Betrifft: Sandzak von Novi Pazar
Wie beurteilt der Rat die aktuelle politische, wirtschaftlich-soziale und menschenrechtliche Lage im serbischen Sandzak von Novi Pazar mit seinen gravierenden Minderheitenproblemen?

Le Conseil n'a pas discuté de la situation dans la région serbe du Sandzak et ne peut pas s'exprimer sur cette question.
Cependant, l'Accord de Stabilisation et d'Association (ASA) dont la ratification est en cours prévoit que la Serbie et l'UE s'attachent à renforcer leur coopération en matière de développement régional et local, en vue de contribuer au développement économique et de réduire les déséquilibres régionaux. Une attention particulière est accordée aux coopérations transfrontalière, transnationale et interrégionale.
Permettez moi d'ajouter que l'ASA établi également une coopération économique étroite, y compris l'établissement d'une zone de libre-échange et une coopération financière qui tient dûment compte des domaines prioritaires de l'acquis communautaire en matière de développement régional.
Le Conseil a affirmé à maintes reprises qu'il soutient pleinement la perspective européenne de la région, y compris la Serbie, qui demeure essentielle pour la stabilité, la réconciliation et l'avenir de la région. Dans le cadre du processus de stabilisation et d'association et surtout de l'ASA dont la ratification est en cours, le Conseil soutient les efforts de la Serbie en vue de renforcer la démocratie et l'État de droit, la stabilité politique, économique et institutionnelle en Serbie, ainsi qu'à la stabilisation de la région.
Le Conseil encourage l'engagement démontré par la Serbie en faveur de l'intégration dans l'UE en engageant des réformes cruciales répondant aux normes européennes. Reconnaissant ces efforts, le Conseil a pris, récemment, des décisions importantes à l'égard de la Serbie: le 30 novembre 2009, le Conseil a libéralisé les visas et il a décidé, le 14 juin 2010, de commencer la ratification de l'Accord de Stabilisation et d'Association et, le 25 octobre 2010, d'ouvrir la procédure de l'Article 49 du TUE.
En ce qui concerne la protection des personnes appartenant à des minorités, conforment aux critères de Copenhague, le Conseil a souligné, en décembre 2009, l'importance qu'il attache à la protection de l'ensemble des minorités et a encouragé les gouvernements de pays de Balkans occidentaux, y compris le gouvernement serbe, à prendre les mesures nécessaires pour s'y atteler. Il a ajouté que la minorité rom continue d'être confrontée à des conditions de vie difficiles et à la discrimination.
Dans ses conclusions du 7/8 décembre 2009, le Conseil a rappelé que le renforcement de l'État de droit, la lutte contre la corruption et l'accélération des réformes économiques restent importants et qu'une participation constructive à la coopération régionale, y compris en matière de commerce, demeure essentielle. Il est important que le calendrier des réformes soit maintenu.
Les priorités spécifiques du partenariat européen pour la Serbie, adopté le 18 février 2008, vise aussi le droits de l'homme et la protection des minorités. Ainsi la Serbie est tenue de s'acquitter de toutes les obligations découlant de l'adhésion au Conseil de l'Europe et de garantir le respect des dispositions de la nouvelle Constitution relatives aux droits de l'homme.

Θέμα: Ανάληψη δράσης για την εφαρμογή της ρήτρας αλληλεγγύης
Τις τελευταίες μέρες, διάφορες χώρες (ΗΠΑ, Μ. Βρετανία, Αυστραλία, κ.ά.) έχουν εκδώσει επείγουσες ταξιδιωτικές οδηγίες με τις οποίες ενημερώνουν τους πολίτες τους για πιθανή απειλή τρομοκρατικής επίθεσης στα δημόσια μέσα μεταφοράς ή/και σε τουριστικά σημεία στην Ευρώπη. Με αφορμή αυτές τις εξελίξεις αναδεικνύεται η σημασία της «ρήτρας αλληλεγγύης» (ΣΛΕΕ, άρθρο 222) καθώς και η ανάγκη για τη "διαμόρφωση λεπτομερών διατάξεων για την εφαρμογή της ρήτρας με απόφαση του Συμβουλίου, αφού προηγηθεί κοινή πρόταση της Ύπατης Εκπροσώπου και της Ευρωπαϊκής Επιτροπής (άρθρο 222, παρ.3)".
Με δεδομένο ότι η βελγική Προεδρία έχει εντάξει στους στόχους του προγράμματός της την ανάληψη των απαραίτητων ενεργειών ώστε να τεθεί σε ισχύ το ταχύτερο δυνατό η «ρήτρα αλληλεγγύης», ερωτάται το Συμβούλιο: Σε ποιο στάδιο βρίσκονται οι συζητήσεις για την εφαρμογή της ρήτρας αλληλεγγύης; Έχει αναλάβει συγκεκριμένες πρωτοβουλίες προς αυτήν την κατεύθυνση και ποιο είναι το χρονοδιάγραμμα υλοποίησής τους, ιδιαίτερα μετά τις τελευταίες εξελίξεις;

La clause de solidarité est une des innovations importantes en matière de lutte contre le terrorisme introduite par le Traité de Lisbonne. Ainsi, l'article 222 paragraphe 1 TFUE précise que l'Union et ses États membres agissent conjointement dans un esprit de solidarité au cas où un État membre est l'objet d'une attaque terroriste ou victime d'une catastrophe naturelle ou d'origine humaine.
Comme le prévoit l'article 222 paragraphe 3 TFUE, le Conseil va adopter les modalités de mise en œuvre de l'article 222 après avoir reçu une proposition conjointe de la Commission et du Haut Représentant de l'Union pour les affaires étrangères et la politique de sécurité.
La Commission a annoncé le dépôt d'une proposition en 2011.

Θέμα: Ανάπτυξη και ανταγωνιστικότητα
Στην ανακοίνωση του προγράμματος της η βελγική προεδρεία έδωσε ιδιαίτερη έμφαση στη λήψη μέτρων για την αποκατάσταση της ανταγωνιστικότητας και των ρυθμών ανάπτυξης των κρατών μελών. Συγκεκριμένα, έθεσε ως βασική προτεραιότητα την αποκατάσταση της εμπιστοσύνης των αγορών στο κοινό νόμισμα και στις οικονομίες της ευρωζώνης, μέσω της προώθησης ισχυρών θεσμικών μεταρρυθμίσεων.
Δεδομένου ότι σε ένα περίπου μήνα ολοκληρώνεται η βελγική προεδρεία, θα μπορούσε ο υπουργός να μας ενημερώσει για την πορεία υλοποίησης των πρωτοβουλιών και του προγράμματος της Προεδρίας στον τομέα της ανάπτυξης και την ανταγωνιστικότητας;
Ποιες οι εκτιμήσεις του Συμβουλίου για την αναπτυξιακή τροχιά των ευρωπαϊκών κρατών, ιδίως εκείνων που πλήττονται από την οικονομική κρίση, για το προσεχές διάστημα;

La crise économique et financière, qui a débuté en 2008, a eu pour effet une diminution importante du nombre d'emplois et de la production potentielle, et a entraîné une grave détérioration des finances publiques.
Sur ce fond de crise, le Conseil européen de juin 2010 a adopté la stratégie Europe 2020, qui ambitionne de garantir une croissance intelligente, durable et inclusive, comme en témoignent ses objectifs, visant notamment l'emploi, la recherche et le développement, les énergies renouvelables et l' efficacité énergétique, l'abandon scolaire et la réduction de la pauvreté.
Sous présidence belge, au mois de juillet le Conseil a adopté les grandes orientations de politique économique qui mettent en œuvre la stratégie de l'Europe 2020 visant à améliorer la compétitivité via des réformes structurelles.
Parallèlement, le Conseil a entamé l'examen de certains éléments structurels tels que les cadres fiscaux, l'efficacité de l'éducation comme facteur de croissance et la soutenabilité des pensions.
Le 21 octobre 2010 le Conseil a en outre adopté les lignes directrices pour les politiques de l'emploi, afin de donner aux États membres des orientations précises concernant l'élaboration de leurs programmes nationaux de réforme et leur mise en œuvre, en tenant compte de leur interdépendance et dans le respect du pacte de stabilité et de croissance.
En matière de gouvernance économique, le Conseil européen des 28 et 29 octobre 2010 a fait sien le rapport du groupe de travail sur la gouvernance économique et a demandé qu'une approche rapide soit suivie pour l'adoption des actes de droit secondaire que requiert la mise en œuvre de nombreuses recommandations, ce qui renforcera la confiance et contribuera, par conséquent, à une croissance durable, à l'emploi et à la compétitivité. Aussi, enfin d'assurer une croissance équilibrée et durable, les chefs d'Etat ou de gouvernement sont convenus que les États membres doivent établir un mécanisme permanent de gestion de crise pour préserver la stabilité financière de la zone euro dans son ensemble.
En ce qui concerne l'évolution de la croissance, le Conseil ne fait pas d'estimations. Selon le dernier rapport intérimaire de la Commission, une croissance de 1,8% pour l'UE et de 1,7% pour la zone euro est prévue en 2010.

Subject: Single Farm Payment
Can the Council ensure that any changes to the Single Farm Payment do not have sudden adverse effects on older farmers who depend on that payment?

Dans la Communication "La Politique agricole commune à l'horizon 2020(1)" qu'elle vient d'adopter, la Commission fait référence à l'option d'une révision du régime des paiements directs dans le cadre de la future PAC après 2013.
En juin 2009 le Conseil a pris note des conclusions de la Présidence, soutenue par un nombre de délégations, qui avaient estimé que pour que l'agriculture puisse relever les défis après 2013, tout futur régime des paiements directs devra être juste et légitime, efficace, simple à mettre en œuvre, suffisamment souple, et facile à justifier et à expliquer.
En outre, le Conseil a bien pris note de la position exprimée par le Parlement européen dans sa Résolution sur l'avenir de la PAC, adoptée le 8 juillet dernier, et en particulier de sa recommandation d'établir, en vue d'une distribution équitable des fonds de la PAC aux agriculteurs de toute l'Union, des critères justes, clairs et objectifs pour la mise en place d'un système de répartition juste qui respecte la diversité de l'agriculture européenne.
J'attire l'attention de l'Honorable Parlementaire sur le fait que ce n'est que lundi prochain, 29 novembre, que le Commissaire Dacian Cioloş viendra présenter sa Communication au Conseil.
La Présidence belge accorde une grande importance à cette question, raison pour laquelle elle a planifié un débat politique lors de la session du Conseil des 13-14 décembre 2010.
Cependant, le Conseil ne pourra se prononcer sur les détails de la question de la distribution équitable des paiements directs que sur la base des propositions législatives que la Commission devrait soumettre au Conseil et au Parlement européen en juillet 2011.
C'est à ce moment là que le Parlement européen et le Conseil seront appelés à décider, dans le cadre de la procédure législative ordinaire.

Tema: Nelegalus darbas Europos Sąjungoje
Pirmininkaujančios Belgijos programoje iškeliami tikslai, jog pagal 2020 metų strategiją valstybės narės turėtų įgyvendinti reformas, kuriomis būtų siekiama pažangos, tvaraus bei skaidraus ekonomikos augimo.
Valstybės narės vis dar neišvengiamai susiduria su nelegaliu darbu, nesąžininga konkurencija verslo rinkoje. Darbo rinkoje darbuotojai yra išnaudojami, jie dažnai netenka savo socialinių garantijų, be to, neretai jie priversti imtis šešėlinio darbo.
Didelio nedarbo sąlygomis darbdaviai negali rasti tinkamų darbuotojų, nes nedarbo išmoka panaši į siūlomą atlygį. Pasitaiko net ir tokių situacijų, kai žmonės verčiau dirba nelegaliai, kadangi taip nepraranda darbo biržos paslaugų ir išmokų. Todėl žmonės dažniausiai renkasi parankesnį variantą. Valstybių narių metinių biudžetų užsibrėžti tikslai nėra įgyvendinami, nes nėra surenkamos planuotos valstybių biudžetų pajamos.
Ar pirmininkaujanti Belgija imsis priemonių ir ar numačiusi konkrečius pasiūlymus, kaip valstybėse narėse kovoti su nelegaliu, šešėliniu darbu?

