  Marios Matsakis, author. − Madam President, Russia is one of the EU’s most important trading partners. Amongst other things, it is responsible for supplying EU Member States with a large percentage of their energy needs. Furthermore, today’s Russia is not what that country was in the past. In this respect we are pleased, for we wholeheartedly wish Russia to be a modern and democratic nation with which we can cooperate to further world peace and prosperity. Unfortunately, our wishes – and now our trust-building – are being shaken by the violation of human rights and disrespect for the rule of law that is still taking place in Russia, albeit at a much reduced rate. A good example is the totally unacceptable way that the whole affair concerning the brutal murder of Anna Politkovskaya in 2006 has been handled by the Russian authorities.

With this motion for a resolution, we call upon the Russian Government to do its utmost to ensure that the road to democratic reforms taken by Russia, and its consequent cooperation with the EU, are not put in jeopardy by the human rights violations still occurring in that country.

  Józef Pinior, autor. − Pani Przewodnicząca! Jeszcze dźwięczą w tej izbie słowa Eleny Bonner wypowiedziane wczoraj w czasie wręczania Nagrody im. Sacharowa, która była w Parlamencie Europejskim w towarzystwie swojej córki Tatiany Jankielewicz. Były to wielkie słowa - przesłanie do dzisiejszej Europy, do dzisiejszego świata kogoś, kto przeżył rosyjski totalitaryzm, kto jest prawdziwym głosem Rosji w dzisiejszym świecie.

Jesteśmy zaniepokojeni w Parlamencie Europejskim obecną sytuacją w tym wielkim kraju. Szykany i represje w stosunku do adwokatów, obrońców w dziedzinie praw człowieka, grożenie im przemocą, a także zagrożenie dla ich życia jest jednym z elementów towarzyszących dzisiejszemu systemowi politycznemu Rosji.

W dniu 4 grudnia br. policja przeprowadziła rewizję w pomieszczeniu Memoriału, zasłużonej instytucji w dziedzinie praw człowieka, w dziedzinie archiwizacji zbrodni totalitaryzmu. Przyznam się, że nie potrafię zrozumieć przyczyn, dla których rosyjskie władze zarekwirowały sprzęt należący do Memoriału: komputery, a także archiwum dotyczące epoki Gułagu. Nie potrafię tego wytłumaczyć w żaden sposób, dlaczego takie archiwum może być zagrożeniem dla porządku publicznego w dzisiejszej Rosji.

Jesteśmy także zaniepokojeni przebiegiem procesu zabójców Anny Politkowskiej. Oczekujemy nie tylko, że ten proces wyjaśni kto realnie dokonał tego zabójstwa, ale także kto stał za tym zabójstwem, kto zlecił to zabójstwo, że sąd wyjaśni wszystkie okoliczności tego szokującego mordu. Dlatego ten proces powinien być otwarty dla dziennikarzy, dla mediów, dla tych wszystkich, którzy chcą monitorować jego przebieg.

Sądzę także, że klauzula dotycząca praw człowieka powinna być częścią fundamentalnych porozumień pomiędzy Unią Europejską a Rosją. Prawdziwa Rosja jest taka, jak powiedziała wczoraj w Parlamencie Europejskim Elena Bonner.

  Erik Meijer, Auteur. − Voorzitter, na 1991 was Rusland een tijd lang een land van openlijke politieke meningsverschillen en politiek debat met een veelpartijenstelsel en uiteenlopende visies op de toekomst. Helaas ging die meest democratische periode ook gepaard met bestuurlijke onbekwaamheid, wilde privatiseringen en corruptie. De chaotische periode onder president Jeltsin in de jaren '90 heeft het klimaat geschapen voor terugkeer naar een sterk centraal staatsgezag zonder veel ruimte voor oppositie of kritische onderzoeksjournalistiek.

Hoewel er nu, anders dan in de communistische tijd, meerdere partijen aan de verkiezingen deelnemen, berust de macht opnieuw bij één partij, worden andere partijen stelselmatig gehinderd en vindt er rond de leider van de leidende partij persoonsverheerlijking plaats. Een belangrijk deel van de publieke opinie staat achter die leider en hecht geen belang aan ruimte voor kritiek, alternatieven of oppositie. Dat zal waarschijnlijk zo blijven, zolang Rusland onverwacht rijk en succesvol is door export van gas en olie. Daardoor wordt de ruimte voor een echte democratie sterk ingeperkt.

