  Zdzisław Zbigniew Podkański, autor.−Panie Przewodniczący! Birmańskiej juncie wojskowej nie udało się spełnić obietnic podjętych wobec społeczności międzynarodowej po tak zwanej szafirowej rewolucji. Nie udało się poprawić sytuacji swojego społeczeństwa, które buntuje się i domaga należnych praw. Brutalne stłumienie we wrześniu bieżącego roku szerzących się protestów ani też więzienia nie zastąpią demokracji i rozwoju.

Birma musi zmierzać do przestrzegania zasad demokracji, do zapewnienia swobody wypowiedzi, wolności zrzeszania się i zgromadzania, wielopartyjności i zwolnienia więźniów politycznych, niezależnego sądownictwa oraz zaniechania czystek etnicznych. Birma potrzebuje pomocy. Konieczna jest więc zwiększona aktywność ONZ, jej Sekretarza, Międzynarodowego Komitetu Czerwonego Krzyża, Komisji Europejskiej oraz rządów państw mających wpływ na władze Birmy. Unia na rzecz Europy Narodów, w imieniu której przemawiam i w imieniu autorów, popieram i wnoszę tę rezolucję z prośbą o poparcie Pań i Panówposłów.

  Marios Matsakis, author.−Mr President, this is the sixth European Parliament resolution on Burma in the last two years, but the monstrous Burmese military junta seems to have taken no notice at all of what the EU thinks or says. Meanwhile, the ordinary citizens of Burma continue to suffer oppression, persecution and poverty, all of which are the result of the brutal, anachronistic and shameful stance taken by the brainless military regime controlling that country. The dictators, of course, continue to get richer and to lead a lavish life at the expense of their citizens’ suffering.

It seems that resolutions have little effect on these military criminals and, in my view, the most significantreason for this is the fact that countries like China, India and Russia continue to support Burma economically and politically. It seems to me that our attention should now be directed not at Burma itself, but at those three countries. It should be made clear to them that they must stop aiding the heartless and mindless military generals of Burma or their relationship with the EU will suffer severely and irreversibly.

  Józef Pinior, autor.−Panie Przewodniczący! Birma staje się właściwie permanentnym przedmiotem obrad Parlamentu Europejskiego. Wracamy do sytuacji w Birmie na każdej sesji posiedzenia Parlamentu Europejskiego w Strasburgu.

Zbliżający się szczyt krajów ASEM jest okazją dla Unii Europejskiej reprezentowanej przez prezydencję francuską do przedstawienia podstawowych kwestii w stosunku do władz Birmy. Po pierwsze, uwolnienie więźniów politycznych. Zdaniem Amnesty International w Birmie znajduje się obecnie około 2100 więźniów politycznych. Po drugie, zaprzestanie torturowania ludzi w więzieniach. Niebezpieczeństwo narażenia na tortury jest w Birmie na porządku dziennym. I wreszcie po trzecie, w akcjach militarnych przeciwko mniejszościom narodowym, w tej chwili przede wszystkim przeciwko Karenom, wojsko musi przestrzegać praw człowieka, musi przestrzegać profesjonalnego zachowania. Przemoc oraz zbrodnie przeciwko ludności nie mogą być akceptowane przez Unię Europejską.

Wreszcie, taktyka Unii Europejskiej musi mieć na uwadze rzeczywiste efekty. Należy się zastanowić, czy sankcje dotykają bardziej społeczeństwo czy rząd Birmy. Ta taktyka musi być mądra.Należy także przemyśleć taktykę sankcji w stosunku do Birmy przez Unię Europejską. Z jednej strony więc domaganie się praw człowieka, wolności demokratycznych, natomiast z drugiej strony taktyka, która pozwoli być efektywna w Birmie przez społeczność międzynarodową.

