  Le Président. – L'ordre du jour appelle le rapport de Ieke van den Burg, au nom de la commission des affaires économiques et monétaires, sur la politique des services financiers 2005-2010 - Livre blanc (2006/2270(INI)) (A6-0248/2007).

  Ieke van den Burg (PSE), rapporteur. – Mr President, in drafting this report for the European Parliament, I have wholeheartedly congratulated Commissioner McCreevy and his predecessor, Mr Bolkestein, on the success of the financial markets legislation and regulation and the executive work of the European Commission in this respect. We have no disagreements about that. We may differ, though, with respect to the assessment of further steps and the priorities for the follow-up.

I think this is linked to a difference in perspective. For me, it is not enough just to look at the success of this financial sector as such. I see this sector as instrumental, and want to assess whether it provides the right infrastructure for economic growth, wealth and well-being. That is why in my report I focus first on the strategic question of who is profiting from this success.

Are end users profiting to the same extent as the few large multinational financial conglomerates that have acquired dominant positions at the top of the financial markets? Who is profiting most from the increased liquidity in the markets? Is it KKR, Blackstone and the other private equity firms that do billion-dollar deals, or is it the companies that are covered because they see credit ratings tumble down to junk status? Do entrepreneurs still dare to invest in long-term research and development projects for the development of innovative new products and services, or are they squeezed in ever shorter cycles of financial planning and reporting? Is the huge increase of complex financial products derived from the traditional bonds and equities really leading to a better allocation of capital, or does it contribute mainly to greater speculative profits for the hedge funds that master the rules of the pyramid game? Are citizens in the recently-acceded Member States better off now with the invasion of foreign banks and insurance companies in their countries, or are they confronted again with monopolistic structures that only provide them with standard, mediocre-quality products at prices higher than in the countries where they have their headquarters?

These and similar questions seem to me to be fundamental to answering the question of what kind of follow-up is required, and the first preliminary message in my report is thus to make more in-depth economic analysis about that.

I shall turn now to the priorities outlined in my report. The first message deals with one of my great concerns, the enormous market concentration at the top of the market, with 30 to 40 major cross-border financial players and a high concentration in several Member States. In the competition report that we adopted at the last part-session, we voiced our concerns and suggested that Commissioner Kroes put on her list of possible enquiries and further investigations the activities at the top of the financial market of investment banks, credit rating agencies, accounting firms, etc. We repeated this suggestion to her last week.

The second issue is the financial stability risks of these new developments of alternative investments – hedge funds, private equity. I do not have to go into detail there because the papers daily show that there are currently more concerns at the developments. Prudential supervisors, central banks, the ECB and our counterparts in the USA, whom we will visit next week, also raised these concerns and I think it is high time that we dealt with these risks.

The third issue is the retail markets. My answer to the lack of integration at the retail side is not just to overhaul this system and open up the borders but to make a more precise focused strategy, particularly for mobile users, who have a real need in terms of accessing and working with service providers in different Members States, so that could be more of a stimulation for pan-European financial products such as the pension product that was presented some weeks ago by the European Banking Federation.

Demand for microcredit is an important issue, as are pension systems, access to basic services, financial education and stronger consumer input and, finally, better regulation and the future architecture of supervision. On this issue, I think the main difference is that your mantra is ‘less is more’, as you said last week. We think that we need a focused regulation. As regards the architecture of supervision I would say that it will be high time to discuss the future architecture in the autumn and not just wait and see what will happen, although there are a lot of good developments.

  Charlie McCreevy, Member of the Commission. Mr President, I would like to commend the Committee on Economic and Monetary Affairs and in particular the rapporteur, Mrs van den Burg, for the initiative she has taken and the hard work put into this report.

It is no easy task to tackle the very wide-ranging policy area of financial services in one report, as it ranges from banking to clearing and settlement, and hedge funds to payment systems. The report you have drawn up is an admirable achievement in that respect.

I would also like to say how pleased I am to see such an apparent convergence of views on so many aspects of financial services policy. Although we may approach subjects from a different angle sometimes, it is very encouraging to note how, in many respects, we are on the same page.

