  Πρόεδρος. – Η ημερήσια διάταξη προβλέπει τη συζήτηση της έκθεσης του Saïd El Khadraoui, εξ ονόματος της Επιτροπής Μεταφορών και Τουρισμού, σχετικά με την πρόταση απόφασης του Συμβουλίου και των αντιπροσώπων των κυβερνήσεων των κρατών μελών της Ευρωπαϊκής Ένωσης που συνήλθαν στο πλαίσιο του Συμβουλίου σχετικά με την υπογραφή και την προσωρινή εφαρμογή της συμφωνίας αεροπορικών μεταφορών μεταξύ της Ευρωπαϊκής Κοινότητας και των κρατών μελών της, αφενός, και των Ηνωμένων Πολιτειών της Αμερικής, αφετέρου [8044/3/07 – COM(2006)0169 – C6-0210/2007 – 2006/0058(CNS)] (A6-0320/2007).

  Jacques Barrot, vice-président de la Commission. Madame la Présidente, Mesdames et Messieurs, Monsieur le député El Khadraoui, le Parlement européen a joué un rôle politique important et nous a aidé à signer le premier accord d'aviation entre l'Europe et les États-Unis le 30 avril dernier, à Washington.

En appuyant l'accord, le 14 mars dernier, avant même que le Conseil des transports ne se prononce, le Parlement a joué un rôle décisif pour moderniser en profondeur le cadre régulant l'aviation transatlantique et offrir de nouvelles possibilités aux citoyens européens. Cet accord entrera en vigueur dès mars prochain et les compagnies européennes et américaines sont dans les starting blocks pour offrir de nouvelles liaisons sur le transatlantique. Le comité mixte, qui a pour vocation d'administrer cet accord, s'est déjà réuni en juin. Il se réunira à nouveau en novembre pour assurer l'application sans heurts et entamer les travaux sur des sujets importants tels que la concurrence ou la sûreté.

En vous prononçant aujourd'hui formellement sur l'accord, vous faites valoir un certain nombre de points clés, que je partage totalement. Vous soulignez l'importance d'un accord de deuxième étape pour faire avancer l'accès au marché américain, notamment de manière à permettre les investissements européens aux États-Unis. Vous soulignez l'importance de la convergence de nos normes, notamment en matière de sûreté, pour parvenir au one stop security. Vous soulignez l'importance de la dimension environnementale et, en particulier, le commerce d'émissions de CO2. Vous soulignez, enfin, l'importance d'informer et de consulter le Parlement européen.

Vos priorités politiques sont également miennes. Je me félicite de l'accord entre nos deux institutions sur des dossiers qui sont politiquement sensibles tant en Europe qu'aux États-Unis.

Je me félicite aussi que le Parlement européen, en entretenant un dialogue continu avec le Congrès et l'administration américaine, fasse entendre les voix des Européens aux États-Unis. Nous aurons besoin de travailler ensemble sans relâche sur les dossiers qui sont difficiles avec Washington. L'Assemblée de l'Organisation de l'aviation civile internationale à Montréal, en septembre, a été une déception. Comme vous le savez, l'Union européenne et ses voisins européens, soit 42 États, ont dû émettre une réserve quant à la résolution sur le commerce des émissions de CO2, car nous nous sommes retrouvés en opposition par rapport aux États-Unis et au reste du monde.

La Chambre des représentants a également adopté un amendement pour restreindre les possibilités de contrôle étranger des compagnies américaines. Bien que cet amendement n'ait pas été voté, à ce stade, par le Sénat, cela jette une ombre sur le déroulement des négociations en vue d'un accord de deuxième étape, qui débuteront au printemps prochain. Le Parlement européen a sensibilisé le Congrès et l'administration à cette question, comme je l'ai fait, et nous devons continuer à mobiliser les énergies pour éviter un mouvement qui ne va pas dans le sens d'une normalisation du secteur de l'aviation.

Mais si ces événements montrent les difficultés à surmonter, il ne faut pas oublier l'essentiel. Nous avons maintenant une base de travail solide entre Européens et Américains pour traiter d'égal à égal. Ce n'était pas le cas il y a six mois. Il faut donc construire sur cet acquis, résultat de quatre années de travail.

Évidemment, Madame la Présidente, Messieurs les parlementaires, Monsieur le rapporteur, je vous assure de mon entière disponibilité pour remplir les objectifs politiques qui sont ceux tant du Parlement européen que du Conseil, en me félicitant de l'unité européenne sur ce dossier, de l'union des Européens.

  Saïd El Khadraoui (PSE), Rapporteur. – Voorzitter, vice-voorzitter van de Commissie, collega's, wanneer we vanmiddag definitief het licht op groen zullen zetten voor de luchtvaartovereenkomst tussen de EU en de Verenigde Staten, dan is dat niet alleen het einde van een procedure die vele jaren heeft geduurd en die zeer moeizaam verliep, maar ook het begin van een nieuw hoofdstuk in de luchtvaartgeschiedenis en de gevolgen - hoewel niet geheel voorspelbaar - kunnen bijzonder groot zijn.

