  Kristalina Georgieva, Member of the Commission. − Mr President, thank you for grounding me from air to rail now. It is my privilege to stand before Parliament to speak on this matter.

I would like to thank Parliament very much for its support for the efforts of the European Commission to control the proper implementation of the First Railway Package by Member States, which is their responsibility. The Commission, for its part, has complied with its obligations as Guardian of the Treaty by sending reasoned opinions to 22 Member States for incorrect implementation of the First Package. I can assure you that the Commission will not hesitate to take Member States which are still not complying with European legislation to the Court of Justice.

While the specific legal details of the infringement procedures are a matter between the Commission and the Member States, our services have already submitted to the Committee on Transport and Tourism, earlier this year, a complete list of all infringements. We also share the regret expressed by the committee that the level of investment in rail infrastructure remains insufficient in many Member States.

However, the Commission cannot agree with the statement that it has not sufficiently focused monitoring on the financial foundations of the railway system. The directives of the First Railway Package only prescribe that Member States have to ensure a balanced budget for the infrastructure managers over a reasonable period of time. Where the Commission has found evidence that Member States have not respected this provision, infringement procedures have been opened.

Some interest groups want to go further and think that the Commission could oblige Member States to increase investment in the railway sector in general. We might like to see this, but there is no legal base to support it. That being said, the Commission has, on several occasions, made a political appeal to Member States because we recognise the importance of investment in rail infrastructure to promote a sustainable transport system in Europe. Not very long ago there was a discussion on that question in this Chamber, in the context of the volcanic ash cloud and the implications it had for connectivity within Europe and between Europe and the rest of the world.

I note the wish that the revisions of the First Railway Package should address the question of lack of resources and powers of regulatory bodies as a priority. I can assure you that the forthcoming Commission proposals will do just that. The recast of the First Package will also contribute to clarifying principles of infrastructure access charging, in line with the request from Parliament.

On the independence of essential functions, the Commission has already made its position very clear in its communication of May 2006. Infrastructure managers must be independent from railway undertakings and railway holdings. A holding should not have operational control over its infrastructure subsidiary. Control and independence exclude each other: you cannot have both at the same time. Based on the case law of the Court of Justice, we have established clear criteria for assessing the independence of an infrastructure subsidiary from the holding company. I am therefore confident that the Commission will win this argument in the forthcoming court procedures.

The resolution also calls for the application of a reciprocity principle. However this is not a principle that we can accept in European legislation in general. Each Member State has to comply with the European directives as they stand, independently of what other Member States do. Otherwise implementation would always follow the path of the slowest Member State.

In conclusion, I acknowledge the critical view the draft resolution takes on the implementation of the First Railway Package by the Member States. I reassure you again that the Commission has done – and intends to continue to do – its job as Guardian of the Treaty.

The Commission should not be left alone in pushing for rail market opening and, ultimately, for the revitalisation of rail as a sustainable and efficient mode of transport. We count on your support to make European rail policy a full success and a contribution to getting Europe out of the present economic crisis.

  Carlo Fidanza, a nome del gruppo PPE. – Signor Presidente, onorevoli colleghi, signora Commissario, è innegabile che sull'attuazione del primo pacchetto ferroviario si è perso troppo tempo. Come è noto, le tre direttive sono state adottate nel 2001 e la trasposizione nelle legislazioni nazionali era prevista entro il 15 marzo del 2003.

In vista della revisione del primo pacchetto ferroviario, voglio soffermarmi, oltre che sul tema degli investimenti che la signora Commissario ha giustamente citato, su tre concetti che ritengo essenziali per una corretta implementazione del primo pacchetto, tre concetti che la Commissione dovrebbe a mio avviso tenere in considerazione.

In primo luogo, tra le varie difficoltà che sono emerse in questi anni, sono emersi degli aspetti da chiarire sulle diverse interpretazioni giuridiche in materia di indipendenza dei gestori delle infrastrutture. Io ritengo, signora Commissario, che si possa avere ancora qualche maggiore chiarimento su questo tema, perché è stato uno degli ostacoli che abbiamo riscontrato in questi anni, e spero che si possa giungere, in occasione del recast del primo pacchetto, a una interpretazione finalmente univoca.