Tegenover die huidige meerderheidsopvatting staan diegenen die wijzen op de enorme tegenstelling tussen armoede en rijkdom, de grote mate van geheimhouding, de intolerantie, de inperking van de rechten van autonome regio's, de behandeling van etnische minderheden, de gewelddadige situatie in Noord-Kaukasus, de verwaarlozing van economisch zwakke regio's, de mishandeling van dienstplichtigen, de discriminatie van homo's, de straffeloosheid voor sommige moordenaars, de eenzijdige partijkeuze van politie en justitie en de belemmering van de vrijheid van niet-gouvernementele organisaties en media.

Onze sympathie moet zijn aan de kant van de critici. We kunnen die critici helpen door zelf het goede voorbeeld te geven en mensenrechtenactivisten te steunen in de strijd tegen verdwijningen, intimidaties, geheimhouding en moorden. In de praktijk dragen landen met een goed functionerende parlementaire democratie onbedoeld bij tot het tegendeel.

Wij helpen de critici niet door de oprichting van een rakettenschild of door steun aan de Georgische pogingen om Abchazië en Zuid-Ossetië te bezetten. Dat wordt gezien als vijandige daden die er alleen maar toe leiden dat de mensen zich achter Poetin scharen. We helpen ze evenmin, in onze behoefte aan gas en olie, door mensenrechtenschendingen in Rusland te accepteren. Terecht zegt de resolutie dat in de contacten met Rusland, mensenrechten, rechtsstaat en democratie voorop moeten staan.

  Tunne Kelam, author. − Madam President, this debate is long overdue. We continue to quote the word ‘interdependence’. That interdependence does not only relate to energy and trade. It also concerns values, justice, human dignity and truth. These are values to which Russia committed itself when it became a member of the Council of Europe.

This debate should remind us of our shared responsibility for the alarming regression in the field of democracy and human rights in Russia.

On 3 December 2008, 17 Russian human rights groups sent a joint statement to the EU. Europe’s reaction has not been adequate, they tell us, to what is taking place in Russia and with Russia’s relations with neighbouring states like Ukraine and Georgia. The EU has failed to hold Moscow to the same standards it insists on holding other partners to. It is precisely that failure, they conclude, that has allowed the Russian authorities to crudely violate human rights and international law.

Yesterday, Elena Bonner delivered to us the essence of Andrei Sakharov’s message: do what you have to do; do what your conscience tells you to do. Should we not do this, we risk sharing responsibility for gassing justice and human rights in our neighbourhood, while making pragmatic attempts to secure energy supplies for ourselves.

Can we make a difference? All those people who have experienced the brutality and seeming omnipotence of Soviet totalitarianism can assure you that we can make a difference if we value our own values seriously. The Russian people deserve to enjoy the same values and justice we do.

  Ewa Tomaszewska, autorka. − Pani Przewodnicząca! Zabójstwa i skrytobójstwa nadal są metodą stosowaną w Rosji wobec obrońców praw człowieka i wszystkich myślących inaczej.

W Moskwie, 28 października zamordowano Otto Messmera, przełożonego jezuitów i księdza Victora Betancourt'a z Ekwadoru. 31 sierpnia zabity został Magomet Jewłojew. Miały miejsce zamachy na życie Ahmeda Kotiewa, Zuraba Cekojewa, Dmitrija Kraiuchina, Stanisława Dmitriewskiego, Kariny Moskalenko. 4 grudnia miała miejsce napaść na lokal Memoriału zorganizowana przez rosyjską prokuraturę, w trakcie której dokonano zaboru bazy danych dotyczącej tysięcy ofiar systemu stalinowskiego.

Procesy w sprawie zabójstw Anny Politkowskiej i Aleksandra Litwinienki wskazują, że władze rosyjskie starają się nie dopuścić, by zapadł w nich uczciwy wyrok, byśmy dowiedzieli się na czyje zlecenie dokonano tych zbrodni. Aresztowania pokojowych manifestantów czy znęcanie się nad poborowymi to zwykła praktyka w Rosji.

Zdecydowanie protestuję przeciw łamaniu praw człowieka w Rosji. Wzywam władze tego państwa do zaprzestania prześladowań obrońców praw człowieka.