Tegelijkertijd weten we dat dit slechts een tussenfase is en dat er nog heel veel werk voor de boeg is om te komen tot de min of meer geïntegreerde trans-Atlantische luchtvaartmarkt die we voor ogen hebben. Sommige collega's zijn van mening dat we in deze eerste fase al te veel toegevingen aan de Amerikanen hebben gedaan. De goesting om te onderhandelen zou verdwenen zijn, met name omdat luchtvaartmaatschappijen uit de VS vandaag al de facto beschikken over het cabotagerecht om van de ene lidstaat naar de andere te vliegen, hetgeen wij niet kunnen op het Amerikaanse grondgebied.

Beide partijen krijgen, wat we noemen, vijfde vrijheidsrechten, hetgeen de mogelijkheid biedt voor Amerikaanse maatschappijen om via Europa door te vliegen naar Afrika of Azië. Omgekeerd kan ook, maar is minder interessant omwille van de geografische ligging van de VS. Bovendien worden vanaf maart volgend jaar de beperkingen opgeheven die vandaag nog bestaan inzake de toegang tot bepaalde luchthavens - denken we maar aan Heathrow - waar vandaag slechts twee Amerikaanse maatschappijen gebruik van mogen maken.

Er is dus in zekere zin geen echt evenwicht, maar daar staat toch tegenover, commissaris, dat de overeenkomst heel duidelijk een stap vooruit is en een verbetering inhoudt ten opzichte van de huidige situatie. Ten eerste maakt de overeenkomst een einde aan de juridische onzekerheid die is ontstaan na de arresten van het Hof van Justitie in 2002, die stelden dat de bestaande bilaterale open skies-overeenkomsten onwettige elementen bevatten die moesten worden aangepast. Ten tweede zullen de consumenten het verschil voelen. Daar waar tot op heden vanuit de lidstaten enkel nationale of Amerikaanse maatschappijen naar de Verenigde Staten konden vliegen, zal in de toekomst elke Europese maatschappij vanuit elk punt in Europa naar elk punt in de Verenigde Staten kunnen vliegen en eventueel dus ook kunnen doorvliegen naar Mexico of Zuid-Amerika bijvoorbeeld. Nu, dit betekent ongetwijfeld meer keuzemogelijkheden voor de consument en wellicht ook lagere prijzen.

Ten derde wordt met de oprichting van het gezamenlijk comité - waarnaar u ook verwezen heeft, commissaris - met vertegenwoordigers van beide zijden een instelling in het leven geroepen die kwesties in verband met de overeenkomst zal bespreken, maar ook zaken die te maken hebben met regelgeving op sociaal vlak, op het vlak van milieu, op het vlak van veiligheid, enz. Een instrument dus dat het wederzijds vertrouwen en begrip kan doen toenemen. Dat is zeer belangrijk omdat het natuurlijk parallel met die opening van de trans-Atlantische markt essentieel is dat de regelgeving geleidelijk aan gelijkwaardig wordt en op elkaar wordt afgestemd en dit op een hoog niveau wel te verstaan.

Naarmate de autoriteiten beter met elkaar opschieten en de voordelen van nauwe samenwerking duidelijker worden, kan ook aan de Amerikaanse zijde de bereidheid toenemen om nieuwe toegevingen te doen inzake de toegang tot de markt in de Verenigde Staten zelf. Er zijn immers nog heel wat hangende kwesties - u heeft er al naar verwezen. Ik spreek dan over cabotage, over het vestigingsrecht voor Europese maatschappijen, regels rond controle en eigendom, allerlei andere beperkingen die nog bestaan.

En dus, goed wetende dat de onderhandelingen voor een tweede fase zeer snel zullen starten, namelijk volgende zomer, is het nodig dat de Commissie reeds nu nadenkt over een goede onderhandelingsstrategie. Wat willen we eigenlijk bereiken? Wat zijn onze prioriteiten? Hoe kunnen we de Amerikanen ervan overtuigen nieuwe stappen te zetten? Waar zijn nog toegevingen te doen zonder dat we daar nadeel van ondervinden? Ik hoef u niet te vertellen, commissaris, dat de context zeer moeilijk is. Volgend jaar zijn er presidentsverkiezingen. Er heerst een algemene argwaan in de Verenigde Staten, tot in het Congres toe, om strategische industrieën zoals de luchtvaart in handen te geven van derden. Er is ook vrees bij de Amerikaanse vakbonden om de greep op de sector te verliezen door buitenlandse inmenging, vooral omdat die wel eens succesvol zou kunnen zijn en omdat wordt aangenomen dat de Europese maatschappijen beter georganiseerd zijn en gemakkelijk stukken van die markt kunnen inpalmen. We hebben natuurlijk ook nog de Europese verkiezingen.