In secondo luogo, sono convinto che il completamento della liberalizzazione del mercato ferroviario debba essere visto come la priorità assoluta per tutti gli Stati membri. Come ben sappiamo, a parole tutti sono favorevoli alla liberalizzazione ma poi ben pochi sono disposti a sperimentarla a casa propria. Per queste ragioni, la piena attuazione del primo pacchetto è una condizione essenziale per il raggiungimento di questo risultato. Chiedo quindi alla Commissione di intensificare la sua azione in questo senso.

Infine, non è più pensabile che soggetti che operano in regime di monopolio assoluto all'interno dei propri confini nazionali possano sfruttare questo vantaggio competitivo a danno di aziende concorrenti nei paesi che hanno aperto il proprio mercato interno. Per questa ragione, condividendo l'obiettivo strategico della liberalizzazione, noi crediamo – lo abbiamo anche inserito insieme al collega Grosch nel testo della risoluzione che voteremo domani – che si debba affermare e applicare il principio della reciprocità che oggi è necessario in attesa di completare l'apertura del mercato.

  Saïd El Khadraoui, namens de S&D-Fractie. – Voorzitter, commissaris, als we het marktaandeel van de spoorwegen bekijken over de laatste twintig jaar, dan stellen we een daling vast en een zekere stabilisering op ongeveer 10% inzake goederenvervoer. Als we daaraan willen werken, moeten we natuurlijk een hele reeks maatregelen nemen. Het gaat niet alleen over marktwerking, het gaat onder meer ook over technische interoperabiliteit, versterking van het Europees Spoorwegagentschap en een oplossing voor de financiering van nieuwe infrastructuur, maar ook het onderhoud van bestaande infrastructuur.

Het is duidelijk dat een efficiënte marktwerking ook een onderdeel is van het verhaal. Het eerste spoorwegpakket wenste daartoe bij te dragen. We hebben dat goedgekeurd in 2001. Dat had moeten worden omgezet tegen maart 2003 en nu, zeven jaar later, stellen we vast dat 22 landen eigenlijk niet in regel zijn en dat onvoldoende hebben omgezet. Dat is uiteraard onaanvaardbaar en de Commissie heeft ook te lang gewacht om echt te reageren.

Drie zaken zijn heel belangrijk. We hebben behoefte aan een onafhankelijk regelgevend orgaan dat voldoende middelen heeft om goede marktwerking op te leggen en te doen toepassen. Ten tweede is er natuurlijk de onafhankelijkheid van de infrastructuurbeheerder - daar werd al naar verwezen - die een gelijk speelveld kan scheppen voor alle spelers. En ten derde moet ook grondiger worden gekeken naar de hoogte van de infrastructuurheffingen. Wat dat betreft, moeten we ook eens kijken naar en een vergelijking maken met de kostenstructuur in andere transportmodi om zo tot een eerlijk speelveld te komen over alle transportmodi heen. Maar dat is een heel ander verhaal.

Wat de verdere liberalisering betreft, moeten we ons nu focussen op het goederenvervoer en een correcte toepassing van het eerste spoorwegpakket. Voor het nationaal reizigersvervoer, dat velen graag geliberaliseerd willen zien, wil ik toch heel voorzichtig zijn. Ik pleit er vooral voor om het volgende voor ogen te houden: in elke omstandigheid een goede publieke dienstverlening op een hoogwaardig niveau, een uitgebreid, efficiënt en comfortabel spoorvervoer voor alle mensen, eerder dan puur liberalisering als doelstelling op zichzelf.

  Gesine Meissner, im Namen der ALDE-Fraktion. – Herr Präsident, Frau Kommissarin! Sie sind jetzt von der Luft zur Bahn gekommen, das ist unser zweites Thema heute Abend. Ich muss sagen, es ist häufig so in der Politik, dass man schöne Worte hat, aber dass die Taten dann zu wünschen übrig lassen. Das haben wir in diesem Fall auch.