The European Parliament and the Commission are united in wanting Europe’s financial markets to go from strength to strength. We all want deep, liquid, dynamic financial markets that act as a real catalyst for investment and growth and ultimately bring benefits to all our citizens. We also want our regulatory and supervisory systems to be stable, fair and efficient and we all want to strengthen Europe’s place on the global financial stage. It is essential that we keep working towards these goals.

I warmly welcome the considerable attention given in the report to the issue of supervision. This is an absolute priority for the Commission in 2007. We are working intensively on our proposals to strengthen the Lamfalussy process due in the autumn this year and we agree with the concerns of the European Parliament on the issue of burden-sharing between home and host supervisors.

With regard to retail financial services, it is striking that many of the subjects touched upon in this report are included in the consultation on the Green Paper on retail financial services, which closes this week. I would argue, however, that we should not limit our ambition to finding solutions for the ‘mobile consumer’. We need our policies to make a difference to all consumers, even those who continue to shop locally. I welcome the support given in the report to initiatives on financial education, an issue on which the Commission is preparing a communication to be adopted towards the end of this year.

I acknowledge the concerns raised in the report with regard to alternative investments such as hedge funds and private equity. As I have stated on other occasions, I believe that we have the necessary regulatory safeguards in place already, but agree with you that constant vigilance will be essential. I also welcome some recent industry-led initiatives to develop voluntary standards or best practice on valuations, disclosure and risk management.

The concerns you express on market concentration in certain specific areas are understandable, although we have yet to receive indications of a problem of market distortion in the investment banking area. Work is already under way to mitigate some of the potential problems, for example through the International Organisation of Securities Commissions’ Code on Credit Rating Agencies, which we closely monitor. These initiatives must be given time to prove their effectiveness. Developing a knee-jerk reaction to a far from unsubstantiated problem would be much more damaging.

I welcome the European Parliament’s support for our regulatory dialogues with key international partners. On global accounting issues, steps are being taken, particularly through the establishment of working groups of the European Financial Reporting Advisory Group, to make European views and inputs more influential in the global accounting debate, something I can only applaud.

However, we cannot take our eyes off the main goal, and that is the continuing convergence process between US GAAP and International Financial Reporting Standards. I trust we can rely on your continued support as this process continues.

In summary, I can only reiterate that, as far as financial services policy is concerned, even if one or two notes clash slightly, we are certainly singing from the same hymn book.

  Jean-Paul Gauzès (PPE-DE), rapporteur pour avis de la commission des affaires juridiques. – Monsieur le Président, Monsieur le Commissaire, mes chers collègues, j'approuve les priorités de la Commission européenne en matière de politique des services financiers jusqu'en 2010. Il est effectivement nécessaire de consolider les progrès accomplis sur la voie d'un marché financier européen intégré, ouvert et compétitif, et d'éliminer les derniers obstacles économiquement significatifs pour que les capitaux puissent circuler librement dans toute l'Union européenne, au coût le plus faible possible et avec un niveau approprié de contrôle prudentiel, de façon à garantir la stabilité financière.

Il est également indispensable d'améliorer la coopération et la convergence en matière de contrôle dans l'Union européenne et d'approfondir les relations avec les autres places financières mondiales. Il me paraît essentiel de poursuivre la consolidation du secteur des services financiers et, plus particulièrement, l'intégration des marchés de détail. Plus les marchés financiers, qui jouent un rôle important dans le bon fonctionnement des économies modernes, seront intégrés, plus l'allocation des ressources économiques sera efficace, et meilleurs seront les résultats économiques à long terme.

S'agissant de la vente de détail, il faut aller plus loin pour faire progresser l'intégration. Il convient d'examiner notamment la question de l'harmonisation des règles nationales de protection des consommateurs. Les efforts doivent être poursuivis. Le secteur des services financiers de l'Union européenne recèle un potentiel considérable de croissance économique et d'emploi qui n'a pas encore été totalement exploité. Le marché intérieur des services de détail est loin d'être achevé; un marché des capitaux à risque plus efficace est indispensable pour promouvoir des entreprises nouvelles et innovatrices et pour renforcer la croissance économique.

