo meramente económico, dado que pretende una colaboración en la gestión sostenible de los recursos y una mejora de la cooperación. El Acuerdo responde a una nueva dinámica de asociación entre la Unión Europea y terceros países en materia de pesca.

También me gustaría resaltar que se trata del mejor acuerdo posible. Quiero decir claramente que me parece un buen acuerdo para el sector pesquero europeo, tanto por el número de licencias que permitirá como por la capacidad de pesca industrial.

Quiero recordar a los que se congratulan del Acuerdo, pero a la vez lo critican, sobre todo que hay que tener en cuenta que va a permitir retomar una actividad que ha estado detenida durante demasiado tiempo, con un número de licencias y una capacidad de pesca industrial inexistentes en estos seis años. Creo que el Acuerdo nace con voluntad de permanencia, con los mecanismos necesarios para resolver cualquier litigio que pudiera surgir y con la posibilidad de mejorar la cifra cuando los recursos lo permitan.

Este Acuerdo llegó al Parlamento hace unos meses, en procedimiento de consulta. Los pescadores, el sector y con ellos la mayoría de los ciudadanos esperaban que el Acuerdo, al que ha costado mucho tiempo, trabajo y negociación llegar, recibiera el apoyo de la Cámara y que entrase en vigor, es decir, que los pescadores pudieran comenzar a pescar lo antes posible. Por ello, por más que se empeñe el ponente, seguimos sin ver justificación alguna en el retraso, que consideramos innecesario.

Este retraso innecesario tuvo su punto culminante en la negativa a la tramitación del informe por el procedimiento de urgencia, que hubiera permitido su entrada en vigor en este mes de mayo. Toda esta demora y el consiguiente perjuicio para los pescadores ha tenido como resultado la presentación de un informe que, a mi juicio, no presenta ningún cambio relevante en el texto y cuyo retraso sólo ha servido para que se abran debates que nada tienen que ver con el sector de la pesca.

Creo que es el momento de mirar al futuro. Me congratulo sin dobleces del Acuerdo, considero positiva la consecución del Acuerdo. Por ello pido que este Parlamento lo respalde, enviando así un mensaje a los pescadores y al sector en el sentido de que su Parlamento apoya sin dobleces su vuelta inmediata a la actividad y pretende que esta vez sea de una forma duradera.

  Elspeth Attwooll, on behalf of the ALDE Group. – Mr President, Commissioner, the ALDE Group has continuing difficulties with the whole range of third country fisheries agreements, although we acknowledge that the new partnership model is an improvement on what went before. The agreement with Morocco creates particular problems, given the situation of the people of Western Sahara.

Whilst the prevailing legal advice is that the agreement is not, on the face of it, in contravention of international law, there is a clear risk of the breach of peremptory norms in its implementation. That is why, at committee stage, we proposed amendments intended to build safeguards into the regulation. These make approval of the agreement subject to its being operated in conformity with international law, insist on that operation being closely monitored and require a suspension if there is evidence of breach. As included in the report, these provisions afford protections that would otherwise be sadly lacking. We are grateful to the rapporteur for his sensitivity to the issues and for the compromise reached, as also for the support afforded to the whole set of amendments in committee.

I know, however, that many colleagues would have preferred a different outcome. I would like to reassure those who are uneasy about the mention of Western Sahara in the recital that it only recognises the fact of occupation and does not in any way imply its legitimacy. I can understand, too, the motivation of those who would like to see the waters adjacent to Western Sahara excluded from the agreement altogether, but I have to point out that this would have the paradoxical effect of depriving its people of the right to any financial benefit from the agreement, whilst not actually giving them greater security with regard to natural resources.

I conclude, though, by saying to the Commission and the Council that, however Members of this Parliament individually approach tomorrow’s vote, concern for the people of Western Sahara is felt across Parliament as a whole. Please take heed of that.