Alors que l'article 3, paragraphe 3, du traité UE dispose que l'Union tend au plein emploi, l'article 147 du TFUE dispose que l'Union contribue à la réalisation d'un niveau d'emploi élevé en encourageant la coopération entre les États membres et en soutenant et, au besoin, en complétant leur action. Ce faisant, elle respecte pleinement les compétences des États membres en la matière.
À ce jour, la Commission n'a soumis aucune proposition législative pour soutenir ou compléter l'action des États membres visant à lutter contre le travail non déclaré des citoyens de l'Union européenne.
Toutefois, le 21 octobre 2010, sous la présidence belge, le Conseil a adopté les lignes directrices pour les politiques de l'emploi des États membres; ceux-ci devront les transposer dans leurs politiques nationales par l'intermédiaire des programmes nationaux de réforme. Ces lignes directrices visant, notamment, à réduire le chômage structurel et à améliorer la qualité des emplois, on peut considérer qu'elles sont conçues pour dynamiser l'emploi déclaré et régulier.
En ce qui concerne la question des ressortissants de pays tiers en séjour irrégulier, le Conseil a reconnu l'importance d'un renforcement des mesures destinées à lutter contre l'emploi de ces personnes pour combattre l'immigration clandestine et le travail non déclaré. Cet objectif, à savoir combattre l'immigration illégale en réduisant le facteur d'attraction que constituent les possibilités d'emploi, ne pouvant pas être atteint de manière suffisante par les États membres, le Parlement européen et le Conseil ont adopté, le 18 juin 2009, la directive 2009/52/CE prévoyant des normes minimales concernant les sanctions et les mesures à l'encontre des employeurs de ressortissants de pays tiers en séjour irrégulier. Cette directive a pour objectif de combattre l'immigration illégale en réduisant le facteur d'attraction que constituent les possibilités d'emploi, objectif dont les deux institutions sont convenues qu'il ne pouvait pas être réalisé de manière suffisante par les États membres et qu'une directive européenne était donc nécessaire. Pour ce qui est des sanctions, elles devraient notamment comprendre la contribution de l'employeur aux frais de retour des ressortissants de pays tiers employés illégalement, ces sanctions pouvant être réduites lorsque l'employeur est une personne physique qui emploie un ressortissant de pays tiers en séjour irrégulier à ses fins privées. Au chapitre des mesures sont notamment prévues des procédures simplifiées pour les employeurs, pour permettre aux États membres de vérifier la validité des autorisations de séjour ou détecter les documents falsifiés. Les États membres sont tenus de prendre les mesures nécessaires pour satisfaire aux dispositions de cette directive pour le 20 juillet 2011.

Subject: End of the recession
With economic activity beginning to pick up in some parts of Europe and the budget deficits of the Member States now being taken under control, does the Council believe that the recession has finally ended in the EU?

Selon les dernières statistiques publiées par la Commission européenne (prévisions intermédiaires de septembre 2010), la croissance du produit intérieur brut (PIB) devrait s'élever, en 2010, à 1,8% dans l'UE et à 1,7% dans la zone euro. Les chiffres confirmés pour le premier et le deuxième trimestres de 2010 font apparaître que le taux de croissance du PIB des 27 États membres de l'UE était respectivement de 0,3% et de 0,7% (le Conseil n'a pas pris position sur la question de la récession). Ces chiffres semblent indiquer, selon une définition largement répandue de la récession, que l'UE n'est plus en récession.
Toutefois, si l'on se tourne vers l'avenir, un fléchissement de la croissance du PIB est prévu au deuxième semestre de 2010, du fait du ralentissement attendu de l'économie mondiale. En conséquence, l'enjeu de demain est de faire en sorte que l'UE continue de consolider sa croissance tout en garantissant la solidité et la viabilité des finances publiques. Cet effort devrait avoir pour objectif une stabilisation des taux d'endettement, et ensuite leur réduction, afin de les ramener, dans un premier temps, aux niveaux d'avant la crise, puis dans les limites définies par le pacte de stabilité et de croissance.
Les États membres et l'UE sont intervenus massivement dans le domaine budgétaire pour soutenir le secteur financier et l'économie réelle, ce qui a naturellement conduit à une augmentation des déficits publics. Ces interventions, nécessaires et opportunes, ont joué un rôle extrêmement important pour empêcher une crise encore plus grave, tout en jetant les bases de la croissance de demain. Néanmoins, la crise a montré que des budgets sains ne sont pas suffisants pour garantir une croissance économique durable.
L'ensemble de mesures approuvé par le groupe de travail, avant d'être validé par le Conseil européen des 28 et 29 octobre 2010, constituera la plus grande réforme de l'Union économique et monétaire depuis la création de l'euro.
Les recommandations et les propositions concrètes figurant dans le rapport du groupe de travail visent en particulier à mettre en place un mécanisme de surveillance, servant de pendant macroéconomique au pacte centré sur les impératifs budgétaires, afin de créer un système d'alerte rapide permettant de détecter le risque de bulles immobilières ou d'évolution intenable de la balance des paiements, ainsi que d'importants écarts de compétitivité.

Subject: Adults on the move
We must remember that there are many adults affected by unemployment too. It is important to have a specialised programme for getting adults back into the labour market, through further training and lifelong learning programmes that will increase their skills.
Can the Council give details of any plans to facilitate an Adults on the Move programme similar to the Youth on the Move programme?

Face au chômage des jeunes qui a atteint un niveau inacceptable, "Jeunesse en mouvement" est l'une des initiatives phares qui s'inscrivent dans la stratégie Europe 2020 de l'UE pour l'emploi et une croissance intelligente, durable et inclusive, adoptée par le Conseil européen le 17 juin 2010. Toutefois, la stratégie Europe 2020 de l'UE concerne l'ensemble de la population, une importance particulière étant accordée aux femmes et aux hommes adultes âgés de 20 à 64 ans, dont la stratégie vise à porter le taux d'emploi à 75 %.
Les États membres sont responsables en premier ressort de l'élaboration et de la mise en oeuvre de leur politique dans le domaine de l'emploi et par leur politique de l'emploi, ils doivent contribuer, entre autres, à la réalisation des objectifs énoncés dans la stratégie Europe 2020. La stratégie Europe 2020 repose en effet sur une série de lignes directrices traitant d'une manière cohérente des questions liées à l'emploi et des grandes questions de politique économique.
Le 21 octobre 2010, conformément à l'article 148 du TFUE et sur la base des conclusions du Conseil européen, le Conseil a adopté les lignes directrices pour les politiques de l'emploi des États membres, dans le cadre de la mise en oeuvre de la stratégie Europe 2020.
À cet égard, la ligne directrice n° 7, "accroître la participation des femmes et des hommes au marché du travail, diminuer le chômage structurel et promouvoir la qualité de l'emploi", met en exergue que "les services de l'emploi jouent un rôle important dans l'activation et l'appariement" et que "ces services devraient être ouverts à tous".
La ligne directrice n° 8, "développer une main-d’œuvre qualifiée en mesure de répondre aux besoins du marché du travail et promouvoir l’éducation et la formation tout au long de la vie", rappelle aux États membres que l'enseignement initial et la formation professionnelle doivent être complétés par des mesures d'incitation efficaces pour l'éducation et la formation tout au long de la vie tant pour ceux qui ont que pour ceux qui n'ont pas d'emploi, assurant ainsi à chaque adulte la possibilité de se recycler ou d'acquérir un niveau supérieur de qualification. En particulier, les efforts devraient être concentrés sur le soutien des travailleurs faiblement qualifiés ou ceux dont les qualifications sont obsolètes et sur l'amélioration de l'employabilité des travailleurs âgés.
Enfin, la ligne directrice n° 9, rendre les systèmes d’éducation et de formation plus performants à tous les niveaux et augmenter la participation à l’enseignement supérieur" prévoit que les États membres devraient investir de manière efficace dans les systèmes d’éducation et de formation, notamment en vue de relever le niveau de compétences de la main-d’œuvre de l’UE, qui serait alors plus à même de répondre à l’évolution rapide des besoins des marchés modernes du travail. Conformément aux principes de l'éducation et la formation tout au long de la vie, les mesures devraient porter sur tous les secteurs (de l'enseignement et des établissements préscolaires à l'enseignement supérieur, en passant par l'enseignement et la formation professionnels, et l'apprentissage des adultes). Les réformes devraient viser à assurer l'acquisition des compétences clefs dont chacun doit pouvoir disposer pour réussir dans une économie de la connaissance, notamment sur le plan de l’employabilité, de l’apprentissage permanent ou encore des technologies de l’information et de la communication.

Subject: Child abduction and the Hague Convention
The Council is no doubt aware that child abduction is hugely distressing and potentially harmful to the child involved.
The foremost goal of the Hague Convention is to protect children from the harmful effects of their wrongful removal or retention and to establish procedures to ensure their prompt return to the state of their habitual residence, as well as to secure protection for rights of access. Sadly, the Convention does not work for everyone.
Does the Council believe there is a need for a more balanced interpretation of the Hague Convention across the Member States?
Does the Council believe there is benefit to be gained in Member States coordinating their approaches to cases of child abduction?

Le Conseil est tout à fait conscient qu'un déplacement ou un non-retour illicite d'un enfant est un événement éprouvant pour l'enfant concerné, lequel risque, en effet, de lui être préjudiciable.
Le Conseil reconnaît que la convention de La Haye de 1980 sur les aspects civils de l'enlèvement international d'enfants constitue un instrument international de grande importance lequel, il faut le souligner, a permis de résoudre bien des cas d'enlèvement d'enfants depuis son adoption. Tout comme l'honorable parlementaire, le Conseil appelle de ses vœux une application efficace de cette convention, au bénéfice des enfants concernés.
Le Conseil tient à rappeler que l'Union européenne, en tant que telle, n'est pas partie contractante à la convention de La Haye. Le Conseil constate, toutefois, que les États membres, lesquels sont tous parties contractantes, procèdent à des échanges de vues et d'expériences dans le cadre des Commissions spéciales convoquées, à intervalles réguliers, par la conférence de La Haye afin de suivre le fonctionnement pratique de la convention.
Dans ce contexte, le Conseil rappelle aussi que la convention de 1980 a été complétée, en 1996, par une autre convention adoptée par la Conférence de La Haye. Il convient de signaler que, dans le cadre de la mise en œuvre de cette dernière convention, les États membres ont collaboré étroitement à l'établissement d'un guide pratique dont certaines parties visent notamment à donner des lignes directrices relatives au traitement des cas d'enlèvement d'enfants.
Quant à l'intérêt d'une coordination des approches des États membres en matière d'enlèvement d'enfants, le Conseil tient à préciser qu'une telle coordination existe déjà. En effet, dans les relations entre eux les États membres sont tenus d'appliquer le règlement (CE) n° 2201/2003 qui règle la compétence, la reconnaissance et l'exécution des décisions en matière matrimoniale et en matière de responsabilité parentale. Ce règlement, dit de "Bruxelles II bis", contient notamment des règles de compétence en matière d'enlèvement d'enfants, particulièrement en ce qui concerne la compétence pour ordonner le retour d'un enfant qui a été déplacé ou qui est retenu illicitement dans un État membre autre que celui de sa résidence habituelle.

