  El Presidente. − El siguiente punto es el debate conjunto de los informes sobre el Defensor del Pueblo Europeo y la aplicación del Derecho de la Unión Europea:

– el informe de Mariya Nedelcheva, en nombre de la Comisión de Peticiones, sobre el Informe anual relativo a las actividades del Defensor del Pueblo Europeo en 2009 (2010/2059(INI)) (A7-0275/2010),

– el informe de Chrysoula Paliadeli, en nombre de la Comisión de Peticiones, sobre el Informe especial del Defensor del Pueblo Europeo a raíz del proyecto de recomendación a la Comisión Europea sobre la reclamación 676/2008/RT (2010/2086(INI)) (A7-0293/2010), y

– el informe de Eva Lichtenberger, en nombre de la Comisión de Asuntos Jurídicos, sobre el Vigesimosexto Informe anual sobre el control de la aplicación del Derecho comunitario (2008) (COM(2009)06752010/2076(INI)) (A7-0291/2010).

  Mariya Nedelcheva, rapporteur. − Monsieur le Président, Monsieur Diamandouros, Monsieur le Commissaire, chers collègues, je crois que l'on peut voir la mission de médiateur européen selon deux objectifs.

Il y a tout d'abord l'objectif légal, qui consiste en la garantie du respect, par les institutions européennes, du droit fondamental qu'est la bonne administration. Faire respecter ce droit est l'essence même de la fonction de médiateur. Et ici, nous sommes à un moment charnière dans la mesure où le traité de Lisbonne, qui comprend désormais la Charte européenne des droits fondamentaux, consacre à son article 41 ce droit comme étant juridiquement opposable. Le médiateur dispose donc aujourd'hui d'une base juridique que je qualifierai de renforcée pour mener à bien son action.

Pour atteindre cet objectif de plein respect de la bonne administration, le médiateur doit rester intraitable vis-à-vis des institutions. Les rapports spéciaux sont un outil qui prend ici tout leur sens. Ils permettent au médiateur de mettre le doigt sur un cas de mauvaise administration flagrant, lorsque toutes les voies de résolution des différends ont été épuisées. L'affaire Porsche en est tout à fait significative. Je salue ici l'acharnement, si j'ose dire, de M. Diamandouros avec lequel il tente d'obtenir les informations qu'il est tout à fait en droit de demander.

Le deuxième objectif est d'ordre moral. Il s'agit, pour le médiateur, de promouvoir la culture du service, qui ne figure pas expressément dans les traités, mais qui fait bien partie des engagements auxquels se sont soumises les institutions. Pour garantir cette culture de service, deux choses sont essentielles. Tout d'abord, le médiateur doit continuer, comme il le fait déjà depuis plusieurs années, à encourager les solutions à l'amiable. Je rappelle que 56 % des plaintes reçues trouvent une solution à l'amiable.

Il doit ensuite continuer ses efforts en matière de communication, de sorte que les citoyens européens soient informés de leurs droits ainsi que des procédures existantes pour les faire respecter. À ce titre, l'établissement d'un guide interactif est une avancée importante et je crois que nombre de nos concitoyens vous en sont reconnaissants.

Donc, le bilan d'activité 2009 du médiateur est tout à fait positif. C'est ce que j'ai essayé de retranscrire dans mon rapport. Toutefois, j'ai aussi inscrit certaines recommandations. D'abord, il me semble primordial de renforcer les liens avec les parlements nationaux et les médiateurs nationaux. Agir à Bruxelles sans s'assurer du lien au niveau national, cela enlève une grande partie de l'efficacité. C'est pourquoi j'invite le médiateur européen à encourager davantage les médiateurs nationaux à procéder à des échanges réguliers avec leurs parlements nationaux sur le modèle des échanges établis entre le médiateur européen et nous, le Parlement européen.

À cette fin, le réseau européen des médiateurs est un outil considérable. Il me semble que le partage d'informations et de bonnes pratiques est primordial en ce sens. Je veux rappeler ici l'importance de la mise en place d'un portail intranet commun aux médiateurs pour échanger toutes ces informations.

Monsieur le Président, le citoyen doit être au centre des préoccupations. Transparence, proximité, bonne administration, culture du service, voilà les mots d'ordre. Or, cette proximité passe aussi par notre institution. C'est pourquoi je voudrais saluer de nouveau M. Diamandouros lorsqu'il consacre autant d'efforts à maintenir un lien constant avec le Parlement européen et, notamment, avec la commission des pétitions. Comme je l'ai souligné dans mon rapport, je crois qu'il serait très bénéfique pour nos deux institutions et, par-delà, pour les citoyens européens que l'on échange davantage lorsqu'une enquête d'initiative est menée par le médiateur.

Jusqu'à présent, M. Diamandouros s'est très bien attelé à la tâche qui lui a été confiée de rappeler les institutions à l'ordre lorsqu'elles s'égarent sur le chemin sinueux de l'opacité et de la mauvaise administration.

Monsieur le Médiateur, je vous souhaite tout le meilleur et j'attends avec impatience de pouvoir lire votre rapport d'activité pour l'année 2010.

  Χρυσούλα Παλιαδέλη, Εισηγήτρια. − Κύριε Πρόεδρε, τον Μάρτιο του 2007 μια περιβαλλοντική οργάνωση ζήτησε τη δημοσιοποίηση της αλληλογραφίας ανάμεσα στην Ευρωπαϊκή Επιτροπή και τις αυτοκινητοβιομηχανίες στο πλαίσιο διαβούλευσης για την προετοιμασία νομοθετικής πρότασης με αντικείμενο τις εκπομπές διοξειδίου του άνθρακα.

Οκτώ μήνες αργότερα η Επιτροπή επέτρεψε την πρόσβαση σε 16 από τα 19 έγγραφα αρνούμενη να δημοσιοποιήσει - χωρίς νομική αιτιολόγηση - τρία έγγραφα με αποστολέα την Porsche. Η περιβαλλοντική οργάνωση κατέφυγε στον Ευρωπαίο Διαμεσολαβητή ο οποίος ένα μήνα αργότερα συνέταξε σχέδιο σύστασης προς την Επιτροπή ζητώντας της να απαντήσει εντός τριμήνου σύμφωνα με το άρθρο 228 της Συνθήκης για τη Λειτουργία της Ευρωπαϊκής Ένωσης.

Η Επιτροπή ζήτησε πέντε παρατάσεις για να δηλώσει τον Ιούνιο του 2009 πως δεν ήταν ακόμη σε θέση - ένα χρόνο μετά το σχέδιο σύστασης του Διαμεσολαβητή - να δημοσιοποιήσει την αλληλογραφία με τη συγκεκριμένη αυτοκινητοβιομηχανία λόγω συνεχιζόμενων διαβουλεύσεων μαζί της. Μέχρι τον Οκτώβριο του 2010 ο Διαμεσολαβητής δεν είχε κανένα στοιχείο στη διάθεσή του.

Η αδικαιολόγητη αυτή καθυστέρηση τον οδήγησε στη σύνταξη ειδικής έκθεσης προς το Ευρωπαϊκό Κοινοβούλιο στην οποία καταγγέλλει την Επιτροπή για άρνηση συνεργασίας με ειλικρίνεια και καλή πίστη επισημαίνοντας ταυτόχρονα τον κίνδυνο που απορρέει από την υπονόμευση της δυνατότητας των δύο θεσμών να ασκούν εποπτεία στην Επιτροπή.

Αποτέλεσμα αυτής της ειδικής έκθεσης του Διαμεσολαβητή - της πρώτης με θέμα την κακοδιοίκηση -, την οποία καλείται να υπερψηφίσει σήμερα το Κοινοβούλιο, ήταν η δημοσιοποίηση των εγγράφων της συγκεκριμένης αυτοκινητοβιομηχανίας δεκαπέντε μήνες μετά το αρχικό αίτημα του Διαμεσολαβητή. Από το Σεπτέμβριο του 2008 μέχρι τον Φεβρουάριο του 2010 η Επιτροπή κατέληξε σε μια απόφαση που της είχε υποδειχθεί με το σχέδιο σύστασης του Διαμεσολαβητή δεκαπέντε μήνες νωρίτερα, ενώ ταυτόχρονα αποδείχθηκε ότι η συγκεκριμένη αυτοκινητοβιομηχανία δέχθηκε εν τέλει την έστω και μερική δημοσιοποίηση των εγγράφων της.

Από τα παραπάνω προκύπτει ότι η Επιτροπή είχε βεβαίως την υποχρέωση να λάβει υπόψη της το σχετικό άρθρο του κανονισμού του Ευρωπαϊκού Κοινοβουλίου στο οποίο προβλέπεται ότι τα θεσμικά όργανα αρνούνται την πρόσβαση σε έγγραφα η γνωστοποίηση των οποίων θα έθιγε την προστασία των εμπορικών συμφερόντων ενός συγκεκριμένου φυσικού ή νομικού προσώπου. Δεδομένου ωστόσο ότι ο έλεγχος των επιστολών από το Γραφείο του Διαμεσολαβητή είχε ήδη δείξει πως δεν περιείχαν στοιχεία που θα έβλαπταν τα εμπορικά συμφέροντα της συγκεκριμένης αυτοκινητοβιομηχανίας, η Επιτροπή όφειλε να προχωρήσει άμεσα στην έστω και μερική δημοσιοποίησή τους ακολουθώντας τις υποδείξεις του Διαμεσολαβητή. Εάν ωστόσο είχε επιφυλάξεις για την ερμηνεία του σχεδίου σύστασης, είχε την υποχρέωση, προκειμένου να αιτιολογήσει τις επιλογές της, να προσκομίσει εξίσου ισχυρές νομικές εκτιμήσεις από τις οποίες θα προέκυπτε το ενδεχόμενο της προσφυγής της συγκεκριμένης αυτοκινητοβιομηχανίας στα δικαστήρια με βάση το σχετικό άρθρο του Κανονισμού 1049/2001 του Ευρωπαϊκού Κοινοβουλίου.

Δεν θα ήθελα να σχολιάσω εδώ την απόλυτη σιωπή της συγκεκριμένης αυτοκινητοβιομηχανίας στις οχλήσεις της Επιτροπής. Θεωρώ, ωστόσο, απαράδεκτο να χρησιμοποιείται ως επιχείρημα από το ανώτατο αυτό εκτελεστικό όργανο της Ενωμένης Ευρώπης η σχεδόν απαξιωτική για τους ευρωπαϊκούς θεσμούς άρνηση μιας ιδιωτικής επιχείρησης να απαντήσει σε ένα τέτοιο αίτημα. Πολύ περισσότερο επειδή από το ίδιο το περιεχόμενο των εγγράφων της δεν προκύπτουν στοιχεία που θα μπορούσαν να ενεργοποιήσουν την εφαρμογή του σχετικού άρθρου του Κανονισμού 1049/2001 του Ευρωπαϊκού Κοινοβουλίου και να οδηγήσουν την Επιτροπή στα δικαστήρια.

  Eva Lichtenberger, Berichterstatterin. − Herr Präsident! Mein Bericht über die Umsetzung von Gemeinschaftsrecht ist einer der besonders wichtigen hier im Europäischen Parlament. Wir haben hier im Europäischen Parlament einen Ablauf der Gesetzeswertung, der hochkomplex, hochkompliziert, aber gleichzeitig auch einer der transparentesten ist im Vergleich mit nationalen Parlamenten. Glauben Sie mir, ich kann das vergleichen, ich war in einem nationalen Parlament.

Dieser lange Prozess, der die Regierungen der Mitgliedstaaten involviert, der das Europäische Parlament involviert, hat Resultate, die sehr oft erst umgesetzt werden in nationale Gesetzgebung. Wenn nun diese Umsetzung in den nationalen Parlamenten nicht funktioniert, nicht effizient ist, dann bekommen wir auch hier als Abgeordnete, als Parlament und als Europäische Union als Ganzes ein Glaubwürdigkeitsproblem. Das halte ich für eine sehr gravierende Geschichte. Als Abgeordnete sind wir ständig konfrontiert mit Bürgerinnen und Bürgern, die zu uns kommen und auf Defizite hinweisen. Die Kommission bekommt Beschwerden von Bürgerinnen und Bürgern, wenn es darum geht, wie nationales Recht umgesetzt wird. Ich möchte nur einige kleine Beispiele ansprechen: Schauen wir zur Müllkrise nach Neapel. Schauen wir in eine Krise, die sich wiederholt, nicht das erste, nicht das zweite, sondern schon das dritte Mal. Und noch immer ist die Umsetzung europäischer Hierarchien der Abfallentsorgung zum Beispiel nicht erledigt. Es gab ein Eintreten der Kommission, aber dieses Eintreten hat nicht dazu geführt, dass endlich das, was wir in Europa als richtig und wichtig in der Abfallentsorgung erkannt haben, dort auch umgesetzt wird. Schauen wir in das Land, aus dem ich komme, nach Österreich. Umweltverträglichkeitsprüfungsrichtlinie schlecht umgesetzt. In einem Fall der Erschließung eines Skigebietes zeigt sich deutlich, dass hier enorme Defizite vorliegen. Oder schauen wir in den Verkehrsbereich, wo es zum Beispiel vorgeschrieben wurde, dass die Mitgliedstaaten die Einhaltung von Lenk- und Ruhezeiten im Verkehr beachten, dass diese Beachtung auch kontrolliert wird. Die enormen Kontrolldefizite in diesem Sektor führen zu Unfällen, vermehrten Unfällen durch übermüdete Fahrer. In diesem Zusammenhang müssen wir sagen: Bürgerinnen und Bürger dürfen nicht frustriert werden in ihrem Wunsch nach Umsetzung von Gemeinschaftsrecht, sie müssen in rechter Zeit klare Auskunft bekommen und sie müssen sich auch darauf verlassen können, dass das Verfahren transparent abläuft.

