  President. − The next item is the report by Krzysztof Lisek, on behalf of the Committee on Foreign Affairs, containing the European Parliament’s recommendations to the Council, the Commission and the EEAS on the negotiations of the EU-Georgia Association Agreement (2011/2133(INI)) (A7-0374/2011).

  Krzysztof Lisek, sprawozdawca. − Pani Przewodnicząca! Pani Komisarz! To jest sprawozdanie, które, pomiędzy wieloma sprawozdaniami przyjmowanymi w Parlamencie Europejskim, ma moim zdaniem niezwykle duże znaczenie. Ma duże znaczenie nie tylko dla nas – dla Unii Europejskiej, instytucji europejskich, państw członkowskich – ale ma przede wszystkim wielkie znaczenie dla państwa gruzińskiego, dla narodu gruzińskiego, który wiąże z tym sprawozdaniem i z przyszłością współpracy w łonie Unii Europejskiej, być może kiedyś jako członek Unii Europejskiej, wielkie nadzieje. To jest sprawozdanie, które dotyczy sensu stricte umowy stowarzyszeniowej i tego, co dzieje się w negocjacjach pomiędzy zespołem negocjacyjnym Unii Europejskiej i zespołem negocjacyjnym państwa gruzińskiego. Ale oczywiście to sprawozdanie, które przedstawiłem Wysokiej Izbie, nie może nie dotyczyć również trudnych kwestii, które wiążą się z dzisiejszym funkcjonowaniem państwa gruzińskiego i z problemami, które wyniknęły z konfliktu w 2008 r. z Federacją Rosyjską.

Bardzo się cieszę, że to sprawozdanie w tej wersji, w jakiej zostało przedstawione uzyskało bardzo szerokie poparcie polityczne w Komisji Spraw Zagranicznych. W Komisji Spraw Zagranicznych Parlamentu Europejskiego za tą wersją, która mniej więcej pewnie zostanie przyjęta – mam nadzieję, że zostanie przyjęta – głosowało 35 posłów, nikt nie głosował przeciwko, 1 głos był głosem wstrzymującym się, co oznacza dla mnie jako sprawozdawcy, że wszystkie główne siły polityczne Parlamentu Europejskiego, wszystkie grupy polityczne poparły w Komisji Spraw Zagranicznych tę wersję sprawozdania. To jest sprawozdanie, które nazwano już w mediach – jako projekt oczywiście – projektem bardzo odważnym.

To jest projekt, który według nas jako parlamentarzystów Parlamentu Europejskiego – mogę już tu mówić w tej chwili w imieniu Komisji Spraw Zagranicznych, bo ona go przyjęła – nazywa pewne rzeczy po imieniu. Myślę tutaj o trudnej sytuacji związanej z regionami Abchazji i Osetii Południowej, które oczywiście Federacja Rosyjska uznaje za niezależne państwa (choć według naszej opinii – na dzisiaj mogę powiedzieć na pewno Komisji Spraw Zagranicznych, ale mam nadzieję również całego Parlamentu jutro), nasze sprawozdanie wzywa Federację Rosyjską do przestrzegania prawa międzynarodowego. Tę sytuację, w której tysiące żołnierzy rosyjskich przebywają, według nas, niezgodnie z prawem międzynarodowym i również niezgodnie z porozumieniami podpisanymi w 2008 r. pomiędzy Rosją a Gruzją, ale w pewnym sensie parafowanymi też przez prezydenta Sarkozy'ego, który reprezentował wtedy prezydencję Unii Europejskiej, uznajemy za coś, co na dzisiaj w nomenklaturze Komisji Europejskiej nie istniało, ale w nomenklaturze Parlamentu Europejskiego już istnieje. Kilka miesięcy temu przyjęliśmy bowiem w dokumencie dotyczącym strategii obszarów Morza Czarnego już to określenie – określenie, które brzmi okupacja.

Według nas to, co dzieje się w Abchazji i Osetii Południowej niestety należy uznać za to okupację. Te terytoria, które według nas stanowią integralną część Gruzji, to są terytoria okupowane. To jest najważniejszy, moim zdaniem, fakt polityczny wynikający z tego sprawozdania. Oprócz tego jest wiele innych rzeczy, o których pani komisarz pewnie wie, dotyczących pogłębionej umowy o wolnym handlu, które chcielibyśmy jak najszybciej wprowadzić w życie, ale ze względu na upływający czas oczywiście nie mogę kontynuować i rozszerzać tych tematów.

  Vasilica Viorica Dăncilă (S&D). - Uniunea Europeană a sprijinit şi sprijină aspiraţiile şi angajamentul Georgiei faţă de valorile comune şi principiile democraţiei, statului de drept, drepturilor omului şi bunei guvernanţe, prin politica sa de vecinătate, dar şi prin dimensiunea parlamentară a Parteneriatului estic, în cadrul reuniunilor delegaţiei Parlamentului European la Adunarea Parlamentară Euronest. Sper doar că autorităţile georgiene vor face tot ce depinde de ele pentru a realiza toate reformele necesare care vor permite dezvoltarea unui mediu propice aplicării standardelor europene în domeniul economiei sociale de piaţă, în domeniul educaţiei, pentru o mai bună integrare a minorităţilor naţionale, dar şi pentru a aplica reformele necesare liberalizării economiei.

