  El Presidente. − El siguiente punto es el informe de James Nicholson, en nombre de la Comisión de Agricultura y Desarrollo Rural, sobre la propuesta de Reglamento del Parlamento Europeo y del Consejo que modifica el Reglamento (CE) nº 1234/2007 del Consejo en lo que atañe a las relaciones contractuales en el sector de la leche y de los productos lácteos (COM(2010)0728 – C7-0408/2010 – 2010/0362(COD)) (A7-0262/2011).

  James Nicholson, rapporteur. − Mr President, I am very pleased that we were able to reach agreement on the dairy package with the Council and Commission in December. In this regard I must thank my shadow rapporteurs for all the very hard work that they put in. We started off with – I think I can safely say – some very divergent views and positions, so it is a testament to their commitment that we found solutions to our differences and ways to incorporate each other’s point of view.

I must also thank the Council and the Commission, who at all stages of the process adopted a very constructive approach towards Parliament. This cooperation was what allowed us to achieve a deal at the end of the day. I was determined to get a deal on the dairy package agreed before we entered into the CAP reform and I am very pleased that we have achieved that. I would also just like to pay my own special thanks to those involved in the Polish Presidency for their hard work through the weeks and the months that we were working on this.

The dairy package was, to a large extent, a dry run for Parliament’s engagement in the CAP reform. It definitely gave us some insight as to how the process will evolve. Although of course the reform will be on a much larger scale, we must bear this in mind, and I think we all gained some valuable experience in terms of how we should go about finding our internal position within Parliament and also how best to negotiate with the other institutions. It is my belief that, in order for Parliament to influence the reform of the CAP to the maximum effect, we should learn from our experiences in working with this dossier.

So what does the dairy package contain and how will it impact on our milk producers? That is the question which everyone is, of course, very keen to know the answer to. From the outset I would say that this legislation will not solve all the problems of Europe’s dairy sector, but I do hope that the measures contained within it will primarily help to strengthen the bargaining power of dairy farmers.

The establishment of the EU-recognised producer organisations and the interbranch organisations for the sector is a step forward. Producer organisations will be able to negotiate milk volumes of up to 33 % of the national production. This is, I believe, a good balance between boosting their negotiating power and protecting against distorting competition. Producer organisations should help farmers to organise themselves better and strengthen their position in the supply chain, especially in Member States where a system of cooperatives is limited or non-existent.

The package also includes provisions for EU contracts to be implemented at Member State level. Some countries may choose to go down this route while others will not. This is likely to depend on the characteristics and the situation of each individual country’s dairy market, whether they are a co-op system or export-driven. The decision to impose contracts will be voluntary, which will give Member States the flexibility to choose what suits them best. If a Member State decides to impose contracts, those contracts must respect the conditions laid down by the regulation. These include the condition that the price, the volume of milk to be delivered and the duration of the contract are outlined in the contract.

One of the main points Parliament has achieved is in the article which allows for the regulation of milk supply for production or for PDO and PGI cheeses. We worked hard on this to achieve a balance between supporting quality production and making sure that we did not interfere with competition law or the functioning of the internal market. I am sure that my southern counterparts will have more to say on this issue and will outline how it will particularly help milk producers in their countries, which are those Member States which have high levels of quality production.

I would like to conclude by saying that I think we have ended up with a package of measures which are flexible. Although milk is produced in every EU Member State, each country has very different needs. There are Member States that would like to see quotas being retained past 2015, while others look forward to increasing production. However, no matter what the focus of the industry, we have a responsibility to ensure dairy farmers have the opportunity to achieve the best possible price for their milk. In this regard, I would urge producers to look carefully at the measures and take full advantage.

  Dacian Cioloş, membre de la Commission. − Monsieur le Président, Mesdames et Messieurs, permettez-moi de féliciter le Parlement européen, et tout particulièrement M. Nicholson ainsi que le rapporteur fictif pour la coopération constructive avec le Conseil et la Commission, qui a permis d'enrichir la proposition initiale de la Commission et de parvenir en même temps à un accord en première lecture.

Les différences d'approche affichées au départ ont pu être surmontées grâce à une discussion ouverte entre les trois institutions ainsi qu'à un grand sens des responsabilités qui n'a pas perdu de vue le véritable objet de l'exercice, à savoir donner au secteur laitier de nouveaux instruments pour assurer la pérennité et renforcer l'organisation des producteurs dans le secteur laitier.

Le paquet "lait" constitue un des premiers actes législatifs importants en matière agricole en passe d'être adopté en première lecture selon la procédure législative ordinaire instaurée par le traité de Lisbonne. Pour moi, il s'agit d'un véritable succès de la coopération entre le Parlement et le Conseil, qui montre que ce n'est pas la procédure ordinaire législative qui nous empêche de prendre des décisions importantes rapidement et de manière cohérente.

Le paquet "lait" donne la possibilité aux États membres, comme M. Nicholson l'a mentionné, de rendre obligatoire le contrat de livraison de lait entre les producteurs et les transformateurs. Cette proposition donne aussi la possibilité aux producteurs laitiers qui le souhaitent de se structurer en organisation de producteurs afin d'affirmer leur position dans la chaîne alimentaire, notamment par la négociation collective des contrats de livraison de leur lait qui est clairement renforcée par cette proposition. Ils pourront également bénéficier de la possibilité laissée aux États membres d'imposer l'obligation aux acheteurs de lait de proposer un contrat aux producteurs laitiers assorti d'une durée minimale d'au moins six mois. Le souci de prendre en compte la nature spécifique des coopératives, exprimé par les groupes de haut niveau organisés autour des experts des États membres, se trouve aussi reflété dans le texte final.

Le paquet "lait" met en lumière le rôle que peuvent jouer les interprofessions qui rassemblent autour d'une même table les producteurs, les industriels, les commerçants, mais aussi les consommateurs pour améliorer la transparence dans la chaîne d'approvisionnement laitier et la compréhension réciproque du rôle de chaque maillon au sein de la filière. Dans ce même souci d'amélioration de la transparence, le paquet "lait" fixe le cadre nécessaire au suivi des livraisons de lait après l'expiration du régime de quotas laitiers en prévoyant la fourniture des données nécessaires en temps utile et donne ainsi la possibilité à la Commission de fournir aux producteurs de lait et aux acteurs du marché laitier les informations du marché en temps utile.

Le paquet "lait" jouera également un rôle important dans la régulation de l'offre de fromage de qualité sous indication géographique, qui apporte notamment dans les régions vulnérables des bénéfices en termes de valeur ajoutée et de durabilité.

Je conclus en disant que deux rendez-vous sont prévus pour faire le point sur l'application des dispositions introduites par le paquet "lait", le premier pour la fin juin 2014 et le deuxième pour la fin décembre 2018.