Σε δηλώσεις του, ο Διοικητής του ΔΝΤ, με ρητό και κατηγορηματικό τρόπο, ανέφερε ότι το ταμείο είναι διατεθειμένο να παρατείνει την αποπληρωμή των δανείων που έχει λάβει η Ελλάδα από τον χρηματοδοτικό μηχανισμό, εφόσον πράξουν το ίδιο και τα κράτη μέλη της ΕΕ. Τα βασικά επιχειρήματα του κ. Στρος-Καν είναι, η υπέρμετρη αύξηση των αναγκών αναχρηματοδότησης του ελληνικού χρέους τη διετία 2014-2015 και η δημιουργία καλού κλίματος στις αγορές. Οι έλληνες πολίτες αγωνιούν στην ιδέα ότι η λεγόμενη επιμήκυνση του χρόνου αποπληρωμής θα προκαλέσει τη διαιώνιση των αντιλαϊκών πολιτικών του Μνημονίου.
Με δεδομένη την πρόταση του ΔΝΤ, δέχεται το Συμβούλιο εισηγήσεις για να θέσει στην ημερήσια διάταξη της συνόδου το θέμα αυτό; Η συζήτηση για την επιμήκυνση της αποπληρωμής των δανείων που έλαβε η Ελλάδα, προϋποθέτει και την ύπαρξη Μνημονίου πέραν του έτους 2013;

Suite à la détérioration de la situation macroéconomique et budgétaire de la Grèce en 2010, le Conseil a adressé à la Grèce des recommandations en l'invitant à adopter les mesures appropriées pour réduire son déficit budgétaire et mettre en œuvre les reformes structurelles nécessaires.
Le Conseil a ainsi adressé à la Grèce, le 10 mai et le 7 septembre 2010, deux Décisions en vue de renforcer et d'approfondir la surveillance budgétaire et mettant la Grèce en demeure de prendre des mesures pour procéder à la réduction du déficit jugée nécessaire pour remédier à la situation de déficit excessif. Les deux Décisions esquissent les éléments principaux du programme économique que la Grèce doit mettre en œuvre, et qui reflète les conditions principales de l'assistance financière.
Le programme de support financier à la Grèce a été convenu et est mis en œuvre par les Etats Membres de la zone euro en dehors des Traités UE. Il a la forme d'un ensemble de prêts bilatéraux donnés individuellement par les Etats Membres de la zone euro qui participent au programme.
La conditionnalité liée aux prêts bilatéraux a fait l'objet d'un accord de prêt spécifique entre les Etats Membres qui fournissent le soutien financier et la Grèce, dont le Mémorandum d'entente constitue une annexe. Ce Mémorandum établit les conditions de déboursement du prêt.
Au vu de la nature des prêts accordés, le Conseil n'est pas en mesure de donner des commentaires sur les décisions des Etats Membres.

Subject: GMO decision-making shift to national governments
The issue of the cultivation of GM crops is dealt with differently from Member State to Member State. However, the Commission has come up with a proposal to devolve decision-making on the authorisation of GMOs to national governments. Allowing authorisation by each country could mark the beginning of a re-nationalisation of EU policy and might have serious implications for the single market.
What is the position of the Belgian Presidency on this particular issue? Is the Presidency in favour of clear rules on the co-existence of GM and non-GM crops at EU level, with the Commission playing a major role, or in favour of decision-making at national level?

La Présidence, ayant pleine conscience de la sensibilité politique et de la complexité technique associées à ladite initiative législative, a promu deux premiers échanges de vues au sein du Conseil, les 27 septembre et 14 octobre 2010.
Ces premiers échanges de vues ont permis de constater que des clarifications sont encore nécessaires sur certains aspects de la proposition de la Commission. En particulier, suite à cet examen préliminaire au sein du Conseil, un Groupe de travail ad hoc a été créé, expressément chargé de préparer le processus législatif au niveau technique, notamment en vue de clarifier les plus importantes questions soulevées par ladite proposition. Ces questions portent en particulier sur la base juridique que la Commission propose d'utiliser dans sa proposition (l'Article 114 du TFEU) et la compatibilité des futures mesures nationales avec les traités et les règles du commerce international (OMC).
Le groupe devra aussi se pencher sur les risques que la proposition de la Commission pourrait comporter pour le respect des règles du marché intérieur, en particulier pour ce qui est des raisons qui justifieraient, au sein des différents Etats Membres, les interdictions concernant les OGM.

Assunto: Adaptação às alterações climáticas e dívida externa dos países em desenvolvimento
O Conselho Europeu, no final de 2009, decidiu que a UE e os seus EstadosMembros estão dispostos a contribuir anualmente com um financiamento para a adaptação às alterações climáticas nos países em desenvolvimento, chamado de “arranque rápido”, de 2,4 mil milhões de euros por ano, para o período de 2010 a 2012.
Este montante corresponde a menos de metade do que o Parlamento Europeu considerou ser o mínimo imprescindível para este período (5 a 7 mil milhões) e a cerca de 2% do que a própria UE estima virem a ser os custos anuais da mitigação e adaptação, entre 2012 e 2020. Por outro lado, representa menos de 1% do valor da dívida externa do conjunto dos países africanos (dados de 2006).
Que montantes foram até à data canalizados para os países em desenvolvimento, no âmbito do chamado “arranque rápido”, previsto para o período 2010-2012? Quais os montantes a transferir nos próximos dois anos? Que formas concretas irá assumir esse financiamento? Considera a possibilidade de aumentar estes montantes?
Não considera que a dívida externa, e o respectivo serviço da dívida, dos países menos desenvolvidos representa um enorme constrangimento ao seu desenvolvimento e que, além do mais, já obrigou a uma significativa afectação de recursos ao serviço da dívida, pelo que se impõe o seu cancelamento?

Le Conseil a approuvé le 17 Novembre 2010 le rapport sur la "mise en oeuvre rapide" suite à l'accord politique conclu au Conseil Européen de décembre 2009(1). Le montant total confirmé du financement à transférer aux pays en développement dans le cadre du financement de "la mise en oeuvre rapide" pendant l'année 2010 s'élève à 2,2 milliards d'euros. Le montant total prévu pour toute la période 2010 -2012 s'élève à 7.2 milliard d'euros. Ces engagements confirment le respect par les Etats membres de l'UE de l'Accord de Copenhague.
Les Etats membres ont avancé considérablement dans la mise en oeuvre des engagements pour 2010. Une liste non exhaustive de projets a été élaborée et diffusée par le Conseil. Le Conseil élaborera pour les deux prochaines années des rapports annuels sur la "mise en oeuvre rapide".
Le Conseil a invité le Comité Economique et Financier et le Comité de Politique Economique d'actualiser les données afin de présenter à la conférence de Cancun des informations aussi complètes que possible.
Le Conseil n'a pas envisagé d'augmenter les montants cités au paragraphe 1. Le Conseil se limite à vérifier que les engagements de Etats membres sont respectés. Puisque la "mise en oeuvre rapide" est un ensemble d'engagements des Etats membres, il est possible que certains Etats membres décident d'augmenter leurs contributions.
L'action de l'UE pour l'allégement ou l'annulation de la dette des pays en développement se déroule dans le cadre de l'initiative en faveur des PPTE (Pays Pauvres Très Endettés) et de la "Multilateral Debt Relief Initiative" (MDRI).
Dans ses Conclusions du 11 novembre 2008(2), le Conseil réaffirme la volonté de l'UE d'intervenir pour aider à rétablir et à préserver un niveau d'endettement supportable dans les pays à faible revenu, notamment en agissant, dans la mesure du possible de manière coordonnée, pour empêcher que des bailleurs de fonds n'ayant pas contribué à l'allègement des charges des pays pauvres adoptent des pratiques non viables en matière d'octroi de prêts.
L'UE est également déterminée à fournir collectivement une assistance technique afin de renforcer les capacités de gestion de la dette des pays débiteurs, ainsi qu'à favoriser la tenue de négociations efficaces sur la dette avec les créanciers publics bilatéraux non membres du Club de Paris et les créanciers commerciaux.
L'UE souligne également l'importance de préconiser un contrôle démocratique renforcé; tant de la dette à contracter dans les pays emprunteurs, que de l'utilisation faite des ressources libérées grâce à l'allègement de la dette.

What are the prospects of South Africa concluding an Economic Partnership Agreement (EPA) with the EU? What is the chance that such an agreement could be concluded before the end of this year?

L'Afrique du Sud participe, avec les autres pays de la Communauté de Développement de l'Afrique Australe (CDAA/ SADC) -l' Angola, le Botswana, le Lesotho, le Mozambique, La Namibie et le Swaziland - aux négociations en vue de la conclusion d'un Accord de Partenariat Économique (APE).
À cet égard on a pu constater un nouveau élan en 2010.
En effet, lors du troisième sommet UE - Afrique du Sud qui a eu lieu le 28 septembre 2010, les dirigeants politiques ont eu des discussions franches et ouvertes sur l' APE UE-CDAA et ont en même temps réaffirmé leur volonté et leur détermination à conclure les négociations en vue d'un Accord de Partenariat économique permettant de promouvoir les relations commerciales et économiques entre la CDAA et l'UE.
les dirigeants se sont félicités du calendrier des négociations jusqu'à la fin de l'année. Ils ont appelé à résoudre tous les différends restants d'une manière satisfaisante pour les deux parties.
Notre objectif commun, qui vise à conclure les négociations d'ici à la fin de l'année 2010 est certes ambitieux - mais il est à notre portée . Certes, il faudra du travail, un engagement sérieux et un esprit de compromis de la part des deux partenaires.
Depuis le sommet, les négociateurs se sont déjà réunis et ils se reverront encore. Je suis convaincu que - grâce à l' élan politique fourni par le sommet - les négociateurs seront capables de trouver une solution aux questions en suspens.
L'Afrique du Sud est l'économie la plus forte de la région et - par conséquent - elle doit jouer un rôle moteur. Je suis confiant sur les perspectives de conclusion d'un accord avant la fin de l'année.

Subject: The Small Business Act
The review of the Small Business Act is a priority of the Belgian Presidency of the EU. Can the Council outline what actions it has undertaken to review this initiative so as to improve the competitiveness of SMEs in the EU?

La Communication intitulée "Small Business Act" pour l'Europe" (SBA), adoptée par la Commission le 25 juin 2008, vise à placer les PME au premier plan du processus décisionnel («priorité aux PME»), à renforcer leur capacité de création d’emplois dans l’UE et à stimuler leur compétitivité aussi bien sur le marché unique que sur les marchés mondiaux.
Le 1er décembre 2008, le Conseil a adopté des conclusions approuvant l'approche de la Commission et invitant la Commission et les Etats membres à s'engager à le mettre en œuvre et en faire le suivi continu.
Dans son rapport du 15 décembre 2009, la Commission a présenté les progrès réalisés dans la mise en œuvre du SBA et a annoncé son intention de publier une Communication en Décembre 2010, après avoir consulté les représentants d'organisations professionnelles de PME, et les autorités publiques compétentes. Le Conseil attend cette Communication pour décider sur des éventuelles suites.
En outre, sous présidence belge, le Conseil a avancé sur des dossiers d'une grande importance pour les PME: le fonctionnement du marché intérieur et le projet du "Single Market Act"; la nouvelle stratégie d'innovation; les mesures concrètes en faveur du tourisme européen approuvés par le Conseil; la simplification des programmes européens de recherche afin d'accéder plus vite à un financement pour les PME innovatrices.
Et le succès a été au rendez-vous: l'adoption ensemble avec le Parlement européen de la directive relative à la lutte contre les retards de paiement dans les transactions commerciales est un succès d'une importance capitale pour les PME, et nous nous félicitons de l'esprit de coopération sans faille du Parlement européen qui a rendu possible ce résultat.
Le Conseil souhaite aussi souligner que les travaux sur l'assainissement et la réglementation appropriée du secteur financier sont engagés avec le but d'améliorer l'accès au capital pour les PME qui sont les entreprises les plus touchés par la raréfaction des crédits.