Dan zijn er nog de moeilijkheden die vandaag al bestaan. U verwijst naar de poging van onze collega, Congreslid Oberstar, om een aantal elementen uit de overeenkomst anders te interpreteren. Maar, dit gezegd zijnde, als rapporteur en als Parlement gaan wij deze middag het licht op groen zetten. Wij gaan met volle overtuiging "ja" stemmen. Wij zullen natuurlijk de voorbereidingen van zeer dichtbij volgen. Wij hopen ook daar, zoals in het verleden, van zeer dichtbij betrokken te worden. Daar rekenen wij op.

  Reinhard Rack, im Namen der PPE-DE-Fraktion. – Frau Präsidentin! Unser Parlament und im Besonderen auch meine Fraktion, die EVP-ED, wird heute diesem Abkommen mit großer Mehrheit zustimmen, weil wir letztlich ein gutes Zwischenergebnis erreicht haben.

Es ist allerdings nur ein Zwischenergebnis, sowohl Vizepräsident Barrot als auch unser Berichterstatter El Khadraoui haben bereits darauf hingewiesen, dass wir noch weitere wichtige Fragen im Zusammenhang mit dem Open-Sky-Abkommen lösen müssen: die Fragen der Kabotage, des Niederlassungsrechts, Eigentumsfragen, eine Reihe von anderen Dingen wie Beihilfen und ähnliches.

Das Abkommen zeigt – abgesehen davon, dass es gelungen ist, es zu einem halbwegs guten Zwischenergebnis zu bringen –, eine Reihe von Schwächen in unserem System. Auch darauf ist bereits hingewiesen worden. Auf Sicht werden wir uns bemühen müssen, dass auch unser Parlament in ähnlicher Weise, wie sich das die Kollegen im amerikanischen Kongress in den letzten Jahrhunderten – man muss fast sagen – arrogiert haben, mehr Möglichkeiten hat, auch inhaltlich auf die Gestaltung dieses Abkommens Einfluss zu nehmen. Wir haben es diesmal gewissermaßen mit einem Systemtrick erreicht, indem wir uns vor der Äußerung des Rates eingebracht haben, aber wir brauchen auf Sicht bessere Regeln für die inhaltliche Mitgestaltung.

Aus gegebenem Anlass möchte ich wieder einmal und zum wiederholten Male auf etwas hinweisen, das auch ein wichtiges Thema im Flugverkehr, und besonders im Flugverkehr zwischen den USA und Europa, ist. Sicherheitsvorschriften und Sicherheitskontrollen sind wichtig, damit die Passagiere auch guten Gewissens und mit dem Gefühl von Sicherheit dieses wichtige Verkehrsmittel nutzen können. Sicherheitsmaßnahmen dürfen aber nicht als Alibimaßnahmen missverstanden werden, die nur zu Belastungen im Flugverkehr führen ohne einen entsprechenden Sicherheitsgewinn. Daher, zum xten-Mal, die Flüssigkeitskontrollregelungen gehören verändert!

  Brian Simpson, on behalf of the PSE Group. – Madam President, first of all I would like to make an apology to you, to the Vice-President of the Commission and to honourable Members, because after I have made my speech I will have to leave the Chamber to do an interview. It is not my habit to do so, and I apologise for not staying for the rest of the debate.

I would like to thank my colleague, Mr El Khadraoui, for his report and warn him that he perhaps may beat my record of being the longest-serving rapporteur in parliamentary history if he continues with this particular dossier! Let us be honest. The marriage entered into between the European Union and the US in the form of the initial civil aviation Air Transport Agreement is a marriage of convenience, with the EU being the eager bridegroom and the US the very reluctant bride. Now, when we come to consummate the marriage, we find that the US bride finds that her EU bridegroom is not very fanciable, and, seeing as she has got all the best bits out of him on their wedding day, the US bride now cannot be bothered to consummate the marriage, because Representative Oberstar is standing over the couple, shotgun in hand.

Great differences exist between the EU and US on aviation policy, and I for one would not be surprised to hear, in the weeks and months to come, that negotiations on the second stage agreement have broken down because the US would not move on key issues. My fear is that the EU bridegroom is so desperate to consummate this marriage of convenience that we yet again give in to the reluctant bride. What about ETS and security, where the EU and US are worlds apart? What about foreign ownership of US airlines, or fifth freedom reciprocals? What about passenger lists and Chapter 11 protection? These are all issues that divide us, and, whilst I accept that there is a willingness to sit down and negotiate, it is always, it would appear to us, on the terms dictated to us by the Americans.

I wish everybody well in their efforts, and the PSE Group will vote in favour. However, I sincerely hope the negotiations are successful, and that a more balanced, reciprocal, fair agreement is forthcoming at the end of the road. But I question whether that will happen, because of US attitudes, and I ask whether the road that we are actually on will lead to this marriage of convenience ending in a Las Vegas-type divorce.