À chacune de ces échéances, la Commission s'engage à présenter au Parlement et au Conseil des rapports sur l'évolution de la situation du marché dans le secteur laitier. Les effets sur les producteurs dans les régions défavorisées seront notamment évalués en lien avec l'objectif général de préservation de la production dans ces régions. Les incitations potentielles visant à encourager les agriculteurs à conclure des accords de production conjointe seront également évaluées.

  Michel Dantin, au nom du groupe PPE. – Monsieur le Président, Monsieur le Commissaire, Monsieur le rapporteur, nous voilà au terme d'un travail.

Monsieur le Commissaire, vous avez dit tout à l'heure des choses que nous pouvons partager. Il y a un mot que je voudrais relever, c'est le mot "rapidement". Je crois que sur ce point nous ne pouvons pas être d'accord. Il y a en effet trois ans, en ce mois de février, qu'éclatait la crise du lait ou qu'elle atteignait son apogée. C'est le temps qu'il nous a fallu pour trouver un compromis entre nous pour pouvoir offrir une nouvelle perspective aux producteurs de lait.

Je voudrais saluer l'esprit dans lequel nous avons travaillé et rendre hommage à notre rapporteur qui, pour cette première, parce que c'était une première d'avoir à colégiférer, nous a permis de travailler dans un véritable dialogue et avec la volonté partagée de construire.

Nous offrons donc aux producteurs une nouvelle capacité, celle de déroger au droit de la concurrence et de s'organiser plus fortement. Mais, Monsieur le Commissaire, nous savons bien les uns et les autres qu'il ne s'agit là que d'une étape, que d'un pas, et que nous n'avons pas encore trouvé la vraie solution et les vrais outils pour sortir de la période des quotas laitiers.

Une phase de sortie devait normalement être mise en place. Cette phase reste à inventer. Nous devons poursuivre le travail sur ce point-là. Vous l'avez dit, nous ne réglons pas non plus complètement la question des territoires fragiles. Si nous leur offrons un outil, avec la possibilité de s'organiser davantage avec les outils de protection géographique, nous ne permettons pas pour autant de conserver le lait dans ces territoires.

Le travail que vous nous livrerez en 2014 doit absolument nous apporter des solutions pour permettre de maintenir cette activité dans les territoires difficiles où souvent l'herbe est la seule production, où souvent le lait est la seule possibilité de valorisation économique. Sans cela, tout le travail et tous les espoirs que nous avons mis dans ce texte seront vains pour un grand nombre de paysans.

  Marc Tarabella, au nom du groupe S&D. – Monsieur le Président, Monsieur le Commissaire, chers collègues, moi aussi je tiens à saluer le rapporteur James Nicholson, également pour sa méthode de travail, qui a veillé à associer tous les rapporteurs fictifs durant toute la procédure, et ce n'est pas monnaie courante.

Le Conseil et le Parlement ont accouché, à l'issue de négociations parfois laborieuses, d'un accord qui, s'il ne soulèvera pas l'enthousiasme, a le mérite de vouloir organiser la filière laitière. En effet, la décision prise de supprimer les quotas à l'horizon 2015 appelait à une réforme du secteur de manière à éviter les autres crises du lait, comme celle rencontrée dans toute l'Europe en 2009, dont on vient de parler.

Je regrette évidemment, comme d'autres, la décision de supprimer les quotas car ce système de régulation – même s'il n'est pas parfait et il ne l'a pas été – a dans l'ensemble bien fonctionné durant 25 ans, a évité des crises majeures et ne demandait peut-être qu'à être assoupli.

Cependant, cette nouvelle réglementation va donner aux organisations de producteurs laitiers la possibilité de négocier collectivement les clauses des contrats et notamment le prix. Nous leur avons donné les outils nécessaires au renforcement de leur position dans la chaîne d'approvisionnement, en dérogeant au droit de la concurrence, et ce n'était pas gagné d'avance.

De plus, les États membres qui opteront pour l'obligation des contrats sur leur territoire pourront fixer une durée minimale équivalente à au moins six mois, et six mois ce n'est quand même pas mal par rapport à ce que fait l'industrie aujourd'hui en revoyant le prix parfois de mois en mois.

Concernant les contrats, j'aurais souhaité, bien sûr, qu'ils soient rendus obligatoires dans toute l'Europe. Cela n'a pas été possible à cause d'une majorité au sein du Conseil qui s'y opposait.

Soulignons aussi comme point positif la reconnaissance des organisations interprofessionnelles, même si je déplore que, comme quatrième acteur autour de la table, on n'ait pas incorporé l'autorité publique, qui devrait jouer le rôle d'arbitre, comme l'observatoire des prix et des marges par exemple.

En conclusion, si cet accord est un pas dans la bonne direction, il reste améliorable en redonnant, par exemple, à l'autorité publique le rôle de régulateur. On reverra cela lors de l'OCM unique.

Permettez-moi, au-delà des mandataires que nous sommes, qui avons beaucoup travaillé sur ce dossier, de saluer aussi – ce n'est pas coutume évidemment de le faire – M. Baragiola, fonctionnaire du Parlement, qui est derrière moi, qui a participé à toutes les réunions entre nous et qui a joué un rôle déterminant. Cela fait du bien aussi de saluer les fonctionnaires, qui sont au service de l'institution publique. Je ne voulais pas manquer de le faire.

  Britta Reimers, im Namen der ALDE-Fraktion. – Herr Präsident, Herr Kommissar, verehrte Kollegen! Ich danke Herrn Nicholson für seine erfolgreiche Verhandlungsführung. Wir haben uns für den Ausstieg aus dem bisherigen kostenintensiven und marktverzerrenden Milchquotensystem entschieden und die Erkenntnisse der high level group für Milch analysiert.

Das nun so ausgehandelte Milchpaket ist ein wichtiger erster Schritt hin zu einem markt- und wettbewerborientierten Milchsektor. Es wird die Bildung von Branchenverbänden gefördert, die für ihre Mitglieder Verträge aushandeln dürfen. Die Verhandlungsmacht der Milcherzeuger wird gestärkt: Sie werden künftig auf Augenhöhe verhandeln können, wenn sie wollen.

Gut ist auch, dass wir dabei nicht über das Ziel hinausschießen. Diese Verträge dürfen nicht mehr als 33% des nationalen und 3,5% des europäischen Marktes umfassen. Hierdurch wird gewährleistet, dass kein neues Ungleichgewicht entsteht und die notwendige Marktfreiheit erhalten bleibt. Da es keine generelle Vertragspflicht gibt, bleibt die unternehmerische Entscheidungsfreiheit des einzelnen Landwirts gewährleistet. Dies ist ein wichtiges Element für einen funktionierenden Markt.