Este necesară, totodată, existenţa unui dialog politic constructiv cu reprezentanţii opoziţiei, inclusiv accesul nediscriminatoriu şi neîngrădit al acestora la mass-media. Europa este pentru Georgia nu doar un model, ci şi un partener, iar pentru ca Georgia să poată fi mai bine conectată la Uniunea Europeană este nevoie ca cetăţenii acestei ţări să poată avea acces uşor la vizele necesare pentru călătoriile în spaţiul comunitar.

  Elena Băsescu (PPE). - Aş dori să îl felicit şi eu pe colegul meu Lisek pentru redactarea acestui raport. Georgia a făcut progrese importante pe calea reformelor democratice. Cooperarea cu Uniunea constituie un stimulent puternic pentru continuarea lor. Susţin recomandările privind perspectiva europeană a Georgiei, menţinerea ritmului negocierilor pentru acordul de asociere, lansarea negocierilor privind zona de liber schimb aprofundate şi cuprinzătoare. Subliniez importanţa implicării mai active a Europei în soluţionarea conflictelor îngheţate, conform comunicării comune „Un răspuns nou în contextul schimbărilor din ţările vecine”.

Salut prelungirea mandatului EUMM, având în vedere rolul său în asigurarea stabilităţii. Trebuie continuate demersurile pentru garantarea accesului deplin în teritoriile ocupate. Evidenţiez, totodată, caracterul pozitiv al acordului recent dintre Georgia şi Rusia privind aderarea la OMC. Îmi exprim speranţa că va deschide calea către o rezolvare durabilă a situaţiei din regiune.

  Jaroslav Paška (EFD). - Gruzínsko je jednou z mnohých krajín, ktorá sa odčlenila od Sovietskeho zväzu a na troskách bývalého Sovietskeho zväzu založila svoju budúcnosť. Cesta budovania demokratického štátu však bola po dlhé roky poznačená hlbokou tradíciou bývalého komunistického režimu a nedostatok demokratického dialógu medzi oficiálnou administratívou a opozičnými skupinami často prerastal do občianskych nepokojov.

K stabilite krajín nepridáva ani spor o správu nad územím Abcházska, ktoré sa podľa v Európe realizovaného modelu Kosova odčlenilo od Gruzínska a hľadá svoju budúcnosť pod ochranou Ruska. Isteže, demokratická spoločnosť v Gruzínsku si zaslúži našu podporu. Nie som si však istý, či náš vplyv v tomto regióne bude dostatočne účinný a silný.

  Ulrike Lunacek (Verts/ALE). - Madam President, I would also like to commend and thank Mr Lisek for his report. It is a very good report, reflecting good cooperation with the various Groups. For our part, the Greens supported the report in the Committee on Foreign Affairs and we will support it again tomorrow.

I would like to highlight one issue that I find important. While I am, and have been, critical and have claimed that Russia is responsible for occupying territories which are an integral territorial part of Georgia, nevertheless we have to look into exactly what happened in 2008. The Tagliavini International Commission report is one that we have amendments to, and we want to include reference to that in the report.

Georgia also needs to show more cooperation with the International Criminal Court. I have here – and I have sent it to some of my colleagues today – a report by the Norwegian Helsinki Committee which clearly states that the Georgian authorities must pay more attention to what happened in the period before and after the activities and the war of 2008, and that they are at least – and I quote – both ‘partly unable and partly unwilling to conduct an effective investigation into international crimes allegedly committed during and after the August 2008 war’.

Condoleezza Rice is quoted in yesterday’s newspapers in Georgia as saying that Georgian President Saakashvili ‘alienated potential NATO allies in 2008 by letting the Russians provoke him into starting a war over South Ossetia’. I do not know exactly what happened, but it has to be investigated. Georgia also needs to be cooperative when it comes to war crimes and to allegations of human rights violations.

  Máire Geoghegan-Quinn, Member of the Commission. − Madam President, I would like to thank you for this opportunity and to welcome the interest and engagement demonstrated by the European Parliament as regards the negotiations on an Association Agreement with Georgia.

We had an intensive and regular exchange with the rapporteurs, which, I believe, has helped in preparing a well-structured and balanced report. The recommendations of this report will be very helpful in our further negotiations with Georgia.

Successful negotiations and conclusion of the agreement will be a major step towards Georgia’s political association and economic integration with the EU and will bring our relations to a new level. We acknowledge the importance Georgia attaches to its European identity. As you know, any reference to Article 49 remains controversial among Member States and is therefore impossible to offer, but what is important for Georgia at this stage is to seize a maximum of the many opportunities which political association and economic integration will offer to change relations now: in short, to create more of Europe within Georgia.

Using this opportunity, let me briefly inform you about the state of play in the negotiations. Together with our Georgian counterparts, we are working intensely to advance the negotiations. Since the launch of these negotiations in July 2010, talks have been conducted in plenary sessions covering political dialogue and foreign and security policy, justice, freedom and security issues, and economic and sectoral cooperation. Seven plenary sessions have already taken place and the eighth round is due to take place soon.