Wir haben ohnehin bei der Europäischen Union viele tolle Ziele. Einiges haben wir schon erreicht, und einiges ist noch gar nicht erreicht. Gerade was den europäischen Binnenmarkt im Verkehr, insbesondere im Eisenbahnverkehr, angeht, da ist noch Vieles nicht erreicht. Wir hatten Vorsätze, und man muss sich fragen: Ist die Europäische Union vielleicht ein zahnloser Tiger? Oder haben wir vielleicht nicht die richtige „Verkaufe“, wie man auf Deutsch so schön sagt, um das, was wir wollen, näherzubringen? Es ist bis jetzt so, dass der Wettbewerb im Eisenbahnmarkt sehr unterschiedlich stattgefunden hat. Unabhängigkeit wollen wir für eine Regulierungsbehörde. In Deutschland hat es in diesem Fall mit unserer Bahn sogar ganz gut funktioniert, aber das heißt ja trotzdem nicht, dass das das Optimale ist. Wir brauchen wirklich eine Möglichkeit, unabhängig die Trassen verteilen zu können, damit es vernünftig läuft und der Wettbewerb wirklich stattfinden kann. Das ist die eine Sache.

Dann ist es natürlich beschämend für uns, dass von den 27 Mitgliedstaaten nur das Vereinigte Königreich, Finnland und die Niederlande es umgesetzt haben, zwei, die keine Eisenbahn haben – Malta und Zypern –, konnten natürlich auch nichts umsetzen. Alle anderen haben ihre Schularbeiten nicht gemacht und sind ganz offensichtlich gut damit gefahren, weil wir sie nicht ermahnt haben. Darum ist es ganz wichtig, dass die Europäische Union tatsächlich entsprechende Sanktionsmechanismen ergreift, denn sonst werden wir nicht ernst genommen. Es ist auch wichtig, den Mitgliedstaaten klar zu machen, dass doch alle davon profitieren. Alle wollen im Prinzip die Öffnung des Eisenbahnmarkts für den Wettbewerb, alle sagen das. Aber wenn dann die Taten folgen sollen, dann bleibt es im Ungefähren.

Wir müssen durchaus vorankommen, was die Finanzen angeht. Zuletzt haben wir gerade in Saragossa festgestellt, dass es überall an Geld fehlt. Und unsere Aufgabe könnte es sein, grenzüberschreitende Projekte zu fördern, und wir müssen natürlich an die Mitgliedstaaten appellieren, mehr zu tun. Wir wissen im Moment, dass es überall schwierig ist, aber Europa braucht das.

  Michael Cramer, im Namen der Verts/ALE-Fraktion. – Herr Präsident, Frau Kommissarin, meine lieben Kolleginnen und Kollegen! Das erste Eisenbahnpaket musste schon im März 2003 umgesetzt sein. 22 Mitgliedstaaten haben das aber bis heute nicht getan. Erst im Juni 2008 wurde die Kommission tätig. Deshalb eine scharfe Rüge des Europäischen Parlaments für die 22 Mitgliedstaaten, aber auch für die Kommission, die Hüterin der Verträge!

Notwendig sind die Unabhängigkeit der Regulierungsstellen und die Trennung von Netz und Betrieb. Die Trassenpreise müssen fair, gerecht und transparent sein. Dazu ein Beispiel aus meinem Heimatland Deutschland: In Berlin sind die Trassenpreise für die S-Bahn doppelt so hoch wie in Hamburg. Und in Hamburg sind sie doppelt so hoch wie im Rhein-Main-Gebiet. Das ist weder fair, noch gerecht und auch nicht transparent – das ist die reine Willkür, und hier müssen Sie tätig werden! Notwendig ist die Öffnung der Netze und auch die Reziprozität. Es darf nicht sein, dass man Schienenunternehmen zuhause vor dem Wettbewerb schützen kann, in anderen Ländern aber daran teilnimmt. Auch hier ist die Kommission als Hüterin der Verträge aufgefordert, das geltende Recht durchzusetzen.