  Michael Gahler, im Namen der PPE-DE-Fraktion. – Frau Präsidentin! Bei vielen Gelegenheiten haben wir unseren Willen zur Zusammenarbeit mit Russland zum Ausdruck gebracht. Wir wollen den wirtschaftlichen Austausch und den politischen Dialog mit Russland. Europa und Russland brauchen einander. Umso besorgter sind wir über die Entwicklung des Rechtsstaats und der Demokratie in diesem Land, dessen Menschen so viele Jahrzehnte bereits unter der Sowjetdiktatur gelitten hatten.

Alle demokratischen Indikatoren zeigen seit der Amtsübernahme von Wladimir Putin nach unten: Presse- und Medienfreiheit, Meinungsfreiheit, Versammlungsfreiheit, die Vereinigungsfreiheit – nicht nur für politische Parteien –, die richterliche Unabhängigkeit, der Respekt vor Minderheiten.

Die Verurteilungen Russlands beim Europäischen Gerichtshof für Menschenrechte hier in Straßburg sind bedrückender Beweis für die Situation der Bürgerrechte in diesem Land. Die Stürmung des Forschungs- und Informationszentrums Memorial am 4. Dezember in Sankt Petersburg zeigt leider u.a., dass die gegenwärtige Führung offenbar die Last des stalinistischen Erbes verdrängen und den Terror Stalins beschönigen will. Das ist keine gute Basis für die Entwicklung einer demokratischen Gesellschaft, die die Voraussetzung für eine gedeihliche wirtschaftliche und soziale Entwicklung, aber auch für das Vertrauen der europäischen Nachbarn in einen verlässlichen und friedlichen Partner Russland ist.

Wir müssen bei allen Kontakten mit Regierung und Zivilgesellschaft und der Wirtschaft im gemeinsamen Interesse auf die Rückkehr zu Rechtstaatlichkeit und Demokratie in Russland drängen.

  Janusz Onyszkiewicz, w imieniu grupy ALDE. – Pani Przewodnicząca! Rosja jest dla nas zbyt ważnym krajem, by nie patrzeć z niepokojem na to, co się w tym kraju dzieje. W czasach komunizmu nie było w Rosji problemu z wolnością wypowiedzi - był problem z wolnością po wypowiedzi. Dziś sytuacja wydaje się jeszcze gorsza. Nie chodzi bowiem tylko o wolność, ale jakże często po prostu o życie.

Rezolucja zwraca uwagę na wiele alarmujących zabójstw osób zajmujących się obroną praw człowieka, bądź z innych powodów niewygodnych dla krajowych czy lokalnych władz. Tym, którzy za tymi zabójstwami stoją, pozwala się zniknąć z kraju jak w przypadku mordu na Annie Politkowskiej, bądź też pozwala się na to, by chowali się za immunitet poselski, jak w przypadku zabójstwa Aleksandra Litwinienki. Ta alarmująca sytuacja sprawia, że trudno nam będzie traktować Rosję jako kraj, w którym jest rzeczywista wola trzymania się podstawowych standardów państwa prawa.

  Mikel Irujo Amezaga, en nombre del Grupo Verts/ALE. – Siento la confusión que ha habido antes con el orden de mi intervención.

Los derechos humanos y la libertad son los pilares más importantes de la Unión Europea y también deben estar en la base de nuestro diálogo con Rusia.

Pero la lista de violaciones aumenta cada día y también aumenta cada día la dificultad con la que trabajan los activistas de la defensa de los derechos humanos.

En los últimos meses, entre otros muchos, se han producido varias violaciones de derechos humanos. Han atacado el domicilio de Stanislav Dmitrievsky, asesor de la Fundación de Nizhny Novgorod por la Promoción de la Tolerancia, tropas armadas secuestraron y golpearon a Zurab Tsetchoev, defensor de los derechos humanos en Ingushetia, y familiares de Ilyas Timishev, abogado de derechos humanos, han sido detenidos e interrogados y han sido víctimas de malos tratos.

Debo recordar también aquí que, el pasado 12 de diciembre, el Gobierno español decidió extraditar a Rusia a Murat Gasayev, ciudadano de este país procedente de Chechenia, que fue detenido por los servicios secretos rusos en 2004 y torturado durante tres días, según denuncia Amnistía Internacional.