Le Sommet UE-USA du 20 novembre a été un grand succès. Les discussions entre les Présidents Obama, Van Rompuy et Barroso ont été d'une très grande qualité.
Sur le plan économique, l'Union européenne et les États-Unis ont discuté des résultats du sommet du G20 qui s'est tenu à Séoul et du rôle que l'Union européenne et les États-Unis peuvent jouer pour garantir une reprise durable et équilibrée et créer des emplois en procédant à une réforme structurelle des marchés financiers et à un assainissement budgétaire qui favorise la croissance.
L'Union européenne et les États-Unis ont insisté sur le fait de mieux exploiter le potentiel qu'offrent les échanges transatlantiques pour stimuler la croissance et générer des emplois des deux côtés de l'Atlantique. L'Union européenne et les États-Unis sont conscients du rôle essentiel que joue le Conseil économique transatlantique dans la réalisation de ces objectifs et ils l'ont chargé d'élaborer un programme d'innovation transatlantique visant à stimuler la croissance et la création d'emplois dans des domaines tels que les énergies propres, la santé en ligne, l'information et la communication, ainsi que d'autres technologies émergentes. Le Conseil économique transatlantique devrait fournir au cours du premier semestre de 2011 un rapport concernant les progrès réalisés dans ces domaines.
L'Union européenne et les États-Unis ont souligné qu'ils restent fidèles aux engagements qu'ils ont pris en décembre dernier à Copenhague pour ce qui est de réduire les émissions de gaz à effet de serre. L'Union européenne et les États-Unis ont convenu d'œuvrer en faveur d'une issue positive de la conférence de Cancun.
L'Union européenne et les États-Unis ont réaffirmé leur volonté de coopérer et de coordonner leur action en matière de développement. L'Union européenne et les États-Unis ont souhaité que la coopération sur le plan de la sécurité alimentaire, du changement climatique et des objectifs du Millénaire pour le développement, y compris en ce qui concerne la santé, se poursuive dans le cadre du dialogue UE/États-Unis en matière de développement.
L'Union européenne et les États-Unis se sont également félicités de leur partenariat qui se renforce sur une large gamme de questions liées à la sécurité transnationale et qui concerne leur citoyens. Conscients de ce danger et des défis de plus en plus importants que représentent les cyberattaques et la cybercriminalité, l'Union européenne et les États-Unis ont mis sur pied un groupe de travail global UE-États-Unis pour les réseaux et la cybersécurité, qui devrait rendre compte d'ici un an des progrès réalisés. Nous voulons faciliter les déplacements transatlantiques des citoyens de nos 27 états membres et des États-Unis tout en nous acquittant de la mission essentielle que constitue le maintien de la sécurité et espérons maintenant connaître autant de succès lors des prochaines négociations en vue d'un accord sur les dossiers sur les données des passagers. Nous poursuivrons également nos efforts en vue d'un accord global sur la protection des données, dont le but est de faciliter la coopération entre nos services respectifs tout en garantissant un haut niveau de protection de la vie privée de nos citoyens. Nous sommes par ailleurs déterminés à développer notre partenariat dans la lutte contre l'extrémisme violent, notamment par l'échange des techniques de recherche et des bonnes pratiques et en renforçant la coopération en ce qui concerne l'aide à apporter aux pays tiers à risque.
Enfin, nous avons également discuté de nos efforts communs pour promouvoir la sécurité dans certains pays du monde.

Subject: The future of the EU Sports Programme
Following the meeting of the Education, Youth, Culture and Sport Council last week, how will the EU Sports Programme evolve over the next 2 years in the absence of a budget?

En 2008(1), le Parlement européen à demandé à la Commission de proposer un programme de l'UE dans le domaine du sport ainsi que des actions préparatoires dans ce domaine. Les actions préparatoires, qui ne peuvent porter que sur trois années consécutives, ont été proposées par la Commission pour les années 2009, 2010 et 2011: ces actions ont pour objectif de préparer de futures actions dans le domaine du sport en vue de la mise en œuvre des dispositions du traité dans ce domaine.
Le Conseil n'a joué aucun rôle dans ces actions préparatoires qui relèvent de la compétence de la Commission et du Parlement européen et sont financées sur les marges d'une rubrique budgétaire du Parlement européen depuis décembre 2009, suite à l'entrée en vigueur du traité de Lisbonne. L'article 165 du TFUE confère à l'UE une nouvelle compétence pour appuyer, coordonner ou compléter l'action des États membres dans le domaine du sport, notamment en ce qui concerne l'inclusion et l'intégration sociales, le sport pour la santé et les activités de volontariat.
Le 10 mai 2010, le Conseil a procédé à un échange de vues général sur l'avenir de la politique de l'UE en matière de sport, apportant ainsi une contribution à la Commission dans la perspective de futures propositions concrètes visant à mettre en œuvre les nouvelles dispositions du traité. Les domaines suivants ont été désignés comme prioritaires par le Conseil: l'inclusion sociale dans le sport et grâce au sport, l'amélioration de la santé par l'activité physique, l'éducation et la formation dans le sport, la lutte contre le dopage, la bonne gouvernance, le dialogue structuré avec le mouvement sportif et l'économie et les statistiques sportives.
Par ailleurs, les 18 et 19 novembre 2010, le Conseil, à l'initiative de la présidence belge, a adopté une résolution concernant le dialogue structuré sur le sport, des conclusions sur la lutte contre le dopage et des conclusions sur le rôle du sport dans la société.
Bien que la Commission envisage de proposer un nouveau cadre, sur la base d'un programme de l'UE en matière d'élaboration des politiques et de coopération dans le domaine du sport pour les prochaines années visant à mettre en œuvre les nouvelles dispositions du traité de Lisbonne dans ce domaine, à ce jour, aucune proposition spécifique (que ce soit un "mini" programme couvrant la période 2012-2013 ou un programme complet couvrant la période 2014-2020) n'a été soumise au Conseil par la Commission.
En l'absence de proposition de la part de la Commission, le Conseil ne peut engager aucune action.

Θέμα: Η συζήτηση για τις νομισματικές ισοτιμίες ενόψει της συνόδου κορυφής του G20
Το θέμα των νομισματικών ισοτιμιών και ο αγώνας υποτίμησης στον οποίος φαίνεται να έχουν αποδυθεί διάφορες χώρες σε παγκόσμιο επίπεδο, με αποτέλεσμα την εξαιρετική μεταβλητότητα των νομισματικών ισοτιμιών, αποτελεί μείζον ζήτημα στην παγκόσμια πολιτική ατζέντα. Στο ίδιο πλαίσιο εμπίπτει, σύμφωνα με πολλούς, η πρόσφατη παρέμβαση ποσοτικής χαλάρωσης από πλευράς Ομοσπονδιακού Αποθεματικού Συστήματος (Federal Reserve) των ΗΠΑ, σε συνέχεια της νομισματικής πολιτικής που ακολουθεί εδώ και καιρό η Κίνα.
Δεδομένης της έντονης αυτής κινητικότητας και της εκτεταμένης ανησυχίας περί παρεμβάσεων χειραγώγησης των νομισματικών ισοτιμιών και της αναμφίβολης επίδρασης που μπορεί να έχει στην ανταγωνιστικότητα των οικονομιών των χωρών μελών της ζώνης του ευρώ, ποια η θέση του Συμβουλίου, ενόψει μάλιστα και της συνόδου κορυφής των G20;

Le taux de change ne devrait être que le reflet des fondamentaux économiques d'une monnaie. Pour fonctionner correctement ce mécanisme nécessite que les pays s'abstiennent de dévaluations concurrentielles.
Afin de renforcer d'avantage le pilier économique de l'UEM, le Conseil européen des 28 et 29 octobre 2010 s'est penché sur la croissance durable, l'emploi et la compétitivité, qui constituent les fondamentaux de la zone euro. L'accent a été mis en particulier sur les plans d'assainissement budgétaire, la réforme de la réglementation financière, la cohésion sociale, la création d'emplois et la nécessité de procéder à des réformes structurelles supplémentaires.
En vue notamment du sommet du G20 de Séoul, le Conseil européen d'octobre 2010 a débattu des priorités que les représentants de l'UE et les États membres de l'UE qui sont membres du G20 y auraient défendu. Une attention particulière a été accordée à la question du rééquilibrage de la croissance mondiale et l'Union européenne a souligné qu'il faut s'abstenir de toute forme de protectionnisme et éviter de faire fluctuer les taux de change pour obtenir des avantages concurrentiels à court terme.

Kokių konkrečių priemonių imsis Europos Komisija, kad pagerintų švietimo lygį Europoje ir pasiektų nustatytą tikslą mažinti mokyklos nebaigusių mokinių skaičių? The Commission intends to propose a Council Recommendation on policies to reduce early school leaving. This Recommendation will set out basic guidelines for coherent, comprehensive and evidence based policies against early school leaving. It will provide a reference framework to assist Member States to develop more effective policies against early school leaving, to support them in their implementation, and so to lead to a significant reduction in the rate of early school leaving in all Member States.
Early school leaving is a complex phenomenon and causes leading to drop-out differ between Member States, regions and localities. The proposed Council Recommendation will add value to Member States’ efforts by supporting them in developing policies that identify the causes of and address early school leaving in a lifelong learning perspective, tackle it as a phenomenon that cuts across several related policy areas, involve all stakeholders, and make policy interventions more systematic and consistent.
The Recommendation itself forms part of a wider ambition to improve education and training in Europe. It is part of the Europe 2020 flagship initiative 'Youth on the Move', plays an important role within the 'Agenda for new skills and jobs' and will be implemented in the context of the Open Method of Coordination in education and training (Education and Training 2020 programme and its predecessor).
Both the Lifelong Learning Programme and the European Social Fund have important roles to play in supporting measures to reduce early school leaving. The future funding for both instruments after 2013 will be determined in the context of the future financial perspectives and the adoption of specific new legal bases for them.

Subject: The Erasmus Mundus programme
Can the Commission outline what strategies it is pursuing to increase levels of participation in the Erasmus Mundus programme in the EU?
The only means to increase the overall number of beneficiaries of the Erasmus Mundus programme, given the full absorption rates of existing funding, would lie in a budget increase. Any occasional increases in funding have been quickly absorbed by stakeholders and have been quickly turned into deliverable and measurable outputs on the ground through, for example, an increase in the number of scholarships or joint programmes.
Since its inception in 2004 the European Commission has put in place measures to ensure a satisfactory participation of EU higher education institutions in the programme. Every year it has organised information days in Brussels, which are specifically addressed to universities interested in participating in the programme. In addition, national information days take place yearly in the different Member States. The Commission also organises Erasmus Mundus coordinators meetings to share information and exchange good practice.
Extensive information is also provided on a website, including a detailed description of the programme's actions, information on the ways to apply and relevant documents (programme decision, programme guide, call for proposals, financial and administrative handbooks, etc.).
Considering the very high application rate by EU higher education institutions and the consequently rather low success rate of applications (around 13% for joint masters courses and 7% for joint doctorate programmes), the Commission does not consider it necessary to increase the level and the scope of its promotional actions within the EU.
Concerning the participation of individual European students in the programme, there have also been no difficulties in absorbing the entire budget for EU scholarships. However, a higher application rate would have ensured stronger competition and subsequently a broader choice of more qualified beneficiaries. The Commission, with the support of the Erasmus National Agencies, has therefore launched an information campaign on the opportunities that the programme offers EU students, including by providing information to organisations such as all Erasmus University Charter holders, university associations(1), student associations(2) and the Erasmus coordinators’ association.