Wir Liberalen werden das Milchpaket unterstützen, und ich bitte hier um Zustimmung bei der morgigen Abstimmung im Plenum.

  Martin Häusling, im Namen der Verts/ALE-Fraktion. – Herr Präsident, lieber Herr Kommissar, liebe Kolleginnen und Kollegen! Das Ziel wurde verfehlt, muss ich sagen, obwohl der eingeschlagene Weg richtig war. Im Gegensatz zu meiner Kollegin Reimers sage ich: Es ist nicht zu einer Erzeugerstärkung gekommen. Die Erzeuger dürfen sich im europäischen Markt mit 3,5 % bündeln. Wir haben aber schon Molkereien auf dem europäischen Markt, die schon über 6 % der Milchmenge bündeln. Ist das fair? Ich sage eindeutig: Nein. Wir bräuchten höhere Bündelungsmengen für die Milchbauern. Wir haben die Verträge. Ja, eine gute Option. Nur, wir haben sie freiwillig gelassen, weil die Mitgliedstaaten diese Verträge in der Mehrheit nicht wollten. Das wird am Markt nichts bewirken. Es wird bei den Verträgen kaum über Preise geredet. Letztendlich haben auch damit viele Milcherzeuger nichts Wesentliches in der Hand.

Wir hatten vorgeschlagen, auch einmal darüber nachzudenken, was eigentlich nach dem Ausstieg aus der Milchquote passiert. Wir hatten vorgeschlagen, über eine Monitoringstelle zu reden, in der die Erzeuger, die Molkereien, aber letztendlich auch die Europäische Union über eine Mengenanpassung auf den Märkten nachdenken. Auch das wurde im Grunde genommen stark verwässert.

Die Milchkrise liegt hinter uns, ja. Aber ich bin mir ziemlich sicher, dass die nächste Milchkrise vor uns liegt. Wir haben stark steigende Erzeugermengen, und wir haben sinkende Preise. Was machen wir denn dann bei der nächsten Milchkrise? Wieder mit Steuergeldern Exportförderung bezahlen, um Mengen aus dem europäischen Markt zu bringen? Das kann doch keine Lösung sein. Deshalb fordern wir die Kommission auf, ihren Bericht, den sie erst im Jahr 2014 vorlegen will, früher vorzulegen und wirklich Lösungsvorschläge für die Zeit nach der Quote jetzt auf den Tisch zu legen. Wir müssen darüber reden.

Ich habe den Eindruck, dass viele Mitgliedstaaten eher an ihre Milchindustrie denken, aber nicht an die Milcherzeuger. Das kann nicht so bleiben. Wir geben mit diesem Paket den Milcherzeugern in Europa keine wirklich guten Instrumente und keine Zukunftsperspektiven in die Hand. Deshalb wird es unsere Fraktion ablehnen!

  Janusz Wojciechowski, w imieniu grupy ECR. – Trochę smutno mówić o sytuacji w sektorze mleka. Kiedy sięgam wspomnieniami wiele lat wstecz, pamiętam, że w mojej rodzinnej wsi na łąkach pasło się kilkaset krów, a dzisiaj nie ma ani jednej. W wielu częściach mojego kraju hodowla bydła mlecznego zupełnie zanikła i tak też dzieje się w wielu innych krajach Unii Europejskiej.

Ale musimy robić to, co do nas należy. Musimy być jak najlepiej przygotowani do sytuacji, gdy zostaną zniesione kwoty mleczne. Na pewno nie unikniemy dramatycznych problemów – już wiele na to wskazuje, ale to, co zaproponował kolega Nicholson, jest krokiem w dobrym kierunku. Regulacje stosunków umownych są bardzo ważną rzeczą. Rolnicy, producenci mleka są tym najsłabszym ogniwem, które trzeba wzmocnić w stosunku do przetwórców, i w tym kierunku idzie propozycja zawarta w sprawozdaniu kolegi Nicholsona. Należy ją poprzeć.

  João Ferreira, em nome do Grupo GUE/NGL. – Senhor Presidente, Senhor Comissário, esta proposta de regulamento não resolve os problemas fundamentais no setor do leite. Ela constitui mais uma etapa no caminho da justificação da decisão inaceitável e desastrosa de acabar com as quotas leiteiras em 2015 e só por isto ela é já inaceitável. O resto são ilusões que os que agora se preparam para aprovar esta proposta vão vendendo aos produtores de leite que vêm a sua situação piorar em cada dia. A ilusão de que, num mercado livre e desregulado que defendem, é possível garantir preços justos à produção. A ilusão de que sem instrumentos de regulação da produção é possível garantir a cada país o direito a produzir de acordo com as suas necessidades. Tremendas ilusões!

Este caminho vai reforçar o poder dos grandes grupos económicos, da grande distribuição e da grande transformação. Vai reforçar a concentração da produção nalguns produtores e países, liquidando-a noutros países, levando à ruína de parte significativa dos seus produtores. Continuará a facilitar a prática de dumping entre Estados-Membros e o encharcamento dos mercados nacionais com leite importado. Vai continuar a promover produções intensivas, de cariz exportador, que põem em causa a segurança e a qualidade alimentar e a sustentabilidade ambiental.

Por tudo isto, o que se impõe é, sim, reconsiderar a revisão de acabar com as quotas leiteiras adaptando-as às necessidades de cada país e ao nível relativo do desenvolvimento da sua capacidade produtiva. O que se impõe são instrumentos de regulação e de intervenção nos mercados que garantam preços justos ao produtor, tendo em conta quer o custo dos fatores de produção quer os preços praticados no consumidor de forma a garantir uma justa distribuição do valor acrescentado ao longo da cadeia de valor do setor.

  Lorenzo Fontana, a nome del gruppo EFD. – Signor Presidente, signor Commissario, onorevoli colleghi, anzitutto desidero ringraziare l'onorevole Nicholson per il suo lavoro, che ha veramente richiesto molto tempo, tutti i relatori ombra e i collaboratori di Nicholson, sicuramente rivelatisi molto efficienti.

Sono oggi qui a sostenere questo accordo, raggiunto dopo un lungo periodo, perché ritengo che la situazione delle quote latte, almeno per quanto riguarda il mio paese, creava davvero enormi difficoltà, soprattutto per i produttori delle nostre regioni. Sono estremamente compiaciuto del fatto che tutti i colleghi si siano impegnati – poi vedremo se il risultato sarà questo – nella difesa dei produttori, perché questo era il nostro obiettivo; vedremo prossimamente se ciò sarà realizzato.