  Sarah Ludford, on behalf of the ALDE Group. – Madam President, I am substituting for my colleague, Ms in ’t Veld.

I bow to the knowledge of other people on the technicalities of this agreement. As an MEP representing London, which includes the major airport of Heathrow, I am certainly encouraged by the fact that this agreement will grant more benefits of competition to passengers and, to that extent, it is good that it has been concluded.

I want to address the security aspects of the agreement, understanding from the report that this is largely left to regulation by the Joint Committee. I agree with the report’s welcoming of cooperation between the EU and US authorities responsible for aviation security. However, as the report says, security measures should be based on a proper risk assessment and should not be excessive or uncoordinated, and the privacy of European and US citizens should be respected when personal passenger data are exchanged between the EU and the US.

Members will be aware of the considerable controversy surrounding the Passenger Name Records (PNR) Agreement. The European Parliament has expressed itself very forcefully on the fact that it has not played the major role that it would have wanted in that agreement. Certainly, the opinion of the European Data Protection Supervisors is that safeguards under the new agreement have been considerably weakened in comparison to previous agreements and that the new agreement leaves open serious questions and shortcomings.

While Commissioner Barrot welcomed the major role Parliament has played in modernising the regulatory framework for other aspects of the aviation business, I am afraid we have to express disappointment that we have not succeeded in having the input we wanted on privacy and the enforcement of personal data safeguards. The data under the PNR Agreement will be retained for 15 years, which, I put to you, is excessive and which this report says we do not want. The US will be able to have access to sensitive data and even to use it in cases of petty crime, which is not fighting terrorism.

All in all, while welcoming this agreement overall, I am afraid to say that the aspirations of this report that security measures should be properly assessed for their contribution to combating risk, should not be excessive and should protect privacy have not been secured in the area of the exchange of passenger name records.

  Eva Lichtenberger, im Namen der Verts/ALE-Fraktion. – Frau Präsidentin, Herr Kommissar! Sie waren nicht zum ersten Mal konfrontiert mit einem Verhandlungspartner, der – vorsichtig gesprochen – äußerst schwierig ist, weil er eben von vornherein und aufgrund seiner Erfahrungen davon ausgeht, dass Europa in jedem Fall und immer nachgeben wird. Nach wie vor, wenn man sich das Werk durchliest, sind die USA weit im Vorteil. Ob für die Europäische Union etwas drin ist, wird sich erst zeigen, denn ein gemeinsamer Ausschuss ist nicht mehr als eine Chance, aber noch kein Erfolg, zumal die Ergebnisse in den USA jetzt schon in Zweifel gezogen werden. Ich sehe noch kein Gleichgewicht und wenig Eingehen auf unsere Forderungen. Der Vergleich meines Vorredners mit der etwas seltsamen Ehevorbereitung ist da durchaus zutreffend.

Die Themen der Flugsicherheit, des Umweltschutzes und der Eigentumsrechte sind nach wie vor auf dem Tisch. In Fragen der Sicherheit haben wir noch nicht das erreicht, was wir erreichen müssen, und vor allem in der Sache des Datenschutzes, beim Schutz der europäischen Bürgerinnen und Bürger vor überzogenen Maßnahmen haben wir noch nicht das Ergebnis, das wir brauchen und das wir erreichen müssen. Dazu kommt, dass der Beitrag des Flugverkehrs zum Nichterreichen des Kyoto-Ziels nach wie vor enorm ist.

Bei den gegebenen Wachstumsraten wird Europa in große Schwierigkeiten kommen, wenn es hier nicht ein gemeinsames agreement mit den Vereinigten Staaten gibt, und das sehe ich derzeit überhaupt noch nicht. Ich sehe maximal erste Schritte, aber Europa muss mit viel mehr Selbstbewusstsein und mit einer Stimme in diesem Verhandlungsprozess sprechen, denn was bis jetzt geschehen ist, gibt uns Möglichkeiten.

Wir haben die Ernte noch nicht eingefahren, und ich kann ankündigen, dass das Europäische Parlament und der Ausschuss für Verkehr und Fremdenverkehr sehr genau die Ergebnisse prüfen werden, die dieser gemeinsame Verhandlungsausschuss vorlegen wird.