À cet égard, je souhaite souligner l'importance de la promotion de la compétitivité des banques européennes vis-à-vis de leurs concurrentes, notamment américaines. Il importe, enfin, de veiller à la mise en place de structures communautaires en matière de réglementation et de surveillance. La fragmentation de la surveillance prudentielle constitue l'un des obstacles majeurs à la consolidation du secteur financier. C'est pourquoi les obligations de coopération et d'échange d'informations entre les autorités de surveillance doivent être renforcées. Il convient également de garantir la sûreté de la coopération en situation de crise.

  Othmar Karas, im Namen der PPE-DE-Fraktion. – Herr Präsident, Herr Kommissar, Frau Berichterstatterin! Ja, wir müssen den Finanzmarkt weiter stärken. Der Aktionsplan für Finanzdienstleistungen bis 2004 hat zur Entwicklung eines integrierten und gut funktionierenden europäischen Kapitalmarktes beigetragen, der nicht zuletzt wegen der Qualität und der Solidität seiner Regulierung weltweit führend ist. Wir sind aber noch nicht fertig, was sich allein schon an dem jetzt vorliegenden Bericht zeigt. Die Berichterstatterin hatte ursprünglich 43 Artikel vorgesehen. Dazu gab es 217 Änderungsanträge. Gemeinsam mit den Schattenberichterstattern – ich möchte Karsten Hoppenstedt entschuldigen – wurden 35 Kompromisse erarbeitet, und im Ausschuss gab es 141 Abstimmungen.

Wir ziehen aber in dieser Frage an einem Strang, weil wir einen gestärkten Finanzbinnenmarkt benötigen. CEPS, CESR, CEIOPS oder lead supervisor sind alles Begriffe, hinter denen sich die Suche nach einer idealen Struktur der europäischen Finanzmarktaufsicht versteckt. Die letzte Krisensimulation zur Überprüfung der Finanzstabilität in der Europäischen Union hat deutlich gezeigt, dass wir noch immer erhebliche Defizite haben.

Eine bessere Koordinierung zwischen den zuständigen beteiligten Aufsichtsgremien ist erforderlich, um ein angemessenes Management und damit Finanzstabilität in einer Krisensituation zu gewährleisten. Eine weitere Simulation dieser Art ist bereits für 2009 vorgesehen. Allen Ausprägungen in der EU ist jedoch gemein, dass der Hauptfokus der Aufsicht nach wie vor auf den einzelnen Instituten und weniger auf der Institutsgruppe liegt. Wir benötigen daher Aufsichtsstrukturen, die sich weiter entwickeln. Wir benötigen eine stärkere Koordinierung der nationalen Aufsichten. Wir benötigen keine Zentralaufsicht, sondern die herrschende Aufsichtskultur, die durch gleiche Werte und Ziele geprägt ist, gehört weiterentwickelt.

  Pervenche Berès, au nom du groupe PSE. – Monsieur le Président, Monsieur le Commissaire, vous le savez, pour mon groupe, le marché n'est pas un but en soi, le marché doit financer une stratégie. Cette stratégie, l'Union européenne vient de la renouveler de manière exceptionnelle, le 9 mars dernier, autour de ce que j'appellerai la stratégie des vingt: en 2020, 20 % de …, etc., je ne développerai pas. Voilà pourquoi nous avons besoin d'intégrer un marché financier cohérent.

Beaucoup a été fait, beaucoup reste à faire. Dans les choses qui restent à faire, il y a bien sûr la question des marchés de détail. À ce sujet, nous pensons qu'une approche bien particulière devrait être au cœur de la stratégie de la Commission. Bien sûr, il faudra favoriser l'éducation financière, c'est presque devenu le sujet à la mode et vous aurez le soutien de mon groupe lorsqu'il s'agira de développer une telle éducation. Mais il faut aussi, comme nous l'avons souligné lors de l'examen de la directive MiFID, examiner les conditions dans lesquelles les produits financiers sont proposés aux épargnants, aux consommateurs et aux petits investisseurs: c'est la question des conditions de commercialisation des produits financiers que nous devons également examiner de près.