In ogni caso, non bisogna dimenticare che in ogni incontro avuto, anche con il Consiglio, l'obiettivo del Parlamento è sempre stato quello della difesa dei produttori. Per questo mi auguro che in futuro riusciremo a intraprendere azioni sempre più volte a specificare l'importanza delle nostre produzioni e della nostra qualità, che rappresentano sicuramente l'unico metodo perché il nostro latte possa continuare a circolare liberamente e venga consumato dal nostro mercato.

  Diane Dodds (NI). - Mr President, firstly I want to thank the rapporteur, my colleague from Northern Ireland, Jim Nicholson, for all of his efforts in getting this report to this stage.

While we all recognise the issues raised by the high-level group and by this report, the elephant in the room remains, namely the question how farmers are to receive a fairer share of the profit within the supply chain, especially from retailers. Prior to the elections in 2010, the Conservative Party in the United Kingdom pledged to put in place a supermarket ombudsman. They have now been the lead party in our coalition government for almost two years and we still have no arbiter for fairness in this food supply chain in place. We need real, tangible progress on this now and such an ombudsman must have the teeth and power to deal with the unfairness within the market.

The report deals with the power farmers have in the supply chain, but I would raise concerns about the level of responsibility given to the Commission and the role of interbranch organisations. I feel that such organisations may well add another layer to the supply chain. Northern Ireland has a unique milk trading system and a cooperative structure, but also trades a large amount of milk with another Member State. Any organisation which would have jurisdiction in two Member States must not affect the current structure or disturb the balance in trading relations. Member States should be given the flexibility to decide what is best, in their own interests and in the interests of their producers.

  Albert Deß (PPE). - Herr Präsident, Herr Kommissar, werte Kolleginnen und Kollegen! Auch ich bedanke mich beim Kollegen Nicholson für diesen Bericht, den er verfasst und auch im Trilog mit ausgehandelt hat, und auch bei allen anderen Beteiligten, dass dieser Kompromiss zustande gekommen ist.

Herr Kommissar, die Richtung stimmt, die Auswirkungen werden jedoch in den Mitgliedstaaten sehr unterschiedlich sein. In Deutschland wird dieses Milchpaket kaum Auswirkungen haben. Wir hatten jetzt bereits Erzeugerzusammenschlüsse nach dem Marktstrukturgesetz. Viele Landwirte in Deutschland sind in Genossenschaften organisiert, d.h. sie vermarkten bereits gemeinsam ihre Milch und ihre Milchprodukte. Die Vertragsbeziehungen sind dort durch die Satzung geregelt. Im Privatsektor gibt es eben bereits diese Lieferverträge.

Leider können wir mit diesem Milchpaket grundlegende Probleme nicht lösen. Dieses Milchpaket regelt die Beziehungen zwischen Erzeugern und Molkereien. Das größte Problem sehe ich jedoch im Verhältnis zwischen der Molkerei und dem Einzelhandel. Das ist jetzt kein Vorwurf an die Beteiligten. Wir haben als Agrarier auch nicht die Zuständigkeit dafür, aber Herr Kommissar, ich bitte Sie, in der Kommission darauf hinzuwirken, dass wir auf diesem Milchpaket aufbauend weitere Fragen regeln, z.B. das Thema Zahlungsziele für Milchprodukte. Es kann nicht sein, dass Landwirte Produkte an die Molkerei liefern – das Verfallsdatum für Frischmilch ist drei Tage – und die Handelsketten erst nach sechzig oder achtzig Tagen zahlen. Da muss eine Regelung gefunden werden.

Ein zweiter Punkt sind die Listungsgebühren, die Rabatte, die hier gewährt werden müssen. Wir brauchen verbindliche Netto-Netto-Preise im Milchsektor, damit hier Transparenz herrscht. Die Liefermengenregelungen sind nicht verbindlich, die Vertragsdauer mit der festen Preisbindung zwischen Molkerei und Handel muss geregelt werden. Es gibt also noch viel zu tun. Meine Fraktion, die EVP wird aber diesem Milchpaket mit Sicherheit mit großer Mehrheit zustimmen.

  Luís Paulo Alves (S&D). - Senhor Presidente, Senhor Comissário, o pacote de leite que aqui é apresentado como um instrumento de organização do setor, contendo elementos positivos e importantes, como o reforço do papel das organizações de produtores e das organizações interprofissionais e aspetos contratuais que nalguns Estados-Membros podem constituir um avanço no relacionamento dos produtores com os transformadores, deixa-nos todavia bastante aquém dos instrumentos de que o setor necessita para prosperar nos próximos anos no quadro de uma agricultura que queremos que tenha, na Europa, acesso à distribuição justa do valor na cadeia alimentar, que não se transforme numa agricultura das grandes explorações intensivas concentradas nuns poucos Estados-Membros.

Se melhorar a condição de auto-regulação no relacionamento entre atores do setor é desejável, já pensar que isso, por si só, é suficiente é laborar num grave erro que pode afastar milhares de produtores de leite, dezenas de regiões e até alguns países de atividade leiteira. O debate sobre a regulação do setor leiteiro na perspetiva de um setor sustentável económica, social, ambiental e territorialmente continua, assim, ainda por fazer. E não poderemos abandonar o regime de quotas leiteiras sem que se tenham garantido verdadeiros instrumentos de gestão da oferta.

  George Lyon (ALDE). - Mr President, could I too offer my congratulations to my colleague Jim Nicholson for delivering the first piece of legislation under the new Lisbon powers. I just hope we make the same speed when it comes to negotiating the CAP as he has managed to achieve during the milk package.

I welcome the dairy package as a significant step forward in bringing greater transparency to the EU milk market; it makes it possible for dairy farmers to come together and have greater strength in the market place. Legislation provides for fair and open contracts and I hope they will help to eradicate some of the abuses in the dairy market. But as Jim himself pointed out, this is no silver bullet to solving some of the problems that there are in the market place.

Producers need to come together to use these powers if they are going to extract a better return. In the United Kingdom the coalition government has called on the dairy industry and the farmers’ representatives to agree a voluntary code of conduct and I welcome that initiative. However, the Minister should make it crystal clear to the dairy trade that, should they refuse to sign up to a voluntary solution, he will wield the big stick and use the contract powers in this legislation to compel them to do so.

One area I am still concerned about is the role of the retailers who are not covered by this legislative package. I think the Agriculture Committee in this House needs to look at this because there are still real concerns that retailers are abusing their dominant position in the market place.

  Alyn Smith (Verts/ALE). - Mr President, I will add my own congratulations to our rapporteur, not – as he might suspect – through gritted teeth, but certainly through a sore throat.

It is right that we acknowledge that he has worked very hard to pull together some very divergent opinions on this issue, but in my Group we still diverge. We do not believe that this package goes far enough. There are some points to like, and there are others to be rather less enthusiastic about, because this is urgent.