Gasayev huyó al Estado español, donde pidió asilo en el 2005. La petición le fue denegada en base a un informe confidencial elaborado por las autoridades españolas al que no tuvieron acceso ni él ni su abogado.

El Estado español es firmante de la Convención contra la Tortura, y dicha extradición se basa en las garantías diplomáticas dadas por las autoridades rusas para proceder a la extradición.

Innumerables informes de organizaciones de derechos humanos han expresado reiteradamente su preocupación por el uso de la tortura en la Federación de Rusia, particularmente en las repúblicas del Cáucaso norte, como Chechenia e Ingushetia.

Si Murat Gasayev es extraditado, existe un peligro real de que sea sometido a tortura y a otros malos tratos una vez se encuentre bajo custodia rusa.

Y acabo −utilizo ya el minuto de intervención incidental, como convenido− citando las palabras de un colega de Grupo, el señor Horáček, quien recordó el pasado mes de julio que en la prisión siberiana de Chita están detenidos los presos del caso Yukos, Mijaíl Jodorkovski y Platón Lébedev. Y hay otros.

Así pues, desearía solicitar que se hiciera cuanto esté en nuestras manos para garantizar su liberación, pero también para alentar a Rusia a hacer de la libertad de opinión y de prensa una realidad y a no obstaculizar el trabajo de las ONG, puesto que todos estos aspectos son de extremada importancia para nuestro futuro común europeo.

  Andrzej Tomasz Zapałowski, w imieniu grupy UEN. – Pani Przewodnicząca! Dziś po raz kolejny padają cierpkie słowa w kierunku rządu rosyjskiego za tolerowanie, a może nawet czasami za inspirowanie działań daleko odbiegających od zasad obywatelskich, które są fundamentem w każdym cywilizowanym kraju. Porwania, zastraszenia czy nawet morderstwa na osobach walczących o prawa człowieka wywołują w Rosji oburzenie. Ale jednocześnie to społeczeństwo popiera w znacznym stopniu właśnie tę władzę, pomimo widocznego niszczenia wszelkiej opozycji.

Większości Rosjan podoba się silna władza - władza bezwzględna. Rosjanie chcą odbudowy mocarstwowej Rosji niezależnie od metod i sposobów dojścia do tego. Europa próbuje tego nie zauważać, bo przecież interesy gospodarcze są najważniejsze. A przecież to duża część społeczeństwa rosyjskiego chce, aby włączyć ponownie do Rosji byłe republiki radzieckie, nawet te należące dzisiaj do Unii Europejskiej. I jest to jeszcze większy problem od łamania praw człowieka w tym kraju. To jest bardziej niebezpieczne, a właśnie to się przemilcza.

  Kathy Sinnott, on behalf of the IND/DEM Group. – Madam President, Russia is Europe’s largest and closest neighbour and, because of our trade relations, also one of the most important. What happens in Russia is very important to Europe for these reasons. Also what happens in Russia has a very big influence on Europe. For these reasons, as well as the human rights violations which it contains, this is a very important resolution.

I would like to highlight the fact that I met with Gary Kasparov, while he was a candidate for the presidency of Russia, in this Parliament here in Strasbourg. He came as an honoured guest when he was a candidate. Kasparov made it clear to us – even then – that the Kremlin’s attitude towards political activity meant that they treated him as a subversive and a criminal – many of the things we are talking about today – liable to manhandling and always under threat of arrest and the arrest of his supporters.

Sometimes this sort of activity even goes beyond Russian borders and even into the EU. On a recent trip by the Petitions Committee to Bulgaria, we were told by the Bulgarian Orthodox Church, which is suffering severe persecution in Bulgaria, of the influence of Russia in their situation.

We must put aside considerations of our fear about energy security that soften our approach to Russia and make us tiptoe in their presence, and speak to Russia strongly and clearly, reminding them that they are members of the Council of Europe and signatories to the European Convention on Human Rights and the Strasbourg Accord, and we must insist that they respect democracy and human rights in Russia and beyond.

  Bernd Posselt (PPE-DE). - Frau Präsidentin! Die Rechtsstaatsprobleme in Russland sind keine punktuellen Fehlentwicklungen, sondern ein Krebs, der sich systematisch ausbreitet. Wir sind in der Phase 2 der Ära Putin, garniert durch einen Herrn Medwedjew, und die dritte Phase wird gerade vorbereitet.