Il reste le débat qui vient de s'ouvrir, avec beaucoup d'éclat sous la présidence allemande, relatif aux fonds alternatifs, les hedge funds. Le fait même qu'un code de conduite ait pu être imaginé au plan international dit combien ce débat a évolué. Pour autant, les acteurs de ce marché bénéficient d'opportunités créées par l'intégration. Cela leur donne un certain nombre de responsabilités et de devoirs. Et de ce point de vue, je crois que mon groupe ne partage pas le point d'équilibre qui est atteint. Si nous voulons garantir la sécurité du système, nous devons poursuivre la discussion, y compris lorsqu'il s'agit d'examiner les conditions dans lesquelles les prime brokers sont à la fois juges et parties dans l'affaire.

Il y a ensuite la question des structures de marché. La législation que nous adoptons a un impact sur les structures de marché et nous ne pouvons pas l'ignorer. En définissant notre législation segment par segment, nous devons avoir une idée claire du marché financier dont nous voulons pour répondre au mieux aux besoins de financement de l'économie européenne. Un marché financier dont les principaux bénéficiaires sont les grandes banques d'investissement localisées en dehors même de l'Union européenne est-il exactement celui dont nous rêvons? Je ne le crois pas. Nous devons intégrer une stratégie qui permette à chaque acteur de trouver sa place dans l'équilibre global.

Et puis, bien sûr, le grand sujet qui est devant nous, c'est la question de la supervision. Je partage entièrement les vues de notre rapporteur sur ce point. Il faut que le pouvoir et la légitimité des comités de niveau III, les superviseurs, soient renforcés; il faut que chaque superviseur national ait une obligation de convergence européenne. De cette façon, nous assurerons la sécurité du système et nous pourrons nous servir de cette supervision intégrée comme d'un meilleur outil pour mettre en place un marché européen.

  Margarita Starkevičiūtė, ALDE frakcijos vardu. – Kaip jau kolegos pažymėjo, Europos finansų rinka yra pirmaujanti pasaulyje, ir mums toliau reiktų įgyvendinti politiką, kuri leistų jai išlikti pirmaujančia pasaulyje rinka. Kokią politiką mes matome, liberalai? Visų pirma mums reikia efektyvios, atviros inovacijoms bei naujiems produktams politikos. Prioritetas turėtų būti teikiamas savireguliacijos priemonėms, nekuriami barjerai naujų finansinių produktų atsiradimui. Reguliavimas taikomas tam, kad būtų galima užtikrinti lygias konkurencijos sąlygas tiek didelėms, tiek mažoms įmonėms. Ypač aš norėčiau pabrėžti žodžius „mažoms įmonėms“. Komisija labai dažnai kreipia dėmesį tik į didžiųjų įmonių interesus.

Taip pat mes norime, kad būtų tinkama priežiūra. Tinkama priežiūra nereiškia smulkmeniškos priežiūros, tai reiškia priežiūrą, vykdomą remiantis tam tikrais principais. Kad tie principai būtų vienodai taikomi įvairiose šalyse, mes norėtume daugiau dėmesio iš nacionalinių vyriausybių ir taip pat iš Komisijos bei pačių Parlamento narių, kad nacionalinės priežiūros institucijos daugiau bendradarbiautų tiek sektoriniu principu, tiek tarp savęs.

Mes taip pat norėtume, kad būtų įvertinti finansų rinkos konsolidavimo iššūkiai, sisteminė rizika ir kad vartotojui būtų aišku, kas galų gale sumokės už tai, jeigu viena ar kita institucija, didžioji Europos institucija, dirbtų nesėkmingai. Mes taip pat norime finansų rinkos, kurioje būtų paisoma mažmeninių vartotojų interesų – milijono eilinių ES žmonių interesai.

Kokia ta rinka turėtų būti? Mažmeninė rinka turi remtis atvira struktūra, kad būtų prieinama didelė finansinių produktų įvairovė, kad nebūtų taip, jog vienose šalyse siūlomi tik vieno banko produktai, kad visų šalių atstovai galėtų vienodai naudotis ta įvairove ir inovaciniu ES rinkos potencialu . Mes norime, kad būtų sukurti tam tikri produktai, naudojami ES mastu, kad darbo jėgai būtų galima laisvai judėti iš vienos šalies į kitą. Kalbama ir apie įvairius pensinius produktus, hipotekinį kreditavimą.