The milk market is not working: it is not functioning in the best interests of our producers, our consumers or our wider society. In Scotland, we have seen a 7% decline in our national herd since 2007. We see systemic imbalances within this market, and even those who are in favour of this report are the first to admit that it is not a silver bullet. It is not going to solve all the problems. Perhaps we should come up with a better package than the one we have before us today.

That said, there clearly is a majority for this package. I am glad to welcome some elements of it. Reluctantly, we will not be supporting the full package, as I fear that it misses the point entirely and that we will all be back here this time next year wondering why so little progress has been made.

  Julie Girling (ECR). - Mr President, I would also like to thank the rapporteur for his report. My constituency, the South-West of England, is the premier area for dairy production in the UK and, I think, one of the best in Europe. Our dairy farmers are forward-looking and increasingly efficient. Most welcome competition. They do not want or expect protection by market distorting measures. They expect support through sensible regulation.

However, it is clear that the balance of cost and income between producers, processors and retailers has become distorted over the years. This will not be solved overnight, but this report goes some way towards doing so. At a time when dairy farmers face increasing costs through, amongst other things, our demands from here on NVZs, greening measures, etc., let us look at the positive in this report: the ability of Member States to make decisions on contracts, and the flexibility that has been left there. Let us look at the positive and look forward to this being the first step towards creating value for farmers and consumers.

  Csanád Szegedi (NI). - Tisztelt elnök úr! Tisztelt képviselőtársaim! Az alapvető probléma abban rejlik, hogy a tejtermelők és a tejfeldolgozók nincsenek egyensúlyban egymással. Alá-, fölérendeltség van sajnálatos módon és a tejfeldolgozók - ki kell mondani - kihasználják a tejtermelőket. Látjuk pontosan azokat a példákat, hogy mi mindent megtesznek egy árversenyben, milyen adalékanyagokat tesznek hozzá bizonyos tejtermékekhez, hogy azokat olcsón el tudják adni. Adalékanyagokat tesznek hozzá, majd a multinacionális üzletláncokon keresztül eljutnak szerte Európába egy olyan árversenyt generálva, ami előbb-utóbb ahhoz fog vezetni, hogy még a tejet is Kínából fogjuk behozni, és a tejtermelők tönkre fognak menni Európában, úgyhogy nagyon fontos, hogy önmérsékletre szólítsuk fel a szabályozási rendszeren keresztül is a tejfeldolgozókat. Itt a megoldás és a kulcsszó az élelmiszer-önrendelkezés. Csak az élelmiszer-önrendelkezés keretén belül oldható meg, hogy a tejtermékekhez olcsón hozzájuthassanak az emberek, és ezek a tejtermékek jó minőségűek legyenek Európa-szerte.

  Mairead McGuinness (PPE). - Mr President, I would like to thank Mr Nicholson, the rapporteur, and all the shadows who worked on this.

This provides answers to some Member States and to the dairy farmers who have particular problems with private operators. For others there are no issues because there is a cooperative structure. I welcome this as an initiative – and might I suggest to Mr Nicholson that he should write the layman’s guide to codecision in agriculture.

I am concerned that, when we move on to these very large dossiers, it will be much more difficult – and I think Jim Nicholson is nodding in agreement – to come to a good outcome, but we live in hope.

The issues I want to raise today are wider than just the report that is before us – which I will be supporting – and relate to the report of December 2010 which spoke of the soft landing for the dairy sector. That report indicated that a soft landing may be not guaranteed in a number of Member States.

I rise on behalf of one of those Member States – Ireland – which has a problem in relation to this much promised soft landing. Dairy farmers in Ireland see a situation where their product is in demand, where Europe is below quota and where they would wish to be able to produce without a penalty. I know the position from the Commission on this issue, but I would ask – like other colleagues – that perhaps we need to bring a report forward from the 2014 date.

We need to consider the position of those Member States which are not enjoying a soft landing and where there are penalties being imposed on producers for supplying a product for which there is a market. The penalty is extremely severe, whereas Europe is actually not filling its entire quota over all of the Member States.

The last point relates to the power of the retail sector – not for this report, but an issue that will not go away – and I know the Commission will have something for us by June of this year.

  Paolo De Castro (S&D). - Signor Presidente, signor Commissario, onorevoli colleghi, col provvedimento che ci apprestiamo ad approvare si chiude un percorso che l'Europa ha intrapreso dopo la crisi del 2009 per individuare soluzioni orientate a stabilizzare il mercato e i redditi dei produttori lattiero-caseari.

Grazie al lavoro e all'impegno del Parlamento europeo e del nostro relatore, onorevole Nicholson, che davvero ringrazio per il suo enorme impegno insieme ai colleghi shadow di questa importante relazione, abbiamo raggiunto velocemente un accordo su un testo migliorativo rispetto alla proposta della Commissione.

Una novità importante è la possibilità di gestire e programmare i volumi produttivi dei prodotti caseari di qualità certificata. Uno strumento che, in una fase storica di forte e prolungata volatilità dei mercati, assume un significato ancora più strategico che consolideremo all'interno delle nuove norme sui prodotti agroalimentari di qualità. È molto importante anche la nuova possibilità di coinvolgere i rappresentanti del commercio nelle organizzazioni interprofessionali, al fine di promuovere e consolidare i positivi rapporti fra tutte le componenti della filiera.

Oggi, signor Presidente e signor Commissario, dimostriamo che il Parlamento sa assumersi le proprie responsabilità e cooperare in tempi rapidi alla conclusione dell'iter legislativo. È il nostro primo banco di prova in vista della grande sfida rappresentata dalla discussione sulla riforma della PAC.

The crisis in the dairy sector in 2009 highlighted the severe vulnerability of this sector and clearly demonstrated that it is essential that a degree of stability and certainty is established for dairy farmers when quotas are abolished in 2015.

Just as my colleague Ms McGuinness has already said about Ireland, as we progress towards the abolition of quotas a very worrying situation is developing for dairy farmers, and the threat of a superlevy is present year on year. The Commission has conceded that, in Member States where milk deliveries exceed quotas, a soft landing may not be guaranteed. The milk quota for Ireland and the threat of a superlevy are hampering growth opportunities for the Irish agricultural sector. Overall milk production in the European Union is 6% under the quota, and it is an unsustainable situation that while Irish dairy farmers can meet the EU quota overall, due to inflexibility they will be penalised and the potential for growth held back.

Agriculture is currently one of the strongest sectors in Ireland, helping us out of our current economic problems, yet its potential is constrained with a one-size-fits-all policy that is not working for dairy farmers. It is clear, therefore, that there is no widespread political will to revisit the Health Check decisions, yet I would urge the Commission to consider measures to ensure a soft landing for all Member States and to consider introducing a degree of flexibility into the system for dairy farmers.