  Carl Schlyter, för Verts/ALE-gruppen. – Varela Suanzes-Carpegna har gjort ett väldigt seriöst arbete, men vi hörde tidigare ikväll hur Bolivias president Morales talade om 500 år av kolonial plundring. Den tiden borde vara över.

Men så står vi då inför detta olagliga fiskeavtal som är ren nykolonialism. Västsahara är ockuperat och ingen erkänner Marockos överhöghet. Enbart om ändringarna för att undanta ockuperade delar från avtalet godkänns så kan Europaparlamentets tal om mänskliga rättigheter infrias i praktiken.

Läs gärna SHERPA:s juridiska analys. De är experter på internationella avtal och dömer fullständigt ut fiskeavtalet. Institutionernas rättstjänster har använts för att misstolka FN-stadgan i exploateringens tjänst, men parlamentets rättstjänst erkänner att avtalet bara är lagligt om det kommer Saharawifolket tillgodo. I de tidigare avtalen struntade Marocko fullständigt i befolkningen. I detta avtal finns ingenting om kompensation till Saharawifolket eller riktade stöd som kompensation. Marocko har stulit Västsahara och den som skriver avtal med Marocko om denna fisk gör sig skyldig till häleri. Det är precis som att uppmana en tjuv att gå in i någons kök och stjäla deras fisk från matbordet, vilket ingen i denna sal skulle göra. Den som sträcker fram handen och trycker på ja-knappen till detta avtal, utan att undanta Västsaharas vatten, sträcker fram handen precis som en hälare för att få betalt för sina varor.

  Pedro Guerreiro, em nome do Grupo GUE/NGL Relativamente ao conteúdo do acordo de pescas entre a Comunidade Europeia e o Reino de Marrocos no que se refere às águas sob sua efectiva soberania apenas sublinho, em termos gerais, as posições expressas por representantes do sector das pescas que consideram as condições deste novo acordo extremamente prejudiciais, pois trazem mais restrições, mais encargos e menos benefícios para os pescadores.

Mas o presente acordo coloca uma questão anterior e mais importante, ou seja, o respeito do direito internacional e dos legítimos direitos do povo do Saara Ocidental. Marrocos ocupou ilegalmente o Saara Ocidental. Aliás, conforme estabelecido em resoluções das Nações Unidas, Marrocos não tem qualquer soberania sobre este território e, consequentemente, sobre os seus recursos naturais, nem qualquer direito como sua potência administrante de facto, nem de jure, nos termos da Carta das Nações Unidas. Marrocos é tão só a potência ocupante ilegal de facto do Saara Ocidental, ou seja, o seu colonizador ilegal.

Qualquer acordo com Marrocos que, de forma ambígua ou não, inclua a exploração dos recursos naturais do Saara Ocidental constitui, por isso, uma clara violação do direito internacional, pelo que, como a Frente Polisário sublinha, a questão que se coloca é a de saber se os países da União Europeia respeitarão a legalidade internacional e contribuirão para uma solução justa e durável do conflito respeitando o inalienável direito de autodeterminação do povo sarauí ou se, pelo contrário, encorajarão a injustiça, a agressão e a violação dos direitos do Homem.

A inclusão de cláusulas no acordo que, de forma mitigada, referem que a contrapartida financeira da Comunidade Europeia deverá também ser utilizada para o desenvolvimento das populações costeiras, de Marrocos e do Saara Ocidental que vivem da pesca, à semelhança do que ficou demonstrado em acordos anteriores, é insuficiente e não salvaguarda os direitos do povo sarauí. Aliás, se verdadeiramente se quisesse assegurar que o povo sarauí usufruiria dos dividendos devidos à exploração dos seus recursos haliêuticos, ter-se-iam assegurado as condições necessárias, como, por exemplo, através da criação de um fundo das Nações Unidas de forma a serem efectivamente garantidos os seus interesses e direitos.