Notwendig ist aber nicht nur der faire Wettbewerb auf der Schiene. Der unfaire Wettbewerb mit Straßen- und Luftverkehr muss unverzüglich beendet werden. So muss für jede Lokomotive auf jedem Schienenkilometer eine in der Höhe unbegrenzte Maut erhoben werden, auf der Straße ist die Maut eine freiwillige Angelegenheit der Mitgliedstaaten, in der Höhe begrenzt und gilt nur auf Autobahnen für Lkw ab 12 Tonnen. In der Slowakei gibt es die höchste Maut auf der Schiene und gar keine auf der Straße. Das fördert die Verlagerung, aber in die falsche Richtung.

Fatal sind auch die Subventionen für den Klimakiller Luftverkehr, obwohl die Emissionen in der Stratosphäre für das Klima drei- bis viermal so gefährlich sind wie auf dem Boden. Die europäische Umweltagentur beziffert die Subventionen für den Luftverkehr auf mehr als 30 Milliarden Euro jedes Jahr. Während die Diesellok den Sprit versteuern muss, ist Kerosin davon befreit. Im internationalen Verkehr wird für die Bahn eine Mehrwertsteuer erhoben. Beim Luftverkehr verzichten die Staaten darauf. Beim Emissionshandel bekommen die Fluggesellschaften 85% der Zertifikate geschenkt, der Bahnstrom muss sie zu hundert Prozent käuflich erwerben.

Das alles ist doch verrückt, und das muss sich ändern! Um das Klima zu retten und die Mobilität zu sichern, brauchen wir fairen Wettbewerb. Nicht nur innerhalb des Schienensektors, sondern auch zwischen den unterschiedlichen Transportarten. Die Kommission als Hüterin der Verträge hat viel zu tun. Packt sie es an, ist ihr die Unterstützung des Europäischen Parlaments sicher!

  Jacky Hénin, au nom du groupe GUE/NGL. – Monsieur le Président, la liberté de se déplacer est un droit essentiel pour chacun des citoyens européens. Pour que ce droit puisse vivre, il est indispensable de pouvoir accéder à des transports sécurisés de qualité, écologiques, financièrement accessibles à tous. Cela passe par un service public du transport ferroviaire performant, desservant tous les territoires, bien maillé et interconnecté. Ceci implique des entreprises ferroviaires intégrées, de propriété publique, pour pratiquer à la fois la péréquation entre territoires et services et la coopération au niveau européen. Ceci implique que l'on considère les voyageurs comme des usagers citoyens ayant des droits et non uniquement comme des clients dont seule l'épaisseur du portefeuille compte.

Malheureusement, la Commission, le Conseil et la majorité de ce Parlement ont choisi dogmatiquement de faire du transport ferroviaire non pas un instrument de liberté, mais un bien comme les autres, livré au marché et à la concurrence. On a cassé les sociétés ferroviaires nationales en séparant infrastructures et services de transport, voyageurs et fret, exploitation et sécurité. On a interdit les subventions croisées qui permettaient la péréquation territoriale et de service. On a poussé la bêtise jusqu'à dépenser des millions d'euros pour que les locomotives, qui pouvaient tracter indifféremment un train de fret ou de voyageurs, ne puissent plus le faire.

Le bilan est accablant: dégradation de la qualité du service et augmentation des prix pour les usagers, fermetures de lignes, infrastructures qui tombent en ruine, et surtout, une baisse importante du niveau de sécurité. Quand vous séparez infrastructures et services, lorsqu'a fortiori, vous confiez la responsabilité de la sécurité à une troisième entité, vous prenez des risques avec la vie des utilisateurs. Les accidents parfois mortels se sont multipliés ces dernières années. C'est l'une des terribles conséquences logiques de votre politique irresponsable.

Avec les paquets ferroviaires, au lieu de moderniser les chemins de fer en Europe et de leur donner les moyens de leurs ambitions, on a désorganisé ce mode de transport pour le lancer dans une concurrence stupide avec l'aérien, injuste et inégale avec la route, au détriment de la cohérence des réseaux et du développement des dessertes de proximité. Grâce à votre paquet, hormis les LGV, on circule maintenant moins vite sur les réseaux ferroviaires français qu'il y a cent ans. On nous avait promis que la concurrence ferait baisser les prix, c'est tout le contraire qui se passe. La concurrence provoque, comme dans le secteur de l'énergie, une forte augmentation des prix pour les usagers.