Wir als Europäisches Parlament brauchen in diesem Zusammenhang sehr dringend eine Prozedur, die uns unter Wahrung des persönlichen Datenschutzes von Petenten, die Möglichkeit gibt, diese Feedbacks aus der Bevölkerung aufzunehmen. Ich frage Sie, Herr Kommissar, ob Sie bereit sind, das Verfahren, das wir in unserem Bericht vorschlagen, zu unterstützen und mitzutragen. Dieses wäre ein wesentlicher Schritt in Richtung Transparenz, in Richtung Offenheit und in Richtung Klarheit des europäischen Prozesses.

Ich möchte zum Schluss noch einmal wiederholen: Wenn uns die Glaubwürdigkeit abhanden kommt, weil wir die Umsetzung von Gemeinschaftsrecht in europäischen Mitgliedstaaten nicht hinreichend beobachten und zur Kenntnis nehmen, dann ist das ein Glaubwürdigkeitsproblem für die gesamte Europäische Union.

  Nikiforos Diamandouros, Ombudsman. − Mr President, honourable Members, thank you for this opportunity to address you. I wish to thank the Committee on Petitions, and especially the chair, Mrs Mazzoni. They continue to offer me valuable support and advice, as evidenced by the excellent reports submitted to this Chamber by Mrs Nedelcheva and Mrs Paliadeli, whom I thank warmly for their kind words.

Parliament and the Ombudsman both work to ensure that citizens and residents of the EU can enjoy their rights to the full, but we do so in different ways. The Ombudsman’s mandate is more limited. I only deal with complaints against EU institutions, whilst you can also examine what Member States are doing. Furthermore, Parliament as a sovereign political body can deal with petitions that request changes in the law, or new laws. In contrast, my role is to help uncover maladministration and to attempt to put it right.

Unlike court rulings, an Ombudsman’s decisions are not legally binding. I can only use the power of persuasion to convince the EU institutions to follow my recommendations, or to achieve friendly solutions which can satisfy both sides.

Where EU institutions refuse to follow my recommendations, it is of fundamental importance that the Ombudsman can turn to Parliament to seek its support, and I am naturally very grateful that Parliament continues to do so, as evidenced by the Nedelcheva and Paliadeli reports.

This is the first annual report presented to you since the entry into force of the Treaty of Lisbon. I will continue to work in close cooperation with Parliament in order to further our common goal of providing European citizens with the maximum possible benefits from their rights under the Treaty, acting always in accordance with my mandate as an independent and impartial investigator of alleged maladministration – an independence and impartiality which applies equally to the complainant as well as to the institution complained against.

In 2009, my office closed 318 inquires, 70% of which were completed within one year. 55% were completed within three months. On average, inquiries took nine months to complete, which was well within my standard goal of completing inquiries within one year.

I am pleased to note that, in 2009, 56% of all investigations were either settled by the institution or resulted in a friendly solution. This represents a large improvement over 2008, when the percentage was 36%. In 35 cases I issued a critical remark. This is a significant improvement compared to 2008, when I issued 44 critical remarks, or even 2007, when I issued 55. The sustained reduction is good news, but this is still too many.

Honourable Members, I make efforts to help every complainant who turns to the Ombudsman, even in cases where the complaint is not within my mandate. In 2009, I received a total of 2 392 such complaints, a 6% decline compared to 2008. This decline is encouraging news. Reducing the number of inadmissible complaints has been a long-standing request of Parliament. I attribute this result at least in part to the fact that more citizens are finding the right address to turn to the first time around.

In January 2009, I launched an interactive guide on my new website, which is accessible in all 23 EU languages. This guide aims to direct complainants to the body best placed to help them, whether it be my own services, the services of national or regional ombudsmen in the Member States, or problem-solving mechanisms such as the crossborder online network Solvit.

During 2009 the guide was used by more than 26 000 people. It is very important for citizens to be guided to the most appropriate complaint-handling body from the outset and to be spared the frustrations and delays associated with having to identify the right institution on their own.

This also means that complaints are resolved more promptly and effectively, thus ensuring that citizens can fully enjoy their rights under EU law and also that EU law is properly implemented.

Over the last three years I have also made strenuous efforts to raise awareness about the services I can offer to businesses, associations, NGOs, regional authorities and other target groups, that is anybody who is involved in EU projects or programmes and who has direct dealings with the EU administration.

To further ensure awareness of the Ombudsman’s work I stepped up cooperation during 2009 with other information and problem-solving networks such as Europe Direct and Solvit. I also intensified my efforts to reach out to potential complainants by organising a range of public events; all these outreach activities, combined with the solid results obtained for complainants, resulted in median coverage of the Ombudsman’s work increasing by 85%.

The number of enquiries opened, based on complaints received in 2009, rose from 293 to 335. This increase must be at least partly attributed to outreach activities. I have also continued my efforts to improve the quality of information provided to citizens and potential complainants concerning their rights under EU law through the European network of Ombudsmen which greatly helps to facilitate the rapid transfer of complaints to the competent Ombudsman or similar body.

Furthermore, I continued to strive to make certain that EU institutions adopt a citizen-centred approach in all their activities. This is a task that must be tackled in tandem with the institutions. To promote this goal with respect to the Commission I am in close contact with the Vice-President of the Commission responsible for relations with the Ombudsman, Commissioner Šefčovič, who I thank for his presence here today, and I am grateful for his close cooperation and support to date.

The most common allegation I examined in 2009 was lack of transparency. This arose in 36% of all enquiries. It is with a certain degree of concern that I note the continuing high percentage of such complaints. An accountable and transparent EU administration is surely key to building citizens’ trust. I also regret the lengthy delays by the Commission in responding to access to document cases. The most outrageous case is dealt with in Mrs Paliadeli’s report which makes clear that Parliament expects substantial improvement from the Commission in this regard.

The entry into force of the Lisbon Treaty was the key event of 2009. The Treaty makes new promises to citizens concerning fundamental rights, enhanced transparency and greater opportunities for participation in the Union’s policy-making. It also makes the Charter of fundamental Rights including the right to good administration legally binding.

Reform of the Financial Regulation offers an additional excellent opportunity to put the fundamental right to good administration into practice. I believe that the relevant rules should provide guidance to officials as to how they should ensure both sound financial management and good administration. Honourable Members, I developed and recently adopted a strategy to cover the whole period of my mandate. The document containing it was circulated during this past week to your Bureau, the Conference of Presidents and the Committee on Petitions for information.

The strategy is designed to implement the mission statement for my institution which I adopted in 2009 and which reads as follows. ‘The European Ombudsman seeks fair outcomes to complaints against European Union institutions, encourages transparency and promotes an administrative culture of service. He aims to build trust through dialogue, between citizens and the European Union and to foster the highest standards of behaviour in the Union’s institutions’.

It is within this spirit, Mr President, Honourable Members, this spirit of the Commission statement that I will continue to work in carrying out the mandate which this august body has entrusted me with.

  Maroš Šefčovič, Vice-President of the Commission. − Mr President, please bear with me because I will try to respond to our three rapporteurs and the Ombudsman. I would like to start by thanking Ms Nedelcheva, Ms Paliadeli and Ms Lichtenberger for their reports. It is very clear that we share the same goals: namely that administration should be efficient and professional and that European law be respected. That is the basis on which we intend to discuss these matters and, I am sure, to seek a positive result.

Turning to Mr Diamandouros, I would also like to express my appreciation for his close cooperation with the Commission. I think this is a special day for him because he can see that his work is also very highly appreciated by the European Parliament. I can assure you that the communication between us and between our services is very intense. Hardly a week passes when I do not send a letter of explanation to the Ombudsman and get a response from him. This is how we try to find the right solutions in our work. Of course there are some outstanding issues, on which we are working, but I think that is simply proof of our fruitful communication.

I would like to emphasise that the Commission welcomes Ms Nedelcheva’s report, which offers a clear and exhaustive overview of the Ombudsman’s activities for the past year. In fact, in the Ombudsman’s report on his 2009 activities, the results of his various inquiries are clearly presented, illustrated with examples and classified into categories according to the nature of the cases of maladministration or the institution concerned.

As Mr Diamandouros has already said, in 2009 the Ombudsman recorded a total of 3098 complaints, as against 3406 in 2008. This represents a 9% decrease on the year, but we are fully aware that 56% of the inquiries were addressed to the Commission. We are also aware that the most frequent claims for maladministration concern a lack of transparency, including refusal to provide information, and I am committed to tackling such cases further.

The Commission welcomes the efforts made by the Ombudsman to further reduce the average length of his inquiries to nine months. The Commission stresses, however, that its own deadlines for internal consultation and for the College of Commissioners to endorse its replies should be taken into consideration by the Ombudsman in his efforts to reduce the time for dealing with a complaint. Each response is confirmed and endorsed by the College, and it takes some time to reach the College.

It should be noted that the Ombudsman has conducted an intensive information campaign, which has resulted in greater awareness of citizens’ rights and better understanding of his spheres of competence. In this regard, the Ombudsman tends readily to issue press releases, and these are often published at a stage when the Ombudsman has just sent the Commission a draft recommendation, thus leaving no room for the Commission for defence, since its reply is still ongoing.

In some cases, a friendly solution may be found if the institution offers redress to the complainant. This solution is freely offered, without involving liability issues or setting a legal precedent. If a friendly solution cannot be found, the Ombudsman can make recommendations to resolve the case. If the institution does not accept his recommendations, he can make a special report to Parliament. In 2009 there were no special reports sent to Parliament by the Ombudsman. A special report was sent to Parliament in 2010 regarding a complaint on access to Commission documents.

Relations with the Ombudsman have occasionally given rise to differences of opinion. This has been the case with inquiries concerning infringement procedures. The Ombudsman often argues that the Commission has not provided a sufficient explanation of its position, which clearly requires a response from the Commission on the substantive content of its reasoning and comes close to a debate on the merits of the Commission’s line. However, the Commission has tended to respond at great length to the Ombudsman, setting out in detail, and backing up, the interpretations of the law that have been applied, while adding a disclaimer about differences in interpretation of the law and stressing that the final arbiter is the European Court of Justice.

Given the developments which have occurred in recent years on the registering and treatment of complaints (the ‘EU Pilot’ project), as confirmed in its annual report on monitoring the application of EU law in 2009, the Commission would like, in the near future, to update its Communication of 23 March 2002 on relations with the complainant in respect of infringements of Community law. I have personally met the Ombudsman and was able to inform him about these developments.

In the field of transparency and access to documents, the Commission thoroughly examines all the complaints addressed to it by the Ombudsman.

One of these cases led the Ombudsman to submit in 2010 a special report to Parliament and this is the subject of Ms Paliadeli’s report. I regret that this special report was sent shortly after the Commission had taken a final decision in the case. Nevertheless, I acknowledge that the time taken for reaching this decision was excessive, even if it was due to the failure of the third party to respond to the Commission’s proposal. I would like to stress that the Commission is fully committed to sincerely cooperating with the Ombudsman. There is no question of unwillingness to cooperate on the part of the Commission and certainly no intention to obstruct the Ombudsman’s work in any way. The Commission always strives to cooperate closely with the Ombudsman. However, some requests for access to documents are particularly complex or voluminous and cannot be handled within normal time-frames. The Commission handles around 5000 access requests per year, of which only 15 to 20 lead to complaints to the Ombudsman.

The entry into force of the Treaty on the Functioning of the European Union has made it possible to start thinking about how to achieve a common approach in order to establish an open, effective and independent European administration. The Commission therefore considers that an interinstitutional dialogue is needed before presenting any legislative proposal. A positive outcome here seems possible, and cooperation between the two institutions on the matter should ensure it.

If you will allow me, Mr President, I will also respond to Ms Lichtenberger because she has made a great effort to be here this morning. I would like to assure her that the Commission attaches great importance to the correct application of EU law and, as you know, this was among the priorities of the Barroso Commission. Already in our communication ‘A Europe of results’, in 2007, the Commission committed itself to improving its working methods to ensure the more efficient pursuit of problems arising in the application of EU law, focusing on the issues which cause the most problems for citizens and businesses. I said in this communication that the annual report represents more of a strategic evaluation of the application of EU law, identifying the main challenges, setting priorities and programming work according to those priorities. The Commission welcomes Parliament’s response to this report. The following remarks pick up on some of the key issues.

Concerning the provision of information on infringements, the Commission is in the process of implementing the new framework agreement with Parliament. It is committed to providing Parliament with the information set out in that agreement. The Commission also looks forward to associating Parliament with its work on the ‘Your Europe’ portal to ensure that citizens know where to go to find the information that they seek.

We welcome Parliament’s recognition of the contribution of the EU Pilot project to a properly functioning, citizen-focused European Union, in accordance with the Lisbon Treaty. This project is designed to ensure that citizens’ concerns and complaints about the application of EU law are followed up, and that is, of course, a major consideration for us. In doing this work, the Commission has to respect the confidentiality to which the Court of Justice has confirmed that the Member States are entitled concerning the investigation of alleged application issues and potential infringement proceedings.