Por estas razões reapresentámos duas propostas de alteração que, reafirmando a legalidade internacional, excluem explicitamente as águas do Saara Ocidental do presente acordo de pesca ao conceder possibilidades de pesca apenas aos pescadores da Comunidade nas águas sob a soberania ou a jurisdição do Reino de Marrocos, ou seja, nas águas situadas exclusivamente a norte do paralelo 27°40'.

Por último, será importante sublinhar que apesar de, por sua iniciativa, ter informado o Conselho Europeu e a Comissão Europeia das suas sérias preocupações quanto a este acordo, a Frente Polisário, legítima representante do povo sarauí, não tenha sido consultada em todo este processo, o que consideramos lamentável.

  Hélène Goudin, för IND/DEM-gruppen. – Vi har tidigare påpekat hur skadliga EU:s fiskeavtal är, såväl för befolkningarna i världens fattiga länder, som för skattebetalarna i EU. De enda vinnarna är fiskeföretag från främst länderna kring Medelhavet vars företag subventioneras starkt genom avtalen.

Denna gång är det dock mycket allvarligare eftersom EU tänker ingå ett avtal med en kolonialmakt av värsta sort. Genom detta godkänner EU indirekt den brutala och folkrättsvidriga ockupationen av Västsahara. Det är ytterst upprörande att gamla europeiska kolonialmakter än idag fortsätter att föra samma politik som förr, i subtilare form, men lika förgörande.

Dessa fiskeavtal är högst förkastliga. De hindrar de fattiga länderna att bygga upp en egen fiskeindustri, de bidrar till utfiskning av världshaven och de kostar skattebetalarna i EU enorma summor pengar. Därför uppmanar jag er att rösta emot alla fiskeavtal som kommer upp till votering i parlamentet, men framför allt emot detta.

  Jean-Claude Martinez (NI). – Monsieur le Président, je me réjouis de cet accord, raisonnable à deux titres.

Raisonnable d'abord en ce qu'il concerne les ressources halieutiques des provinces marocaines du Sahara occidental. Ce n'est pas l'avis du service juridique du Parlement qui compte, mais celui de la Cour internationale de justice. Pendant des siècles, le Maroc a exercé une certaine forme de souveraineté sur ce territoire. Que l'Algérie veuille une sortie sur l'Atlantique, c'est son problème, mais cela ne permet pas de fabriquer du droit.

Raisonnable ensuite, car il est bien de conserver les bénéfices de ces accords et de les reverser aux provinces sahariennes du Maroc, et aux populations. Je ferais cependant une seule réserve: elle concerne les 60 000 tonnes annuelles de pêche industrielle accordées aux grands senneurs de l'Europe du Nord qui n'ont pas de droits historiques, surtout pas par rapport aux droits historiques du Maroc, qui y a tout de même laissé 244 navires, disparus à la fin de l'accord.

Comme l'accord avec l'Angola a été dénoncé, nous devons nous réjouir d'avoir conclu cet accord raisonnable et équilibré avec le Maroc, et ne cherchons pas des poux sur la tête des Marocains.

  Margie Sudre (PPE-DE). – Monsieur le Président, Monsieur le Commissaire, mes chers collègues, je voudrais féliciter le rapporteur pour l'excellent travail qu'il a accompli afin de ménager les intérêts de chacun et de parvenir au meilleur compromis possible.

En vertu du statut juridique international du Sahara occidental, aucune entité, pas même le Parlement européen, ne peut intervenir dans ce différend, conformément au droit international, et comme nous l'a confirmé le service juridique du Parlement européen. C'est pourquoi je me réjouis de constater que l'accord n'a pas fait l'objet d'une querelle politique, ce qui ne l'empêche pas de préserver les droits du peuple marocain et sahraoui tout autant que celui des pêcheurs et de l'industrie de la pêche en Europe.