  Raül Romeva i Rueda, Autor.−Señor Presidente, la reunión de ASEM de mañana en Pekín supone una enorme oportunidad para que los Jefes de Estado y de Gobierno de la Unión Europea allí presentes aprovechen para poner sobre la mesa, nuevamente, la preocupante situación de los derechos humanos en Birmania.

En concreto, tal y como ha solicitado ya por carta Amnistía Internacional, sería muy oportuno que el Presidente de turno del Consejo, Nicolas Sarkozy, en tanto que Copresidente del encuentro euroasiático, señalara la gran preocupación que tenemos en Europa con relación a los más de 2100 presos políticos y que, más aún, solicitara su inmediata liberación.

Otra fuente de preocupación es la actual ofensiva militar contra la población karen en el este del país, donde ha tenido lugar la mayor operación militar en una década, cuyo objetivo directo es la población civil y que ha comportado, de hecho, el desplazamiento interno de 150000 personas. Ya en junio de 2006 Amnistía Internacional estableció que este tipo de prácticas constituían, de hecho, crímenes contra la humanidad.

Por otro lado, y tal y como han solicitado, entre otras, la Campaña Birmania por la Paz o Burman Campaign International, en la visita que tiene previsto llevar a cabo el Secretario General de las Naciones Unidas en diciembre se discutirán por primera vez los problemas políticos de fondo, después de que el Secretario General haya visitado recientemente el país en dos ocasiones, tras el paso del ciclón Nargis este año.

El caso es que, ciertamente, nunca antes habíamos tenido, aparentemente, tan amplioconsenso entre europeos y asiáticos para unir fuerzas y presionar al régimen para que libere a todos los presos políticos, por lo que la Cumbre, que empieza mañana, es de vital importancia.

Asimismo, cabe lamentar también que las Naciones Unidas hayan obviado —y, en algunos casos, incluso creído—durante mucho tiempo las mentiras del régimen, como demuestra el hecho de que después de 37 visitas del enviado de las Naciones Unidas no haya sido posible observar ningún avance significativo.

Por todo ello, me sumo a las voces que reclaman tanto a los Jefes de Estado y de Gobierno europeos —incluido, lógicamente, el Presidente del Gobierno español, José Luis Rodríguez Zapatero— como a las Naciones Unidas que den muestras de que apoyan realmente un cambio en Birmania. Para ello, es imprescindible que exijan la liberación inmediata de las personas detenidas.

Es importante, por lo tanto, que no se pierda la oportunidad que se nos brinda a partir de mañana y que los Jefes de Estado y de Gobierno respondan en función de las expectativas creadas.

Confío en que estos Jefes de Estado y de Gobierno —y, especialmente, el Presidente Sarkozy— estén a la altura de las circunstancias, sean conscientes sobre todo de la gravedad de la situación y actúen consecuentemente. Si la Unión Europea quiere ser realmente un actor político creíble, con una política exterior que se base en la defensa y en la promoción de los derechos humanos y no aparezca, como suele ocurrir, al servicio de los intereses económicos de grandes compañías como Total o Chevron, es éste el momento de demostrarlo y es en situaciones como éstas en la que es posible ganar esa credibilidad.

Son muchas las vidas que dependen de este tipo de gestos.

  Colm Burke, author.−Mr President, tomorrow marks the 13th anniversary of the unjust incarceration of Aung San Suu Kyi, Burma’s most revered political prisoner. This timely Parliament resolution condemns her continued detention and insists upon her immediate release.

Aung San Suu Kyi’s latest five-year term of house arrest was extended in May for a further year. Article 10b of the Burmese stateprotection law 1975 stipulates that a person judged to be a threat to the sovereignty and security of the state and the peace of the people can only be detained for up to five years. Therefore this prolonged detention is illegal. Suu Kyi has spent more than 13 years of the past 19 years confined to her Rangoon home.

I also deplore the fact that the number of political prisoners in Burma has increased from 1300 to over 2100 since the Saffron Revolution of September 2007. The military junta has clearly failed to deliver on promises made to the international community in this regard.