Subject: The future of the EU Sports Programme
Given that the EU will not be funding the EU Sports Programme in 2011 and 2012 because of budget constraints and given that sport now falls under the EU’s competence, how can an EU sports policy be established and supported?
Over the next two years, how can the EU influence and be effective in the areas of grassroots sport and lifelong amateur sport for all?
Does the Commission expect there to be a funded EU Sports Programme after 2013?
In the light of budgetary constraints at national and European levels, the Commission has taken the view that there is no scope to put forward a meaningful proposal for a Sport Programme in the framework of the current multi-annual financing framework which runs until 2013. Šiuo metu kultūra Europos Sąjungoje yra finansuojama taikant keletą finansinių mechanizmų, kuriais užtikrinami kultūriniai mainai bei bendradarbiavimas, kultūrų dialogas ir šio sektoriaus stiprinimas. Europos Sąjungos strategijoje „ES 2020“ kalbama apie ekonominį augimą, pagrįstą žinių visuomene, žaliąja industrija ir pan. Pasigirsta nuogąstavimų, kad remiantis minėta strategija kultūra bus matoma kaip ekonominio augimo sudėtinė dalis. Kultūrinis identitetas yra viena iš pamatinių ES vertybių ir ją vertinti pagal kiekybinius rodiklius iš esmės neįmanoma. Nerimą kelia ketinimai sujungti dabar galiojančius finansinius mechanizmus, t. y. programas, kurios, nors ir apima kultūrą, iš esmės yra skirtingos. Nerimą kelia ir kita tendencija – bandymas sujungti kultūros programas su pilietiškumo programa, nes tai baigtųsi mažai meninės vertės turinčiais projektais.
Ar jau yra žinomi Komisijos planai, kaip bus finansuojamos kultūros programos naujuoju programavimo laikotarpiu? Ar išliks tokia kultūros programa kaip dabar ir ar bus remiami kultūriniai mainai ir bendradarbiavimas?
The European Union supports cultural cooperation activities within the framework of its Culture Programme, running from 2007 until 2013. This Programme aims to enhance the cultural area shared by Europeans through the development of cultural cooperation projects between cultural organisations from different countries participating in the Programme.
The thrust of this strand, which receives over three quarters of the overall Programme budget, is to help organisations, such as theatres, museums, professional associations, research centres, universities, cultural institutes and public authorities to cooperate so that different sectors can work together and extend their cultural and artistic reach across borders.
It is too early to say anything on the specific financing mechanism of future cultural initiatives, for which proposals will only be made in the second half of 2011. However it is already clear that the formulation of any programme proposal will take into account the objectives and priorities of the Europe 2020 strategy.
In that light, the Commission is looking at a number of issues which will contribute to designing future initiatives in the field of culture.
The midterm evaluation of the current Culture Programme is currently being finalised and will include recommendations for the future. In addition, a public online consultation is currently underway asking for views on future actions to promote culture. More than 160 responses have already been received and the Commission will take them into account when reflecting on a new culture programme. The consultation will remain open until 15 December 2010.
Following the consultation, a debate with stakeholders will take place in February 2011 to enable them to express their views in more detail and to discuss the various options for future initiatives.
Finally, prior to making any proposals for future actions, the Commission will conduct an assessment to ensure the maximum impact and added value of any possible programme.

Θέμα: Σκάνδαλα παγκοσμίων διαστάσεων από γερμανικές εταιρείες
Έχουν πάρει πλέον διαστάσεις παγκοσμίου σκανδάλου οι δωροδοκίες από γερμανικές εταιρείες, προκειμένου να επιτύχουν διείσδυση σε αγορές και να εξασφαλίσουν δημόσια έργα και συμβάσεις. Πρόκειται για υποθέσεις όπως της Siemens με τη χρηματοδότηση και τη διαφθορά πολιτικών προσώπων, της Deutsche Telekom για δωροδοκίες σε χώρες των Βαλκανίων, των Daimler, Ferrostaal-Thyssen, MAN με υποθέσεις δωροδοκιών σε δεκάδες χώρες της Ευρώπης. Για τις περισσότερες από αυτές τις περιπτώσεις έχει κινηθεί δικαστική έρευνα μετά από πρωτοβουλία των αμερικανικών δικαστικών αρχών.
Ερωτάται η Επιτροπή για ποιο λόγο καμία έρευνα δεν έχει ξεκινήσει από ευρωπαϊκές δικαστικές αρχές για τις υποθέσεις δωροδοκιών; Τι μηχανισμούς διαθέτει η Κομισιόν; Υπάρχουν στοιχεία για τις παραπάνω περιπτώσεις από τα οποία να συνάγεται ανάμειξη ευρωπαϊκών υπηρεσιών, αφού πολλές από τις συμβάσεις και έργα που κερδήθηκαν μέσω δωροδοκιών, συγχρηματοδοτούνται από τα ταμεία της ΕΕ;
The Commission fully understands the Honourable Member’s concerns regarding the allegations of corrupt practices and recalls that he raised some of the same issues in his question H-320/09(1) to which he received a response in October 2009.
Action by judicial authorities comes under the responsibility of the Member States. The Commission’s responsibility in anti-corruption matters focuses on prevention, legislation and monitoring. Should the matters to which he refers concern EU funds, the Commission would recall that Member States are required under Treaty obligations to take all necessary measures to protect the EU’s financial interests. They are also obliged under the relevant sectoral regulations to notify the Commission of any cases of fraud, irregularity or any other illegal activities involving EU funds which they have detected.
As was already explained in its response to question H-320/09, European Anti-Fraud Office (OLAF) may intervene when a corruption case involving EU funds is brought to light, but on a more general level the Commission may act through legislative initiatives, intervention in international fora, dialogue with the Member States, etcetera in order to develop efficient tools to combat such activity. The Commission has not been inactive in this last area. As foreseen in the Action Plan implementing the Stockholm Programme, the Commission envisages presenting in April 2011 a Communication on a comprehensive policy against corruption in Member States, including the establishment of an evaluation mechanism as well as presenting modalities of cooperation with the Council of Europe’s Group of States against Corruption (GRECO) for that purpose.
The Commission has been informed by the OLAF that the number of current cases with which it is presently concerned is quite limited. The following is an overview of the two cases, both of which involve only Siemens and not any of the other companies mentioned in the question:
- a case investigated by OLAF and closed in the last quarter of 2003, involving external aid, is in judicial follow-up in Germany. OLAF is following closely the judicial proceedings in that country;
- a second OLAF case relating to projects funded by the European Investment Bank has just been concluded. It involves public procurement procedures.

Θέμα: Φορολογικές ανισότητες και σύγκλιση στο πλαίσιο της ΕΕ
Σύμφωνα με πρόσφατη έκθεση της Επιτροπής, τα συνολικά φορολογικά έσοδα των 27 κρατών της ΕΕ, περιλαμβάνοντας και τις εισφορές για κοινωνική ασφάλιση, κυμαίνονται από 28% - 48,2% επί του Α.Ε.Π. τους, όταν ο αντίστοιχος ευρωπαϊκός σταθμισμένος μέσος όρος ανέρχεται σε 39,3 %(1). Ωστόσο, δίχως τις εισφορές κοινωνικής ασφάλισης τα αντίστοιχα φορολογικά έσοδα κυμαίνονται από 17,2% - 47,2 % και ο ευρωπαϊκός σταθμισμένος μέσος όρος καθορίζεται στο 26,8%. Δεδομένου ότι η σύγκλιση ευνοεί την πρόληψη δημοσιονομικών ανισορροπιών και ενισχύει την ισορροπημένη ανάπτυξη, το ενιαίο νόμισμα και την ενιαία αγορά, ερωτάται η Επιτροπή:
Πώς αντιμετωπίζει τις διαφορές αυτές αλλά και τις επιπτώσεις τους σε επίπεδο οικονομίας και κοινωνίας;
Πόσο επηρεάζουν οι αποκλίσεις αυτές την εμπιστοσύνη των αγορών και τις προσπάθειες για οικονομική ολοκλήρωση;
Πώς εντάσσει την αντιμετώπιση των αποκλίσεων στην πολιτική της οικονομικής διακυβέρνησης αλλά και της λειτουργίας της ενιαίας αγοράς;
Provided they respect EU law, Member States are free to design their national tax systems according to their priorities and preferences. Given different national preferences for the provision of public goods and for equity concerns, this naturally results in some divergence in tax levels.
One should not assume that divergence in tax levels necessarily affects economic performance. Economic literature does not show any mechanical cause-effect link between the level of tax revenues of an economy and growth: some high tax-countries perform better than some low tax countries and vice-versa. Furthermore, differences in rates for many types of taxes do not impede economic integration and do not disrupt markets.
The promotion of a favourable tax environment is at the heart of the Europe 2020 Strategy. In this framework, the Commission encourages Member States to simplify tax systems, to reduce non-wage labour costs and to adapt national tax systems to environmental challenges.

The Commission has recently outlined its vision concerning the taxation of the financial sector in a Communication(1) adopted on 7 October 2010.
Globally, an Financial Transactions Tax (FTT) could be an appropriate option as a revenue raiser in particular to provide financing for global policy goals. For it to work effectively and fairly, participating countries should try to come to an agreement on global financing tools that can be acceptable to all. The Commission is committed to continuing to work with its international partners, in particular in the G-20, to reach such an agreement. In the Commission's view the FTT is less suited for a unilateral introduction at EU-level because of risks, such as relocation and reduced liquidity, are high and would undermine the ability to generate revenue. Thus, the Commission is currently exploring the possibility to introduce a Financial Activities Tax (FAT) at EU level, as an alternative instrument. The Commission will conduct an Impact Assessment in order to be able to propose, where appropriate, tax designs, aimed at minimising distortions or adverse effects on the economy and the internal market.

Η Οδηγία 2003/96/ΕΚ σχετικά με την αναδιάρθρωση του κοινοτικού πλαισίου φορολογίας των ενεργειακών προϊόντων και της ηλεκτρικής ενέργειας, δεν περιλαμβάνει το κριτήριο των εκπομπών διοξειδίου του άνθρακα. Αυτή η αποφυγή διάκρισης ανάμεσα σε προϊόντα υψηλής και χαμηλής ή μηδενικής περιεκτικότητας εκπομπών άνθρακα δημιουργεί ζητήματα ανταγωνισμού και είναι ασύμβατη με τους κύριους στόχους της ΕΕ όσον αφορά την κλιματική μεταβολή.
Κατά πόσο η αναθεώρηση της εν λόγω Οδηγίας στην κατεύθυνση της εισαγωγής του κριτηρίου των εκπομπών διοξειδίου του άνθρακα αποτελεί προτεραιότητα της Επιτροπής και για ποιούς τομείς; Δεδομένου ότι ορισμένα κράτη μέλη της ΕΕ έχουν ήδη προχωρήσει σε ανάλογες νομοθετικές ρυθμίσεις σε εθνικό επίπεδο, θεωρεί η Επιτροπή σκόπιμη την άμεση αναθεώρηση με στόχο την αποφυγή τάσεων διαστρέβλωσης στην εσωτερική αγορά; Κατά πόσο η εν λόγω αναθεώρηση θα μπορούσε να διασφαλίσει μία πιο δίκαιη κατανομή του φορολογικού άχθους προς τομείς που παρουσιάζουν σημαντικές εξωτερικές συνέπειες (externalities), όπως η μόλυνση του περιβάλλοντος;
The Commission is currently completing the impact assessment of a possible proposal revising Council Directive 2003/96/EC(1) following the orientation debate it held on this issue on 23 June 2010. Until this work is completed, it is not possible to give a clear indication of the timetable of such a proposal.
The main objective of the revision corresponds to the request of the March 2008 European Council(2) to bring the Directive more closely into line with the EU's energy and climate change objectives, inter alia, by basing minimum taxation rates on Carbon Dioxide (CO2) emissions and energy content of energy products and by aligning the Directive to the EU Emissions Trading System.
This in other words means that the revision shall provide enabling an internal market framework for energy taxation as a means to address CO2 emissions in the non-ETS sectors, facilitate energy savings and deployment of renewables and revenue generation in an un-distortive way.
This also means avoiding negative interference with the EU ETS. In addition, the revision should, in general, improve the structure of the current Directive, so as to enable the Member States to use energy taxation more effectively for environmental and other policy purposes and to improve the functioning of the internal market.