Pour terminer, je vous donnerai un dernier exemple. La SNCF, premier consommateur français d'électricité, achetait son énergie à EDF à un tarif spécifique. Mais pour mettre en place la concurrence ferroviaire, la Commission oblige la France à légiférer pour qu'en juin 2011, la SNCF paie 25 % plus cher sa facture d'électricité. Merci la Commission, merci la concurrence. En pleine crise, les demandeurs d'emploi et les familles vont payer leurs tickets de train beaucoup plus cher.

  Antonio Cancian (PPE). - Signor Presidente, onorevoli colleghi, signora Commissario, io credo che sia da quasi vent'anni che si parla della revisione di questo pacchetto ferroviario e credo che questo sia proprio un esempio da non seguire.

Ieri il Parlamento ha approvato la rete ferroviaria europea per un trasporto merci competitivo, con l'obiettivo di migliorare la circolazione lungo le principali tratte europee. La libera circolazione deve essere garantita attraverso l'abbattimento di tutti i tipi di barriere, fisiche ma anche amministrative, e dobbiamo assolutamente rendere il mercato libero sotto il profilo delle barriere, sotto il profilo della semplificazione delle procedure e sotto il profilo del mercato vero e proprio nella reciprocità. Questa parola è stata ricordata in molti degli interventi che mi hanno preceduto.

Io sono convinto che la separazione della struttura dalla gestione e gli investimenti attraverso il sistema pubblico-privato siano una cosa positiva. Io immagino che tutto questo possa avvenire nella trasparenza in un mercato libero e che possa permettere a tutti di poter arrivare a far sì che si entri in un mercato che oggi ha estremamente bisogno.

Soprattutto in questo momento di difficoltà economiche o finanziarie, io credo che per gli investimenti l'Europa farebbe bene a stanziare e ad avviare anche dei fondi appositi per tirare e sollecitare il privato a investire e a recuperare il tempo perduto, naturalmente il tutto nella sicurezza e nella protezione e nella salvaguardia dell'ambiente. Questi aspetti vanno assolutamente salvaguardati. Però è tempo che la Commissione oggi dia delle risposte chiare a queste nostre domande.

  Brian Simpson (S&D). - Mr President, Members will recall a previous debate in this Chamber in which I, as chairman of the Committee on Transport, highlighted the lamentable record of Member States in implementing the First Railway Package. This resolution is a follow-up to that debate and proves, I hope, to the other institutions that Parliament not only expects the Member States to implement what they agreed to back in 2001, but also expects the Commission to use its legal powers to ensure that this happens.

The first Railways Directive, as Mr Fidanza said, should have been transposed by Member States in March 2003. The fact that 22 states have failed to do this shows a lamentable effort on the part of the Member States and, despite what the Commission says, a pretty poor and slow effort at protecting EU law by the Commission. This failure reminds us of the many obstacles that still remain when attempting to revitalise Europe’s rail sector and the rhetoric that often emanates from both inside and outside the rail industry.

Indeed this very week we have seen one country and its major rail company lobbying hard against Mr Marinescu’s report. Thankfully, they failed miserably, but yet again it highlights to us that certain rail companies and certain Member States are more concerned with self-interest rather than European interests.

I believe the Transport Committee is running out of patience with the lack of progress on this dossier. This lack of progress is slowly strangling the ability of European railways to compete effectively and the long list of infringement proceedings taken out against Member States simply serves to reinforce the urgency of taking action. We need a true European perspective for our railway network and this can only be achieved if all the different actors are fully committed to that goal.

We expect the Council to deliver on their agreements, and we expect the Commission to ensure that they do. The Commissioner has given us some assurances tonight, but it is action that we want to see. Today is Mr Cramer’s birthday, and I hope that we can deliver this package in his and all of our lifetimes!