Whereas the release of veteran journalist and National League for Democracy (NLD) secretary U Win Tin and six other leaders last month was a step in the right direction, further moves must be made to free Burmese political dissidents.

I call on the Secretary-General of the United Nations to press ahead with a secondvisit to Burma in December irrespective of the prevailing conditions in order to make an urgent personal appeal for the release of all political prisoners and the full inclusion of the National League for Democracy in preparations for the 2010 elections.

Finally, I call on leaders at the ASEM summit beginning tomorrow in China on the 13th anniversary of Suu Kyi’s detention to understand their responsibilities regarding ongoing oppression in one of their neighbouring countries and to take decisive action accordingly to condemn the Burmese military junta for their continued suppression of political dissidents.

  Esko Seppänen, laatija.−Arvoisa puhemies, arvoisa komissaari, Burmassa ei kunnioiteta ihmisoikeuksia ja kansalaisvapauksia. Kuten edellä on monella suulla todettu, emme ota ensimmäistä kertaa kantaa ilmaisunvapauden puutteeseen, informaation tukahduttamiseen, kokoontumisvapauden kieltämiseen, alkeellisimpienkin oikeusvaltion periaatteiden rikkomuksiin ja opposition toiminnan kieltämiseen.

Burman kansan pahin vihollinen on sen oma valtiojohto, joka armeijan tuella, asevoimalla ja väkivallalla pakottaa kansansa valtamonopolinsa alaisuuteen. Juntan vankiloissa on entistä enemmän poliittisia vankeja. Sen ohella juntta toimii omaa kansaansa vastaan, estämällä kansainvälisen hätäavun luonnonkatastrofialueille. Kansainvälinen yhteisö joutuu voimattomana katsomaan burmalaisten menehtymistä omien johtajiensa, toisaalta toimettomuuden ja toisaalta repressiivisen toiminnan johdosta.

Vetoamme julkilausumassamme Asemin huippukokoukseen, jotta alueen muut maat painostaisivat junttaa toimimaan poliittisten vankien vapauttamisen puolesta. Tämän vaatimuksen osalta olemme itse vähän tekopyhiä, sillä tiedämme, että Burma ei ole alueella ainoa maa, jossa ihmisoikeuksia poljetaan lokaan. Ryhmämme tukee yhteistä päätöslauselmaa.

W rok po brutalnym stłumieniu protestów buddyjskich mnichów społeczność międzynarodowa pozostaje podzielona w kwestii, jak należy postępować z jednym z najbardziej represyjnych reżimów świata. Europa i Stany Zjednoczone zaostrzają sankcje i głośno wyrażają swoje oburzenie łamaniem praw człowieka - podobnie jak my dzisiaj na tej sali. Z drugiej strony regionalni sąsiedzi Myanmaru: Chiny, Indie, Rosja, kraje ASEAN odmawiają otwartej krytyki reżimu birmańskiego pod hasłem niemieszania się w wewnętrzne sprawy tego państwa. Dlatego popieram to, co powiedział już pan poseł Matsakis. Komisja Europejska powinna odważniej i bardziej otwarcie poruszać tę kwestię w rozmowach z Chinami, Rosją i krajami ASEAN.

Drugi problem to działania na poziomie ONZ, które są całkowicie nieskuteczne. Był zapowiadany przełom przed ostatnim Zgromadzeniem Ogólnym w sprawie Birmy. Tego przełomu nie było. Komisja Europejska i państwa członkowskie powinny aktywnie działać, aby na poziomie międzynarodowym robić więcej w sprawie birmańskiej.