  Hynek Fajmon (ECR). - Vážený pane předsedající, evropský sektor produkce mléka prošel v posledních letech poměrně složitým vývojem, což se ale týkalo také dalších sektorů evropského hospodářství. Všichni dobře víme, že od roku 2008 prakticky dodnes trvá střídavě buď hospodářská nebo dluhová krize, což se nemohlo nepromítnout v poptávce i po mléku a mléčných produktech.

Jak se během posledních let ukázalo, tak ani evropský systém kvótové regulace v sektoru mléka nedokázal zabránit negativním dopadům výše zmíněné krize, a je proto načase tento zastaralý systém z časů centrálního plánování definitivně opustit. Mléko v EU žádné kvóty nepotřebuje, stejně jako je nemají rohlíky, chleba, auta a jiné komodity.

Je žádoucí, aby přechod k tržnímu systému bez kvót byl co nejhladší, a proto podporuji, aby členské státy měly možnost upravit smluvní vztahy v rámci tohoto odvětví dle vlastní úvahy, ale musí to být provedeno tak, aby to bylo v souladu s principy jednotného evropského trhu. Podpořím tedy zprávu kolegy Nicholsona, protože si myslím, že jde tím správným směrem.

  Esther de Lange (PPE). - Voorzitter, dit debat duurde al bijna een uur voordat de twee magische woorden genoemd zijn en dat is soft landing. In de tekst van de Commissie zijn ze niet te vinden, in de tekst van het akkoord ook niet. Ik wil u echter toch nog herinneren aan het volgende, mijnheer de commissaris: bij de hervormingen van 2007 en 2009, toen wij definitief kozen voor een einde aan de melkquota, voor meer marktoriëntatie, is gezegd dat alle lidstaten de kans moeten hebben om zich voor te bereiden op de nieuwe situatie, met andere woorden, om geleidelijk over te gaan in dat nieuwe systeem. Nu merken we, op het moment dat je kiest voor meer marktoriëntatie, dat je die markt een grotere rol laat spelen, dat de macht ongelijk verdeeld is als het gaat om de voedselproductieketen.

Dit akkoord is een poging om de positie van de primaire producent te versterken en dat akkoord moet je dus verwelkomen. Er zitten goede elementen in dat akkoord, zeker, en ik feliciteer de onderhandelaars. Maar ik heb ook twijfel. Het gaat vooral om de verhouding tussen boer en verwerker, terwijl de problemen nu juist zo vaak verder in die productieketen zitten, bij de inkopers van de supermarkten en de supermarkten zelf. Dààr wordt het grote geld verdiend, dààr zie je een situatie waar supermarkten een aantal jaar geleden een marge hadden op een kilo jonge kaas van € 0,20 om vervolgens, twee jaar later, een marge te hebben op diezelfde kilo jonge kaas, van € 1,20. Dat is zes keer zo veel. Dus voor de zoveelste keer vragen wij de Europese Commissie: zorg voor transparantie in die voedselproductieketen, als het gaat om waar de macht ligt en hoe de marges verdeeld worden.

Tot slot: dit akkoord is een goed instrument in handen van bepaalde lidstaten om ze voor te bereiden op de nieuwe situatie. Ik denk aan berggebieden, andere benadeelde gebieden, lidstaten met veel beschermde oorsprongsproducten. Maar andere landen blijven nu tot op het laatste moment in het harnas van dat melkquotumsysteem zitten en moeten van de ene op de andere dag over van het oude naar het nieuwe systeem. Dat is dus geen beloofde soft landing.

Zoals mijnheer Dantin al gezegd heeft, er is een stap gezet, maar wij zullen met het oog op de nieuwe situatie na 2015 andere stappen moeten zetten en ik hoop dat de Europese Commissie dat snel zal doen.

  Estelle Grelier (S&D). - Décidé sous présidence française, le démantèlement des quotas risquait de laisser les producteurs de lait sans garde-fou en cas de perturbation du marché. Nous accueillons donc la proposition du paquet "lait" comme un premier pas favorable. Il était en effet nécessaire de renforcer le pouvoir de négociation des producteurs face à l'industrie privée de transformation, en favorisant leur regroupement et la contractualisation, laquelle ne concernera que la moitié de la production.

Les collègues socialistes, Stéphane Le Foll en particulier, ont permis d'améliorer la proposition en assurant l'avenir de la production laitière dans les zones fragiles où sont fabriqués des fromages sous appellation.

Néanmoins, beaucoup reste à faire. Le rééquilibrage en faveur de l'élevage notamment et d'autres outils de marché seront indispensables pour éviter toute nouvelle crise du lait. La réforme de la PAC doit être l'occasion de compléter ce dispositif, pour garantir les revenus des agriculteurs et leur redonner la place prépondérante qui devrait être la leur dans le processus d'approvisionnement et dans la sécurité alimentaire de l'Europe.

  Valdemar Tomaševski (ECR). - Panaikinus pieno kvotas, Europos pieno sektoriaus laukia didžiulės permainos, kurios gali nulemti derybinės galios lygsvaros sutrikimą tarp ūkininkų ir pieno perdirbimo įmonių. Taip pat tai gali privesti prie nesąžiningų komercinių praktikų, nustatant pieno supirkimo kainas. Toks procesas ypatingai pakenktų smulkiesiems gamintojams, ypač tose šalyse, kur veikia daug smulkių ūkių.

Būtent dėl to Europos Sąjunga turėtų remti žemdirbių bendradarbiavimą bei organizuotumą į gamintojų asociacijas ir kooperatyvus. Tai ateityje sustiprintų jų derybines galias. Kooperacijos rėmimas ypač aktualus Lietuvoje ir tose šalyse, kur ūkininkų kooperacija nebuvo tinkamai remiama. Tokiu būdu apsaugosime ūkininkus nuo nesąžiningos konkurencijos pieno sektoriuje.   Georges Bach (PPE). - Herr Präsident, Herr Kommissar! Ich unterstütze den im Trilog gefundenen Kompromiss, der die Verhandlungskraft der Milchbauern gegenüber der verarbeitenden Industrie stärken soll, obschon ich weiß, dass er in manchen Mitgliedstaaten nicht alle Probleme löst, mit denen die Milchbauern zurzeit konfrontiert sind.

Schon Kommissionspräsident Mansholt hatte vor 50 Jahren im Rahmen der GAP Vorzugsmaßnahmen für die Schaffung von Produzentengemeinschaften vorgesehen. Auch in meinem Land, in Luxemburg, ist die Milchwirtschaft aufgrund des hohen Grünlandanteils das Hauptstandbein unserer Landwirtschaft. Unsere Landwirtschaft und unsere Landwirte haben schon lange verstanden, dass es die beste Lösung ist, sich in einer Genossenschaft zusammenzuschließen, welche die Verarbeitung der Milch selbst übernimmt.