  Γεώργιος Τούσσας (GUE/NGL). - Κύριε Πρόεδρε, οι σιδηρόδρομοι αποτελούν χαρακτηριστικό παράδειγμα ξεπουλήματος του δημόσιου λαϊκού πλούτου και παράδοσής του στα χέρια των μονοπωλίων.

Η επιβράδυνση της εφαρμογής της ιδιωτικοποίησης των σιδηροδρόμων και της ολοκλήρωσης της πρώτης φάσης της απελευθέρωσης στις περισσότερες χώρες της Ευρωπαϊκής Ένωσης είναι αποτέλεσμα των εργατικών λαϊκών αγώνων αλλά και των οξυμένων ενδοϊμπεριαλιστικών αντιθέσεων για το ποιο από τα μονοπώλια θα πάρει μεγαλύτερο κομμάτι των σιδηροδρομικών μεταφορών.

Οι εξελίξεις στις σιδηροδρομικές μεταφορές στο Ηνωμένο Βασίλειο, στη Γαλλία, τη Γερμανία, την Ελλάδα και σε άλλα κράτη μέλη της Ευρωπαϊκής Ένωσης επιβεβαιώνουν τις εκτιμήσεις μας. Οι ελληνικοί σιδηρόδρομοι περικόπτουν τα δρομολόγιά τους στο όνομα της εξυγίανσης και στα πλαίσια των δεσμεύσεων που προκύπτουν από το μνημόνιο της κυβέρνησης του ΠΑΣΟΚ με την Ευρωπαϊκή Ένωση, την Ευρωπαϊκή Κεντρική Τράπεζα, το Διεθνές Νομισματικό Ταμείο αφαιρώντας το δικαίωμα της μετακίνησης σε κατοίκους και της μεταφοράς προϊόντων σε πολλές περιοχές της Ελλάδας, υποβαθμίζοντας τις δυνατότητες ανάπτυξης της χώρας.

Η υπερχρέωση του ΟΣΕ προκλήθηκε από την αντιλαϊκή πολιτική της Ευρωπαϊκής Ένωσης και των κυβερνήσεων του ΠΑΣΟΚ και της Νέας Δημοκρατίας, τον εκφυλισμό του δημόσιου χαρακτήρα του σιδηροδρόμου και τη μετατροπή του σε παράδεισο ιδιωτικών εργολαβικών συμφερόντων, χρυσοφόρο τομέα για την αύξηση των κερδών των μονοπωλιακών επιχειρηματικών ομίλων που λεηλάτησαν τον ΟΣΕ.

Σήμερα η κυβέρνηση του ΠΑΣΟΚ ετοιμάζεται να ξεπουλήσει τα φιλέτα του ΟΣΕ, να παραχωρήσει τις εκτάσεις του στο Θριάσιο και άλλες υποδομές στα λιμάνια της Ελευσίνας, του Πειραιά, της Θεσσαλονίκης και να επιδοτήσει τις επιχειρήσεις για τις άγονες σιδηροδρομικές γραμμές εφαρμόζοντας την πολιτική των ιδιωτικοποιήσεων της Ευρωπαϊκής Ένωσης, τις δεσμεύσεις που έχει αναλάβει στα πλαίσια του μνημονίου.

Το μεγάλο κεφάλαιο αντιμετωπίζει την κρίση σαν μια νέα ευκαιρία για να εξασφαλίσει και αύξηση των κερδών του από την ένταση της εκμετάλλευσης των εργαζομένων και των φυσικών πόρων και το ξεπούλημα της λαϊκής δημόσιας περιουσίας.

Το ξεπούλημα του Οργανισμού Σιδηροδρόμων Ελλάδας περιλαμβάνει πακτωλό κρατικών επιδοτήσεων σε μεγάλους επιχειρηματικούς ομίλους, αύξηση των ατυχημάτων, μαζικές απολύσεις και σαρωτικές αλλαγές σε εργασιακά, ασφαλιστικά και συνταξιοδοτικά δικαιώματα των εργαζομένων.

Oι μεταφορές, το σύνολο των υποδομών, όπως και άλλοι στρατηγικοί τομείς της οικονομίας πρέπει να είναι λαϊκή περιουσία και να λειτουργούν προς όφελος της εργατικής τάξης και των λαϊκών στρωμάτων.