  Γεώργιος Τούσσας, εξ ονόματος της ομάδας GUE/NGL. – Κυρία Πρόεδρε, κυρίες και κύριοι, ο κεντρικός πυρήνας της εξωτερικής πολιτικής της Ευρωπαϊκής Ένωσης για τις αερομεταφορές είναι η θέσπιση ενός ανοικτού αεροπορικού χώρου μεταξύ της Ευρωπαϊκής Ένωσης και των Ηνωμένων Πολιτειών της Αμερικής. Είναι μια πολιτική πλήρως ενταγμένη στην ικανοποίηση των αναγκών του κεφαλαίου. Αξιοποιείται ως μέσο πίεσης και εκβιασμών για τη δημιουργία δύο έως τριών μονοπωλιακών αεροπορικών επιχειρηματικών ομίλων στα πλαίσια της Ευρωπαϊκής Ένωσης που θα έχουν το φιλέτο και των διεθνών αερομεταφορών, ενώ οι υπόλοιπες αεροπορικές εταιρείες -όσες απομείνουν- θα έχουν περιφερειακό χαρακτήρα και θα περιορισθεί η δράση τους στα κράτη μέλη. Χαρακτηριστικό είναι αυτό το διάστημα η μεγάλη πίεση και οι εκβιασμοί που δέχονται οι εργαζόμενοι στην Alitalia, στην Ολυμπιακή Αεροπορία καθώς και σε άλλες αεροπορικές εταιρείες στα κράτη μέλη. Στις διαπραγματεύσεις με τις Ηνωμένες Πολιτείες της Αμερικής και την μετέπειτα συμφωνία εκδηλώνονται αντιθέσεις με σημεία τριβής τις κρατικές επιδοτήσεις στην Airbus και Boing, την άρση του καμποτάζ στις εσωτερικές πτήσεις των ΗΠΑ και την άρνηση της κυβέρνησης των ΗΠΑ να επιτρέψει τη συμμετοχή ή και την εξαγορά αμερικανικών αεροπορικών εταιρειών από ευρωπαϊκούς αερομεταφορείς.

Η συμφωνία αποτυπώνει το αναγκαίο επίπεδο συμβιβασμών ανάμεσα στην Ευρωπαϊκή Ένωση και τις ΗΠΑ. Είναι μακριά από την ανάγκη ικανοποίησης των λαϊκών αναγκών. Θα αποτελέσει παράγοντα επιτάχυνσης της τάσης για συγκέντρωση μέσω των εξαγορών και συγχωνεύσεων των αεροπορικών εταιρειών. Σε όλα τα παραπάνω, παραμένουν ανοικτά σοβαρά προβλήματα σε ό,τι αφορά την προστασία των προσωπικών δεδομένων, αλλά και την προστασία του περιβάλλοντος.

Γι’ αυτούς τους λόγους θα καταψηφίσουμε τη σχετική πρόταση συμφωνίας για τις αεροπορικές μεταφορές μεταξύ ΗΠΑ και Ευρωπαϊκής Ένωσης.

  Luca Romagnoli, a nome del gruppo ITS. – Signora Presidente, onorevoli colleghi, la reciprocità è un valore importante nei rapporti interpersonali e tanto più nei rapporti ancorché commerciali fra gli Stati. Difatti, nella relazione El Khadraoui ho cercato di inserire alcuni emendamenti, ho tentato di sensibilizzare senza fortuna i colleghi della Commissione in tale ottica e non solo.

In quest'epoca in cui fondamentali sono le comunicazioni – e quelle aeree consentono possibilità di viaggio mai esperite prima – è chiaro che accordi sui trasporti aerei tra diverse nazioni sono necessari e auspicati. Quello che però non è chiaro, è perché in questa relazione – come in tutti gli atti che l'Unione europea assume – ci sia sempre l'incapacità di pretendere reciprocità, che significa anche parità di condizione e di concorrenza. Non dovremmo ragionare come sudditi, soprattutto noi in Parlamento, visto che siamo l'unica istituzione dell'Unione effettivamente dotata di un diretto mandato popolare.

Allora, se il Parlamento volesse dimostrare una capacità di indipendenza nel tentare di orientare le politiche delle altre istituzioni, dovrebbe nei suoi atti e nelle sue, già di per sé limitanti, codecisioni dimostrare di non essere prono ad interessi extraeuropei. Oggi è il caso della relazione del collega El Khadraoui, altrimenti ottima in tanta parte, che con l'occasione ringrazio per l'impegno. Ma, come in tantissime altre occasioni, manca la capacità di dire chiaro che se libera concorrenza deve esserci, è indispensabile vi siano pari condizioni di cabotaggio e di rispetto degli standard sociali e ambientali. Anche in materia di sicurezza e di diritti dei passeggeri non c'è invece reciprocità.

Inoltre nella relazione è stato riconosciuto che il settore dell'aviazione produce molti effetti negativi che contribuiscono al cambiamento climatico. Allora, non capisco perché i colleghi non hanno sostenuto l'emendamento che avevo presentato, su quanto influiscano negativamente i composti delle scie di emissione dei motori e che tali effetti rischiano di aumentare con la crescita del settore, chiedendo quindi di includere l'aviazione nel sistema europeo di scambio delle emissioni.