Fünf Mitgliedstaaten haben im Rat aus genau diesem Grund gegen den Kompromiss gestimmt, der seiner Vorgabe als soft lending-Instrument nicht gerecht wird. Die Europäische Kommission hat das Initiativrecht, was legislative Vorschläge angeht, und deshalb möchte ich Sie auffordern, dem Rat und dem Europäischen Parlament noch 2012 einen legislativen Vorschlag zu unterbreiten, um diesen offensichtlichen und kostspieligen Fehler im System zu beheben.

Eine lineare Absenkung der Superabgabe, die für jeden überlieferten Liter Milch anfällt, bis zum Jahr 2015, oder die Abschaffung der Fettkorrektur könnten die negativen Auswirkungen der auslaufenden Regelung zumindest abschwächen, ohne die nicht betroffenen Mitgliedstaaten zu schädigen. Das vorliegende Milchpaket versteht sich aber auch als Abschlussbericht der high level group, der den Milchquotenausstieg zu einer sanften Landung verhelfen soll.

Erstaunlich, dass in diesem Bericht von Milchquoten an keinem Punkt die Rede ist. Die jungen und ehrgeizigen Landwirte in Luxemburg und in vier anderen Mitgliedstaaten, die versuchen, sich auf die Liberalisierung des Milchmarkts vorzubereiten und ihre Produktion ausbauen wollen, um nach 2015 auf dem Weltmarkt mithalten zu können, können dies nur, indem sie auch jetzt, so kurz vor dem Ende des Milchquotensystems noch Quoten hinzukaufen. Dies ist ein enormer zusätzlicher und unnötiger Kapitalaufwand, der sie gegenüber ihren Kollegen in den übrigen 22 Mitgliedstaaten benachteiligt.

  Sergio Gutiérrez Prieto (S&D). - Señor Presidente, el Reglamento que debatimos hoy no es perfecto, no puede por sí solo arreglar las dificultades de un sector con problemas estructurales y también, por el contexto económico que vivimos, con problemas coyunturales. Pero, este Reglamento, sin ser perfecto, es un paso hacia adelante, decidido y en la buena dirección.

Porque, pese a que en la última época nos hemos dado cuenta todos de que no hay ningún mercado perfecto, era muy necesario introducir en este tablero, donde además estamos jugando con la seguridad alimentaria de la gente, todos los elementos que pudiéramos de regulación y de protección a nuestros productores.

Era muy necesario que permitiéramos la obligatoriedad de los contratos con un plazo mínimo y con un volumen máximo, al menos como instrumento de defensa, porque, por supuesto, nuestros productores no parten con la misma fortaleza negociadora ante la distribución, los intermediarios o los recolectores.

Quedan muchas cosas por hacer. Deberemos mejorar las redes de seguridad y hacerlas más ágiles y más efectivas. Deberemos apostar por vertebrar aún más el sector en la cadena de valor, controlar que no haya reparto de cuotas —especialmente en determinadas zonas— o impulsar la política de calidad.

Pero, sin ninguna duda, con nuestro voto positivo y con todo lo que queda por hacer, hoy muchos ganaderos podrán ver que este Parlamento ha defendido su derecho laboral más básico: el de poder vivir con dignidad de las rentas de su trabajo.

  Herbert Dorfmann (PPE). - Herr Präsident, geschätzter Herr Kommissar! Ich möchte mich herzlich bei den Berichterstattern und bei den Schattenberichterstattern bedanken. Wir bekommen eine gute und notwendige Gesetzgebung! Das Ziel dieser Gesetzgebung ist es, die Angebotskette neu zu definieren und zu regeln. Das wird für den ersten Teil der Kette – das heißt vom Bauern bis zum Verarbeiter – auch gelingen. Was mir in dieser Gesetzgebung fehlt – das haben schon einige Kollegen gesagt –, ist der zweite Teil der Kette. Was passiert vom Verarbeiter hin zum Konsumenten? Da sind manche Fragen offen: manche sind schon genannt worden, z. B. der Verkauf unter Einstandspreisen, und viele andere Fragen auch.

Deswegen kann dieses Paket keine endgültige Antwort auf das Auslaufen der Milchquote sein. Denn gerade in Gebieten, wo das Auslaufen der Milchquoten schwierig ist – also in Berggebieten, in benachteiligten Gebieten –, ist die Produktion bereits heute genossenschaftlich organisiert, und dort wird sich wohl auch wenig ändern.

Gut und positiv an dieser Gesetzgebung ist die Möglichkeit für die Erzeugerorganisationen und die Verbände, im Bereich der g.g.A. und g.U., also der geschützten Ursprungsbezeichnungen, gesonderte Regelungen und Angebotssteuerung zu machen. Das brauchen manche Organisationen, und im Hinblick auf die Diskussion des Qualitätspakets ist das ein richtiger Ansatz. Wir sollten das im Qualitätspaket auch für andere Produkte durchführen. Denn das, was für die Milch recht ist, kann für andere Produkte eigentlich nur billig sein.

  Wojciech Michał Olejniczak (S&D). - Panie Przewodniczący! Produkcja mleka to chyba najważniejszy sektor w całej Wspólnej Polityce Rolnej. Na producentów mleka i na przetwórstwo wydajemy największą część funduszy ze Wspólnej Polityki Rolnej. Dlatego powinniśmy bardzo pieczołowicie dbać o to, aby sektor mleczarski mógł się dalej rozwijać w sposób stabilny. Przez ostatnich wiele lat dokonaliśmy bardzo dużo, z czego skorzystali producenci rolni, ale też i konsumenci. Rozwiązania, które są dzisiaj proponowane, wychodzą w jakimś sposób naprzeciwko oczekiwaniom – po pierwsze – rolników, a po drugie – również konsumentów.

Chciałbym jednak, żebyśmy w toczących się później pracach zwrócili większą uwagę na rozwój spółdzielczości i na oparcie tego sektora na tym sposobie gospodarowania. Jest on dobry zarówno dla samych rolników, jak i dla konsumentów. Niezwykle ważne jest, aby stabilizacja, która w tym sektorze w ostatnich latach była zachwiana, została przywrócona do pewnych standardów, do pewnej normy, która obowiązywałaby przez wiele lat w przyszłości.

  Elisabeth Köstinger (PPE). - Herr Präsident, sehr geehrter Herr Kommissar! Vielen Dank den Berichterstattern für die geleistete Arbeit. Das Milchpaket, das wir morgen nach langen Verhandlungen beschließen werden, halte ich prinzipiell für begrüßenswert.