Therefore, while the Commission provided extensive information in its report adopted in March this year on the functioning of the EU Pilot project, it does not grant access to, or divulge information on, the particular cases being handled under EU Pilot. At the same time, the Commission recognises the importance of ensuring the timely provision to citizens of a full and clear evaluation of the outcome of work done with the Member States in EU Pilot, and it is committed to ensuring that complainants have an opportunity to comment on the outcome.

On the question of the adoption of the procedural code under Article 298, the Commission understands that a working group has been set up in Parliament to study the potential scope and content of such an initiative. The Commission also considers it appropriate to weigh the outcome of initial work on the overall issue before considering any more specific elements. For the moment, therefore, we reserve our position on all aspects.

The Commission is also preparing to provide up-to-date information on the resources devoted to the application of EU law. The draft resolution being discussed today covers a wide range of issues and, in its response to the resolution, the Commission will provide additional explanations which would be very difficult to provide today, mainly through lack of time.

Mr President, Honourable Members, we are glad to share the common interest in the current application of EU law for the benefit of EU citizens and businesses. The effective application of EU law is one of the cornerstones of the EU, as a well as a key component of smart regulation.

I would like to apologise to the interpreters for speaking so quickly. Thank you very much for your patience, and thanks to all of you for your attention.

  Rainer Wieland, Verfasser der Stellungnahme des mitberatenden Petitionsausschusses. − Herr Präsident, Herr Ombudsmann, Herr Kommissar! Wir führen hier eine gemeinsame Debatte. Ich spreche für die Vorsitzende des Petitionsausschusses, die leider erkrankt ist, und möchte mich auf den Bericht von Frau Paliadeli beschränken.

Wir haben uns in diesem Hause schon öfter darüber gestritten und unterhalten, wie weit der Zugang zu Dokumenten möglich sein sollte, über den Sinn von Transparenz, den Nutzen von Transparenz und auch darüber, wo die rote Linie gezogen werden soll zwischen den berechtigten Interessen der Öffentlichkeit und den berechtigten Interessen von einzelnen Personen und von Firmen. Übrigens kann, Frau Paliadeli, der Fall auch einmal umgekehrt liegen, nämlich dass eine Information an eine NGO herausgegeben worden ist und eine Firma oder ein Einzelner sagt: Ich möchte gerne wissen, welche Information denen gegeben worden ist. Hier gibt es kein Gut und Böse, sondern hier gibt es Fristen, und die Fristen sind gegenüber dem Bürger und selbstverständlich auch gegenüber dem Ombudsmann einzuhalten. Das ist sozusagen das kleine Einmaleins des Verwaltungshandelns. Und da erwarten wir von der Kommission, dass sie in diese Richtung ihre Tendenz zur Beschleunigung, die der Vizepräsident gerade erwähnt hat, vielleicht auf dieses Thema richtet und dort etwas mehr Verbesserung erzielt.

  Elena Băsescu, în numele grupului PPE. – Doresc să intervin în calitate de raportor alternativ al grupului PPE pentru raportul special al Ombudsmanului European. Subliniez în primul rând faptul că atingerea unui consens între toate grupurile politice a facilitat elaborarea raportului. Menţionez că nu a existat niciun amendament depus şi doresc să o felicit totodată pe doamna Paliadeli pentru acest rezultat.

Este îngrijorător faptul că practicile necooperante ale Comisiei faţă de Ombudsman pot genera o lipsă de încredere pronunţată a cetăţenilor în instituţiile europene. Absenţa unei bune colaborări pune în pericol capacitatea Ombudsmanului şi a Parlamentului European de a supraveghea Comisia într-un mod eficient. Reamintesc, de asemenea, principiul cooperării sincere prevăzut în Tratatul privind funcţionarea Uniunii Europene. El presupune consolidarea relaţiilor de bună credinţă între instituţiile UE. Din nefericire Ombudsmanul se confruntă foarte des cu nerespectarea termenelor limită de către Comisie privind accesul public la documente.

Un alt aspect îngrijorător este faptul că Ombudsmanul a trebuit să elaboreze un raport special ca ultimă soluţie pentru a convinge Comisia să fie mai cooperantă. Astfel de cazuri nu ar trebui să mai fie întâlnite în viitor. În acest sens, doresc să solicit Comisiei Europene să facă eforturi suplimentare pentru a coopera mai eficient cu Ombudsmanul. Nu trebuie neglijat faptul că, în condiţiile în care Comisia nu-şi va lua un astfel de angajament, Parlamentul va putea să aplice sancţiuni. Situaţia expusă în raport creează o problemă sistematică. Ea privează cetăţenii de unul dintre beneficiile-cheie pe care ei se aşteaptă să-l obţină în urma dreptului fundamental de a adresa plângeri.

  Monika Flašíková Beňová, za skupinu S&D. – Ja chcem poďakovať všetkým trom kolegyniam za správy, ktoré tu dnes prerokúvame v spoločnej debate, ale ak dovolíte, vyjadrila by som sa najmä k správe pani kolegyne Lichtenberger, pretože ju považujem za mimoriadne precíznu a v mnohom s ňou súhlasím. Preto, ak dovolíte, pán viceprezident, budem aj ja dnes trochu kritickejšia.

Súhrne sa dá konštatovať, že Komisia nie celkom dostatočne komunikuje s občanmi i s Parlamentom o tom, ako kontroluje uplatňovanie práva Spoločenstva. Pritom aktívnu úlohu občanov európskej únie jednoznačne zakotvuje Zmluva o Európskej únii, napríklad vo veci Európskej iniciatívy občanov. A ja som veľmi rada, pán viceprezident, že ste to práve Vy, ktorý je tu dnes s nami pri tejto debate, pretože viem, že Vy osobne ste nielen kompetentný, ale mimoriadne sa angažujete práve vo veci európskej občianskej iniciatívy.

Napriek tomu ale každoročné správy Európskej komisie o kontrole uplatňovania práva v Európskej únii vo svojej aktuálnej podobe poskytujú občanom a Parlamentu nedostatok informácií o stave veci. Komisia sa doteraz príliš fixovala na transpozíciu európskeho práva do národného, avšak nedbala už toľko na jeho skutočné uplatňovanie. Strohý odkaz na formálne konanie v prípade členského štátu, ktorý ešte netransponoval právo Európskej únie na vnútroštátnej úrovni, nám ani občanom veľa nenapovie. My sa musíme a chceme dozvedieť viac o prípadoch, kedy Komisia prešetruje nepresnú alebo úplne chybnú transpozíciu. Až keď budeme plnohodnotne informovaní o takýchto prípadoch, môžeme hovoriť o dôslednej kontrole uplatňovania práva Európskej únie.

Ako iste všetci vieme, kolegyne a kolegovia, Európsky parlament má voči Komisii isté povinnosti a právomoci. Jednou z nich je aj kontrola, resp. hodnotenie činnosti. My v Európskom parlamente máme úprimný záujem zmysluplne hodnotiť pokrok Komisie v plnení vašich úlohy, strážiť zmluvy a plnenie práva Európskej únie. Nemáme však dostatočný prístup k údajom, na základe ktorých Komisia rieši porušovanie predpisov. A toto, pán viceprezident, nie je nová požiadavka.

Už vo februári sme v uznesení o revidovanej rámcovej dohode medzi Európskym parlamentom a Európskou komisiou požiadali Komisiu, aby, a teraz citujem: „sprístupnila Európskemu parlamentu súhrnné informácie o všetkých konaniach vo veci porušenia predpisov na základe úradnej výzvy, ak o to Európsky parlament požiada", koniec citátu. Naozaj by som chcela veľmi apelovať, aby nám a prostredníctvom nás aj občanom Európskej únie Komisia poskytla tieto údaje.

Záverom, vážený pán viceprezident, niekoľko krát som vo svojich vystúpeniach už hovorila o tom, že Európsky parlament má úprimný záujem Komisii pomáhať a dokonca ju podporovať aj proti Rade. Teraz Vás žiadame o to, aby Komisia na revanš Európskemu parlamentu poskytovala informácie, ktoré žiadame nielen pre nás, ale aj pre občanov členských štátov Európskej únie.

  Margrete Auken, for Verts/ALE-Gruppen. – Hr. formand! Fra Udvalget for Andragender, altså borgerklageudvalget, er respekten for EU-lovgivningen helt i centrum. Borgerne kommer til os, fordi nationale eller lokale myndigheder ikke lever op til EU-lovgivningen om beskyttelse af f.eks. menneskers sundhed og naturen. Tag nu bare de mange klager, vi har fået over den langvarende affaldskrise i Campania trods en klar dom fra EU-Domstolen, og over indefrysning af penge. Der er ikke gjort noget seriøst for at få has på problemet. Såvel borgerne som beskyttet natur lider. Det, vi kaldte det lykkelige Campania – ak! Her må alle forhåndenværende midler tages i brug af Kommissionen omgående.

Traktaten giver Kommissionen en afgørende rolle. Den skal overvåge medlemsstaternes opfyldelse af EU-lovgivningen. Vi er derfor i udvalget meget opmærksomme på, hvordan Kommissionen håndterer overtrædelserne af reglerne. I det lys hilser jeg Eva Lichtenbergs rapport velkommen. Hun gør det helt klart, at det ikke går an bare at sende klager over medlemsstaternes overtrædelser tilbage til dem selv for at få dem løst der. Det er jo dem, der klages over. Det er at lade borgerne helt i stikken.

I den sammenhæng vil jeg gerne komplimentere EU-Ombudsmanden for at have lavet en egen initiativundersøgelse af netop Kommissionens nye måde at behandle klager og overtrædelser på, især måden hvorpå Kommissionen registrerer eller måske netop ikke registrerer anklager mod medlemsstaterne for at tilsidesætte fællesskabsloven. Ombudsmanden har kompetence til også at forholde sig til substansen, når man beskylder Kommissionen for ikke at have fulgt op på overtrædelserne, selv om det i sidste instans naturligvis er Domstolen, der skal afgøre sagen.

Under alle omstændigheder er det et fremskridt, hvis vi vedtager fru Nedelchevas forslag i hendes betænkning om at få en ordentlig lov om procedurer for EU-administrationen, hvilket vi endelig har fået basis for i Lissabontraktatens artikel 298.

Skønt Ombudsmandens årlige rapport påviser mange tegn på forbedringer, er det stadigvæk bekymrende, at over en tredjedel af klagerne drejer sig om mangel på transparens og adgang til dokumenter og information. Her er det beskæmmende, at såvel Kommissionen som flere medlemsstater forsøger at beskytte store lobbyister frem for borgerne gennem noget, der klart ligner misbrug af databeskyttelsesreglerne.

Et hårrejsende eksempel er her Ombudsmandens specialrapport om Porsche og korrespondancen om beskyttelse af CO2-grænser for biler. Tror nogen herinde, at en mindre eller mellemstor virksomhed var blevet konsulteret af Kommissionen om adgang til breve, eller at Kommissionen ville have forsinket sagen i 15 måneder for en mindre virksomheds skyld? Selvfølgelig ikke! Det er, fordi det var Porsche, og selvfølgelig måske også fordi det var hr. Verheugen. Ombudsmandens særlige beretning fortæller en længere historie, og jeg vil anbefale alle at læse såvel fru Paliadelis fortræffelige betænkning, som rapporten selv. Det er stor underholdning. Man spærrer øjnene op igen og igen. Det mest alvorlige i denne sag er imidlertid Kommissionens mangel på loyalt samarbejde med Ombudsmanden. Det er en vigtig betænkning. Det er nødvendigt, at Parlamentet kommer med en klar tilkendegivelse i den sag. Tak til Ombudsmanden og tak til fru Paliadeli.

  Oldřich Vlasák, za skupinu ECR. – Výroční zpráva veřejného ochránce práv je dobrým příkladem toho, jak bychom měli představovat svoji činnost veřejnosti. Zpráva je srozumitelná, výstižná a drží se věci. Velmi si proto vážím Vaší snahy i vynaloženého úsilí a rád bych Vás osobně touto cestou ocenil. Rád bych však současně na tomto místě konstatoval, že v činnosti úřadu veřejného ochránce práv spatřuji jeden systémový problém. Tímto problémem je informovanost. Připusťme si totiž, že Evropská unie jako mezinárodní organizace je do značné míry nesrozumitelná, a to nejen, pokud jde o její dotace, ale také v oblasti svých pravomocí, institucí, rozhodovacích procesů či přijímaných politik a legislativy. Myslím tím nesrozumitelná pro běžného občana. To stejné platí logicky i o úřadu veřejného ochránce lidských práv. Nepochybuji o tom, že kdybychom provedli průzkum mezi evropskými občany ohledně úlohy evropského veřejného ochránce práv, jeho působení a jeho činnosti, bohužel bychom zjistili, že občané ho vnímají jako někoho, kdo je daleko, a v mnoha případech ani netuší, že existuje. Fakta jsou poměrně jednoznačná. Drtivá většina zaslaných stížností, které předložili moji spoluobčané z České republiky, nespadalo do kompetence evropského veřejného ochránce práv. Nejinak je tomu i v jiných členských státech.