Good progress was made on the preamble, the objectives and general principles of the agreement. We have been able provisionally to agree on a large part of the text. Provisional agreement was also reached on a number of elements relating to political dialogue and foreign and security policy. It is not surprising that security and stability, as a result of a peaceful resolution of the existing conflicts over South Ossetia and Abkhazia, are the core issues for Georgia. We have achieved substantial progress on justice, freedom and security as well.

The sides also advanced on economic and sectoral cooperation – 19 chapters have been provisionally closed out of 28.

The EU is committed to starting the negotiations with Georgia on a deep and comprehensive free trade area (DCFTA), as an integral part of the future Association Agreement, as soon as possible. This commitment was also made at the Eastern Partnership Summit of 29-30 September in Warsaw. The launch of negotiations is conditional upon Georgia making sufficient progress in the implementation of certain ‘key recommendations’. The EU appreciates all the efforts that Georgia has undertaken to address the issues and take the necessary steps to prepare for the negotiations. We are now in the final stages of the process, which should allow the Commission to make its formal recommendation to the EU Member States before the end of the year.

Last week, an important agreement was reached between Georgia and Russia on Russia’s accession to the World Trade Organization. The EU welcomes and appreciates Georgia’s acceptance of a compromise. It is in everyone’s interests – including those of the EU and Georgia – to have Russia inside the rules-based WTO system.

The Vice-President of the Commission/High Representative of the Union for Foreign Affairs and Security Policy, Catherine Ashton, is visiting Georgia today and meeting President Saakashvili. The main aim of this visit is to reinforce the message of the EU’s continuing commitment to Georgia, and to demonstrate that the political and economic ties between the EU and Georgia are being further strengthened.

  Jaromír Kohlíček (GUE/NGL), písemně. – Dohoda o přidružení Gruzie k EU je velmi rozporným materiálem. Evropská unie zde přistoupila na tezi, že hlavní je změna legislativy a verbální odsouhlasení jakýchkoliv požadavků vyjednavačů EU. To ostatní snad jednou přijde. Důležité je kritizovat Rusko, nepřiznat samostatnost Jižní Osetie a Abcházie a prohlásit, že Gruzie je evropský stát. To považuji za jednu z mnoha zbytečných tezí, kterými tato zpráva oplývá. V dokumentu se vůbec neobjevuje problematika zrušené třetí autonomní jednotky (vedle Jižní Osetie a Abcházie). Její likvidace zjevně vyjednavačům unikla. Škoda, bylo by zajímavé zjistit, jak v daném případě postupuje příkladná aplikace demokratických principů vyžadovaná v textu u tzv. okupovaných území. Jednotlivé kapitoly dobře ukazují šíři problémů, které je nutno postupně řešit. Jde prakticky o všechny oblasti práva, spravedlnosti a bezpečnosti. Podobně v kapitole týkající se hospodářské a odvětvové spolupráce je vidět, že země je teprve na začátku složité cesty a jen obtížně se vyrovnává se základními požadavky mezinárodních standardů. Cesta k přiblížení se Evropské unii je zjevně ještě velmi dlouhá a klikatá. Manipulace s občanstvím, o kterých se dozvídáme, rozhodně nejsou na této cestě dobrým znamením. Skupina GUE/NGL i já osobně přesto dohodu nezamítám.

  Justas Vincas Paleckis (S&D), raštu. – Šis pranešimas dėl derybų dėl ES ir Gruzijos asociacijos susitarimo – svarbus dokumentas Europos Sąjungai ir Gruzijos valstybei. Tai žingsnis šios šalies Europos Sąjungos narystės link. Pritariame Gruzijos europinei perspektyvai ir derybų eigai. Svarbu, kad ES toliau aktyviai tarpininkautų sprendžiant 2008 metų Rusijos ir Gruzijos teritorinį konfliktą. Raginame Gruziją glaudžiau bendradarbiauti su Tarptautiniu baudžiamuoju teismu tiriant 2008 metų karo nusikaltimus. Pritariu pranešėjui, kad Rusijos ir Gruzijos susitarimas dėl Rusijos narystės PPO turėtų būti kuo greičiau pasiektas. Tikime, kad Gruzijos institucijos imsis visų priemonių, kad būtų laikomasi visų ES standartų įtvirtinant šalyje teisės viršenybę, socialinę rinkos ekonomiką ir žmogaus teises. Kartu su pranešėju raginu Gruzijos vyriausybę platesniu mastu dalyvauti konstruktyviame dialoge su opozicinėmis jėgomis ir toliau kurti demokratinę aplinką žodžio laisvei, ypač sudarant sąlygas visoms politinėms partijoms pasinaudoti valstybine žiniasklaida. Taip pat kviečiu Gruzijos valdžios institucijas prisiimti tvirtesnius įsipareigojimus užimtumo politikos ir socialinės sanglaudos srityse ir toliau kurti aplinką, palankią ES socialinės rinkos ekonomikos standartų įgyvendinimui.