Herr Putin hat seine erste Ära mit dem zweiten Tschetschenien-Krieg, einem völkermordartigen Überfall auf ein kleines Volk aus massiven Rohstoffkolonialinteressen heraus, begonnen. Seitdem breitet sich die Sache aus, der Rechtsstaat und die Pressefreiheit werden zurückgedreht, Menschenrechtsverteidiger wie Frau Moskalenko werden bis hierher in die europäische Hauptstadt Straßburg verfolgt, und wir erleben einfach, dass es keine Fortschritte gibt und, wie gesagt, nicht nur punktuelle Fehlentwicklungen, sondern einen systematischen Verlust der geringen Reste von Rechtstaatlichkeit und Demokratie, die noch da sind.

Deshalb müssen wir als Europäische Union wesentlich energischer auftreten. Wir sind es im Rahmen der Verhandlungen um ein Abkommen den Menschen schuldig, die – wie z.B. Frau Politkowskaja, Herr Litwinenko und viele andere – dafür gestorben sind, dass sie es auch nur gewagt haben, diese Fehlentwicklungen zu untersuchen oder beim Namen zu nennen.

Wer in Russland offen darüber spricht, dessen Leben ist schon gefährdet. Und jedes Mal ist es angeblich ein mysteriöser, nicht durchschaubarer Hintergrund. Deshalb haben wir, die wir hier in Freiheit und relativer Sicherheit leben, die Pflicht, dafür zu sorgen, dass endlich Licht in dieses Dunkel gebracht wird und dass wir hier im Europäischen Parlament wenigstens das tun, was wir tun können, nämlich in einer klaren und ehrlichen Sprache mit den russischen Machthabern zu reden. Denn eine andere Sprache verstehen sie nicht, wie Frau Bonner gestern auch eindrucksvoll deutlich gemacht hat.

Nehmen wir uns am Mut einer Elena Bonner und eines Andrej Sacharow ein Beispiel, und hören wir endlich auf, zu heucheln und uns selbst in die Tasche zu lügen. Sprechen wir die Dinge so aus, wie sie wirklich sind. Damit leisten wir dem russischen Volk den größten Dienst, den wir ihm leisten können.

  John Bowis (PPE-DE). - Madam President, two years ago Anna Politkovskaya was murdered. She was shot down at home, in the lift of her block of flats. A gun was dropped beside her. It was broad daylight. The question at the time was ‘who pulled the trigger?’. The question since then has been ‘who pulled the strings that pulled the hands that pulled the trigger?’. It was in the style of a mafia killing, but she never wrote about the mafia. She only wrote about the Russian Government and its actions in Chechnya. It was a warning – a warning to other free-spirited journalists to keep off the authoritarian grass.

It will succeed unless world opinion and a clear message from the EU institutions force a proper trial and a proper exposé of those who gave the orders. We cannot bring Anna back, but we can bring her justice. We can make her a symbol of freedom, and not one of suppression. We must unite to that end.

  Paulo Casaca (PSE). - Senhora Presidente, estamos a concluir um debate de extrema importância que, como já aqui foi dito, é um debate que já devíamos ter tido há muito tempo. A Rússia é fundamental para nós sob todos os pontos de vista, mas, acima de tudo, como um país onde os direitos humanos devem ser respeitados. Esses direitos humanos incluem necessariamente a negação da xenofobia e da homofobia, e eu queria apelar a todos os colegas que não deixassem de fazer uma referência explícita a esses dois flagelos enormes na Rússia, que estão correctamente considerado como tal na resolução que está a ser proposta, e que não aceitassem retirá-los.

  Zbigniew Zaleski (PPE-DE). - Madame la Présidente, Monsieur le Commissaire, la résolution parle directement des cas condamnables.

Cette résolution ne doit pas être une résolution d'urgence mais un appel constant aux autorités russes, car nous condamnons leurs méthodes de persécution. Cette résolution est un appel au peuple russe, aux militants, aux héros russes qui lutteront pour la liberté jusqu'au moment où plus personne ne devra craindre d'être exécuté pour avoir exercé son droit à la liberté d'expression.

Je crois que vous devez relayer notre appel dans le cadre des relations et des entretiens entre le gouvernement russe et notre Commission européenne.

  Marcin Libicki (UEN). - Pani Przewodnicząca! My dzisiaj omawiamy sprawy łamania praw człowieka na przykładzie morderstwa pani Politkowskiej i innych wypadków w Rosji, które mają charakter terroryzmu państwa przeciwko swojemu społeczeństwu.