Když se na tomto místě projednávala zpráva za rok 2008, všichni jsme zde apelovali na větší informovanost. Byly navrhovány rozsáhlé informační kampaně, bylo oceňováno spuštění internetových stránek. Sám jsem se však včera fiktivně pokusil na Vašich internetových stránkách stížnost podat. Musím konstatovat, že interaktivní průvodce je až příliš složitý a po pravdě řečeno pro běžného občana nesrozumitelný. Stejně tak složitý je i samotný formulář stížnosti. Připomíná mi tak trochu daňové přiznání u nás doma, které bez daňového poradce není běžný občan schopen správně vyplnit. Po pravdě řečeno, občany Vaše stránky od sepsání stížnosti spíše odradí. Apeluji proto na zjednodušení.

Co dále považuji za nesmírně důležité, je také zkrácení doby potřebné na vyřízení případů. Koneckonců víme, že pokud si někdo stěžuje, je z hlediska důvěry nanejvýš důležité, aby stížnost byla co nejrychleji vyřízena a stěžovatel obdržel odpověď co nejdříve. A pokud není daná věc v kompetenci orgánu, kterému je stížnost adresována, měl by stížnost postoupit přímo vnitrostátním nebo regionálním veřejným ochráncům práv, kteří mají příslušné pravomoci.

Dámy a pánové, příliš mnoho komunikace zabíjí informace. Příliš mnoho informací zabíjí evropské občany. Podle mého názoru by mělo být prioritou veřejného ochránce práv nejenom řešení, ale spíše předcházení nesprávným úředním postupům. Považuji proto za klíčové, aby tato instituce nebyla zneužívána k mediálním kampaním a aby nedocházelo k rozšiřování jejich pravomocí. Po svém zvolení ochránce práv Diamandouros uvedl: „Budu pokračovat ve snaze zvýšit kvalitu administrativy Evropské unie.“ Proto bych se na závěr rád zeptal, jaký systémový problém, co konkrétně se Vám podařilo zlepšit a na co hodláte svoji pozornost upřít v následujícím roce. A právě při hledání systémových řešení Vám přeji mnoho úspěchů.

  Willy Meyer, en nombre del Grupo GUE/NGL. – Señor Presidente, mi grupo querría agradecer a la Señora Nedelcheva este informe, que nos permite disponer de toda una información, desde la Comisión de Peticiones, sobre el trabajo del Defensor del Pueblo.

Se trata de un informe muy descriptivo de toda la actividad del año 2009 y recoge gran número de todas las quejas, que se han reducido, por cierto, en un 9 % respecto al año anterior, y están relacionadas, en más de la mitad de los casos, con la Comisión Europea.

Creo que las quejas que se han presentado al Defensor del Pueblo denuncian malas prácticas administrativas, como la falta de transparencia y la denegación de acceso a documentos. Podemos estar satisfechos de que una gran parte de estas quejas son resueltas por la propia gestión del Defensor y que, por lo tanto, vamos en un camino acertado.

En relación con los objetivos para el 2010, que se resumían en 5 objetivos, el escuchar abierto a sugerencias para identificar mejores prácticas, el cumplir para encontrar formas de lograr resultados más rápidos, el persuadir para poder tener un impacto más favorable en la cultura administrativa de las Instituciones, el comunicar en la información puntual, útil, de acceso rápido, el adaptarse para hacer una gestión buena de recursos, de eficacia y de eficencia. Creo que estos objetivos que se plantearon para el 2010 tienen tremenda actualidad.

Tenemos por delante la necesidad de actualizar mecanismos que nos permitan resolver casos de opacidad, de falta de información, que sin duda alguna se están dando. Tenemos el ejemplo del informe Paliadeli, en relación con el caso de la empresa Porsche, y, como la empresa Porsche de automóviles se negó, o la Comisión se negó, mejor dicho, a publicitar algunas de las cartas de esta empresa, se nos hace necesario, al Parlamento Europeo, apoyar al Defensor, y al Defensor también apoyarse en el Parlamento Europeo para conseguir una mayor información sobre estos asuntos.

Es muy preocupante la reciente decisión del Tribunal de Justicia de la Unión Europea que anula la decisión de la Comisión de publicar la lista de destinatarios de las ayudas de la PAC. Es decir, esta decisión va en contra de los principios de transparencia, básicos, que deben regir todo lo relacionado con el presupuesto europeo y supone un ataque directo contra el derecho de los ciudadanos a saber a quién se destinan sus impuestos. Creo que esta es una mala práctica que deberíamos intentar resolver a través del Parlamento con los cambios legislativos que fueran precisos.

  Νικόλαος Σαλαβράκος, εξ ονόματος της ομάδας EFD. – Κύριε Πρόεδρε, μετά την ανάγνωση της ετήσιας εκθέσεως του Ευρωπαίου Διαμεσολαβητή για το έτος 2009 αισθάνομαι την υποχρέωση να επαινέσω τον κ. Διαμαντούρο γιατί εκπροσωπεί και υπηρετεί επάξια τον θεσμό ο οποίος ενώνει τους ευρωπαίους πολίτες και τους δημιουργεί ασφαλές αίσθημα καταφυγής.

Είναι βέβαια καθήκον του Ευρωπαίου Διαμεσολαβητή να διασφαλίζει ότι οποιοδήποτε φυσικό ή νομικό πρόσωπο ενδέχεται να αντιμετωπίζει προβλήματα με τα όργανα της Ευρωπαϊκής Ένωσης, με τις υπερβάσεις των οργάνων αυτών και με ό,τι συνιστά κακοδιοίκηση, πρέπει να προσφεύγει σε αυτόν.

Όμως διεπίστωσα από την ανάγνωση της εκθέσεως ότι η επιτυχία του θεσμού και των λειτουργών του οφείλεται στο γεγονός ότι : πρώτον, οι περισσότερες έρευνες, ήδη το 70% από αυτές, περατώθηκαν μέσα σε διάστημα ενός έτους και πάνω από τις μισές, το 55%, περατώθηκαν εντός τριών μηνών. Αυτό αποδεικνύει την ταχύτητα ενέργειας του Ευρωπαίου Διαμεσολαβητή και των συνεργατών του και συνεπώς την εύρυθμη λειτουργία του θεσμού.

Δεύτερον, σε ποσοστό 80% των υποθέσεων που επελήφθη ο Διαμεσολαβητής ήταν σε θέση να βοηθήσει τον ενδιαφερόμενο να επιλύσει το θέμα του με τον άλφα ή βήτα τρόπο, είτε παραπέμποντάς τον στο αρμόδιο όργανο είτε παρέχοντας συμβουλές σχετικά με τον φορέα στον οποίο πρέπει να απευθυνθεί για την ταχεία επίλυση του προβλήματός του. Αυτό αποδεικνύει την αποτελεσματικότητα του θεσμού.

Δεν πρέπει να διαφεύγει της προσοχής μας ότι το 84% των αναφορών υποβλήθηκε από ιδιώτες και μόλις το 16% από επιχειρήσεις και ενώσεις, πράγμα που επίσης σηματοδοτεί το κύρος του θεσμού και των εκπροσώπων του στον ευρωπαίο πολίτη που θεωρεί ότι είναι θύμα κακοδιοικήσεως. Ιδιαιτέρως τονίζω ότι εννέα από τις υποθέσεις που περαιώθηκαν το 2009 συνιστούν παράδειγμα βέλτιστης τακτικής. Και σημειώνω ότι ιδιαίτερα με ευχαρίστησε προσωπικά το γεγονός ότι εκδηλώνεται στο προοίμιο της εκθέσεως η πρόθεση του Ευρωπαίου Διαμεσολαβητή να συμβάλει στη διασφάλιση των συνθηκών που θα επιτρέψουν στην Ευρωπαϊκή Ένωση να αποδώσει στους πολίτες τα οφέλη που τους υποσχέθηκε η Συνθήκη της Λισαβόνας. Συγχαίρω λοιπόν τον κ. Διαμαντούρο.

Auch ich habe schon einmal eine Beschwerde beim Bürgerbeauftragten eingereicht, auch wenn das Ergebnis für mich jetzt nicht unbedingt positiv ausgefallen ist und ich damit nicht zufrieden war, möchte ich doch dem Herrn Bürgerbeauftragten für seine Arbeit ein Kompliment machen und ein Lob aussprechen. Ich denke, es ist sehr, sehr wichtig, dass wir ihm hier von diesem Haus aus den Rücken stärken.

Er hat in seiner Eingangsrede ganz richtig angesprochen, dass sein Erfolg ganz wesentlich vom Verhalten der Institutionen abhängt. Wenn man sich den Fall Porsche AG anschaut, dann zeigt der doch ganz deutlich, wo die Grenzen des Bürgerbeauftragten liegen und wie ernsthaft manche Institutionen mit seinen Empfehlungen umgehen.

Es gilt natürlich auch hier vor der eigenen Türe zu kehren, z.B. beim Fall des Kaufs des Altero-Spinelli-Gebäudes gab es massive Ungereimtheiten. Es gab deutliche Empfehlungen des Bürgerbeauftragten, es gab Änderungsanträge, doch bis jetzt ist in diesem Haus eigentlich nicht wirklich viel passiert. Die Änderungsanträge wurden abgelehnt. Ja, das zeigt auch wieder, wie das Haus mit diesen Empfehlungen umgeht. Was ich damit sagen will, ist, dass es sehr wichtig ist, vor der eigenen Türe zu kehren und die Empfehlungen des Bürgerbeauftragten ernstzunehmen und ihm dadurch auch den Rücken zu stärken.

  Tadeusz Zwiefka (PPE). - Panie Przewodniczący! Jak co roku Komisja Prawna przedstawia Parlamentowi raport dotyczący sprawozdania Komisji Europejskiej w kontekście stosowania prawa unijnego i jak co roku członkowie Komisji Prawnej mają wiele zastrzeżeń zarówno co do meritum, jak i do formy, w jakiej Komisja to sprawozdanie sporządza.

Nie ulega wątpliwości, że bardzo ważnym problemem we Wspólnocie jest kwestia transpozycji prawa unijnego do systemów krajowych. Te same przepisy są wprowadzane przez różne kraje w różnym czasie, co pod pewnymi względami jest oczywiście zrozumiałe. Jednak nie może prowadzić do takich opóźnień, które powodują brak pewności prawnej, a w konsekwencji uniemożliwiają korzystanie przez obywateli z przysługujących im praw. Jak słusznie zauważa nasza sprawozdawczyni, opóźnienia w transpozycji oraz niewłaściwe stosowanie prawa unijnego pociągają za sobą realne koszty oraz prowadzą do braku zaufania obywateli do instytucji wspólnotowych. Dlatego też z zadowoleniem przyjmuję wszelkie inicjatywy Komisji, takie jak spotkania ekspertów i dwustronny dialog pomiędzy Komisją a państwami członkowskimi, których celem jest jak najszybsze rozwiązanie powyższych problemów. Z wielkim zainteresowaniem przyglądam się programowi EU pilot, który ma być narzędziem, dzięki któremu można będzie szybko reagować na wszelkie przypadki niewłaściwego stosowania lub dostosowywania prawa unijnego do prawodawstwa krajowego.

Po raz kolejny także podkreślamy rolę, jaką odgrywają sądy krajowe w procesie praktycznego stosowania i wykładni prawa unijnego. Rola ta nie będzie jednak poprawnie wypełniana, jeśli nie będą prowadzone odpowiednie szkolenia, spotkania i tworzenie wspólnotowej kultury prawnej. Słowo o naszej Izbie – Koleżanki i Koledzy – otóż tworzone przez nas prawo, to my jesteśmy legislatorem, musi być jasne i czytelne, bowiem tylko wtedy, kiedy jest ono zrozumiałe będzie w sposób łatwy transponowane do systemów krajowych i będzie mniej problemów z tym związanych.

  Lidia Joanna Geringer de Oedenberg (S&D). - Panie Przewodniczący! Analizując sprawozdanie z działalności Europejskiego Rzecznika Praw Obywatelskich za 2009 rok z zadowoleniem zauważam dalszy rozwój współpracy pomiędzy rzecznikiem i Komisją Petycji. Bardzo pozytywnie oceniam pracę profesora Diamandourosa, który pełni funkcję rzecznika od 2003 roku, a także jego wysiłki w dziedzinie informowania obywateli o możliwościach wnoszenia skarg dotyczących niewłaściwego funkcjonowania administracji Unii Europejskiej oraz zachęcania obywateli do korzystania z przysługujących im praw.

Biorąc pod uwagę, że wśród zarejestrowanych w 2009 roku ponad trzech tysięcy skarg tylko 23 % wchodziło w zakres kompetencji rzecznika, absolutnie należy kontynuować działania informacyjne. Ze względu na ograniczone kompetencje może on bowiem rozpatrywać skargi dotyczące jedynie instytucji i organów Unii Europejskiej. Jednakże, co ważne, wszyscy zwracający się do rzecznika ze skargami niedopuszczalnymi ze względów formalnych otrzymują informację o właściwej instancji, do której w konkretnym przypadku skarżący może się zwrócić.