Infine, quanto all'applicazione della legislazione sociale internazionale, mi sembra che non vi siano condizioni di parità tra vettori europei e statunitensi e quindi anche in questo non vi è bilateralità. Tutto questo mi appare sufficiente a non votare per questa relazione.

  Georg Jarzembowski (PPE-DE). – Frau Präsidentin, sehr geehrter Herr Vizepräsident der Kommission, liebe Kollegen! Ich möchte Frau Lichtenberger und den Kollegen Romagnoli in ihren Ausführungen doch einmal zurückweisen. Natürlich ist keine totale Gegenseitigkeit der Rechte gegeben, aber im Verhältnis zu der früheren Situation ist dies ein ausgewogenes Abkommen. Deshalb stimmen wir dafür! Wenn Sie der Auffassung sind, es sei kein ausgewogenes Abkommen, stimmen Sie gern dagegen, aber wir und der Berichterstatter sind der Auffassung, dass das ein ausgewogener erster Schritt ist, und wir sind uns einig, dass ein zweiter Schritt folgen muss. Ich unterstütze den Berichterstatter natürlich in seiner Forderung – wie mein Kollege Rack auch schon gesagt hat –, dass wir schnell zur zweiten Stufe kommen müssen.

Wir sollten einfach das, was jetzt vereinbart worden ist, nutzen. Deshalb rufe ich die europäischen Fluggesellschaften auf, die neuen Möglichkeiten, die sie nach diesem Abkommen haben, um ihre Eigentums- und Kontrollrechte auszuüben, Lizenzbetriebe einzurichten, Markenpolitik zu betreiben und an dem amerikanischen Regierungsprogramm teilweise teilzunehmen, jetzt auch zu nutzen. Sie sollten nicht auf die zweite Stufe warten, sondern die erste Stufe jetzt nutzen, damit wir, wenn wir in die zweite Stufe der Verhandlungen gehen, schon von den ersten Erfahrungen profitieren und feststellen können, was uns im Hinblick auf die Rechte für unsere europäischen Gesellschaften auf dem amerikanischen Markt noch fehlt.

Wir müssen die Administration und auch unsere Kommission aufrufen, die Möglichkeiten dieses Abkommens zu nutzen, also zum Beispiel eine one-stop security nachhaltiger zu vereinbaren. Das kann man mit dem gemischten Ausschuss und der Zusammenarbeit mit der Administration erreichen, und wir können den Bürgern zeigen, dass dieses Abkommen für die Bürger von Vorteil ist, zumal sie nicht noch ein zweites Mal am Flughafen kontrolliert werden müssen.

Meine Kollegen und ich bedanken uns bei der Kommission, mit der wir in diesem Fall gut zusammengearbeitet haben, aber wir müssen auch darauf bestehen, dass wir bei der Aushandlung des zweiten Abkommens ebenfalls gut zusammenarbeiten. Ich warne die Amerikaner, den Antrag von Herrn Oberstar anzunehmen, denn wenn sie dieses Abkommen mit all ihren einseitigen Anträgen unterlaufen wollen, werden wir scharf reagieren. Also, lassen Sie uns den Amerikanern sagen, dass wir weiterhin gerne zu Gesprächen auch zwischen dem Kongress und dem Europäischen Parlament bereit sind, sie aber das Abkommen nicht durch einseitige Auslegung unterlaufen dürfen.

  Ulrich Stockmann (PSE). – Frau Präsidentin, Herr Kommissar! Ich möchte zunächst dem Berichterstatter für seine klare Situationsbeschreibung und Positionsbestimmung danken.

Zunächst zu dem Positiven, das auch mein Vorredner erwähnt hat. Mit dem Open-Sky-Abkommen zwischen den USA und Europa besteht nun endlich die Möglichkeit, Flugstrecken von der Europäischen Union über die Vereinigten Staaten in Drittstaaten zu realisieren, wie z. B. nach Mexiko oder nach Südamerika. Und es besteht für jedes Luftfahrtunternehmen der Gemeinschaft die Möglichkeit, von jedem Ort der Europäischen Union zu jedem beliebigen Ort in den USA zu fliegen, und zwar ohne Preis- und Kapazitätsbeschränkungen. Ich stimme dem Vorredner zu: Diese Chancen müssen genutzt werden!

Auch im Bereich der Investitionen in Luftfahrtunternehmen der USA wurden mit diesem Abkommen Fortschritte erzielt. Mit dem Open-Sky-Abkommen wird somit ein erster wichtiger Schritt zur Schaffung eines offenen Luftfahrtraumes ohne beiderseitige Restriktionen realisiert. Es sind also zusätzliche sinnvolle Flugverbindungen schaffbar, und damit eine große Zahl neuer Arbeitsplätze.