  Lidia Joanna Geringer de Oedenberg, w imieniu grupy PSE.– Panie Przewodniczący! Minęły niespełna 4 miesiące od ostatniej rezolucji Parlamentu Europejskiego alarmującej o dramatycznej sytuacji wewnętrznej w Birmie. Rządzący reżim wojskowy nie spełnił właściwie żadnej z obietnic złożonych wspólnocie międzynarodowej po wybuchu ubiegłorocznego powstania. Istnieje ryzyko, że Sekretarz Generalny ONZ odwoła swą grudniową wizytę, jeśli nie nastąpi poprawa sytuacji w kraju. Więźniowie polityczni, których liczba wzrosła do 2 tysięcy, przetrzymywani są nadal w nieludzkich warunkach pozbawieni dostępu do opieki medycznej. Lauretka Nagrody Sacharowa i Nagrody Nobla Aung San Suu Kyiod 17 lat przebywa w niewoli. Birmański reżim dalej ogranicza podstawowe prawa człowieka i wolności, w tym dostęp do niezależnych źródeł informacji. Prześladowana przez władze mniejszość kareńska szuka schronienia w Tajlandii żyjąc na skraju nędzy, podobnie jak mieszkańcy terenów dotkniętych huraganem, do których reżim wstrzymał dostęp pomocy humanitarnej narażając tysiące swych obywateli na śmierć głodową.

Powinniśmy żądać od birmańskich władz zniesienia wszelkich restrykcji w niesieniu pomocy humanitarnej oraz przywrócenia podstawowej wolności w kraju. Należy zabiegać silnie o realizację wizyty Sekretarza Generalnego ONZ w Birmie oraz włączenie Narodowej Ligi na Rzecz Demokracji w proces przygotowań do wyborów w 2010 roku. Chiny i Indie powinny wywrzeć nacisk polityczny i ekonomiczny na birmański reżim poprzez zaniechanie udzielania pomocy birmańskiemu wojsku, zaś społeczność międzynarodowa powinna zastosować sankcje gospodarcze, łącznie z zamrożeniem funduszy członków rządu i innych osób z nimi związanych.

  Kathy Sinnott, on behalf of the IND/DEM Group.–Mr President, Burma is a country which is steeped in corruption. With 2000 political prisoners under arrest, access to free media impeded by the authorities and widespread slavery in industry, the people of this country need serious help.

However, in spite of more than 37 visits by UN envoys in the past 20 years and six resolutions in this House, there has been not a single reform made by the military junta. I would agree with Mr Matsakis that it is not good enough to point to Burma: we must point to Burma’s supporters and main supporter, especially China, its most powerful economic and military ally. Yet a smiling Mr Sarkozy represented the European Council at this summer’s Olympic Games. Did he press China’s top officials, who stood with him, about the Burmese, about the Sudanese, about the people of Tibet and about China’s own persecuted people?

I particularly also want to mention the misuse of aid funds that go into Burma, because we still try to reach the ordinary people of Burma and, yet, these goods are often given to favourites of the Burmese Government to resell at high value.

  Paulo Casaca (PSE).- Senhor Presidente, Senhor Comissário, celebra-se amanhã o 13° aniversário em que a dirigente birmanesa Aung San Suu Kyiestá detida indevidamente. É a melhor ocasião para que a União Europeia e o seu Presidente, que estão presentes em Beijing numa cimeira da ASEM, declarem de forma muito formal que o estado da situação na Birmânia é inaceitável, façam a necessária pressão, nomeadamente sobre a China, como já aqui foi proposto por vários dos nossos colegas,sigam o exemplo que já foi dado, nomeadamente pelos Estados Unidos em 2003, e recusem a continuação de importação de produtos de vestuário feitos em perfeita escravatura. Para além disso um regime de sanções que seja absolutamente claro e consequente. Se isso for feito eu creio que vamos finalmente começar a observar transformações na situação na Birmânia.

  Peter Skinner (PSE).- Mr President, I should like to thank the Commissionerfor listening to us. Along with colleagues such as Glenys Kinnock, I have long looked forward to the day when resolutions on human rights in Burma and elsewhere do not have to be considered in this Parliament, but we continually have to return to this.