Ważne jest także, aby zaznaczyć, że wejście w życie Traktatu z Lizbony umacnia znacznie legitymację demokratyczną rzecznika i rozszerza jego kompetencje na politykę zagraniczną. Należy również odnotować fakt, że Ombudsman coraz częściej podejmuje działania z własnej inicjatywy, na przykład w zakresie opóźnionych płatności z Unii Europejskiej, niepełnosprawności czy dyskryminacji. Jego działalność przyczyniła się również do powstania Europejskiego Kodeksu Dobrej Praktyki Administracyjnej. Cieszy również skrócenie czasu prowadzenia postępowań do dziewięciu miesięcy.

O skuteczności rzecznika oraz jego dobrej współpracy z innymi podmiotami świadczy również wysoki odsetek zakończonych spraw, w których instytucja, której dotyczyła skarga, przystała na ugodę lub rozwiązała poruszoną kwestię na korzyść skarżącego. W 2009 roku dotyczyło to aż 56 % przypadków. Mam nadzieję, że rzecznik wspomagany przez nas, przez Parlament i inne instytucje, będzie kontynuował swoją pracę z równą energią i jeszcze większą niż dotychczas skutecznością.

  Anneli Jäätteenmäki (ALDE). - Arvoisa puhemies, kiitokset oikeusasiamiehelle ja koko hänen toimistolleen arvokkaasta työstä vaikeissa oloissa. Avoimuus, oikeus tutustua tietoihin ja oikeus hyvään hallintoon ovat keskeisiä edellytyksiä kansalaisten luottamukselle EU-toimielinten kykyyn valvoa heidän oikeuksiaan. On huolestuttavaa, että vuosi vuoden jälkeen suurin hallinnollinen epäkohta on avoimuuden puute, jopa kieltäytyminen tietojen ja asiakirjojen antamisesta. Porsche-tapaus on tässä suhteessa erittäin vakava. Viivyttämällä pyydettyjen asiakirjojen antamista 15 kuukautta komissio laiminlöi vakavasti velvollisuutensa tehdä vilpitöntä yhteistyötä oikeusasiamiehen kanssa. Tämä komission asenne rapautti kansalaisten luottamusta sekä komissioon että EU:n julkiseen kuvaan.

Nyt kun komission edustaja ja oikeusasiamies istuvat siinä sovussa vierekkäin, minusta olisi hyvä, että aloitettaisiin luottamuksellinen ja perusteellinen keskustelu siitä, kunnioitetaanko toisen työtä, ollaanko valmiita tekemään yhteistyötä ja toimimaan EU:n omien perusperiaatteiden mukaan. En halua tässä syyttää ketään yksittäistä komission jäsentä, mutta asiasta olisi syytä aloittaa komissiossa todellinen keskustelu, koska ei EU:n julkinen kuva kyllä niin hyvä ole, että tällaisiin Porsche-tapauksiin olisi tulevaisuudessa varaa.

Kansalaisten oikeuksia täytyy kunnioittaa komissiossa, neuvostossa ja tietysti myös parlamentissa, kaikissa EU-toimielimissä.

  Gerald Häfner (Verts/ALE). - Herr Präsident! Herr Diamandouros ist ein Glücksfall für die Bürger und für diese Union, und ich möchte ihm aufrichtig für diese Arbeit danken. Sie legt aber zugleich natürlich den Finger in die Wunde dessen, was besser werden muss. Gerade wurde der Porsche-Fall angesprochen. Ich sage das hier ausdrücklich auch als Deutscher: Mich beschämt ein solcher Vorgang. Ein deutscher Kommissar, eine deutsche Autofirma, ein Briefverkehr zwischen beiden, alle anderen Briefverkehre mit italienischen, spanischen und anderen Autoherstellern werden veröffentlicht, dieser Briefwechsel nicht. Es gibt Rügen des Bürgerbeauftragten, einmal, zweimal, dreimal – es passiert nichts. Hier muss sich dringend etwas verbessern. Das möchte ich mit allem Nachdruck hervorheben.

Ich möchte etwas Zweites sagen: Piloten, das ist eine Berufsgruppe, die sich meistens weit vom Boden abhebt, in den Lüften schwebt. Mir ist nicht ganz klar, wie die Kommission auf den Gedanken kommen konnte, nun ihr neues Projekt zum Umgang mit Bürgerbeschwerden Pilotprojekt zu nennen, denn was da geschieht, ist genau dasselbe. Bürger beschweren sich aus guten Gründen, zunächst in ihrem Land. Dort passiert nichts. Dann wenden sie sich an die Kommission. Und was tut die Kommission? Sie schickt das Schreiben mit einem Piloten auf die Reise zurück, dorthin, wo nichts passiert ist, und es passiert wieder nichts. Ich glaube nicht, dass das ein adäquater Umgang mit Bürgeranliegen und Beschwerden sein kann, und würde diese Gelegenheit gerne nutzen, lieber Kommissar Šefčovič, den ich über die Maßen schätze, dass Sie uns hier erklären: Sie beenden entweder dieses Projekt oder denken darüber nach, wie man es so machen kann, dass Bürgerbeschwerden auch dort landen, wo sie wirklich bearbeitet werden und die Bürger Recht und Abhilfe bekommen.

  Marek Henryk Migalski (ECR). - Pani Przewodnicząca! Panie Komisarzu! Nie chciałbym zamieniać tej sali w salę uniwersytecką czy seminaryjną. Natomiast jak państwo wiecie, pierwszy urząd ombudsmana powstał właśnie w Europie prawie 300 lat temu. Dlatego nie jest dziwne, że tymi rzeczami się interesujemy i poświęcamy im tyle uwagi.

Myślę, że wszystkie trzy sprawozdania zasługują na uwagę, z jednym tylko zastrzeżeniem. W sprawozdaniu pani Maryi Nedelchevy jest jednak ten niepokojący fragment. Oprócz tej zbożnej i dobrej działalności Europejskiego Rzecznika Praw Obywatelskich, czy ten urząd musi jednak kosztować prawie 9 milionów euro? Czy nie da się ograniczyć tego prawie bizantyjskiego sposobu funkcjonowania tego urzędu? Dlatego moja grupa w tej materii, akurat przy tym sprawozdaniu, wstrzyma się od głosu, życząc wszystkiego najlepszego rzecznikowi, a przede wszystkim obywatelom, którzy zwracają się do niego ze swoimi skargami.

  Rui Tavares (GUE/NGL). - Em primeiro lugar gostaria de agradecer ao Sr. Diamandourus pelo seu trabalho e pelo relatório que nos entregou. É indubitavelmente um trabalho de rigor e de qualidade, e agradeço-lhe por isso. Gostaria de falar da questão da quantidade mais do que da qualidade, porque é também interessante saber quantas vezes têm os cidadãos recurso a estes serviços.

Aparentemente, há poucos milhares de queixas e, desses poucos milhares, algumas não têm cabimento. Mas é interessante saber porque é que não há mais queixas. Quer dizer, trata-se de uma questão de copo meio cheio ou copo meio vazio. Pergunto-me até que ponto o próprio carácter excessivamente complexo e opaco das instituições europeias e da legislação, sobre a qual elas se baseiam, não está na base do facto de ser difícil uma relação entre o cidadão e as instituições. Ou seja, para fazer uma queixa é preciso conhecer os seus direitos, para conhecer os seus direitos é preciso conhecer a legislação e os mecanismos necessários para apresentar essa queixa. Portanto, mais do fazer sugestões ao Sr. Diamandourus, eu pediria que o Provedor de Justiça nos fizesse a nós, isto é, ao Parlamento enquanto câmara legislativa, sugestões no sentido da simplificação dos processos legislativos e, tanto quanto possível, dos mecanismos institucionais da União Europeia. Fala-se muito em transparência e em clareza, mas a simplicidade é também um valor democrático, que nós muitas vezes esquecemos, porque permite o acesso generalizado às instituições.

Sr. Diamandourus, estou ao mesmo tempo na Comissão das Liberdades e Direitos Civis, que tem votos ao mesmo tempo. Quero assegurar que vou prestar atenção às suas respostas neste domínio.

  John Stuart Agnew (EFD). - Madam President, perhaps the most disgraceful aspect of the Commissioner’s conduct which this report discloses, over and above the appalling treatment meted out to the complainant in this case, is that it was not an isolated case of maladministration. Indeed, the facts disclosed in this trenchant report go beyond the realms of mere negligence and indolence. Rather, it is a reasonable conclusion to draw that this sort of behaviour on the part of the Commission is both quite deliberate and nothing less than a calculated course of conduct designed to thwart the hard work of the Ombudsman and to trash the rule of law.

His work is difficult enough without the added problem of a Commission that set out, as the facts here show, to impede at every turn the proper conduct of his office. There was a time when, if such shabby conduct on the part of public servants was revealed, both functionaries and the minister responsible would fall on their swords. Instead, I expect we shall see here an arrogant and overweening Commission doing what it does best, thumbing its nose at the public whilst the guilty ones go unpunished. No wonder the EU has never been so unpopular!

  Csanád Szegedi (NI). - Az omudsmani jelentésből tisztán kitűnik, hogy az uniós intézmények átláthatóságának hiánya az egyik legnagyobb probléma. A legtöbb panasz a Bizottsággal kapcsolatban érkezik, ami rendre késlekedve a válasszal, megrendíti az európai uniós intézményekbe vetett bizalmat. Növelni kell az átláthatóságot az intézmények munkájának optimalizálásával, szélesebb körű kommunikációval, ugyanakkor odafigyelve arra, hogy a költségek ezzel ne növekedjenek. Propagandára, saját reklámra már így is rengeteget költött az Európai Unió.

A panaszok száma ráadásul valószínűleg tovább fog nőni a Lisszaboni Szerződés bevezetésével, illetve az európai jogszabályok tagállamokban történő hiányos vagy késedelmes alkalmazásával. Ennek megelőzésének érdekében a nemzeti bírák, a gyakorló jogászok, a közigazgatási- és köztisztviselők számára kibővített és összehangolt igazságügyi képzéseket kell szervezni. Emellett tudatosítani kell a polgárokban, hogy az uniós jogot sértő cselekményt az érintettek nemzeti bíróságok előtt is megtámadhatják. 2011 első felében Magyarország látja el az Európai Unió soros elnökségét, ezért is különösen nagy feladat hárul ránk, magyar képviselőkre, a jogharmonizáció beültetésében.

  Peter Jahr (PPE). - Frau Präsidentin, Herr Diamandouros, sehr geehrter Herr Kommissar! Die Institution des Bürgerbeauftragten in Europa blickt mittlerweile auf eine sehr beeindruckende Vergangenheit zurück. Entstanden in Schweden, versuchen die Bürgerbeauftragten seit nunmehr 200 Jahren, durch eine unparteiische Vorgehensweise Streitfragen zu lösen und Probleme zu beheben. Das heißt, der Bürgerbeauftragte entspringt dem zutiefst menschlichen Bedürfnis, Streitfragen friedlich zu lösen.

Der aktuelle Tätigkeitsbericht ist der insgesamt fünfzehnte Bericht des Europäischen Bürgerbeauftragten und der siebte von Herrn Diamandouros. Eine stolze Bilanz, wie ich finde, und zu der ich Herrn Diamandouros beglückwünsche. Bei seiner Wahl im vergangenen Jahr habe ich mir gewünscht, dass sich der Bürgerbeauftragte für transparentere und bürgernahe Entscheidungen in der EU einsetzt, und dass wir eine gute Zusammenarbeit mit dem Petitionsausschuss pflegen. Man kann mit gutem Recht behaupten, dass Ihnen und uns das sehr gut gelungen ist. Als Reserve sehe ich noch eine bessere Koordinierung zwischen den Funktionen und Aufgaben des Bürgerbeauftragten und denen des Petitionsausschusses. Zunehmend erreichen uns Petitionen, die sowohl Aspekte des klassischen Petitionsrechtes als auch Aspekte des Bürgerbeauftragten berühren. Da geht es um Menschenrechte, Eigentumsrechte, Behinderung der wirtschaftlichen Tätigkeit. Hier ist eine Vernetzung angemessen und angebracht, damit wir dann gemeinsam mit der Kommission im positiven Sinne ringen können und auch die entsprechenden Antworten im notwendigen Zeitraum bekommen.

Positiv hervorheben möchte ich auch die neue Website, den interaktiven Leitfaden, der dafür sorgen wird, dass sich die Menschen der Möglichkeiten, die sie in Europa haben, auch bewusst werden. Ich wünsche Herrn Diamandouros, dass es ihm gelingt, seine gute Arbeit fortzusetzen und, wo es geht, auch noch zu verbessern. Der Petitionsausschuss wird sich auch zukünftig um einen engen Austausch mit dem Ombudsmann im Sinne der Bürger der Europäischen Union bemühen.

  Συλβάνα Ράπτη (S&D). - Κυρία Πρόεδρε, σήμερα εδώ συζητάμε για δύο πολύ σημαντικά θέματα. Το ένα είναι το συμφέρον των Ευρωπαίων πολιτών· το δεύτερο είναι η συμφιλίωση των Ευρωπαίων πολιτών με τους ευρωπαϊκούς θεσμούς.

Οι τρείς εκθέσεις των τριών κυριών, που πραγματικά είναι εξαιρετικές, αλλά και η δραστηριότητα του Ευρωπαίου Διαμεσολαβητή με κάνουν να φέρνω στο μυαλό μου, για λογαριασμό των Ευρωπαίων πολιτών, τον κ. Διαμαντούρο ως Ντ'Αρντανιάν και τις τρεις εισηγήτριες ως τους τρεις σωματοφύλακες για τα συμφέροντα των Ευρωπαίων πολιτών.