Weiß die Kommission vom Projekt einer Europa-Universität in Sarajewo oder einer benachbarten Region Bosnien-Herzegowinas, und ist sie bereit, dieses konkret zu unterstützen?
The Commission would like to underline the importance of education and its role in the reconciliation process in Bosnia and Herzegovina and the whole Western Balkans region. Under the Instrument for Pre-Accession Assistance, the Commission supports all countries of the Western Balkans to meet the obligations of the accession process. Programmes also address reforms of the respective higher education systems. In recent years, the Commission supported higher education reform in Bosnia and Herzegovina with more than EUR 7 million, in particular through the Tempus Programme.
Within the framework of the European Instrument for Democracy and Human Rights, the Commission continues to support the Master Programme for Democracy and Human Rights in Sarajevo with currently EUR 1.5 million. In addition, there are a number of regional initiatives which are financed by the EU, such as the Regional School for Public Administration in Montenegro and the South East European University in the former Yugoslav Republic of Macedonia.
Apart from these programmes, the Commission is not involved in plans to establish a European University in Bosnia and Herzegovina or the neighbouring countries and therefore does not foresee financial support in this respect.

Θέμα: Τελωνειακή ένωση ΕΕ-Τουρκίας και στρέβλωση του ανταγωνισμού
Η τελωνειακή ένωση ΕΕ-Τουρκίας έχει εξασφαλίσει για τα συμβαλλόμενα μέρη αυξημένη πρόσβαση στην αγορά, με τον όγκο των εμπορικών συναλλαγών να αγγίζει τα 100 δισ. ευρώ ετησίως το 2008.
Ωστόσο, σημαντικό πρόβλημα για τις εμπορικές σχέσεις ΕΕ-Τουρκίας αποτελούν τα προϊόντα απομίμησης και η έλλειψη προστασίας των πνευματικών δικαιωμάτων· ένα γεγονός που προκαλεί έντονη στρέβλωση του υγιούς ανταγωνισμού και στην ευρωπαϊκή αγορά.
Υπό το φως των ανωτέρω, ερωτάται η Επιτροπή: Ποιες συγκεκριμένες δράσεις προτίθεται να αναλάβει και σε ποιο χρόνο για την καταπολέμηση του φαινομένου αυτού που αποτελεί την πιο χαρακτηριστική έκφραση του ευρύτερου και συνεχώς εντεινόμενου προβλήματος της απομίμησης- παραποίησης- πειρατείας;
As the Honourable Member points out, the EU-Turkey Customs Union has contributed largely to the substantial increase of the trade volume between the two partners. The Commission is also aware of the fact that counterfeit products and inadequate protection of intellectual property rights (IPR) in Turkey constitute significant problems in the EU-Turkey trade relations.
To address the above shortcomings, the Commission proposed in April 2008 to Turkey the establishment of a joint working group on IPR issues. The aim of the working group will be to discuss in depth issues related inter alia with the enhancement of IPR enforcement capacity in Turkey. After long hesitations, Turkey accepted recently the establishment of the working group and appointed the relevant coordinating authority. The Commission is now expecting Turkey's formal response to its proposal to hold the first meeting of the working group and start discussing substantial IPR matters.
Moreover, the establishment of the EU-Turkey working group on IPR issues and the successful engagement of Turkey into an IPR dialogue is a key requirement for progress under the relevant negotiation chapter "Intellectual property law" (chapter 7). Therefore, in the framework of discussions with regard to IPR chapter, the Commission is monitoring progress of Turkey towards further alignment and implementation of the IPR acquis as well as its enforcement.
Furthermore, in the framework of EU-Turkey Customs Union, the Commission is urging Turkey to comply with the provisions of Article 31 of Decision 1/95 of the EU-Turkey Association Council establishing the Customs Union, which invites Turkey to improve the effective protection of IPR in order to secure a level of protection equivalent to that in the European Union.

Subject: Narrow route to market in the food supply chain
The food supply chain in the EU is characterised by a broad base of producers with a very narrow route to the market for these products. Market power in the chain is ultimately in the hands of a few operators.
Is the Commission aware of this narrow route to market in the food retail sector? Does the Commission consider this trend to be problematic? Has the Commission analysed this issue or does it have any plans to do so?
The Commission is aware of the consolidation process which took place along the food supply chain, and agrees that this situation is liable to give rise to significant imbalances in bargaining powers beetween contracting parties. The Commission has identified in its Communication on the food supply chain of 2009(1), as well as in its Retail Market Monitoring Report of July 2010(2) the existence of situations where some actors face large companies that are often their only channel for accessing the market. It should be stressed that this situation is found throughout the supply chain and is liable to affect both producers that have a weak bargaining position vis à vis retailers – specifically those of non differentiated products, including farmers who produce mostly undifferenciated commodities - and also retailers that do not have access to certain branded products sold by large multinational producers.
The Commission is aware of the fact that imbalances in bargaining power in certain specific conditions can lead to the imposition of unfair commercial practices by one of the contracting parties on the other. Unfair commercial practices can have a negative impact and limit a company's capacity to invest in innovation and quality of products, be they food or non food products or services.
However, it should be noted that in general imbalances of bargaining power resulting from the unequal size of contracting parties are not per se problematic in competitive markets, as the lower costs achieved through bargaining tend to be passed through downstream market chain to the ultimate benefit of consumers.
The Commission is currently exploring how to address the issue and will come forward with an initiative geared towards business-to-business relations aiming at protecting the different operators in the supply chain against unfair commercial practices. As far as food is concerned, the Commission has established an Expert Platform on Business-to-Business (B2B) Contractual Practices in the Food Supply Chain to collect information on possible unfair commercial practices. This Platform will report to the High Level Forum for a Better Functioning Food Supply Chain(3).
The Commission is also currently preparing legislative proposals to strengthen the bargaining power of milk producers in the specific sector of dairy products following the debate within the High Level Group on Milk.

The Commission would refer the Honourable Member to the Commission Statement on the sludge catastrophy in Hungary (plenary session of 19 October 2010).
The acute impact of the accident is mainly due to the very big amount and high alkalinity of the leaked sludge. The longer term impact on the environment is likely to be confined to a limited territory in Hungary. The alkaline pollution also reached the Danube River, but due to the safety measures taken by the Hungarian authorities (dilution of the pollution with gypsum and acidic materials), this water body did not suffer any significant harmful effects.
The Commission received notification through the early warning system of the International Commission for the Protection of the Danube River (ICPDR). This information has been sent to all countries in the Danube basin in order to allow them to take the necessary protective measures to safeguard their water catchments. The Commission has been in contact with Slovakia, Romania and the ICPDR. Based on their sampling results cross-border effects are likely to be minimal.
The Monitoring and Information Centre (MIC) was in close contact with Hungary from the outset of the emergency and offered assistance in case of need. Information has been shared with all Member States on the disaster and its possible effects on the population and the environment.
On 7 October 2010, at 8 pm the Hungarian Government activated the EU Civil Protection Mechanism by issuing a request for assistance to the MIC. The request was for a team of 5 experts with strong field experience in preventing/mitigating damage from alkali sludge on flora and fauna, and decontamination of agricultural land. The EU Civil Protection Team was deployed to Hungary for 1 week and delivered a number of recommendations for measures agreed upon with the Hungarian authorities to further enhance the remedial and recovery plan for the affected area.
Industrial accidents are normally not covered by the European Union Solidarity Fund. The Fund may provide assistance in case of natural disasters and when the damages exceeds 0,6% of Gross National Income following an application from an affected Member State. Damage for which there is liability may not be compensated by the Solidarity Fund. Operational programmes co-funded by the European Regional Development Fund might contain provisions for prevention of disasters and remove risks for further development. However the polluter pays principle is to be applied, before a project could be approved for funding under any of these programmes.
The "polluter pays" principle likewise applies to rural development policy. Nevertheless, Council Regulation (EC) n° 1698/2005(1) foresees possibilities to grant support for 'Restoring agricultural production potential damaged by natural disasters and introducing appropriate prevention actions'. This measure is not programmed in the New Hungarian Rural Development Programme (NHRDP), but it could still be introduced if the Member State requests so. In addition, the measure 'Restoring forestry potential in forests damaged by natural disasters and fire and introducing appropriate prevention actions' provides a similar support for the affected forestry sector. This measure is included in the NHRDP. Support under both measures can be provided under the condition that the catastrophe has to be recognised as a natural disaster.

Относно: Преработка и съхранение на отпадъците на гр. София
В края на 2009 г. ЕК информира, че е изготвила мотивирано становище за отнасяне на случая с отпадъците на София до Съда на Общността. Година по-късно проблемът продължава да съществува, въпреки внесената през април 2010 г. апликационна форма за финансиране на бъдещ завод за преработка на столичните отпадъци.
Отговаря ли внесената от българска страна апликационна форма на финансовите и технологичните изисквания на ЕК и счита ли ЕК, че избраната технология гарантира всички необходими изисквания, както от екологична, така и от финансово – икономическа гледна точка за евентуалното съфинансиране на проекта?
Ще бъде ли прекратена наказателната процедура и евентуално дело срещу България за неизпълнение до настоящия момент на Директивата относно отпадъците, в случай че България финализира административните подробности по своя подаден проект и пристъпи към неговото реализиране?
Информирана ли е Комисията за съхраняването на отпадъците на територията на Столична община до изграждането на завода за преработка и неговото пускане в експлоатация?
As the Honourable Member pointed out, in November 2009 the Commission decided to refer Bulgaria to the European Court of Justice for the failure to establish an integrated and adequate network of waste disposal installations as required by the Waste Framework Directive(1) and in April 2010 Bulgaria submitted to the Commission a major project application "Integrated System of Municipal Waste Treatment Facilities for Sofia Municipality".
With regard to whether the application made by Bulgaria meets the financial and technical criteria laid down by the Commission, and whether the Commission considers the technology selected to fulfil all the necessary requirements from an environmental and financial-economic standpoint with a view to co-financing of the project, it should be pointed out that the technical assessment of Bulgaria's application by the Commission has confirmed the viability of the first substantial components of the new waste management system, namely an adequate long-term landfill capacity and the facilities for composting. At the same time, in view of the need for more consistent and up-to date waste stream data and for additional assurance regarding the cost-efficiency of the system, certain parts of the submitted project will have to be reworked. In this regard, while the upgrade of the integrated waste management system should be seen as one project, the Commission considers that time can be gained by implementing this project in two phases, with a first phase to start immediately and a second phase to be implemented once the additional analyses have been completed. This model should give the opportunity to the Bulgarian authorities to develop a well-functioning waste management system that is viable in the long term both from an environmental and economic efficiency point of view.
With regard to your question on the infringement proceedings, suspension would require a new Commission's decision amending the decision from November 2009 to refer Bulgaria to the Court. However, in line with its practice in such cases, the adoption of a decision regarding the first phase of the project and the rapid start of the construction of the first-phase infrastructure should be sufficient for the Commission to suspend the pending infringement procedure, which will provide Bulgaria with the necessary time to prepare an environmentally compliant and long term cost-efficient second phase of the Sofia Municipal Waste Management Project.
With regard to the storage of waste in the city of Sofia, until such time as the new processing factory is constructed and enters into operation, the Commission will work together with the Bulgarian authorities to ensure that the storage of waste complies with the main requirements of the EU waste acquis. The Waste Framework Directive requires MS to ensure that storage is taking place without endangering human health and without harming the environment. The Waste Framework Directive also contains specific provisions on the storage of hazardous waste. In addition, the requirements of the Landfill Directive apply to the storage of waste prior to recovery for a period of three years or longer and the storage of waste prior to disposal for a period of one year or longer.