Par contre, il appartient à l'Union européenne de s'assurer que les bénéfices de l'accord profitent à tous, y compris au Sahara occidental. C'est précisément l'objet des amendements qui ont été présentés par la commission de la pêche en séance plénière. Le respect du droit international lors de la mise en œuvre de l'accord est à nouveau mis en avant. L'aide financière devra être utilisée pour favoriser le développement des populations côtières qui subsistent grâce à la pêche, et ce afin de permettre la création de petites et de moyennes entreprises dans ce secteur, que ce soit au Maroc ou au Sahara occidental.

Enfin, la Commission devra présenter un rapport annuel afin d'évaluer la bonne application de l'accord et pourra, dans le cas contraire, le suspendre, comme cela a été prévu. Je suis persuadée que ces amendements sont le gage d'un accord cohérent et juste. Je souhaite que le Parlement européen les adopte, à son tour, à une large majorité.

  Henrik Dam Kristensen (PSE). – Hr. formand! Da Vestsahara ikke er en suveræn stat, er det folkeretten, der gælder for dens befolkning. Ifølge folkeretten har denne befolkningsgruppe ret til selvbestemmelse via sine anerkendte repræsentanter. Det betyder, at hvis en aftale skal indgås, skal Vestsaharas befolkning inddrages, og de skal tilgodeses økonomisk. Juridisk Tjeneste i Europa-Parlamentet har slået fast, at så længe de marokkanske myndigheder kompenserer den vestsahariske befolkning økonomisk for de ressourcer, der tages fra deres farvande, så er aftalen ikke i strid med international ret. Det står imidlertid ikke i aftalen, at der skal ske en kompensation. Faktisk er Vestsaharas folk ikke nævnt med et ord, og de har ikke været inddraget i indgåelsen af aftaler.

Jeg mener ikke, at det er Fiskeriudvalgets opgave at løse konflikter mellem Marokko og Vestsahara, men for mig er det vigtigt, at folkeretten bliver overholdt, og at befolkningen i Vestsahara ikke ender som tabere i denne aftale. Derfor mener jeg også, at det er vigtigt, at vi stemmer for de ændringsforslag, der ekskluderer Vestsaharas territorium. Hvis disse ændringsforslag bliver vedtaget, så synes jeg, at det kunne ende med at blive en god aftale. Hvis ikke, så er det en dårlig aftale.

  Cecilia Malmström (ALDE). – Det finns mycket att säga om EU:s fiskepolitik. Nog är det mycket politik i det utöver själva fiskeavtalen! Just detta avtal innehåller väldigt mycket politik och det finns många oklarheter när det gäller Västsahara.

Marocko ockuperar Västsahara sedan 1975 och denna fråga har världssamfundet ännu inte lyckats lösa. Marocko har vägrat att acceptera FN:s plan på folkomröstning och har tyvärr inte bidragit till någon form av dialog eller förhandling.

Jag är väldigt orolig för att vi genom att rösta för detta betänkande ger möjligheter för Marocko att exploatera fiskeresurser som tillhör just Västsahara och dess folk. De juridiska analyserna är motstridiga och flera pekar på att finns ett oklart folkrättsligt läge eftersom gränserna för Marockos territorialvatten suddas ut. Det kan leda till att Marocko delar ut fiskelicenser som tillhör Västsahara vilket skulle strida mot både FN-stadgan och folkrätten. Marocko har gjort det förut och pengarna har inte kommit det västsahariska folket tillgodo. Jag kommer därför att stödja de ändringsförslag som begränsar avtalet till det som är förenligt med det internationell lag. Jag menar att det är viktigt att EU inte godkänner ockupationspolitiken utan att vi visar att vi vill ha en lösning på konflikten om denna Afrikas sista koloni. Om ändringsförslagen inte går igenom tänker jag, och många med mig hoppas jag, rösta nej till detta avtal. Vi kan inte säga att detta bara handlar om fiske och fiskarnas villkor. Det handlar i allra högsta grad om politik och det måste vi inse. Vi har ett stort ansvar att markera vår ståndpunkt och det kan vi göra genom att rösta nej till detta avtal.