Musimy zdać sobie sprawę, że to że z jednej strony w Rosji łamie się prawa człowieka, że z drugiej strony Rosja coraz bardziej nabiera charakteru imperialistycznego, grozi swoim sąsiadom po bardzo krótkiej przerwie, która miała miejsce na początku lat 90., jest rezultatem tego, że komunizm nigdy nie został formalnie rozliczony i potępiony. To, że dzisiaj mówimy o Niemczech jako o kraju demokratycznym i szanującym ludzi, to dlatego, że Hitler został tam rozliczony.

My dzisiaj musimy starać się, tutaj w tej izbie i tam wszędzie, gdzie mamy na to wpływ, doprowadzić do rozliczenia komunizmu, bo to tylko postawi tamę rosyjskiemu terrorowi zewnętrznemu i imperializmowi na zewnątrz.

  Jacques Barrot, vice-président de la Commission. − Madame la Présidente, le 5 novembre, le président Medvedev, dans son premier discours annuel au Conseil de la Fédération, a mentionné explicitement la Convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales.

Cette mention symbolique, en cette année anniversaire de la Déclaration universelle, témoigne de l'intérêt que porte le nouveau président aux questions de réforme judiciaire et de l'impact de ces réformes sur les droits de l'homme. Ses mots sont encourageants mais l'Union européenne devra suivre de très près les évolutions dans ce domaine. La réalité de ces dernières semaines nous a rappelé une fois de plus les grands défis auxquels sont confrontés les défenseurs des droits de l'homme en Russie. Nous avons écouté avec attention, bien sûr, les différents orateurs, Madame la Présidente, qui n'ont pas manqué de souligner les graves menaces aux droits de l'homme en Russie.

Deux ans après sa mort, le procès pour homicide, dans le cas d'Anna Politkovskaya, a commencé. Il a d'abord été ouvert au public, puis s'est déroulé à huis clos, puis a été de nouveau ouvert au public. Le procès sera suivi de près par tous ceux qui défendent la liberté d'expression.

Comme nous l'a rappelé le meurtre de Magomed Yevloyev, fin août, placé en garde à vue par la police, la profession de journaliste en Russie devient de plus en plus dangereuse.

Début décembre, Memorial, l'une des ONG les plus anciennes et les plus prestigieuses qui travaillent sur le passé douloureux de la Russie du 20e siècle, a fait l'objet d'une perquisition policière. Résultat de cette perquisition: la confiscation des archives historiques sur les goulags.

Si nous voulons vraiment continuer le travail que nous avons commencé en avril dernier lors de la conférence sur les crimes commis par les régimes totalitaires en Europe – conférence que j'ai ouverte moi-même –, il va de soi que les historiens doivent absolument avoir accès aux archives. La perquisition du 4 décembre est un message inquiétant pour ceux qui croient à la nécessité du débat, et d'un débat honnête, sur les blessures profondes du passé. Ce débat est nécessaire pour assurer, à l'avenir, les réconciliations nécessaires.

Bien sûr, les consultations entre les autorités de l'Union européenne et de la Russie sur les droits de l'homme sont autant d'occasions de rappeler la nécessité de respecter les engagements auxquels la Russie a souscrit dans le domaine des droits de l'homme. La Commission continue son travail d'appui aux initiatives de la société civile, notamment à travers l'initiative européenne pour la démocratie et les droits de l'homme.

L'appui à la réforme judiciaire constitue aussi une priorité dans nos programmes de coopération avec la Russie. Je suis entré en contact, lors de la dernière rencontre avec la Russie, avec les nouveaux responsables chargés de la justice, et j'ai bien l'intention de poursuivre un dialogue exigeant. Par ailleurs, l'Union européenne et la Russie négocient en ce moment une nouvelle base contractuelle afin de remplacer l'actuel accord de partenariat et de coopération.

Évidemment, le respect des droits de l'homme doit être un élément essentiel de ce nouvel accord. Il faut que les engagements que les parties ont pris dans le contexte de l'ONU, de l'Organisation de la sécurité et de la coopération en Europe, ou du Conseil de l'Europe, trouvent leur place; la Commission reste mobilisée dans ce sens. Mme Ferrero-Waldner m'a demandé de vous remercier d'avoir introduit ce débat et m'a confirmé son engagement personnel. J'y ajoute le mien puisque j'ai l'occasion, dans le domaine de la sécurité et de la justice, de pouvoir entretenir un dialogue avec les autorités de Moscou.