Objet: Lancement d'une étude sur les wagons isolés
La Société nationale des chemins de fer a présenté en septembre 2009, dans la continuité du plan Veron, un schéma directeur qui fixe les axes de développement du transport de marchandises pour les années à venir et qui comprend l'abandon d'environ 60 % de l'activité wagon isolé. Pourtant, cette activité représente actuellement 42 % du volume du fret ferroviaire et recèle un important potentiel de développement.
Concrètement, cette décision induit le report sur la route de 255 000 wagons de marchandises et, à brève échéance, un recul d'un tiers des volumes transportés par rapport à 2008. Au total, cela équivaut à augmenter le trafic routier de 1 200 000 camions soit, selon une étude menée par la SNCF, 300 000 tonnes équivalent CO2 par an. Ces risques environnementaux sont inévitablement accompagnés d'un recul de l'emploi inadmissible en cette période de crise.
La Commission peut-elle indiquer si elle envisage toujours de lancer, d'ici 2011, une étude complète sur les wagons isolés?
The Commission is well aware of the situation and developments in single wagonload traffic in France and other Member States, which have been aggravated by the recent economic crisis. Single wagonload services in many Member States accounts for an important part of total rail freight traffic and its discontinuation in some countries could jeopardize the viability of this kind of traffic in other parts of Europe, where railway undertakings are still committed to it. This would have a negative impact on transport options for shippers and result in undesired modal-shift effects on a European level. The Commission therefore considers single wagonload services as an important part of European rail freight.
The Commission confirms that it plans to launch a comprehensive study on single wagonload traffic in 2011 in order to identify possible policy options. The study is intended to address questions related to the "last mile" (industrial spurs, freight terminals), freight flow consolidation and deconsolidation, train formation facilities and services as well as regulatory issues related to these. It will take into account possible future production methods and business models for single wagonload services.

Subject: ACTA - injunction powers going beyond those provided for in the EU acquis
In the Civil Enforcement section of the Anti-Counterfeiting Trade Agreement (ACTA), paragraph 1 of Article 2.X: Injunctions allows judicial authorities to issue an order (injunction) against a party, or a third party, to ‘prevent infringing goods from entering into the channels of commerce’. This injunction power is considerably different from that existing under the EU acquis (Article 9 of the Intellectual Property Rights Enforcement Directive (Directive 2004/48/EC)), which permits injunctions ‘to prevent any imminent infringement’. Furthermore, the third parties need to be involved in the infringement (‘against an intermediary whose services are being used’). The ACTA text essentially eliminates the thresholds for injunction powers that exist under the EU acquis.
Given that, by laying down the thresholds for injunctions, the EU acquis has struck a delicate balance between enforcement and fundamental rights safeguards, how will the Commission ensure that these safeguards under the current EU acquis are maintained?
How will the Commission safeguard the thresholds currently provided for in the EU acquis?
The Commission would like to clarify that Article 2.X.1 ACTA (page 6) refers to injunctions in the sense of measures taken when the court establishes an infringement ("… order against a party to desist from an infringement"), while Article 9 of the Enforcement Directive refers to provisional and precautionary measures (also described in EU law as interlocutory injunctions, hence the possible misunderstanding), which are temporary measures taken before a final decision is issued by the court. This is the reason why these two provisions make reference to different requirements, or "thresholds".
The provision dealing with injunctions in Article 2.X.1 ACTA (page 6) must be compared with the equivalent provision in Article 11 of the Enforcement Directive, while the provision addressing provisional measures in Article 9 of the Enforcement Directive is equivalent to the provision in Article 2.5.1(a) of ACTA (page 8). The Commission submits that the two ACTA provisions are fully compatible with the respective measures defined in the Enforcement Directive.

Tema: Biologinio saugumo užtikrinimas valstybėse narėse
Komisija pramoniniais tikslais yra įteisinusi vienos rūšies genetiškai modifikuotų bulvių ‘Amflora‘ auginimą Europos Sąjungoje. Šiuo metu jos auginamos Vokietijoje, Švedijoje ir Čekijoje.
Švedijos laukuose greta bulvių ‘Amflora‘ buvo aptikta ir draudžiamų auginti bulvių ‘Amadea‘ kelmų. Tai kelia didžiulį susirūpinimą dėl akivaizdaus biologinio saugumo užtikrinimo trūkumo Sąjungoje.
Kokių veiksmų ėmėsi Komisija, kad būtų ištirtas minėtasis atvejis, ir kokie yra rezultatai? Kaip Komisija ketina užtikrinti, kad ES neįteisintų genetiškai modifikuotų rūšių augalai nepatektų į ES rinką? Ar Komisija nemano, kad būtina sugriežtinti valstybių narių atsakomybę, jei jų teritorijoje randama ES draudžiamų genetiškai modifikuotų augalų?
In the case of the admixture of genetically modified (GM) Amflora potatoes with the non-authorised GM Amadea potato in Sweden, the Commission has, upon reception of information from the Swedish authorities, contacted the company BASF Plant Science and the three Member States where this genetically modified organism (GMO) is cultivated (Czech Republic, Germany, and Sweden). The Commission ensured coordinated actions notably through the organisation of a joint mission with experts from the three Member States to the facilities of the company where the first steps of the process for the production of GM Amflora potatoes take place. The main objective of the mission was to gather more information on the possible sources of the admixture for all lots of Amflora potatoes cultivated in 2010. This coordination will be pursued in order to ensure that there will be no contamination in the future.
On the basis of available information, the Commission considers that the actions taken by the three Member States following the admixture of GM Amflora potatoes with the other non-authorised GM potatoes are sufficient. The Commission is examining further options to reinforce monitoring of environmental effects of GM crops. This will provide proper feedback so as to enable them to enhance their assessments.
Member States are responsible for the official control regarding the implementation of the legislation of GMOs, including the control on the illegal release of non-authorised GMOs. It is also the role of Member States to impose sanctions on the operators that are infringing the legislation, and to impose corrective actions addressing deficiencies in their production process.
The Commission welcomed the decision taken by the Member States' competent authority to request to destroy the areas with the illegal released non-authorised GMOs. In addition, the Commission has requested the 27 Member States to provide an overview of the presence of non-authorised GMOs in seeds.
As already done in the past, the Commission may where necessary take specific measures to ensure that products containing non-authorised GMOs are not placed on the market.

Oggetto: Maggiore protezione per lavoratori e cittadini esposti all'amianto
Com'è noto, l'amianto è una sostanza estremamente nociva e pericolosa, che provoca l'insorgenza di malattie respiratorie e di vari tipi di cancro, tra cui il mesotelioma alla pleura. In Italia vi sono circa 32 milioni di tonnellate di cemento amianto da smaltire e 3000 vittime all'anno per patologie correlate a tale sostanza. Nei Paesi Bassi vengono diagnosticati ogni anno 1000 casi di malattie legate all'esposizione a tale sostanza, mentre in Francia il numero delle vittime aumenta a 3000 all'anno.
Consapevole del fatto che l'Unione Europea si è occupata della questione nella direttiva 2009/148/CE sulla protezione dei lavoratori contro i rischi connessi con un'esposizione all'amianto durante il lavoro, l'interrogante chiede alla Commissione se intenda adottare misure più incisive al fine di garantire giustizia ai cittadini colpiti da malattie legate all'esposizione all'amianto e alle famiglie che hanno subito delle perdite, e farsi garante delle operazioni di bonifica dei siti inquinati prevedendo appositi finanziamenti.
The Commission is well aware of the risks posed by asbestos fibres. With a view to stepping up worker protection, Directive 2009/148/EC(1) consolidates various asbestos-related legislative instruments to make the legislation easier to understand and implement. In particular, Article 14 of that Directive makes it an obligation for employers to provide appropriate training for all workers who are, or are likely to be, exposed to dust from asbestos or materials containing asbestos. The transposition and effective implementation of that legislation is the responsibility of the Member States.
As regards further steps or stronger protection measures needed, the Commission is drafting guidelines for workers who are mainly but not exclusively in the construction sector and who may be in contact with and affected by asbestos, with a view to preventing further cases of asbestos contamination and any ensuing asbestos-related diseases.
The Commission will ensure that the guidelines and related material are disseminated as widely as possible. It is also in contact with professional organisations in the field with a view to gathering evidence and ultimately helping to design the best possible strategy to address the problems posed by asbestos.
The Commission would also draw the Honourable Member’s attention to the information available on the website of the European Agency for Safety and Health at Work, including guidance on asbestos-related safety(2).
Lastly, the issue of measures targeted at workers suffering from illnesses related to exposure to asbestos and families of workers who have died as a result of exposure is linked to the recognition of asbestos-related diseases, which is the sole responsibility of the Member States. The EU-level legal instrument of relevance to the recognition of and compensation for asbestos-related diseases is Recommendation 670/2003/EC(3), which is not legally binding. Article 2 of that Recommendation specifically acknowledges that the Member States are to determine the criteria for the recognition of each occupational disease in accordance with the national laws or practices in force.
The European Regional Development Fund (ERDF) can support the decontamination of asbestos in contaminated worksites. In the framework of the 2007-2013 Cohesion Policy, about EUR 3.5 billion are planned to be invested in the rehabilitation of industrial sites and contaminated land. Based on the principle of shared management, it is up to the Member States and their Managing Authorities to select and implement the co-financed project in line with the priorities set in the relevant Operational Programmes, for instance the rehabilitation of sites or land contaminated with asbestos.

Subiect: Sprijin pentru implementarea reţelelor de tip "smart grid"
În ultimii ani, statele membre au acordat anual miliarde de euro pentru utilizarea energiei din surse regenerabile. Ulterior, unele dintre capacităţile de producţie astfel realizate au fost închise din cauza incapacităţii reţelelor electrice de a prelua electricitatea produsă. Consider că UE şi statele membre trebuie să investească în modernizarea infrastructurii de energie electrică astfel încât aceasta să poată prelua energia produsă şi să eficientizeze astfel investiţiile în infrastructura de producţie a energiei din surse regenerabile.
Prin Programul de lucru pentru 2011, Comisia s-a angajat să prezinte, după efectuarea unui studiu de impact, o iniţiativă legislativă privind măsuri de sprijin pentru implementarea reţelelor de tip „smart grid”. Aş dori să întreb Comisia care vor fi principalele măsuri ale acestei iniţiative?
Deployment of Smart Grid requires a coordinated approach as it touches upon many new areas, redefines relations between market players and poses new challenges to the regulators. The challenges posed by smart grids include technology, customer engagement, business models, market models and regulation. In the context of the Strategic European Technology Plan, the industry-led European Electricity Grids Initiative and a Joint Programme of the Research Alliance were launched in June 2010 to accelerate the development and deployment of technology and system innovations in the electricity grids.
In November 2009, the Commission decided to set up a Task Force on Smart Grids to explore the adequate regulatory framework for the implementation of Smart Grids, the requirements for data security and data handling, as well as consumer protection and privacy issues.
The Commission's intention is to first assess the outcomes of the Task Force before defining the scope of the future Smart Grid initiative to be presented in 2011.