Mes taip pat norime efektyvios kaštų požiūriu rinkos. Ką reiškia kaštai, tinkami mažmeniniam vartotojui? Tai nereiškia reguliavimo, tai reiškia skaidrumą. Turi būti aiški paslaugų, finansinių paslaugų kaštų struktūra, kad kiekvienas mažmeninis vartotojas galėtų pasirinkti jam tinkamą paketą pagal savo galimybes ir savo sąlygas, ir mes tikimės, kad tokiu atveju Europos finansų rinka išliks konkurencingiausia pasaulyje.

  Sahra Wagenknecht, im Namen der GUE/NGL-Fraktion. – Herr Präsident, werte Kolleginnen und Kollegen! In dem vorliegenden Bericht wird im Abschnitt „Alternative Investitionsvehikel“ auch auf Hedgefonds und private Beteiligungsgesellschaften eingegangen. Es ist absolut notwendig, dass das Parlament dazu klare Aussagen trifft. Hedgefonds sind weltweit bekannt und berüchtigt für eine ganz besonders aggressive Art der Ausbeutung von Arbeitskraft, der Plünderung von Unternehmen und der rücksichtslosen Arbeitsplatzvernichtung. Zu Recht wird ihr Vorgehen mit dem von Heuschrecken verglichen.

Angesichts dieser Gefahren bleiben die Formulierungen im Bericht deutlich hinter dem Erforderlichen zurück. Wir brauchen klare und eindeutige Bestimmungen. Es ist notwendig, dass in die Richtlinien für die Geschäfte von Hedgefonds und privaten Beteiligungsgesellschaften folgende Bestimmungen aufgenommen werden: Mindestanforderungen für den Eigenkapitalanteil solcher Fonds, Einbeziehung der Veräußerungsgewinne in vollem Umfang in die Einkommens- und Gewinnbesteuerung im Land der jeweiligen Managementgesellschaft, Pflicht zur Registrierung, Verpflichtung zur Offenlegung der Vermögens- und Eigentümerstruktur und der laufenden Geschäfte, und viele andere mehr.

Unsere Fraktion hat entsprechende Änderungsanträge gestellt und wir hoffen sehr, dass sie bei der Abstimmung Berücksichtigung finden.

  John Whittaker, on behalf of the IND/DEM Group. – Madam President, the financial services action plan is a huge, complex body of regulation. In the vain attempt to harmonise financial products and to legislate risk away, the only effect will be to drive business out of the European Union. Even the City of London is now realising that the costs of compliance with the Markets in Financial Instruments Directive are likely to be far greater than any benefits from greater market access. And there are always unwanted side effects. The rapporteur complains that not enough is being done for the retail consumer of financial services. She says the basic needs for every citizen are access to a bank account, financial transfers at low cost and the possibility to save or borrow money. But the largest impediment to retail banking is the highly bureaucratic know-your-client procedures that banks must follow as a result of the EU’s own money-laundering regulations. In English, we would call this ‘shooting yourself in the foot’.

  Petre Popeangă, în numele grupului ITS. – Consider că o lucrare având ca obiectiv stabilirea unei politici pe termen mediu în domeniul serviciilor financiare este una a cărei necesitate şi importanţă nu pot fi puse la îndoială.

Concentrarea pieţei, mijloacele alternative de investiţii, accesul la finanţare în sectorul cu amănuntul, riscurile sistemice, îmbunătăţirea prevederilor legale şi altele reprezintă categorii importante de activităţi a căror aplicare la nivel naţional, ca şi impactul acestora la nivel global, justifică asemenea acţiuni iniţiate şi la nivelul Uniunii Europene.

Necesitatea unui asemenea demers rezultă în primul rând din necesitatea asigurării unei transparenţe sporite şi a unui spaţiu de acţiune uniform pentru concurenţă, dar şi din necesitatea separării diferitelor servicii furnizate consumatorului şi, nu în ultimul rând, de gama limitată a produselor cu amănuntul oferite de către grupurile financiare care operează pe pieţele naţionale.

Cantonându-mă din lipsă de timp doar la domeniul protecţiei consumatorului, menţionez că, deşi acesta este considerat la nivelul Uniunii Europene ca fiind una din activităţile prioritare, practica demonstrează că în anumite zone nu se ridică la cotele necesare fie datorită insuficienţei prevederilor legale, fie din lipsa unor garanţii certe că furnizorii de servicii sunt organisme fiabile şi solide din punct de vedere financiar.