  Ian Hudghton (Verts/ALE). – Mr President, I have become increasingly sceptical over the years I have been here about the value of fishing agreements in general: usually only a few of our Member States benefit, while all our taxpayers foot the bill. I am far from confident that the European Union can properly monitor fishing activity in these agreements or guarantee that our money ends up where it should.

However, this agreement has an added dimension: the absolute right of a people to self-determination, the right, in this case, of the Saharawi people to control their own resources. We should not be signing up to any deal with Morocco that leaves any doubt whatsoever whether Western Saharan waters can be included by the Moroccan Government.

If Amendments 14 to 18, restricting the agreement to Moroccan waters only, are approved – amendments which my group and I have signed – I would consider supporting this report, otherwise I would have to reject it.

  Vittorio Agnoletto (GUE/NGL). – Signor Presidente, onorevoli colleghi, il mio gruppo non può votare a favore dell'accordo con il Marocco perché la sua entrata in vigore si prefigura come una violazione del diritto internazionale. La pretesa di definire come acque territoriali marocchine anche quelle in realtà appartenenti al Sahara occidentale significa calpestare i diritti del popolo saharawi, chiaramente definiti dalle Nazioni Unite, in particolare il suo diritto all'autodeterminazione, già contenuto nella dichiarazione.

Tutti sappiamo che da molti anni il governo marocchino ostacola in ogni modo l'organizzazione del referendum sull'indipendenza del Sahara occidentale. Invece di far pressione su Rabat affinché intraprenda la strada della soluzione diplomatica, con la firma dell'accordo oggi in discussione, l'Unione rischia di dare il segnale sbagliato, legittimando una situazione d'occupazione denunciata da anni.

Alcune tornate fa abbiamo votato una risoluzione in cui si chiedeva di rispettare la sovranità saharawi sulle risorse di quel paese. Ritengo che occorra ribadirlo, denunciando l'accordo nelle parti in cui il Marocco ingloba le acque territoriali saharawi, come il mio gruppo ha cercato di fare.

Infine, credo che tale accordo dimostri una necessità di inserire la clausola democratica in tutti gli accordi di pesca dell'Unione con i paesi terzi. A febbraio il Parlamento approvava all'unanimità la mia relazione su questo tema. Non è accettabile che, come in questo caso, l'Unione e il Marocco facciano affari alle spese dei saharawi. Il rispetto del diritto internazionale, e dunque della sovranità del Sahara occidentale, deve essere una condizione per lo sviluppo ulteriore delle relazioni UE-Marocco.

  Rosa Miguélez Ramos (PSE). – Señor Presidente, creo que la de hoy es una fecha importante, porque, con la firma del Acuerdo de asociación en el sector pesquero entre la Comunidad Europea y el Reino de Marruecos y de un protocolo para los próximos años, se reinician unas relaciones, las pesqueras, que quedaron en suspenso tras la denuncia del anterior, en 1999.

Recuerdo perfectamente, señor Comisario, el difícil trago que pasamos cuando se rompió el anterior Acuerdo y cómo muchos pescadores, en su mayoría españoles -y de éstos, la mayor parte gallegos, canarios y andaluces-, se vieron obligados a una difícil reconversión.

Aquel momento no es que fuera agridulce, señor Comisario, es que fue un momento manifiestamente amargo -y muy amargo-.

En este sentido, a la consecución de este Acuerdo, por lo que le felicito calurosamente a usted, señor Comisario, y a todo su equipo -y, además, le agradezco muy especialmente que esté hoy aquí con nosotros-, ha contribuido, y no poco, el inicio de una nueva etapa de colaboración y de diálogo entre la Comisión y el Reino de Marruecos.

Y quiero resaltar, porque creo que merece ser resaltado, que, a diferencia de lo que ocurrió hace seis años, el Gobierno español acompañó, con su esfuerzo, el proceso negociador de la Comisión, que ha culminado con éxito.