On 13 August I sent a written question to the Commission and the Council with the subject line 'WikiLeaks case, transparency, press freedom and access to information in the EU' through the urgent procedure.
The status of the written question for the Commission was subsequently changed to that of a regular written question. The period of six weeks to answer my questions lapsed on 1 October. Please note that the answer given by the Council is not a satisfactory one (‘It is Council policy not to comment on articles in the Press [...]’).
Why has the Commission failed to answer my written question within the deadline?
The Honourable Member's question E-7329/10 was answered by the Commission on 16 November 2010. The Commission regrets the delay of the reply which is due to the wide scope of the questions raised and the need to involve a number of Commission departments in preparing the reply.
Question no 47 by Laima Liucija Andrikienė (H-0550/10)
Subject: Absorption of Structural and Cohesion Funds
As the EU approaches the midterm review of the 2007-2013 financial perspective, it is timely to assess the absorption record of the Structural and Cohesion Funds in different Member States.
Which countries are the leaders in terms of absorbing the funds? What is the risk that some Member States might not be able to fully use the funds earmarked for them in the current financial perspective? What can be done to improve the absorption capacity in different Member States? What is the record of Lithuania in this regard thus far?
Article 93(1) of Council Regulation (EC) No 1083/2006 as modified by Regulation 539/2010(2) foresees automatic decommitment of unused funds by 31 December of the 2nd year for each commitment. Paragraph 2 mentions the exception for some Member States benefiting from the rule as from 31 December of the 3rd year for each commitment. The so-called 'N+2/ N+3 rule' works as an incentive for Member States to spend the allocated funds in a timely manner.
It is worth noting that the absorption rate does not completely reflect the level of spending on the ground. It only reflects the payment requests submitted by Member States to the Commission for reimbursement of final beneficiaries' expenses. Moreover, most Member States tend to submit high payment claims towards the end of the year, resulting in some payments executed only the following year. The real level of advancement on the ground is reflected then in the absorption rate with a delay.
Figures as of 8 November 2010 show an average absorption rate for all Member States of 19.3% for European Regional Development Fund, 18.2% for the Cohesion Fund and 20.0% for European Social Fund. In the specific case of Lithuania, these figures respectively amount to 34.7%, 29.0% and 27.9%.
Evidence shows that most programmes are reaching cruising speed and the absorption rate is increasing month by month. The Commission is constantly working with Member States to ensure regular and timely submission of payment claims. This works well in the case of Lithuania which regularly submits payment claims to the Commission four times per year.
It is however difficult to compare the absorption rate per Member State for the various Funds, as the de-commitment rule is applied differently for the various Member States. Lithuania will only be subject to the rule as from 'N+3' (i.e. 2011) whereas some Member States already face the risk of de-commitment this year. This has an impact on the spending profile and consequently on the absorption rate.
Lithuania's absorption rate for each fund is higher than the average 'paid/decided' for all Member States. The relatively high absorption rate is partly due to payments in favour of financial engineering instruments.
Θέμα: Εργασιακή ομηρία συμβασιούχων στο ΧΥΤΑ Θεσσαλονίκης
Ακόμη ένα σοβαρό χτύπημα στο δικαίωμα για σταθερή και μόνιμη εργασία αποτελεί η δικαστική απόρριψη της προσφυγής 160 συμβασιούχων εργαζομένων του Συνδέσμου ΟΤΑ Θεσσαλονίκης. Το γεγονός αυτό προκαλεί τεράστιο πρόβλημα στη λειτουργία του ΧΥΤΑ Θεσσαλονίκης στη Μαυροράχη, το βιολογικό καθαρισμό, τα προγράμματα ανακύκλωσης και τη λειτουργία του περιβαλλοντικού πάρκου στις παλιές "χωματερές". Οι αρχές της τοπικής διοίκησης ανακοίνωσαν την υπογραφή δίμηνων συμβάσεων για την λειτουργία των παραπάνω υπηρεσιών, παρατείνοντας την πολιτική και εργασιακή ομηρία τους με στόχο την επιτάχυνση της παράδοσης της διαχείρισης των απορριμμάτων στους ιδιώτες – εργολάβους και την απόλυση χιλιάδων εργαζομένων.
Πώς τοποθετείται η Επιτροπή στα σχέδια παράδοσης από τον ΣΟΤΑ ενός κρίσιμου για την δημόσια υγεία τομέα, της διαχείρισης απορριμμάτων, στο ιδιωτικό κεφάλαιο, που εκτός από τους κινδύνους για την υγεία των κατοίκων και το περιβάλλον θα έχει σαν αποτέλεσμα χιλιάδες απολύσεις εργαζομένων και την αντικατάστασή τους με προσωρινές, ελαστικές και χωρίς δικαιώματα θέσεις εργασίας;
In accordance with the division of competences in the Treaties, it is not for the Commission to express a view on any decision by national authorities to privatise services or on how such privatisation is carried out, provided it complies with the applicable EU law.
With regard to the general issue of restructuring, and especially where this is likely to lead to redundancies, the Commission would stress that it is the employer’s duty to comply with the national provisions implementing the EU directives on informing and consulting workers. In this connection, special attention should be paid to compliance with the provisions implementing Directives 98/59/EC(1) and 2002/14/EC(2). Should the measures taken by local authorities regarding waste management referred to by the Honourable Member lead to a transfer of undertakings, Directive 2001/23/EC(3), which protects workers employed permanently or on fixed-term contracts at the time of the transfer, should be complied with.
The ‘contract workers’ to whom the Honourable Member refers are taken to mean workers on fixed-term employment contracts, who are protected from abuse arising from the use of successive fixed-term employment contracts by Directive 1999/70/EC(4), regardless of whether the employer is public or private.
The aforementioned Directives have been transposed into the Greek national legal order. It is for the competent national authorities, including the courts, to ensure the application of the transposing legislation on the basis of the facts and circumstances of the particular case.
The Commission would also point out that workers who are affected or likely to be affected by restructuring may qualify for support from the Structural Funds, and in particular the European Social Fund or, under certain conditions, from the European Globalisation Adjustment Fund.

Betreft: Zonnepanelen op daken EU-gebouwen
Almaar meer (overheids)bedrijven maken afspraken met installateurs van zonnepanelen om de daken van hun gebouwen kosteloos ter beschikking te stellen voor het plaatsen van zonnepanelen in ruil voor de levering van gratis duurzame elektriciteit.
Is de Commissie bereid ook in dergelijk model mee te stappen en de daken van haar gebouwen ter beschikking te stellen? Heeft de Commissie al onderzocht om welke potentiële dakoppervlakte het gaat, welke de impact hiervan kan zijn op haar energiefactuur en op haar ecologische voetafdruk?
The Commission has not so far been approached by solar panel installation firms with a view to reach agreements to install solar or photovoltaic panels on the roofs of its buildings, whether in Brussels or in Luxembourg. The Commission's policy is to install photovoltaic solar panels for its own buildings, where possible, based on the results of feasibility studies. The question whether firms who do the installation free of charge should be used has not been considered so far.
In Brussels, the Commission's new "Cornet Leman" nursery which is to open in early 2011 has been equipped with photovoltaic solar panels (over a roof surface area of approximately 70 square meters) which will provide 9.89 kW peak power. In addition, the Commission is currently examining the possibility of installing photovoltaic solar panels on the roofs of other buildings and has already identified two buildings where this appears feasible (Rue Demot 24 and Rue du Luxembourg 46). Further verifications still have to be carried out before the Commission can proceed in line with the relevant procurement rules. Feasibility studies show that the installation of photovoltaic solar panels is expected to provide a return on investment after approximately eight to ten years, taking into account the local electricity production as well as the various support mechanisms available such as investment aid, green certificates, etc. The final return on investment can of course be affected by changes in these support mechanisms. In Luxembourg no panels have so far been fitted on any Commission building. On the other hand, the Commission has made arrangements in Luxembourg to be supplied exclusively with "green" electricity, from renewable sources. It should be pointed out in this connection that all the Commission's buildings in Luxembourg are rented, with the (partial) exception of the EUROFORUM building, in respect of which it has the right/option to purchase.
In order to assess the overall potential for reducing the Commission's energy bills and/or its carbon footprint, individual studies have to be made of the possible sites which would be adequate and of the energy potential of any solar panel installation. These studies will have to look at matters such as the characteristics of the roof concerned, the possible presence of other equipment on the roof and the physical environment of the building concerned etc. At this early stage, it is not yet possible therefore to give an overall estimate of the impact this long term project might have on the Commission's energy bills or on its carbon footprint.

Subject: Undermining of the internal market in medicines and the European quality and safety standards by Member States
Apparently Member States are increasingly undermining the internal market in medicines, patients’ access to medicines and the role of the European Medicines Agency (EMA) by using the so-called ‘fourth hurdle for market access’, i.e. the national pricing and reimbursement decisions, to undermine the European quality and safety standards. It seems that some Member States are trying to establish a second standard for the safety, quality and efficacy of medicines. These actions could undermine the EU regulatory framework for medicines, which requires a long and costly process for market authorisation. These practices also threaten the single market in pharmaceuticals. It is contrary to single market principles to distort competition between those pharmaceutical companies that undertake the proper clinical research and tests to secure authorisations and those that disregard them.
Is the Commission aware of this problem? Is the Commission looking into this development and warning Member States not to pursue such practices?
The Court of Justice in its case-law has ruled that it is within Member States' powers to determine the prices of medicinal products and decide on their inclusion in the scope of national health insurance systems, but that they must comply with EU law when exercising their power(1). In the light of this, Directive 89/105/EEC lays down a series of procedural rules for how these decisions should be made, to ensure timely and transparent decisions.
The Commission is fully aware that a number of Member States use a methodological approach often referred to as HTA – Health Technology Assessment – as a basis for such decisions. Such assessments may include a comparison between a new medicinal product and existing alternatives on the market, considering patient outcome and in many cases also the relative cost-effectiveness of the new product.
The Commission considers HTA a relevant tool for this purpose which does not unduly distort competition in the pharmaceutical market.
To ensure that HTA does not constitute an unnecessary extra burden for the industry, the Commission supports European cooperation to develop common standards and methodologies for HTA use. This could benefit the patients, the Member States and the industry, as it would lead to better access to medicines, reduced duplication of work and a clearer framework for innovative medicines.

Om: EASA-udtalelse om flycertifikater
EASA fremlagde i august 2010 en udtalelse til Kommission om nye regler for flycertifikater. Forslaget har til formål at forbedre flysikkerheden.
EASA ønsker blandt andet, at alle piloter, som flyver i EU, skal have et flycertifikat, der er udstedt i EU. Hvis man har et certifikat fra f.eks. USA, vil man altså ikke længere nødvendigvis være berettiget til at flyve i EU.

Regulation EC 216/2008(1) adopted by the European Parliament and Council requires pilots residing in the EU and involved in the operation of an aircraft into the EU to comply with the European licensing requirements. Those requirements may be satisfied by the acceptance of licences issued by third countries in case of operating non EU-registered aircraft.
After extensive consultation with stakeholders, the European Aviation Safety Agency (EASA) has made a proposal (opinion) to the Commission on pilot licences issued by third country authorities, which reproduces largely the standards commonly applied in Member States and developed previously by the International Civil Aviation Organisation (ICAO) and the Joint Aviation Authorities (JAA). This opinion also contains a proposal for the acceptance of licences issued by or on behalf of third countries, including a proposal for the conversion of third country licences issued in compliance with ICAO Annex 1. This proposal will be further discussed in the framework of the Committee established by Article 65(1) of Regulation 216/2008.
Beyond the current proposal for third country licence conversions the Commission takes the opportunity to recall that the recognition of non-EU licences could be simplified in case bilateral safety agreements between the EU and third countries are put in place. Such agreements, still to be ratified, have already been established with the United States, Canada and Brazil.