Cu aceste câteva precizări, menţionez că susţin aprobarea propunerii raportorului privind Carta Albă a Comisiei referitoare la politica serviciilor financiare în perioada 2005-2010, ca şi a propunerilor referitoare la organizarea de dezbateri pe tema fondurilor speculative, puncte de vedere care constituie, de altfel, şi poziţia autorităţii competente din România faţă de problematica pieţelor de instrumente financiare.

  Gunnar Hökmark (PPE-DE). – Madam President, I wish to begin by thanking the rapporteur.

There are certain things we have to ask ourselves as we proceed with the financial services and the reform process, and that is whether we want the European financial markets to be vital and dynamic and at the centre of the global financial development. The answer is obviously ‘yes’.

However, we also need to be sure that they can be attractive globally and that they can attract capital and vitality. That gives us some aims, because we must have regulations in place to ensure transparency and credibility, and we should avoid regulations aiming to regulate the competition, the product and the services. It should be the opposite. We should ensure that we have fundamental common rules that give way for the new future-oriented financial services here in Europe. This is a balance where I would like the final outcome of the report to be more open-minded, advocating opening up for competition. I should like to stress that there should not be any sort of economic patriotism in the financial sector in Europe, because that would hinder the dynamic development and growth of European financial markets. With regard to the future of the financial services in Europe, we should head for the words of the French Revolution: liberté, égalité, fraternité. That is competition and that could create dynamics in the European financial markets.

  Harald Ettl (PSE). – Frau Präsidentin! Ein integrierter europäischer Kapitalmarkt, der gut funktioniert, ist beim derzeit weltweit rasanten Globalisierungstempo wesentliche Grundlage der europäischen Wirtschaft. Der Berichterstatterin ist dafür zu danken, dass sie nicht allein den wirtschaftlichen Erfolg der europäischen Kapitalmarktentwicklung in den Vordergrund gestellt, sondern auch die Verteilung und den sich daraus ergebenden Nutzen sowie die Risikopotenziale angesprochen hat.

Finanzdienstleistungsprodukte sind dann gut, wenn sie dem Willen und Nutzen unserer Gesellschaft entsprechen. Das aber erfordert eine Verbesserung der Kontrolle. Den Markt sich selber zu überlassen, fördert Marktmissbrauch. Auch wenn Hedgefonds und private equities für steigende Liquidität und bessere Marktdiversifizierung sorgen können, birgt die Gefahr von Systemrisiken mit überproportional negativen Auswirkungen, z. B. durch Fehler im asset management, ein nicht übersehbares Krisenpotenzial. So verändern sich beispielsweise die Geschäftspraktiken von Hedgefonds überaus rasant. Selbst die Finanzmarktaufsicht in London stellt immer öfter die Umgehung von Offenlegungspflichten fest.

Raffinierte Marktteilnehmer finden immer öfter neue Wege, um ihre Aktivitäten zu verschleiern — so nachzulesen in der Neuen Zürcher Zeitung. Raffinierteste Überrumpelungstaktiken bei Firmenübernahmen sind die Folge davon. Die Arbeitnehmerinnen und Arbeitnehmer, die für den nachhaltigen Mehrwert der Volkswirtschaften sorgen, werden zunehmend zum Spielball reiner Kapitalinteressen. Das zu verhindern, ohne ein Prosperieren des Marktes zu gefährden, und auch für bessere Gewinnverteilungen zu sorgen, erfordert noch mehr Kopfarbeit in den zuständigen Kommissionsbereichen. Nicht die Wirtschaft soll für sich alleine entscheiden, was ihr gut tut, sondern die Politik muss regeln und überwachen, was für die Gesellschaft der Europäischen Union von nachhaltigem Nutzen ist.

  Sharon Bowles (ALDE). – Madam President, I have three words of caution, or three points, on our report. Firstly, where I have disagreed most in this report is in the fashion zone, where it is de rigueur to criticise private equity and, even more so, hedge funds. It can be good to look at things, analyse and discuss, but it is then wrong to prejudge what is needed as the outcome just in order to be fashionable.