Andererseits muss natürlich – und das wurde bereits gesagt – klar und deutlich gemacht werden, dass dies nur ein erster Schritt ist, ein endgültiges Abkommen kann das noch nicht sein. Wir erwarten von der Kommission, in einem zweiten Schritt die offenen Fragen wie Kabotage, Niederlassungsrecht, Eigentum und staatliche Beihilfen mit den USA zu verhandeln. Das Konfliktpotenzial haben Sie, Herr Kommissar, sehr deutlich gemacht. Ich hoffe aber, dass die Arbeit des Ausschusses für die transatlantischen Beziehungen vorankommt, damit wir letztlich reziproke Rechte durchsetzen können, die dem Namen des Abkommens, Open Sky, wirklich gerecht werden.

Parallel dazu sollte der Ausschuss auch die Einbeziehung von Flügen aus den USA in das Emissionshandelssystem voranbringen, denn wir wissen, dass wir beim ICAO-Treffen nicht viel erreicht haben, das haben Sie erwähnt. Und natürlich sollte er unserer Forderung Ausdruck verleihen, dass wir eine one-stop security wollen.

  Γεώργιος Γεώργιου (IND/DEM). – Κυρία Πρόεδρε, παρατήρησα κατά τη διάρκεια των τελευταίων ετών μια αγωνιώδη προσπάθεια εκ μέρους των Ευρωπαίων να υπογράψουν μια συμφωνία αερομεταφορών με τις Ηνωμένες Πολιτείες. Ενώ, όμως, παρατήρησα μια μεγάλη προθυμία εκ μέρους μας, μου έκανε εντύπωση και η απροθυμία που είδα εκ μέρους των Αμερικανών. Εάν οι Αμερικανοί θέλουν να επιτύχουν μια λεόντειο συμφωνία, τότε πρέπει να ειδοποιήσουμε τους Ευρωπαίους να είναι έτοιμοι να παραδώσουν λευκή επιταγή. Αλλά αυτές οι συμφωνίες, κυρία Πρόεδρε, δεν αφορούν μόνον μηχανές, συμφέροντα και εταιρείες. Αυτές οι συμφωνίες αφορούν ανθρώπους, ανθρώπους που ταξιδεύουν από την Ευρώπη στις Ηνωμένες Πολιτείες, μεταξύ δε αυτών και οι Έλληνες, οι οποίοι εξαιρούνται από τους λοιπούς Ευρωπαίους και έχουν πολλά να πουν για τις ταλαιπωρίες τις οποίες υφίστανται προκειμένου να πάρουν θεώρηση για να επισκεφθούν τις Ηνωμένες Πολιτείες καθώς και για όσα επίσης υφίστανται όταν φθάσουν στις Ηνωμένες Πολιτείες, όπου τους επιβάλλονται έλεγχοι και έρευνες ως να επρόκειτο για εν δυνάμει τρομοκράτες. Αυτό, βεβαίως, αντιλαμβάνεσθε ότι δημιουργεί ένα άγχος στην ελληνική τουλάχιστον πλευρά που, εν πάση περιπτώσει, ανήκει στην Ευρώπη.

Οι συμφωνίες αυτές που υπογράφονται μεταξύ των κυβερνήσεων, κυρία Πρόεδρε, ή υπογράφονται μεταξύ των κοινοβουλίων, εάν δεν αγγίξουν τις καρδιές και τις ψυχές των λαών, των ανθρώπων της Ευρώπης, θα είναι εξαιρετικά βραχύβιες και απολύτως ανεπιτυχείς, και αυτό θα ήθελα να συμπεριληφθεί στις δικές μας παραινέσεις στη νέα διαπραγματευτική προσπάθεια. Οι συμφωνίες πρέπει να εδράζονται επί της ισότητας, της εντιμότητας και της αμοιβαιότητας.

  Jim Higgins (PPE-DE). – Madam President, first of all I welcome the principle of the agreement. The agreement between the United States and the EU will be, when it is finally negotiated, a major and historic development. For EU airlines it means more transatlantic flights to the United States. It is also good from the point of view of airline passengers, with more airlines, more competition and lower air fares. We have already seen within Europe the positive impact that low fares airlines have on the aviation sector in terms of the huge increase in passenger numbers.

I pay tribute to the EU negotiators for successfully pursuing what are very difficult negotiations. These are not yet concluded and are taking a lot of patience and diplomacy, but when this eventually happens the net outcome will hopefully have been worth waiting for. I sincerely hope that the outstanding problems with the agreement can be overcome.

I agree with all the previous speakers with regard to the problems. We have to dig in to ensure that this is a 50:50 agreement and that, at the end of the day, we fly the flag for Europe in terms of insisting that, whatever they look for, we look for too. I believe that the restrictions by the United States authorities in relation to demanding personal details for security reasons are most unreasonable. We have got to ensure in fact that this is not a deterrent to EU passengers going to the United States, because if we do not solve this particular problem it will be a major deterrent.