Quiero recordar que este Acuerdo, que pertenece a una nueva generación de acuerdos, contribuirá de forma muy positiva a valorizar el sector pesquero en nuestro vecino del Sur. Y, en este sentido, señor Comisario, lo felicito, porque vamos a contribuir a generar empleo estable y vamos a ayudar a combatir la inmigración ilegal.

  Raül Romeva i Rueda (Verts/ALE). – Señor Presidente, entendemos que es legítimo, incluso necesario -como se ha dicho-, normalizar las relaciones entre Marruecos y la Unión Europea en el tema de la pesca, pero ello no debería hacerse a costa de legitimar una ocupación ilegal del Sáhara Occidental por parte de Marruecos.

Las Naciones Unidas no consideran a Marruecos como administrador del Sáhara, por lo que no puede negociar sobre las aguas saharauis, y la Unión Europea, aceptando de facto que se incluyan dichas aguas, está contribuyendo, lamentablemente, a que continúe la situación de expolio que tantas veces hemos denunciado en esta Cámara.

Tal y como establece la Convención sobre el Derecho del Mar, los beneficios de la explotación de un territorio con un estatuto aún por definir, según las Naciones Unidas, deben favorecer a la población del territorio afectado. Sin embargo, la actitud hostil y nada cooperativa de las autoridades marroquíes en relación con el contencioso del Sáhara Occidental las hacen muy poco fiables en este sentido.

Por ello, consideramos que el Acuerdo de asociación en el sector pesquero entre la Comunidad Europea y el Reino de Marruecos debe excluir explícitamente las aguas saharauis o, en caso contrario, nuestro Grupo se verá obligado a votar en contra del informe y, por tanto, del Acuerdo.

  Jonas Sjöstedt (GUE/NGL). – Detta fiskeavtal är ett skamligt avtal som innebär att EU bidrar till brott mot folkrätten!

Avtalet omfattar Västsaharas fiskevatten, men Marocko är Västsaharas ockupant och förtryckare och har ingen rätt till landets naturresurser. Västsaharas legitima företrädare, befrielserörelsen Polisario, motsätter sig bestämt detta avtal. Genèvekonventionen förbjuder en ockupant att nyttja ockuperade områdens naturresurser för egen vinning, men det är just detta som detta avtal innebär. Det innebär att även EU profiterar på och legitimerar Marockos olagliga ockupation av Västsahara och därmed aktivt bidrar till brott mot folkrätten.

Herr kommissionsledamot, ni har förhandlat fram ett avtal med Marocko som är ett skammens avtal!

  Dorette Corbey (PSE). – Voorzitter, visserijovereenkomsten moeten ingezet worden om duurzame visserij te promoten. Helaas is dat niet altijd het geval. Ook bij deze overeenkomst zijn er vraagtekens te plaatsen bij de 22 trawlers die toegelaten worden. Maar deze overeenkomst is beperkter dan de vorige, die tot 1999 liep, en het sluit een aantal kwetsbare vissoorten, vooral inktvissen en schaaldieren, uit. Er is meer nadruk op kleinschalige visserij en dat is belangrijk. De overeenkomst met Marokko zal bijdragen aan een duurzame omgang met schaarse visbestanden en gebaseerd zijn op het principe van maximum sustainable yield.

Dat is mooi natuurlijk maar helaas kan het Parlement dit allemaal nauwelijks toetsen op het moment dat we ons advies geven over de nieuwe overeenkomst met Marokko. We hebben immers geen toegang tot de ex ante evaluatie van de Commissie. Ik steun de amendementen van de rapporteur waarin wordt gevraagd om meer informatie, zowel over de visstanden als over de wijze waarop de overeenkomst ten goede komt aan de betrokken partijen. Maar ik pleit er ook met nadruk voor dat het Parlement in de toekomst tijdig toegang krijgt tot deze evaluaties of effectbeoordelingen zodat we goed geïnformeerd onze mening kunnen geven.