Secondly, in paragraph 6 we refer to the concentration of financial services provided to large listed companies. It may be proper to mention audit firms in this context as their consolidation has left us with less than a handful that can do large audits. However, it is not correct to suggest that investment banks are in a comparable concentration, given that none of the top three have a 10% market share. Indeed, viewed in that light, to mention investment banks dilutes the very point we wish to make about audit firms.

Thirdly, with the regard to the issue of supervision, this is very interesting, but cooperation and changes are under way. Levels 2 and 3 have to bed down and be refined. How can the next stage be evaluated before outcome of the last is known?

  Alexander Radwan (PPE-DE). – Frau Präsidentin, Herr Kommissar! Zuerst ein herzliches Dankeschön an die Berichterstatterin für ihre Arbeit. Sie hat es geschafft, ein breites Spektrum im Europäischen Parlament zusammenzufassen.

Der EU-Binnenmarkt für Finanzdienstleistungen ist eine Erfolgsgeschichte. Die Vorgaben der Kommission, die Umsetzung durch das Parlament und den Rat und in den Mitgliedstaaten führen dazu, dass der europäische Markt allmählich attraktiver wird als der amerikanische. Das erkennen wir auch daran, dass europäische Börsen durch die Amerikaner aufgekauft werden, damit sie ihren Einfluss entsprechend absichern können. Darum stehen wir jetzt vor neuen Entwicklungen und vor der Frage, wie wir die Marktgeschehnisse angehen sollen.

Ein Hauptpunkt ist die künftige Aufsicht in Europa. Wir verzeichnen die Entwicklung von grenzüberschreitenden Banken. Ich nenne nur UniCredito, die aus Bayern stammende HypoVereinsbank, die Bank Austria. Wir haben die Diskussion um ABN Amro und die Bank Santander, die sich in Großbritannien eingekauft hat. Hier müssen wir darauf achten, dass die Aufsichtsregime dieser Entwicklung folgen, dass also nicht nur ein einzelner Aufseher jeweils für sein Mitgliedsland zuständig bleibt, sondern dass es eine Kooperation in Europa gibt. Das ist kein Plädoyer für einen europäischen Aufseher! Aber wir müssen die europäische Entwicklung mehr in den Mittelpunkt rücken.

Wir haben mit Basel II und dem lead supervisor den ersten Schritt gesetzt. Ich unterstütze die Kommission ausdrücklich, bei Solvency II einen mutigen Ansatz zu wählen. Ich hoffe, dass die nationalen Aufseher und die nationalen Finanzministerien hier etwas kooperativer sind und sich den Veränderungen mehr stellen als bisher.

Wir müssen auch darüber nachdenken, wie wir künftig das transatlantische Verhältnis gestalten. Die Entwicklung geht immer mehr dahin, dass die SEC – die amerikanische Aufsicht – den europäischen Markt indirekt mitreguliert. Das darf nicht sein! Wir brauchen eine europäische Antwort auf die SEC, die dies entsprechend zu verhindern sucht. Ich erinnere nur daran, dass eine österreichische Bank ihren Kunden kündigen musste, nur weil sie von einem amerikanischen Fonds aufgekauft wurde. Die Kunden waren nämlich Kubaner.

Herr Kommissar, die Kommission beschäftigt sich regelmäßig mit Regionalbanken. Das mag durchaus richtig sein. Kollegin Bowles, ich will das Ergebnis der Diskussion nicht vorwegnehmen, aber das Thema Hedgefonds muss in einer offenen Diskussion ergebnisoffen thematisiert werden! Man kann nicht sagen, dieses Thema behandeln wir nicht, weil wir Angst vor dem Ergebnis haben!

  Antolín Sánchez Presedo (PSE). – Señora Presidenta, los servicios financieros son una fuente estratégica de eficiencia y de prosperidad en una economía globalizada. Quisiera felicitar a la ponente, Ieke van den Burg, por su informe, que supone una reflexión profunda y una valiosa contribución al futuro de la política de servicios financieros, al establecer importantes pautas para aprovechar sus potencialidades:

En primer lugar, aumentando nuestros puntos fuertes, siguiendo la línea de la resolución de marzo de eliminar obstáculos para facilitar las adquisiciones transeuropeas y las adquisiciones de acciones en banca, seguros y empresas de inversión, a fin de que nuestros operadores aprovechen el mercado interior y se preparen para competir con motores globales.