I am now going to be very parochial and provincial. I have another problem, which is that the first international transatlantic airport in Ireland was Shannon airport. It was the gateway to Europe for many a long day, but the mandatory stopover in Shannon will now go, under this agreement. That will effectively undermine the viability of Shannon airport and have major consequences for the Mid-West region, which is a very disadvantaged region. However, that is not a matter for Europe but for the Irish Government. Again, at the end of the day, the EU badly needs an agreement and passengers need an agreement – but not at any price.

  Jacques Barrot, vice-président de la Commission. Madame la Présidente, je remercie tous les membres du Parlement qui se sont exprimés. Je veux d'abord dire, en réponse à votre rapporteur, M. El Khadraoui, que l'on peut dire, quand même, que la première phase a donné un accord équilibré. D'ailleurs, il y a eu un engagement des États-Unis de négocier la deuxième phase. Il y a même une obligation de débuter les négociations dans un délai de soixante jours après l'application provisoire. La partie européenne a retenu des mesures de rétorsion. On pourra revenir en arrière sur certaines concessions si la deuxième phase ne satisfait pas les intérêts européens. C'est tout de même un point majeur.

La Commission a lancé déjà un débat avec les États membres, dans le cadre du comité spécial de négociation, pour définir la stratégie de négociation pour la deuxième phase. Vous avez insisté, et aussi M. Jarzembowski, sur la nécessité de définir une bonne stratégie de négociation. Évidemment, j'ai l'intention de vous associer, d'associer le Parlement, pour que nous puissions vraiment négocier dans la plus grande efficacité.

Ce qui est vrai, c'est que, comme l'a dit M. Jarzembowski, il y a aujourd'hui, pour les compagnies européennes, des opportunités qu'il faut saisir. Cet accord permet un plus grand choix de services, des prix réduits, crée des emplois et nous permet déjà d'engager une coordination pour les mesures qui risquent d'affecter le passager – des problèmes de sécurité et de sûreté et, à terme, le one stop security – et, évidemment, dans les questions d'environnement.

Je veux répondre à Mme Ludford que le PNR ne fait pas partie de l'accord aérien. Toute décision ou mesure dans le cadre du PNR devra être compatible avec les termes de l'accord. Mais la question du PNR doit être revue dans son contexte et là, mon collègue Frattini est conscient de vos préoccupations à cet égard. C'est vrai que vous avez insisté beaucoup sur le problème de la sûreté et c'est vrai qu'il faut vraiment que ce dialogue s'engage dans le cadre du comité conjoint de l'accord pour développer des solutions de façon positive. Les deux parties travaillent pour maintenir un haut niveau de sûreté, qui ne pénalise pas les services aériens et les passagers. Le Transportation Security and Coordination Group, évidemment, doit pouvoir, en s'appuyant sur cet accord, apporter des réponses concrètes à vos préoccupations, dont j'ai évidemment pris acte avec beaucoup d'attention.

Je voudrais dire un mot aussi, si vous voulez, nous avons deux problèmes, n'est-ce pas, qui devraient pouvoir trouver progressivement des améliorations et vraisemblablement des solutions: le problème de la sûreté et le problème de l'environnement. À cet égard, sur le problème de l'environnement, nous avons évidemment, pour le défi du changement climatique, le souhait d'une approche intégrée et globale et, vous le savez, je l'ai dit tout à l'heure et je le répète, nous avons, à Montréal, à l'Organisation de l'aviation civile internationale, défendu tous ensemble le système d'échange de quotas d'émissions qui est un recours à des instruments de marché qui apparaît la solution la plus efficace. Pour le moment, nous nous sommes heurtés à un refus des États-Unis et aussi de certains pays asiatiques. Nous pensons néanmoins que cela n'empêche pas une coopération. Vous savez que dans le projet Cleansky, nous avons là aussi, avec les États-Unis, une coopération qui progresse. L'initiative Atlantic Interoperability Initiative to Reduce Emissions est intéressante. Ce sont des nouvelles procédures d'atterrissage qui sont en cause et qui peuvent nous permettre, là aussi, d'améliorer les conséquences de l'émission de CO2.

Ce que je voudrais dire, Madame la Présidente, Mesdames et Messieurs les parlementaires, c'est qu'évidemment, nous sommes là devant la nécessité de réussir la deuxième étape. Il faudra une forte pression, un engagement sans faille des Européens pour obtenir cette deuxième phase qui est évidemment très importante, puisqu'elle nous permettrait vraiment d'achever cet accord de ciel ouvert.

Soyez sûrs que le Parlement sera très associé à une négociation qui s'avère, certes, difficile, mais qui, comme je l'ai dit tout à l'heure, s'ouvrira en temps utile, étant donné que nous n'avons signé la première partie de l'accord que dans la mesure où il y avait cette deuxième étape. Je remercie en tout cas beaucoup le Parlement de son appui, qui me paraît tout à fait large et solide et nous aurons encore besoin de cet appui parlementaire pour parfaire cet accord et réussir cette deuxième étape.