Είναι πάρα πολύ κρίμα που σε όλο αυτό δεν συμμετέχει τόσο όσο θα έπρεπε η Ευρωπαϊκή Επιτροπή. Το μόνο "θετικό" που βρίσκω στη σημερινή τοποθέτηση του Επιτρόπου ήταν η ταχύτητα της ομιλίας του. Και εάν η Ευρωπαϊκή Επιτροπή δρούσε με την ίδια ταχύτητα, δεν θα χρειαζόταν να κάνουμε σήμερα αυτή τη συζήτηση.

Είναι πάρα πολύ σημαντικό να αποκτήσουν οι Ευρωπαίοι πολίτες εμπιστοσύνη στους ευρωπαϊκούς θεσμούς, να τους δουν θετικά και να αισθανθούν ότι εργάζονται για το συμφέρον τους. Δεκαπέντε μήνες καθυστέρηση - όπως αναφέρει στην έκθεσή της η κ. Παλιαδέλη - για να δοθούν τρεις επιστολές μιας αυτοκινητοβιομηχανίας που ειδικεύεται σε αυτοκίνητα μεγάλης ταχύτητας, σχήμα οξύμωρο! Εάν στη θέση της αυτοκινητοβιομηχανίας ήταν τα συμφέροντα ενός μεμονωμένου Ευρωπαίου πολίτη, θα ήταν τόσο μεγάλη η καθυστέρηση; Αναρωτιέμαι!

Εν πάση περιπτώσει, νομίζω ότι πρέπει να είμαστε ειλικρινείς. Πρέπει όλοι να συνεργαστούμε, πρέπει να δείξουμε εμπιστοσύνη σε αυτά που είπε ο Επίτροπος, να πιστέψουμε ότι η Επιτροπή έχει την καλή διάθεση να συνεργαστεί με τον Ευρωπαίο Διαμεσολαβητή και πραγματικά να εργαστούμε όλοι για τα συμφέροντα των Ευρωπαίων πολιτών. Ας αποκτήσει η Επιτροπή την ταχύτητα στη δράση ίδια με την ταχύτητα που είχε στην ομιλία του και δυσκόλεψε τους διερμηνείς ο κ. Επίτροπος.

  Oriol Junqueras Vies (Verts/ALE). - Señora Presidenta, bon dia. Lamento que ya no presida la sesión el señor Vidal-Quadras, porque seguro que habría apreciado mi intervención.

En primer lugar, quiero agradecer al Defensor del Pueblo Europeo su trabajo y animarle a seguir defendiendo con coraje el derecho de los ciudadanos europeos, que a menudo se ven amenazados por algunas administraciones públicas.

En este sentido, quiero recordar que una asociación cultural valenciana ha recogido 650 000 firmas a favor de una iniciativa legislativa para garantizar la recepción de radios y televisiones en catalán. Se trata simplemente de cumplir el artículo 12.2 de la Carta Europea de las lenguas regionales o minoritarias del Consejo de Europa y la Directiva de servicios de medios audiovisuales sin fronteras.

Pues bien, el Gobierno español se ha negado a tomar en consideración estas 650 000 firmas. Esperemos que el Defensor del Pueblo Europeo las acoja y proteja los derechos de estos 650 000 ciudadanos europeos amparados por la legislación europea.

  Jaroslav Paška (EFD). - Úvodom by som chcel vysloviť názor, že výročné správy Komisie o kontrole uplatňovania práva Európskej únie majú isté rezervy, keďže vo svojej súčasnej podobe neposkytujú občanom ani dotknutým inštitúciám potrebné informácie o skutočnom stave uplatňovania práva Európskej únie.

Najmä v prípadoch, keď Komisia koná vo veci porušovania z dôvodov nesprávnej transpozície práva Európskej únie by bolo v budúcnosti dobré uviesť aspoň základné informácie o charaktere a rozsahu týchto porušení. Lepšej informovanosti
o konaniach pri porušeniach na základe úradnej výzvy sa nakoniec Európsky parlament už domáhal aj uznesením zo 4. februára 2010.

Ako pozitívny signál z vystúpenia podpredsedu Európskej komisie, pána Šefčoviča, vnímam úmysel Komisie preskúmať možnosť zavedenia kódexu postupu vyšetrovania, ktorý by stanovil rôzne aspekty postupu pri porušení práva vrátane časových obmedzení, práva na vypočutie, povinnosti uvádzať dôvody a podobne.

Som presvedčený, že z tesnejšej spolupráce Komisie a Európskeho parlamentu môže vzísť ešte lepší a prehľadnejší mechanizmus kontroly uplatňovania práva Európskej únie.

  Csaba Sógor (PPE). - Az európai ombudsman az Európai Unió demokratikus lelkiismerete. Évről évre hozzájárul a panaszos polgárok intézményekbe vetett bizalmának erősítéséhez. Külön örömömre szolgál, hogy a Lisszaboni Szerződés életbelépésével immár az Alapjogi Charta tiszteletben tartását is felügyeli, elsősorban a megfelelő ügyintézéshez való jog betartásán őrködve. Rendkívüli hasznosnak tartom az ombudsmanok európai hálózatát, hiszen az állampolgári tudatosság és a közszolgálat minősége egyes tagállamokban, köztük Romániában, ahonnan én jövök, nem éri el az európai átlagot. Ezt tükrözi az ombudsman tevékenységéről szóló jelentés is. Éppen ezért arra kérem az ombudsmant, hogy a jövőben próbálja meg összegyűjteni az európai jog tagállamok általi alkalmazására vonatkozó, nemzeti ombudsmanokhoz benyújtott panaszokat is, hiszen a polgárok legtöbbször saját hatóságaik révén kerülnek kapcsolatba az európai joggal.

  Κρίτων Αρσένης (S&D). - Κυρία Πρόεδρε, κύριε Επίτροπε, κατ’ αρχήν θα ήθελα να δώσω τα συγχαρητήριά μου στον Ευρωπαίο Διαμεσολαβητή για την εξαιρετική δουλειά που κάνει όλο αυτό το διάστημα. Τα συγχαρητήριά μου επίσης στις εισηγήτριες των εκθέσεων.

Θα ήθελα να αναφερθώ ειδικά στην έκθεση της κ. Παλιαδέλη. Εδώ τίθεται πραγματικά ένα συγκλονιστικό ζήτημα: η μη αποκάλυψη του πλήρους περιεχομένου της αλληλογραφίας της Επιτροπής με την αυτοκινητοβιομηχανία Porsche κατά τη διάρκεια της προετοιμασίας της οδηγίας για τις εκπομπές αυτοκινήτων. Τα θέματα που τίθενται είναι η αντικειμενικότητα των νομοθετικών προτάσεων της Επιτροπής και κατά πόσον είναι πραγματικά ανεξάρτητη η Επιτροπή από βιομηχανικά συμφέροντα.

Πολύ ορθώς η έκθεση προτείνει, εφόσον συνεχίζονται αυτές οι πρακτικές από την Επιτροπή, να δεσμευθεί τμήμα του προϋπολογισμού της Επιτροπής. Και αυτό, κ. Επίτροπε, θα το κάνουμε στο Κοινοβούλιο εάν δεν αλλάξουν αυτές οι πρακτικές.

  Salvatore Iacolino (PPE). - Signora Presidente, onorevoli colleghi, è naturale ritenere che un incontro come questo con il Mediatore europeo e con il Commissario acquisti un ruolo particolarmente significativo in una realtà, come è quella europea, in sviluppo dinamico e concreto nell'interesse del cittadino.

Gli strumenti peraltro recentemente previsti dal trattato di Lisbona offrono quell'iniziativa legislativa in capo ai cittadini che permette oggi di poter affermare quanto il Parlamento europeo voglia essere realmente più vicino alle esigenze e alle attese del cittadino europeo.

È vero che l'applicazione effettiva del diritto dipende prevalentemente da quanto saprà far bene la Commissione, con il supporto autorevole del Mediatore europeo. Bisogna ascoltare le istanze e le aspettative del cittadino, così come pretendere che vi siano gli strumenti realmente applicati nell'interesse del cittadino. Non si può che accogliere con favore l'esigenza manifestata attraverso l'iniziativa di un codice procedurale.

L'informazione deve avvenire attraverso criteri di accessibilità, di congruità e di trasparenza assoluta delle informazioni, perché noi riteniamo che molte regioni attendano dalla Commissione europea un maggiore slancio rispetto a quello fin qui manifestato. Non dobbiamo dimenticare quanto possa essere importante l'apporto di altri mediatori europei nel segmento relativo alle attività di cooperazione interparlamentare.

Se è vero, come è vero, che i parlamenti nazionali e il Parlamento europeo debbono cooperare efficacemente nell'interesse del cittadino, non vi è dubbio che questo arricchimento personale di storia, professionale e di culture giuridiche diverse debba trovare un momento di mediazione in questa cooperazione come metodo efficace di risoluzione di problemi nell'interesse del cittadino.

  Vilija Blinkevičiūtė (S&D). - Dėkoju ponui Ombudsmenui už pateiktą ataskaitą. Iš tiesų Europos Ombudsmeno vaidmuo yra ypač reikšmingas siekiant padėti piliečiams išsiaiškinti iškilusias problemas, pagerinti institucijų veiklos skaidrumą bei atskaitomybę. Ombudsmeno institucija siekia, kad Europos Sąjungos institucijų sprendimai būtų prieinami piliečiams, nes piliečiai turi turėti galimybę gauti norimą informaciją, kad jie galėtų pasitikėti institucijų gebėjimu ginti jų teises dėl diskriminacijos, dėl institucijų piktnaudžiavimo savo galiomis, dėl neatsakymo laiku į užklausas ar apskritai atsisakymo teikti informaciją. Komisijos sulaukia daug skundų dėl netinkamo darbo, todėl labai svarbu, kad Komisija imtųsi veiksmų, kad nebūtų vilkinami atsakymai į prašymus susipažinti su dokumentais, nes tinkamas Europos Sąjungos teisės aktų taikymas turi tiesioginės įtakos kasdieniam piliečių gyvenimui, jų teisių įgyvendinimui. Be to, dėl netinkamo teisės aktų taikymo atsiranda mažėja pasitikėjimas Europos Sąjungos institucijomis ir atsiranda papildomų išlaidų.

Na początku chciałem podziękować pani sprawozdawczyni za bardzo dobre, wszechstronne oraz zbilansowane sprawozdanie, a także rzecznikowi za jego nieustającą pracę na rzecz zwalczania niewłaściwego administrowania oraz podnoszenia standardów administracji w Unii Europejskiej.

Jak sprawozdawczyni słusznie zauważyła, ostatni rok działalności rzecznika to dobre zarządzanie i postępy w zmniejszaniu liczby skarg oraz skrócenie procedury rozpatrywania skarg. Myślę, że to także efekt ciągłości sprawowania urzędu. Jak widać, wybór pana Diamandourosa to była dobra decyzja. Rzecznik musi jeszcze jednak reagować szybciej na potrzeby obywateli. Aby to było możliwe, musi jeszcze ściślej współpracować z krajowymi rzecznikami praw obywatelskich. Funkcja Europejskiego Rzecznika Praw Obywatelskich jest funkcją zmieniającą się wraz ze zmieniającymi się czasami, ale musi on reprezentować stały uniwersalny zestaw wartości. Wierzę, że w kolejnym roku kadencji będzie jeszcze usilniej wsłuchiwał się w głos obywateli.

  Pascale Gruny (PPE). - Madame la Présidente, Monsieur le Médiateur, Monsieur le Commissaire, chers collègues, donnons un visage à l'Europe des citoyens. Il est de la responsabilité de toutes les institutions européennes de tout mettre en œuvre pour informer les citoyens de tous leurs moyens de recours en cas de violation du droit communautaire et de mauvaise administration des institutions européennes.

Tout d'abord, je salue le travail de ma collègue, Mariya Nedelcheva, pour son rapport sur les activités du Médiateur européen en 2009. La Commission européenne y est le plus souvent pointée du doigt par le Médiateur, et souvent pour l'absence d'informations. Le rapport de notre collègue, Mme Paliadeli, que je félicite également, en est un exemple flagrant.

Ensuite, je souhaite remercier notre Médiateur européen pour tout le travail accompli, avec l'ensemble de son équipe, pour sa disponibilité et son excellente collaboration avec la commission des pétitions. C'est très important. Son rôle représente une garantie essentielle pour le respect du principe de transparence et de bonne administration, et c'est là la véritable protection pour nos concitoyens.

Enfin, il serait temps que nos concitoyens soient davantage informés des moyens de recours qu'ils ont envers la Commission européenne, à savoir le Médiateur européen et la commission des pétitions. Nous avons besoin pour cela d'un portail Internet, certes, mais commun, comme nous vous l'avions déjà demandé. Il constituerait une véritable aide pour nos citoyens.

  Mairead McGuinness (PPE). - Madam President, I would like to thank the Ombudsman for his work. He has a very specific job to do, namely maladministration, and therefore it is important that citizens understand what that term means.

Much of what I am about to say does not directly impact on the Ombudsman, but I think it needs to be placed on the record. Some of the biggest problems and complaints we get are about our own Member States. Citizens then complain – as Mr Busuttil said – directly to the Commission who, under this pilot scheme, go back to the Member State to try to have the matter resolved when the citizens themselves have failed. That mechanism is not transparent and needs to be looked at. We need a discussion on it in this House.