I can only agree with colleagues around the House that, when we look at the attempts, time and again, to make changes in Burma, we see nothing but failure instead. We need to expose those countries that aid and bail out this corrupt regime with trade. We have announced the names of some of those countries and should do more at European level to make sure their exposure leads to real change. We need to see changes in Burma leading to freedom of assembly and association, the release of prisoners of conscience and a full transition to a multi-party democracy. We have seen off juntas in Europe. We need the world to see off the junta in Burma.

  Zbigniew Zaleski (PPE-DE).- Panie Przewodniczący! Jeżeli jest tylko jeden oponent w stosunku do władzy, to jest bardzo bardzo słaby. Ale jeżeli będą nasze głosy z tego zgromadzenia, jak też i z innych krajów, to będzie to wiadomość dla innych obywateli krajów pod opresją, że warto i opłaci się mówić prawdę i przeciwstawiać się reżimowi. Jest więc to wzmocnienie dla ludzi. Z drugiej strony poza samym słowem trzeba podjąć konkretne kroki, żeby pokazać juncie, że nie opłaci się opresja do końca, ponieważ przekłada się to zarówno na naród, jak też na samą władzę, a więc takie dwa kroki zdecydowane muszą być podejmowane i niestety powtarzane aż do skutku. Ja wierzę w to, że prawda wygra i im będzie więcej mówców tej prawdy w samej Birmie, tym będą mocniejsi.

  Gerard Batten (IND/DEM).- Mr President, earlier this year we saw the failure of the Burmese Government to deal with the consequences of a natural disaster in that country. Considering the amount of money spent by the military on its own upkeep and the tight hold it has on national life, onemight at least have expected it to be able to respond to the needs of its own people in a humanitarian crisis. It did not, because it has no real function, except to perpetuate its own existence and stranglehold on power.

Referring back to what I said in my previous remarks on the Congo, I wonder how many of the military junta have bank accounts in Western banks and enjoy shopping trips to London, Paris and Rome. A direct way of showing support for the Burmese people would be for democratic countries to stop them coming until human rights and democracy are practised in Burma.

  Justas Vincas Paleckis (PSE).- Aš įdėmiai sekiau šią diskusiją ir norėčiau atkreipti dėmesį į dvi mintis. Kolega M. Matsakis, man atrodo, labai teisingai pabrėžė, kad raktas į padėtį Birmoje guli ir Maskvoje, ir ypač Pekine, ir Delyje. Reikia didinti spaudimą ne tiktai Birmai, bet ir toms šalims. Antras, labai svarbus, pastebėjimas, kurį kolega J. Pinior pabrėžė, ir aš visiškai prisijungiu prie to reikia – žiūrėti, kiek tas spaudimas Birmai, kiek tos sankcijos Birmai liečia chuntą ir liečia paprastus žmones. Aš pakviesčiau Europos Komisiją padaryti analizę kiek tai mūsų visi tie žingsniai apsunkina chuntos veiksmus ir kiek jie paliečia žmones. Ir visokeriopai, man atrodo, reikėtų skatinti Birmos atsivėrimą pasauliui ir tik tada ta šalis galės žengti demokratijos keliu.

  Marios Matsakis (ALDE).- Mr President, in coming to the end of this part-session’s debate on human rights here in Strasbourg, it is worth noting that life is getting back to normal, with a very few faithful and determined colleagues still present, along with the Commission’s representatives – we are grateful that the Commission always has representatives at these debates – and, of course, the absence of any representatives from the Council. We should all just be gratefulthat the roof has not fallen on us. Let us hope that it never will!

  Andris Piebalgs, Member of the Commission.−Mr President, I would like to start by reminding you that the Commission’s response to the cyclone last May was quick and substantial. We provided humanitarian and food aid and worked through the civil protection mechanism in cooperation with the EU Member States.