Voilà ce que je peux dire, Madame la Présidente, je souhaite que 2010 soit l'occasion pour les responsables russes de pouvoir mieux tenir leurs engagements qu'ils ne l'ont fait au cours de cette année.

  Urszula Gacek (PPE-DE), in writing. Severe human rights violations persist in the ongoing Yukos affair. Five years after Mikhail Khodorkovsky’s arrest, he and other Yukos officials remain incarcerated under questionable circumstances. Of gravest concern is the case of former Yukos lawyer Vasily Alexanyan, held in pre-trial detention since 2006. Now near death suffering from AIDS, lymphatic cancer and tuberculosis, Alexanyan has stated that he refused to submit to blackmail to provide false testimony against Khodorkovsky in exchange for medical treatment. His previously controllable medical condition therefore developed terminal complications. Even with expiry in December 2008 of the statute of limitations for the allegations against him, judicial authorities will only release Alexanyan if he pays an unconscionable bail of EUR 1.4 million. Meanwhile, Khodorkovsky has not been paroled, though eligible for release under Russian law and practice. Investigators have prepared implausible new charges against Khodorkovsky and have been holding him in pre-trial detention for nearly two years.

The handling of these and several other cases exposes deep weaknesses in Russia’s justice system. The release of these people will be a benchmark of Russia’s success combating ‘legal nihilism’. The EU-Russia Partnership and Cooperation Agreement should be contingent upon resolution of rule-of-law issues including the issue of political prisoners.

  Eija-Riitta Korhola (PPE-DE), kirjallinen. – Venäjä on Euroopan neuvoston ja Etyj:n jäsenvaltio, joka on, tai ainakin pitäisi jäsenyytensä myötä olla, täysin sitoutunut kunnioittamaan ihmisoikeuksia. Maan todellinen ihmisoikeustilanne on kuitenkin heikko. Muukalaisviha ja homofobia ovat Moskovan ihmisoikeustoimiston mukaan kasvaneet, ja johtaneet vuonna 2008 yli 100 ihmisen surmaan rodun, kansallisuuden, uskonnon ja sukupuolisen suuntautuneisuuden vuoksi. Lokakuussa Venäjän jesuiittaveljeskunnan johtaja Messmer ja ecuadorilainen pappi Betancourt murhattiin raa'asti heidän Moskovan asunnossaan. Ongelmallista on että Venäjän viranomaiset eivät käytännössä tuomitse tällaisia rikoksia.

Myös ihmisoikeuksien puolustaminen Venäjällä tarkoittaa itsensä asettamista erityisen vaaralliseen asemaan. Ihmisoikeusaktivistien tilanne on vakava huolenaihe, kuten myös vaikeudet, joita ihmisoikeuksien edistämistä ajavat kansalaisjärjestöt kohtaavat. Strasbourgissa sijaitseva Euroopan ihmisoikeustuomioistuin on käsitellyt lukuisia Venäjän kansalaisten esittämiä kanteita. Tuomioiden mukaan vakavia ihmisoikeusrikkomuksia ja Venäjän valtion viranomaisten mielivaltaa on esiintynyt monissa tapauksissa.

Näihin seikkoihin on suhtauduttava nyt vakavasti neuvoteltaessa uutta puitesopimusta, joka tarjoaa kattavan kehyksen EU:n ja Venäjän välisille suhteille. Marraskuisen EU:n ja Venäjän välisen huippukokouksen yhteydessä käynnistettyjen neuvotteluiden tulee huomioida ihmisoikeuksien, oikeusvaltion ja demokratian keskeisyys. Venäjän viranomaisia tulee myös vaatia noudattamaan kaikkia Euroopan ihmisoikeustuomioistuimen päätöksiä viiveettä.

Ihmisoikeusjuristit, jotka käsittelevät väitettyjä rikkomuksia ja samalla ottavat valtavia henkilökohtaisia riskejä tutkiessaan tapauksia, ansaitsevat suurimman kunnioituksen arvokkaasta työstään. Heille tulisi taata valtion suoja ja kansainvälisen yhteisön riittävä tuki.