The second issue which arises relates to property purchases and transactions between citizens in different Member States. We have no remit in this area, but it is a growing concern and we need to address it in some way.

Lastly, the Irish Ombudsman has issued two reports, which our own government have rejected. It is of deep concern that an Ombudsman in any Member State would have their work literally torn up. You are aware of that, Mr Ombudsman. I am glad that you are nodding approvingly. This must be addressed. It cannot be allowed to continue.

  Andrew Henry William Brons (NI). - Madam President, I refer to the third item: Application of European Law. It could be argued that the only thing worse than clear and transparent European law is ambiguous and uncertain EU law.

The Commission’s ‘better regulation and simplification’ agenda seems to be as elusive as the Holy Grail. The standard of English in some proposed legislation led me at first to the conclusion that it had originated in a southern dialect of Albanian. However, I discovered at an early stage that most of the worst examples originated in English.

The legislative process does not improve poorly-drafted legislation. Amendments are sent to MEPs at the last possible moment; votes are split and then reunited; we have gone into the Chamber confident that we have the latest, most final version of the voting list, only to find that it was superseded during the morning.

Those MEPs in large groups who are content to be lobby fodder for their party leaders do not have to worry. They simply follow the gesticulations of their party tic-tac men. However, for conscientious MEPs and those in the non-attached group, it is a nightmare.

  Andreas Mölzer (NI). - Frau Präsidentin! Seit Jahrzehnten bemüht sich die Union bekanntlich um Bürokratieabbau und um mehr Transparenz. Im Europäischen Parlament selbst ist davon allerdings wenig zu merken. Ganz im Gegenteil, man hat da eher das Gefühl, dass der bürokratische Papierkram jedes Jahr stärker und größer wird.

Auch im Vorfeld der Anhörungen zu den letzten Wahlen war Transparenz allerhöchstens in Ansätzen vorhanden. Die EU-Abgeordneten haben Kraft ihres Amtes und der damit verbundenen Rechte die Möglichkeit, sich Gehör zu verschaffen. Die Bürger haben das nicht. Dafür haben sie aber den Europäischen Ombudsmann. Und wenn mehr als ein Drittel der vom Europäischen Bürgerbeauftragten durchgeführten Untersuchungen mangelnde Transparenz betreffen und in 56 % aller Fälle die betroffene Einrichtung eine gütliche Einigung suchte oder das Problem löste, dann beweist das meines Erachtens, wie wichtig die Funktion des Bürgerbeauftragten ist.

Um es mit den Worten des Herrn Bürgerbeauftragten selbst zu sagen: Die Bürger haben ein Recht darauf, zu wissen, was die EU und ihre Verwaltung tut. Hinzuzufügen ist dieser Aussage nur noch, dass sie auch ein Recht darauf haben, zu wissen, wofür diese Europäische Union ihr Steuergeld ausgibt und wo es verschwendet wird. Es ist also Zeit, die Haushaltskontrolle auf Vordermann zu bringen, damit deren Berichte irgendwann auch nur annähernd so erfreulich sind, wie jene des Bürgerbeauftragten.

  Maroš Šefčovič, Vice-President of the Commission. − Madam President, in my introductory remarks I talked too fast, so I will try to correct this. I will not try to impress the Members of Parliament with the speed of my speech but with the commitment which I am very clearly making here that the Commission is very much interested in having the best possible close cooperation with the Ombudsman. I think Mr Diamandouros knows this.

He knows how closely we cooperate, and I think that the success rate in sorting out the problems of maladministration or other issues that he is investigating is so high because we are cooperating very closely and in a very positive spirit. Of course, sometimes you have cases with which there are additional problems which need more energy to tackle, and this was clearly true of the case to which most of you have referred.

This was very clearly a situation where the Commission was torn between on the one hand the commitment to transparency and the legal obligations stemming from European Court of Justice case law, and on the other hand our commitment to honour professional secrecy. If we wanted to divulge the information – which was very pertinent in this particular case – we needed the agreement of the third party, which we have spent several months trying unsuccessfully to get. Only after we made it very clear that we would publish the information anyway and informed the company that they had ten days to lodge a complaint with the European Court of Justice did we reach an agreement.

What would have happened if we had not proceeded according to our legal obligations? The complaint would probably have been filed with the European Court of Justice, and maybe we would not have had that information made public even today. So please bear with us sometimes. We are really very committed to transparency, but we must always look for a very fine line among the different commitments that we have to respect in these very complex cases.

Nevertheless, I acknowledge – as I said in my introductory remarks – that this delay was long, and that we should probably have pressed the company more. We should have got their response faster, and I can assure you that the Commission will do its utmost to ensure that we will not replicate this situation in any similar cases – we will not look for ways to drag the process out to 15 months, which was indeed unbearable. I fully agree with Mrs Paliadeli in this respect.

Regarding the access to information: again, let us just keep the numbers in proportion. We receive around 5 000 requests per year and we have 80 people working on them. Some of the files we have to make accessible are this thick. Many of them are citizens’ requests, but I can tell you that many of them are questions from very distinguished law firms trying to get additional information on very sensitive competition files. We have to be very careful with this process. I think we are doing a good job in this respect, because of these 5 000 files, only 15 to 20 end up on the Ombudsman’s desk. 85% of these requests are granted access at first request, so you can calculate how many thousand files become accessible every year. We are very serious about this commitment and we will continue to proceed in this way.

Concerning EU transposition and implementation: here I can assure you that we are seeking very close cooperation with the European Parliament. We are fully aware that appropriate speedy transposition and correct implementation are things that glue the European Union together. They are absolutely essential for the good working of the single market, therefore we try to make absolutely sure that, in terms of the implementation and transposition of European law, we are very precise and very strict. If you will allow me to quote, we already agreed in the framework agreement that:

‘In order to ensure better monitoring of the transposition and application of Union law, the Commission and Parliament shall endeavour to include compulsory correlation tables and a binding time limit for transposition, which in directives should not normally exceed a period of 2 years.

‘In addition to specific reports and the annual report on the application of Union law, the Commission shall make available to Parliament summary information concerning all infringement procedures from the letter of formal notice, including, if so requested by Parliament, on a case-by-case basis and respecting the confidentiality rules, in particular those acknowledged by the Court of Justice of the European Union, on the issues to which the infringement procedure relates’.

So there is an additional way in which we can communicate and keep the European Parliament better informed. If I may ask the assistance of the European Parliament in this particular area, I would like to ask you to insist a little bit more on correlation tables where directives are concerned. This is always the Commission’s proposal. We cannot always get it through in the final procedures when the legislator is finalising the negotiations on the Commission’s proposal, but this is possible in Parliament and the Council. The correlation tables make it much easier for the Commission to police the correct application of European law and to find errors and look for corrections.

In answer to Mr Hefner’s question concerning the EU pilot and why it is so named: this is because, when we started with this new project on creating additional possibilities for the Member States to correct their mistakes themselves more quickly, it was an accepted procedure which was started by a few Member States. Now most of them apply it. We are still in the initial phase. So far the results are very positive. Of course, when we reach the stage when all Member States are using this tool for better and faster application of European law, I am sure we will look for another name, because it will no longer be a pilot project.

To conclude, Madam President, I would like to thank the Members of the European Parliament and, of course, our Ombudsman for the very satisfactory cooperation, and for a very good debate and the many new ideas which I heard this morning in the debate. I would just like to remind all of us that, thanks to the Lisbon Treaty, citizens have the right to good administration. The respect of European law is, of course, key to that – to the EU’s level playing field. I am sure that, together with the European Parliament and with the Ombudsman, we will achieve it.

Seeing Madam Durant presiding over our session this morning, I would like to highlight one additional element. This is the fact that we managed to finalise agreement on the joint EU transparency register, which will bring additional light and transparency to lobbying activities and the activities of interest-representatives in Brussels. I think this is also a very important contribution to the increased transparency and higher quality of the EU legislative process.

  Nikiforos Diamandouros, Ombudsman. − Madam President, first of all I wish to thank very warmly all the Members who took the time to comment on my report. I want to thank them for their warm endorsement of the work of the Ombudsman. I derive a great deal of satisfaction, but also inspiration, from the kind of encouragement I receive from you, and I want to say to you openly that this kind of encouragement also increases the sense of responsibility that I feel is being put on my shoulders for carrying forward efforts to defend the rights of citizens.

I want to thank you very much for that – for your concerns in relation not only to the annual report, but also of course to the special report – and to thank the two rapporteurs who took the time to prepare excellent reports on my annual report and my special report.

Permettez-moi aussi de m'adresser à Mme Nedelcheva pour la remercier de ses remarques. Je tiens en particulier à vous dire, Madame, que j'ai noté vos remarques qui m'encouragent à essayer d'avoir un dialogue avec les collègues nationaux en ce qui concerne l'application correcte du droit communautaire.

Madam President, allow me now to focus on some of the remarks by Vice-President Šefčovič. Let me begin with a general remark. I wish to make it clear to this Chamber that Mr Šefčovič has gone out of his way to try and work very closely with the Ombudsman, and I am very grateful to him for what he has done so far.

I also wish to make it clear to this Chamber that Mr Šefčovič, upon assuming his duties, in effect – these are my words – reversed the position of his predecessor and publicly acknowledged that, when it came to the Porsche situation, the Commission’s response had been unsatisfactory and regrettable. Therefore I wish to draw a distinction between the person of the Commissioner and the Commission’s institutional response to this issue, which resulted in my needing – for the first time in 15 years – to feel constrained to submit a report to this body concerning that behaviour. It behoves me to make this distinction concerning the handling of the situation, and again to thank Mr Šefčovič for his efforts in trying to move forward and to be constructive in this area.

Having said that, let me say a few more things. Commissioner, I consider the 2002 communication concerning citizens as of fundamental importance for the application of good administration of the Union. If, therefore, the Commission is considering changing this communication, I should very much hope that the Commission will see to it that it consults both the Ombudsman and the Committee on Petitions of the European Parliament before actually changing what is an instrument of fundamental importance for the citizens.

We are very much in agreement – and I am glad that you in fact also mentioned this – that the courts are the highest and the only authority which can take decisions on an authoritative interpretation of the law. I am very glad that the Commission also acknowledges that. In terms of draft recommendations, let me just make a small clarification, Commissioner.

A draft recommendation constitutes a finding of maladministration by the Ombudsman. That does not prevent the institution involved from responding to this particular draft recommendation and rectifying the matter, and I will take that into consideration for closing the case. Therefore, a press release at the point of having found an instance of maladministration is in no way intended to pre-empt or to prevent an institution from being able to respond, and I want you to have my assurance personally on that.

Finally, as concerns the special report, again a clarification. The report was submitted because of the excessive delay. It was not – because I noted your regret – that it was released just after the Commission had released the documents. The two were unrelated. It was the great length of the response that prompted the report, and I was very happy to have had the response as I did. But again, you have adopted a position on that one.

Finally, I hope that there will be an effort to try and deal with the delays. What I will say about the delays, Commissioner, is that I expect the Commission to be able to abide by the rules concerning delays that it has itself adopted and is trying to abide by. I will abide by my deadlines in terms of dealing with this kind of situation. I think this will result in a better outcome.

I shall say two more things. I want to thank Mr Vlasák – I hope I am pronouncing the name correctly, because my Czech is non-existent – for his remarks, because the gives me the opportunity to say that I am actively looking forward to the possibility of making use of the facilities of the Eurobarometer, in order to be able to find more about what citizens think and feel about the Ombudsman and about the handling of complaints. I want to thank him for that.

I will do my best to see how the website can become user-friendly. Let me just assure him that we put it through very many pilot phases and very many target groups, and they all found it very user friendly. More than 46 000 people have used it so far, and they were guided to the right place the first time around. I want to assure him that this is what we are doing in order to be able to combat maladministration and that the interactive guide has very much helped reduce maladministration in the institutions as a response to his question.

Two more things. Ms Geringer de Oedenberg: it may not be easy to grasp that the vast majority of the complaints, whether to the European Ombudsman or the national ombudsman, do indeed deal with EU law. Therefore we have the network of ombudsmen that I coordinate in order to be able to send the complaints to the right institution from the very beginning so as to avoid problems. Focusing only on what lies within the ombudsman’s mandate neglects the fact that the network ensures that the bulk of the complaints go to the right national regional ombudsman concerning EU law and that are dealt with there.

A comment on Mr Migalski’s question. I can assure him that the Ombudsman’s budget was approved by the Council without any change. We are very mindful of the constraints, but we are also encouraged by the fact that the major budgetary institution – not only Parliament – has approved it.

Regarding Mr Szegedi’s question, we agree emphatically that the courts of the Member States do not know EU law sufficiently well, and I make a special point in my visits to all the Member States, where I have been many times, of visiting the judiciary to be able to help them move in this particular direction.

Finally – and I will close with this – Mr Sógor also asked for the Ombudsman to be able to receive complaints concerning EU law submitted at national level. Regrettably, this is not in my mandate. I would be violating my mandate if I were to accept this task, and I would also be encroaching on the legal responsibilities and mandate of my colleagues in the Member States if I were to do it. I try to collaborate with them to do it, but I have no authority to receive complaints that concern the application of EU law in the Member States.