En segundo lugar, reduciendo debilidades. Hay un ejemplo claro en las actividades de calificación en las que existe esta debilidad como consecuencia de un vacío regulatorio y la ausencia de operadores europeos. El informe propone un tratamiento adecuado en ambos casos.

En tercer lugar, controlando los riesgos, tanto los que afectan a la estabilidad financiera general como los operativos que resultan de las distorsiones o el mal funcionamiento del mercado y las prácticas desleales o la información privilegiada, o aquellos que resultan de la excesiva concentración de algunas actividades de servicios financieros de segmento alto en las grandes compañías, como las agencias de calificación, las grandes auditoras y los bancos de inversión.

El tratamiento es igualmente correcto: por una parte, la estrecha vigilancia por parte de las autoridades de la competencia para evitar abusos y barreras a nuevos entrantes, por otra parte, reclamar que la Comisión, siguiendo su enfoque de estudios sectoriales, examine exhaustivamente la situación y, finalmente, avanzar en la integración de la supervisión financiera europea.

Con relación a la arquitectura de la supervisión financiera, aunque el actual sistema no es perfecto está funcionando razonablemente bien y merece un tratamiento evolutivo como el que propone la ponente. Es necesario reforzar la cooperación entre las autoridades supervisoras y esto sólo será posible con una perspectiva europea, es decir, avanzando hacia una cultura europea común y mediante prácticas que permitan que los supervisores nacionales no solamente tengan prácticas similares sino competencias y mandatos que hagan posible usar nuevas técnicas e instrumentos.

  Charlie McCreevy, Member of the Commission. Madam President, as I indicated earlier, the report under discussion shows that Parliament’s and the Commission’s thinking on key financial services issues is very much in harmony. Both our institutions are thinking ahead beyond 2010, which is the date that our current policy works towards. We are aware of the potential innovations and hazards that lie around the corner. We are working on how to make our supervisory structures work better. We are building strong relationships with our regulatory partners in other jurisdictions, knowing that our interlinkages will only increase.

We are constantly looking for ways to ensure that our financial markets work to the benefit of all citizens.

Given the positive collaboration between the institutions I am sure we will be successful.

  Gábor Harangozó (PSE), in writing. – First of all, I would like to warmly congratulate the rapporteur, Ieke van den Burg, for her excellent report on the White Paper on the financial service policy 2005-2007. This report and the White Paper are indeed of the utmost importance since it is obvious that the creation of a genuine European world leading capital market in line with the objectives of the Lisbon agenda relies profoundly on the viability and consistent nature of the Community’s financial regulations. Besides the viability of the financial regulations in line with the objectives of better regulation, it is necessary to foster the transposition of Community law by the Member States in order to achieve efficiently the thorough implementation of the Financial Services Action Plan (FSAP). It will of course be necessary to assess the real effects of the implementation of the FSAP for its beneficiaries and, in this respect, I fully support the rapporteur when she calls for a more in-depth examination of the economic effects of the FSAP measures in the light of the Lisbon Strategy. Consistent implementation and continuous evaluation of the financial regulations are indeed the key elements for a successful achievement of a dynamic European world leading capital market.

  Piia-Noora Kauppi (PPE-DE), in writing. – This past spring has been an appropriate time to discuss the future of financial services policy in the EU. Groundbreaking changes are afoot, both on the regulatory side and in the markets’ own development. Seldom has a week gone by without a significant development with direct impact on the functioning of European financial markets, and on how we, as legislators, should address them.

The growing number of marriages between stock exchanges is probably the most visible. As banks and other trading venues are attracting larger volumes of trade, it is only normal that exchanges seek to pool their strengths. The upgrade and modernisation of our trading infrastructure will benefit investors, and spur more innovation in financial instruments.

The big question now has to do with supervision. We should not approach this only from a worst-case-scenario viewpoint. It is true that there are legitimate concerns as regards the regulation of various private pools of capital. Nor is it yet clear what happens if and when something goes wrong. But for now, let us work towards a convergence of practices in the Level 3 committees. In the long-run, Parliament signals it is willing to see something more unified on the European supervisory scene.