  Georges Bach (PPE). - Herr Präsident! Sehr geehrte Frau Kommissarin! Diese Entschließung ruft die Kommission auf, das Ziel eines der europäischen Regelwerke für den Schienenverkehr – die Schaffung eines freien grenzüberschreitenden und europaweiten Eisenbahnmarktes – mit größerem Einsatz voranzutreiben. Ich möchte allerdings an dieser Stelle darauf hinweisen, dass die Ursache für die mangelnde Umsetzung der bestehenden Richtlinie nicht ausschließlich der fehlende Wille der Mitgliedstaaten ist, sondern auch rechtliche Unklarheiten bestehen.

Einige Länder haben zum Beispiel beim Infrastrukturbetreiber nationale Lösungen gefunden, die der Öffnung des Marktes nicht im Wege stehen und die Berücksichtigung finden sollten. Die materielle Realität auf dem Terrain, insbesondere die fehlende technische Harmonisierung zwischen den Mitgliedstaaten, aber auch die verschiedenen Sicherheitssysteme beim Zugmaterial erschweren auch heutzutage noch einen problemlosen grenzübergreifenden Verkehr.

Ein Aspekt, der in meinen Augen bei der Auswertung, bei der Neufassung bisher zu kurz gekommen ist, ist der soziale Aspekt. Hier muss der Aus- und Weiterbildung und den Arbeitsbedingungen, den Vorschriften für die Kontrollen usw. der Eisenbahner unbedingt Rechnung getragen werden.

Ein anderes ernst zu nehmendes Hindernis sind die Infrastrukturengpässe, die so genannten bottlenecks an den Grenzen. Hier besteht noch sehr viel Nachholbedarf, um den grenzüberschreitenden Verkehr auf Dauer zu stärken. Ein konkretes Beispiel hierfür ist die Strecke von Deutschland nach Luxemburg. Seit Jahren wird darüber diskutiert, die Infrastruktur zu erweitern, aber mangels konkreten politischen Willens und wirtschaftlicher Prioritäten auf einer Seite der Grenze ist dies immer noch nicht zustande gekommen.

Ich möchte die Kommission auffordern, mit dem gleichen Nachdruck, wie sie den Wettbewerb vorantreibt, auch die anderen Aspekte, die technische Harmonisierung und den Infrastrukturausbau, voranzutreiben.

  Silvia-Adriana Ţicău (S&D). - Uniunea Europeană are nevoie de un sistem de transport transeuropean intermodal, sustenabil şi eficient, iar dezvoltarea transportului feroviar este prioritară. Solicităm statelor membre să acorde un sprijin mai mare transportului feroviar, inclusiv prin alocarea resurselor financiare necesare întreţinerii şi modernizării infrastructurii de cale ferată şi a materialului rulant.

Procesul de liberalizare a transportului feroviar a început. Deschiderea pieţelor în domeniul transportului feroviar nu trebuie însă să se facă în detrimentul calităţii serviciilor de transport feroviar. Siguranţa transportului feroviar şi respectarea drepturilor pasagerilor sunt esenţiale pentru ca acesta să dobândească o cotă mai mare de piaţă în totalul transportului terestru.

Pentru respectarea acestui deziderat, resursele umane sunt esenţiale şi, de aceea, solicit Comisiei ca, la următoarea revizuire a pachetului feroviar, să aibă în vedere includerea unor clauze sociale care să asigure standarde europene solide pentru condiţiile de lucru, astfel încât schemele de securitate socială, în vigoare la nivel naţional în statele membre, să fie implementate de către toţi operatorii şi administratorii de infrastructură din sectorul feroviar.

  Jaroslav Paška (EFD). - Hovoríme o implementácii prvého železničného balíka v krajinách Európskej únie. Konštatujeme, že hoci smernice upravujúce pravidlá železničnej dopravy mali byť implementované už v roku 2003, do dnešného dňa ich nezapracovalo do národnej legislatívy 22 krajín.