Madame la Présidente, j'espère que j'ai répondu à toutes les remarques et je voudrais à nouveau remercier tous les députés pour leurs remarques d'encouragement et vous féliciter également, Madame, comme l'a déjà fait M. le commissaire, pour l'importante initiative en vue d'approuver un registre commun entre le Parlement et la Commission. Monsieur le Médiateur, l'année 2009 a marqué le quinzième anniversaire de l'institution. Elle a aussi marqué l'entrée en vigueur du traité de Lisbonne. De par votre élection par le Parlement européen, une légitimité supplémentaire à votre fonction a été ajoutée. Je dis bien ajoutée, car au fond, la légitimité de votre fonction provient de tous ceux, citoyens européens, qui ont pu s'adresser à vous et qui ont pu trouver une solution grâce à vos interventions.

Ce qu'il y a, en revanche, de plus fascinant dans la fonction de médiateur européen, c'est que rien n'est jamais acquis. La diminution du nombre de plaintes, la réduction du temps pour trouver une solution, les plaintes réglées à l'amiable, voici autant d'avancées que d'exigences de toujours. Derrière ces faits, je crois qu'il ne faudrait pas perdre de vue deux défis majeurs: celui de plus de transparence dans le fonctionnement des institutions et celui d'un dialogue meilleur entre les citoyens et les institutions au niveau européen et au niveau national.

Monsieur le Médiateur, je vous remercie et je vais conclure en disant que, de par votre action au quotidien, nous avons une illustration concrète qu'il est possible non seulement de relever ces défis, mais surtout d'apporter des réponses adéquates et satisfaisantes pour les citoyens. Certes la tâche n'est pas facile, mais avec le rapport annuel de 2009 et avec l'engagement que vous venez de prendre pour la rencontre à Copenhague, je crois que nous sommes sur la bonne voie.

  Χρυσούλα Παλιαδέλη, Εισηγήτρια. − Κυρία Πρόεδρε, κύριε Διαμαντούρο, κύριε Επίτροπε, θεωρώ ότι η συγκεκριμένη αναφορά του κ. Διαμαντούρου, την οποία είχα την τιμή να αναλάβω να παρουσιάσω στο Ευρωπαϊκό Κοινοβούλιο, δεν πιάνει την ουσία του ζητήματος· πιάνει τον τύπο του ζητήματος. Και αυτό είναι για μένα πάρα πολύ σημαντικό.

Θεωρώ ότι δεκαπέντε μήνες αργοπορία στην απάντηση και στην τελική απόφαση, αλλεπάλληλες παρατάσεις της αρχικής προθεσμίας, κυρίως όμως η περίεργη, κατά την εκτίμησή μου, απόφαση της Επιτροπής να μην κοινοποιήσει την επιστολή που είχε ετοιμάσει προς τη συγκεκριμένη αυτοκινητοβιομηχανία, λέγοντάς της ότι θα δημοσιοποιήσει μερικώς τα έγγραφά της, είναι σοβαρά θέματα· ιδιαίτερα, όμως, το τελευταίο δημιουργεί, κατά την άποψή μου, σοβαρό ζήτημα.

Εάν η Επιτροπή μετά από τόσο καιρό - και δεν οφείλετε σε εσάς, κύριε Επίτροπε· εσείς αναλάβατε πολύ πρόσφατα την ευθύνη του συγκεκριμένου τομέα - εάν η Επιτροπή είχε αποφασίσει να κοινοποιήσει στις 18 Φεβρουαρίου στον κ. Διαμαντούρο την επιστολή που είχε ετοιμάσει να στείλει στη συγκεκριμένη αυτοκινητοβιομηχανία, αυτή η ειδική έκθεση δεν θα γινόταν ενδεχομένως. Ο κ. Διαμαντούρος αποφάσισε να δεχθεί τις αλλεπάλληλες παρατάσεις που ζητούσε η Επιτροπή.

Παρά ταύτα θεωρώ ότι χάρη σε αυτή την καθυστέρηση, στην παράλειψη της Επιτροπής να ενημερώσει τον κ. Διαμαντούρο έγινε δυνατόν να έχουμε μια έκθεση η οποία καταγράφει ζητήματα που έχουν και τύπο και ουσία. Εγώ δεν θα συζητήσω καθόλου για την ουσία. Πρέπει όμως η Επιτροπή να λάβει πολύ σοβαρά υπόψη της - και χαίρομαι που το είπατε πριν από μένα - ότι οποιαδήποτε δυσκολία στη δουλειά που κάνει ο Ευρωπαίος Διαμεσολαβητής είναι σε βάρος της ενότητας της Ευρωπαϊκής Ένωσης, υπονομεύει την εμπιστοσύνη των πολιτών απέναντι στους θεσμούς της και θίγει τη δημόσια εικόνα για τη λειτουργία τους.

Ζητάμε πραγματικά να αποτελέσουν δέσμευση αυτά που μας είπατε πριν, γιατί είμαστε όλοι συνυπεύθυνοι. Και ευχαριστώ ιδιαίτερα τον κ. Διαμαντούρο διότι χάρη σε αυτή την αναφορά του μας έδωσε τη δυνατότητα να καταλάβουμε στο Ευρωπαϊκό Κοινοβούλιο και τη δική μας δύναμη προκειμένου να διεκδικήσουμε θέματα τα οποία θεωρούμε πρώτιστα για την ευρωπαϊκή συνοχή.

  Eva Lichtenberger, Berichterstatterin. − Frau Präsidentin! Lassen Sie mein Resumé mit einem ganz besonders herzlichen Dank an den Bürgerbeauftragten beginnen. Ich schätze seine Arbeit sehr und ich weiß, wie wichtig sie ist für die Bürgerinnen und Bürger, weil er eine ganz wichtige Anlaufstelle für sie geworden ist.

Ich möchte jetzt aber auch in erster Linie auf die Ausführungen von Kommissar Šefčovič zurückkommen, besonders was das EU-Pilotprojekt betrifft, das von einigen Mitgliedern des Europäischen Parlaments sehr kritisiert wurde, weil – und Sie haben es ja sehr deutlich gesagt – es more possibilities for Member States schafft, nicht aber für Bürgerinnen und Bürger.

Ich glaube, dass man hier noch einmal nachschauen muss, ob es wirklich so ist, denn was wir brauchen, ist mehr Transparenz. Ein Brief an den Beschwerdeführer, in dem steht, dass die Beschwerde bei uns eingegangen ist, reicht nicht. Wir müssen hier klarer werden, wir brauchen mehr Bürgernähe, sonst haben wir langfristig ein Glaubwürdigkeitsproblem.

Zusätzlich sind natürlich auch dringendst echte Konsequenzen erforderlich, wenn es sich um echte Verstöße handelt. Die Konsequenzen für Mitgliedstaaten, die nicht umsetzen und die vielleicht in ihren jeweiligen nationalen Medien sogar noch stolz darauf sind, können nicht einfach darin bestehen, dass man ihnen vielleicht noch einmal ein Briefchen schickt. Da muss es schon ein Stückchen weitergehen, wenn es um die Interessen der Bürgerinnen und Bürger der Europäischen Union geht.

Die Überarbeitung der Mitteilung von 2002, vor allem was die Rechte des Beschwerdeführers betrifft, halte ich für zentral. In diesem Zusammenhang wünsche ich mir, dass auch die Rechte des Parlaments berücksichtigt werden. Wir brauchen als Feedback für unsere legislative Arbeit ein Register dessen, was an Beschwerden hereinkommt. Ich muss nicht wissen, wer sich bei wem über was beschwert hat.

Was das Beschwerdethema ist, was die Konsequenzen daraus waren, das ist ein wichtiges Feedback für die gesamte Legislative. Das brauchen wir. Und deswegen bitte ich Sie, das mit zu berücksichtigen. Wir brauchen ein klares Register, das uns einen Überblick darüber gibt, wo die Schwerpunkte der Beschwerden liegen und was eingemahnt wird. Und ich möchte, dass dieser Vorschlag bald kommt. Ich bin gerne bereit zur Zusammenarbeit. Wir helfen Ihnen gerne bei den Korrelationstabellen. Ich halte sie auch für wichtig. Es ist ein Geschäft auf Gegenseitigkeit und darauf bestehe ich.

  Cristian Silviu Buşoi (ALDE), în scris. – Aplicarea dreptului european este vitală pentru ca cetăţenii UE să poată beneficia pe deplin de avantajele pieţei interne, întrucât chiar şi cea mai performantă legislaţie devine inutilă, dacă nu este aplicată. În ce priveşte legislaţia pieţei interne, există numeroase progrese care pot fi făcute, în special în ce priveşte Directiva privind serviciile sau cea privind recunoaşterea calificărilor profesionale. E adevărat că această legislaţie are un caracter tehnic, ceea ce complică procesul de aplicare. Din această cauza, cooperarea între instituţiile europene şi administraţiile naţionale este esenţiala. Sistemul de informare al pieţei interne, utilizat pentru servicii, s-a dovedit deosebit de util şi cred că am avea de câştigat extinzându-l la alte sectoare. Insist însă asupra necesitaţii ca statele membre să ia in serios transpunerea şi să evite pe cât posibil întârzierile care fac ca piaţa internă să funcţioneze la parametri suboptimali. În fine, insist asupra necesitaţii ca cetăţenii să îşi poată rezolva problemele legate de aplicarea dreptului european rapid şi cu costuri minime. Pentru aceasta e nevoie de suplimentarea resurselor SOLVIT, precum şi de promovarea intensă a acestui instrument de rezolvare informală a problemelor. Nu în ultimul rând, trebuie acordată prioritate dezvoltării modalităţilor alternative de soluţionare a diferendelor.

  Ágnes Hankiss (PPE), írásban. – Az ombudsman éves tevékenységét értékelő jelentés margóján a dokumentumokhoz való nyilvános hozzáférés parlamenti véleményalkotójaként engedjék meg, hogy kitérjek az intézményi átláthatóságra. Örömömre szolgált, hogy az értékelés készítője, Nedelcheva asszony a polgárok ombudsmanhoz intézett panaszainak vizsgálatakor külön figyelmet szentelt az átláthatóság és a jó adminisztráció közötti összefüggéseknek. A megfelelő adminisztrációhoz való jog a Lisszaboni Szerződés értelmében kötelező érvényre emelkedett, mindezzel együtt hasonlóan fontos a személyiségi jogok maradéktalan érvényesülése is.

Diamandouros úrral folytatott egyik közelmúltbeli tárgyalásunkon az intézményi transzparencia és az adatvédelem kényes egyensúlyát vitattuk meg. Külön kitértünk az Európai Bíróság Bavarian Lager-ügyben hozott, az átláthatósági vitákat a holtpontról kimozdító júniusi ítéletére is, mely azért kiemelt jelentőségű, mert iránymutatást ad az olyan esetekre, amikor vélt vagy valós közérdek áll konfliktusban a személyes adatok védelméhez fűződő joggal. Nagyon örültem annak, hogy Diamandouros úr is nyomatékosította azt az alapelvet, miszerint személyes adatot kizárólag az érintettek jóváhagyásával lehet közreadni.

Fontosnak tartom tehát hangsúlyozni, hogy az uniós intézmények munkájának átláthatóbbá tételére és a megfelelő adminisztrációs technikák megalapozására vonatkozó erőfeszítéseket messzemenően támogatom. Az európai ombudsman tevékenységének középpontjában az éves jelentés szerint éppen ennek az előmozdítása áll.

  Alexander Mirsky (S&D), rakstiski. – Es pilnīgi atbalstu Eiropas ombuda darbu. Viņa neatlaidīgums un principialitāte deva konkrētus rezultātus, jo viņš dara savu darbu godīgi un konsekventi. Latvijā izveidojās pilnīgi pretēja situācija. Formāli Latvijas Saeima par ombudu ievēlēja Romānu Apsīti. Taču reāli kopš 2007. gada 1. janvāra, kad Apsīša kungs stājās ombuda amatā, viņš tā arī nav sācis strādāt pēc būtības. Viņš diemžēl tā arī nav ievērojis, ka Latvijas teritorijā dzīvo ap 330 000 iedzīvotāju, kuriem ir atņemtas pilsoņu pamatbrīvības. Izskatās, ka Latvijas valdība un Saeima izvēlējās ērtu, klusu un beziniciatīvu ombudu — R.Apsīti, kurš faktiski aizver acis uz nopietniem pārkāpumiem Latvijas likumdošanā. Atgādināšu, ka, saskaņā ar ieņemamo amatu, Apsīša kungam ir jāpilda sekojoši darba pienākumi: 1. Veicināt vienlīdzīgas attieksmes principa ievērošanu un diskriminācijas novēršanu. Latvijā tā pastāv izglītības jomā. 2. Veicināt objektīvu juridisko un citu jautājumu izskatīšanu saprātīgos termiņos. Latvija jau ir zaudējusi ap 10 tiesas prāvās Eiropas Tiesā par šo tēmu. 3. Nodrošināt trūkumu novēršanu jautājumos par cilvēktiesību pārkāpumiem. Ap 330 000 iedzīvotāju Latvijā, no kuriem daudzi visu mūžu ir dzīvojuši Latvijā, ir atņemtas pilsoņu pamattiesības. Vārds “ombuds” šodien Latvijā izsauc smaidu, ja situācija nemainīsies, tas var tikt pielīdzināts vārdam “klauns”.