En dan is er natuurlijk de kwestie van de Westelijke Sahara. Het verslag is op dit punt onvolledig. De overeenkomst wordt niet beperkt tot de Marokkaanse kustwateren, maar is ook van toepassing op de wateren behorend tot de Westelijke Sahara. Hoewel een gezamenlijke commissie moet waarborgen dat de bevolking van de Westelijke Sahara zal profiteren van deze overeenkomst, is het nog maar de vraag of de Saharaanse bevolking er daadwerkelijk beter van wordt. Dat is in ieder geval niet duidelijk in de overeenkomst. We zouden onomwonden moeten stellen dat deze overeenkomst slechts betrekking zal hebben op de Marokkaanse kustwateren. Er zijn amendementen met deze strekking ingediend en ik hoop dat ze uw steun zullen krijgen.

  Manuel Medina Ortega (PSE). – Señor Presidente, quiero agradecer a la Comisión y al Comisario el trabajo que han realizado, permitiendo que se alcanzara este Acuerdo con Marruecos.

Quiero manifestar mi conformidad absoluta con los puntos expresados por el Comisario sobre el rechazo de las enmiendas infundadas que se quieren introducir, porque no tiene ninguna base en el Derecho internacional la pretensión de subordinar este Acuerdo a condiciones políticas de otro tipo.

Al hacerlo, quiero expresar el agradecimiento de una parte de la población a la que represento y en la que vivo; me refiero a la población de las islas Canarias, que es también población vecina de estas aguas, que ha pescado siempre en estas aguas y no, como han dicho algunos, con medios colonialistas. Mi bisabuelo firmó un acuerdo con la población de la costa para pescar en ella, basándose en el principio del interés mutuo. Veníamos pescando en esas aguas, volveremos a seguir pescando y quiero agradecer a la Comisión el esfuerzo que ha realizado.

Espero que este Parlamento apruebe por una gran mayoría este Acuerdo, muy justo y muy correcto desde el punto de vista del Derecho internacional.

  Paulo Casaca (PSE). – Senhor Comissário, Senhor Presidente da Comissão das Pescas, estamos perante um debate muito vivo e muito importante porque, por um lado, temos os interesses e os direitos legítimos dos pescadores e de Marrocos mas, também é verdade que não podemos esquecer que este acordo não pode legitimar a ocupação do Saara Ocidental, que não está reconhecida pelo direito internacional. Esta questão é absolutamente estratégica e fundamental e, por isso, não posso dar o meu acordo a uma proposta que faça tábua rasa deste problema, que é um problema de primeiríssima importância para a comunidade internacional, embora compreenda quem tome outras opções neste debate.

  Joe Borg, Member of the Commission. Mr President, first of all I would like to thank Mr Varela Suanzes-Carpegna for his opening remarks. I fully understand the points raised regarding monitoring and I have no difficulty with keeping the Committee on Fisheries informed of how the agreement is actually implemented. I fully share the concern to keep Parliament informed of the various aspects of the implementation of the protocol. I would like to underline that the Commission already complies with the requirements on the transmission of information, in line with the current institutional arrangements. We have also continued discussions with the chairman and members of the Committee on Fisheries in order to try to improve the existing exchange of information and dialogue, in particular with regard to the conclusion and the ex-post follow-up to the conclusion of fisheries agreements.

Concerning the points raised by Mrs Fraga Estévez, in particular with regard to cephalopods and crustaceans, I would like to underline that Article 4 of the protocol provides for reviewing the fishing possibilities under the agreement if the scientific reports indicate an improvement of the situation of certain stocks. On the basis of the conclusions of the annual Scientific Committee meetings, the two parties can agree jointly to modify the existing fishing possibilities as long as sustainable management of the resource is ensured.

The fishing possibilities established in the agreement reflect the total amount of available species, as recommended by the scientific report, and the capacities of the Moroccan national fleet. The Commission does not intend to re-open discussion on this issue except within the parameters of Article 4. Also, with regard to the point raised concerning modalities, the modalities referred to are certainly important but let me emphasise that these are technical questions that by their nature are not defined in the agreement.