We are pleased with ASEAN’s active role in coordinating international efforts. The Commission funded the largest part of the needs assessment undertaken jointly by ASEAN, the United Nations and the Government. The humanitarian emergency is not over, but we will now also look at rehabilitation issues. Most remarkable during this period has been the outpouring of solidarity among citizens, local NGOs and the Myanmar Red Cross. This is a clear signal that giving up on civil society is not an option.

The problems that need to be addressed are the following:

Firstly, we must reduce the isolation of the Burmese people. Civil society needs strengthening. The Commission is co-hosting a conference on the role of civil society in Myanmar in Brussels, which will take place on 29October.

Secondly, we must keep open all possible channels of communication with the Government. At the ASEM Summit, which will take place in Beijing on 26October, President Barroso is expected to take the floor. In addition, the Commission has established working relations with line ministries in matters of health, education and livelihoods.

Thirdly, we must keep and strengthen the United Nations as a driving force. There is no alternative to the good offices of the UN Secretary-General and the UN Special Adviser, Ibrahim Gambari. The Commission strongly backs the efforts of the UN Special Rapporteur on Human Rights in Myanmar, Mr Tomás Ojea Quintana.

National reconciliation also requires an inclusive dialogue. It cannot take place with political stakeholders in jail or under house arrest. We continue to request the release of all those being detained on political grounds. The Commission also backs the ILO efforts to end forced-labour practices used for military and infrastructural programmes.

The Commission is using all its channels to express concerns regarding forced labour and non-respect for fundamental freedoms. The people of Myanmar deserve our attention and assistance, and the Commission will continue to do everything in its power.

  Sebastian Valentin Bodu (PPE-DE), în scris.–Parlamentul European trebuie să facă front comun în condamnarea crimelor împotriva umanităţii din Myanmar unde situaţia a devenit dramatică. Asociaţii neguvernamentale cu o reputaţie de neclintit semnalează că aproape 70,000 de civili au fost forţaţi să îşi părăsească locuinţele în ultimele 6 luni, încercând să scape de abuzurile sistematice ale huntelor militare.

Myanmar are o istorie de aproape 50 de ani de dictatură militară şi este condamnabil faptul că locuitorii săi nu pot duce o viaţă normală de jumătate de secol.

Persecuţiile, tortura, munca forţată, confiscarea terenurilor şi restrângerea drepturilor de mişcare la nivelul la care se întâmplă în Myanmar pot cu uşurinţă face ca autorităţile să fie acuzate de crime împotriva umanităţii.

Ca membru al Parlamentului European, instituţie ce ce are ca fundament principiul respectării drepturilor omului, consider că este necesar ca autorităţile din Myanmar să fie atenţionate în mod public că respectarea drepturilor omului stă la baza prosperităţii economice a unei ţări. Eliberarea tuturor deţinuţilor politici din Myanmar, în frunte cu laureata Premiului Nobel pentru Pace, Aung San Suu Kyi, ar fi un prim semnal important din partea autorităţilor acestui stat că sunt deschise dialogului internaţional şi că nu au în intenţie completa izolare de restul lumii.

  Jules Maaten (ALDE), schriftelijk.Op de aanstaande ASEM-top op 24 oktober 2008 in Beijing zit de Birmese oppositieleidster en Nobelprijswinnares Aung San Suu Kyi in totaal exact 13 jaar gevangen. VN-secretaris-Generaal Ban Ki-Moon heeft aangekondigd in december Birma te willen bezoeken, maar heeft aangegeven dit slechts te zullen doen,als er serieuze vooruitgang in de politieke en mensenrechtensituatie in Birma geboekt kan worden en dat anders zijn bezoek uitgesteld moet worden. De aanstaande ASEM-top is een uitgelezen mogelijkheid om stevige druk uit te oefenen op Birma om snel aan de voorwaarden van de VN te voldoen en zo het bezoek van Ban Ki-Moon te bespoedigen.