Vážená pani komisárka, nebolo by dobré zamyslieť sa nad tým, či pravidlá zavedené prvým železničným balíkom sú dobré, ak ich väčšina členských krajín odmieta aplikovať? Nebolo by správne, keby ste sa na túto tému stretli s ministrami dopravy členských štátov, aby ste sa dozvedeli, aké sú dôvody tohto stavu? Možnože v takomto pragmatickom dialógu dokážeme problém implementácie prvého železničného balíka úspešne posunúť dopredu v záujme zlepšenia podmienok železničnej dopravy celej Európy.

  Kristalina Georgieva, Member of the Commission. − Mr President, I would like to thank the Parliament again for this very useful engagement on an issue which is actually quite emotional from time to time, because we all want to see an integrated European railway system in our lifetime. Hopefully we will all live long enough to do so.

In the past I was engaged in the restructuring of railways in two countries that are now EU Member States. I know how very difficult it is to move forward a system that has long traditions and an enormous amount of vested interests surrounding it. Yet I think we all need to persevere because an integrated and highly efficient railway system is absolutely essential for the well-being of Europeans and also for the competitiveness of our region.

We, in the Commission, take your comments very seriously and we will continue to work to move forward on the initiatives that require success in this area. I do not think it is a paper tiger if we judge by the number of infringement procedures.

Why has it taken so long? It has taken so long because there has been a process of engagement with Member States. There was also an enlargement that brought new elements into the system and there has been an attempt by the Commission to make this engagement meaningful – in other words to send serious questionnaires, to analyse the responses carefully and then to follow up with Member States. So the result has legs, and bites!

Infringement procedures are not an objective in itself. What we are aiming at is a well-functioning railway market able to provide more numerous, safer, consumer-oriented services to our citizens and our undertakings. With this in mind, the recast of the first railway package will be designed to simplify and clarify the existing provisions with a view to facilitating their implementation, but also to modernise them.

I would like to make two points in response to comments and questions put to us. One is on the level of safety. The data is categorical that the level of safety has actually increased since the market was opened but, since we are talking about people’s lives, even if we have one accident it is one too many, so obviously we need to strive to increase this level of safety.

Since in two comments a question was posed regarding the imposition of public service obligations, I would like to clarify that the first package is not an obstacle to that. These obligations are regulated under separate legislation and therefore pursuing them is a possibility.

Many Members spoke about strategy and directions. I will share with the Parliament our three main priorities – and they reflect many of the comments that have already been made. Firstly, improving market access conditions and making them more transparent and non-discriminatory, secondly establishing a regulatory framework, fostering both public and private investments in the rail sector and, thirdly – something that many of you spoke about – reinforcing the regulatory supervision of the rail market to ensure fair competition between the operators and, ultimately, lower costs for those who use the service.

The Commission will engage the Ministers in dialogue on these matters, in the permanent form of Ministers of Transport. The rail sector has been a focus of attention and we will make sure that it remains so and actually expands its presence on their agenda. We will soon adopt the recast proposal so it may be tabled in Parliament by September and we look forward to a very fruitful cooperation with you on the forthcoming legislative process, and certainly to visible and tangible results within our lifetime.

  Artur Zasada (PPE), na piśmie. – W kontekście dzisiejszej debaty należy zauważyć, że w poszczególnych państwach członkowskich koleje działają w różnych uwarunkowaniach. Pierwszy „pakiet Kolejowy” przyjęty został w 2001 r. i można założyć, iż był przygotowany głównie pod względem sytuacji na rynkach kolejowych krajów UE-15. Natomiast sytuacja kolei w nowych państwach członkowskich była i jest bardzo różna – szczególnie w kontekście tzw. architektury finansowej, tj. właściwego finansowania infrastruktury, umów wieloletnich pomiędzy państwem a zarządcą infrastruktury, długów historycznych czy finansowania usług o charakterze publicznym. W pierwszej kolejności należy zapewnić równe warunki działania kolei i egzekwowanie przepisów o właściwym finansowaniu systemu kolejowego, co ma fundamentalne znaczenie dla rozwoju tej gałęzi transportu.