Technical modalities such as the use of lamparo, the number of hooks for long-liners and the issue of landings for industrial pelagic fishery will be fine-tuned during the first Joint Committee meeting that will be convened after the entry into force of the agreement, and we certainly have no problem with keeping Parliament and the sector fully informed. Information could be given on technical modifications during our regular closed session meetings. The next one is foreseen for 21 June and if by then we have already had contact with the Moroccans, we will certainly report back to the Committee on Fisheries on the outcome of those contacts.

I was asked by Mrs Fraga Estévez how far Morocco has proceeded with regard to concluding the process of adoption of the agreement. Our information is that everything is moving smoothly. We do not know of any particular difficulties on the Moroccan side. It should therefore be adopted by the Moroccan Parliament immediately after we have adopted it some time in June.

I would like to thank all those who have expressed support for the agreement reached. Regarding the point raised by Mrs Corbey concerning the ex-ante evaluation, let me say that it was sent in September to the Chairman of the Committee on Fisheries and distributed to all members of the Committee on Fisheries.

As regards the points raised by Mrs Attwooll and a number of others, I repeat that concerning Western Sahara the wording used in the agreement was formulated very carefully. I repeat that it neither defines nor prejudges the legal status of the waters concerned. Again, with regard to what Mr Schlyter, Mr Hudghton, Mr Guerreiro and others said on the question as to whether Morocco can conclude agreements that concern the exploitation of the natural resources of Western Sahara, the United Nations legal adviser gives a clear answer. Although the United Nations has never recognised Morocco as an administrative power in accordance with Article 73 of the Charter of the United Nations, and Morocco is not listed as an administering power of the territory in the United Nations’ list of non-self-governing territories – this is point 7 of the Opinion of the United Nations legal adviser – agreements can be concluded with the Kingdom of Morocco concerning the exploitation of natural resources of Western Sahara.

The interpretation given by the UN legal adviser recognises the competence of Morocco to conclude these types of agreements and in this way implies that Morocco is a de facto administrative power of the territory of Western Sahara; the mandate given to the Commission by the Council was to negotiate with the Kingdom of Morocco.

In the framework of these agreements, international law seeks to assure the right of peoples and nations to use and dispose of the natural resources in their territories. In that respect, the agreements are considered compatible with the Charter obligation of the administering power and in conformity with the General Assembly resolution and the principle of permanent sovereignty of natural resources enshrined therein, if the exploitation of the resources in non-self-governing territories is considered for the benefit of the peoples of those territories, on their behalf or in consultation with their representatives. In that respect, Morocco is under an obligation to take all appropriate measures to ensure the full application of the EC-Morocco Fisheries Partnership Agreement in accordance with the obligations of international law.

May I say in response to Mrs Sudre’s and Mr Kristensen’s concerns that the agreement itself already guarantees certain benefits for the local population. In particular with regard to industrial pelagic fishery, which is focused on stock C, the agreement foresees the obligation to land 25% of captures. The main purpose of this provision is to contribute to the better supply of pelagic fish to the transformation industry that has in recent years suffered from irregular and short supplies of raw material. Additional economic incentives are therefore foreseen to encourage pelagic vessels to land a bigger part of their catches, more than the obligatory 25%, in the local ports in the south.

In addition to the above-mentioned landing obligation, the agreement also makes stipulations regarding services and infrastructure activities in the local ports in the south. That provides for additional earnings and contributes to development of these ports. The agreement also ensures additional support for the development of the coastal area through the following financial measures. The agreement sets an amount of at least EUR 4.75 million per year for the modernisation and upgrading of the coastal fleet. The agreement also specifies that part of the financial contribution should be used, among others, for the restructuring of small-scale fishing, training and support of professional organisations. The industrial pelagic fishery is under the obligation to land 25% of all catches in the local ports. This obligation has been inserted into the agreement in order to support the development of the local fishing industry, which suffers from an irregular or insufficient supply of raw material.