Das Ziel ist, die Stellung der Bauern in der Wertschöpfkette zu stärken. Das Parlament erkennt an, dass die Verhandlungsposition der Bauern im Milchmarkt gegenüber den Handelsketten zu schwach ist. Mittlerweile wissen auch die Konsumenten, dass es nicht die Bauern sind, die von etwaig hohen Lebensmittelpreisen profitieren. Der Erzeugerpreis beträgt immerhin nur einen Bruchteil des Verkaufspreises.

Das, was wir morgen beschließen, wird weder die Situation der Milcherzeuger verbessern, noch eine nachhaltige Lösung für den hochsensiblen Milchmarkt bieten. Auch von einem soft lending – und das wurde bereits angesprochen – kann keine Rede sein.

Die Einführung von eigenen Erzeugergemeinschaften muss jeder Mitgliedstaat für sich selbst bewerten. Ein erzeugerdominiertes System gibt es in Form der Genossenschaften bereits. Für manche Mitgliedstaaten hat es daher mehr Sinn, die Genossenschaften weiterzuentwickeln. Die Milchbauern müssen ihre Marktposition auf Augenhöhe stärken können. Vor allem in Bergregionen wird das die Schlüsselfrage sein. Viele Milchbetriebe spezialisieren sich dort auf Qualitätsproduktion. Qualität muss sich aber lohnen, und deshalb ist der Schutz der europäischen Qualitätserzeugnisse das oberste Ziel.

Es ist wichtig, dass die Mitgliedstaaten diese Instrumente nun auch annehmen. Dies bietet einen Zusatznutzen und fördert die Wettbewerbsfähigkeit, vor allem für die am stärksten benachteiligten ländlichen Gebiete. Dieses Milchpaket ist ein erster Schritt, um den angeschlagenen Milchsektor zu unterstützen. Es liefert aber keine echten Lösungsansätze hinsichtlich des Auslaufens der Milchquoten.

Für diese absolut freie Marktsituation und die volatilen Preise müssen dringend weitere Maßnahmen folgen. Es sind Instrumente erforderlich, die für die Milchbauern in allen Mitgliedstaaten eine Lösung darstellen, die den Wert des Produkts Milch herausstellen und die den Landwirten das Überleben sichern. Es braucht mehr Mut, Herr Kommissar, für den Kampf um einen lebensfähigen Milchsektor.

  Ulrike Rodust (S&D). - Herr Präsident, Herr Kommissar, meine Damen und Herren! Ich begrüße den Ansatz der Verordnung zu den Vertragsbeziehungen im Milchsektor, die Verhandlungsmacht der Milcherzeuger zu stärken und für fairere Preise zu sorgen. Es ist wichtig, dass wir die Milcherzeuger nach dem Auslaufen der Milchquote nicht im Regen stehen lassen. Gerade kleine und mittlere Familienunternehmen sind darauf angewiesen, dass sie von der Europäischen Union gefördert werden und nicht den Milchabnehmern und dem Einzelhandel schutzlos ausgeliefert sind.

Ich hätte mir allerdings sehr gewünscht, dass wir auf Ebene der Mitgliedstaaten eine Vertragspflicht einführen. Der Rat und die Kommission haben sich dagegen jedoch mit Händen und Füßen gewehrt. Schade, dass der Rat jetzt nicht hier ist. Der jetzt gefundene Kompromiss ist meiner Meinung nach tragbar, aber auf jeden Fall nicht genug. Daher müssen wir dafür sorgen, dass bei der hier anstehenden Reform der Gemeinsamen Agrarpolitik gerade kleine und mittlere Milcherzeuger berücksichtigt werden.

Mein Hauptanliegen wird es weiterhin bleiben, für eine flächendeckende, nachhaltige und multifunktionale Landwirtschaft in Europa zu kämpfen.

  Maria do Céu Patrão Neves (PPE). - A proposta da Comissão para o setor do leite é insuficiente, sobretudo tendo em atenção que se trata de um setor extremamente volátil, que passa por crises cíclicas e que atravessa uma reestruturação com o fim anunciado das quotas.

Este relatório, não obstante o meritório trabalho do relator e dos relatores-sombra, não faz o milagre de tornar a proposta suficiente para garantir o futuro para este setor. O pacote do leite não substitui as quotas leiteiras. Afinal pouco muda: os contratos, que já antes se celebravam, são agora ditos voluntários; as cooperativas, apesar do seu diferente perfil em muitos Estados-Membros, são tratadas por igual e excluídas do pacote do leite, como se todas refletissem o real poder dos produtores. Os limites de concentração estabelecidos são atualmente ultrapassados e não há mecanismos previstos para inverter a situação.

Sem novas orientações significativas para o setor, com muitos produtores a pagarem ainda o crédito bancário a que recorreram para a aquisição de uma quota, que parece nada valer, com o preço da venda do leite a descer, com práticas de dumping e cartéis a funcionarem ao nível da distribuição, qual será o futuro de regiões fortemente dependentes da produção leiteira como acontece nos Açores?

  Zofija Mazej Kukovič (PPE). - Prisrčne čestitke poročevalcu in pa koordinatorju za vse, kar je narejenega v dobro kmetov, ki so dejansko najšibkejši člen, najšibkejši člen z veliko dela in z malo zaslužka.

In tudi po letu 2015 bo potrebno razmišljati v smeri tistih, ki bodo še vedno šibki, to pa so kmetije, ki so na oddaljenih hribovskih področjih.

Da bo to kombinacija s turizmom, z zdravim načinom življenja, tudi s pridelavo lokalne hrane in s tem tudi pogojev za podjetništvo in za nova delovna mesta, kajti novih delovnih mest zmanjkuje v klasični industriji in zato je ravno to področje, urejeno področje, lahko velika priložnost.

  Ricardo Cortés Lastra (S&D). - Señor Presidente, señor Comisario, este acuerdo recoge contenidos realmente interesantes, como que los Estados puedan establecer la contratación obligatoria que regule los volúmenes y la duración mínima, así como un precio.

Pero esta nueva figura, además, permitirá fijar un precio entre el productor y las empresas, y tendrá una vigencia de, al menos, seis meses. Esto aporta más estabilidad —es cierto— y más beneficios al productor. Pero esto solo es un paso, señor Comisario.

Señor Comisario, la verdad es que la industria del sector sigue abusando de su posición negociadora, hundiendo los precios de los productores —lo que conduce a la ruina a este sector— y sometiendo a estos últimos a incertidumbres e hipotecando su futuro.

Señor Comisario, acabo de hablar con productores de mi región, de Cantabria, y la situación —usted la conoce muy bien— es muy complicada, muy difícil, y espero que se tomen más medidas en el futuro que verdaderamente saquen adelante a este sector.

  Miroslav Mikolášik (PPE). - Sektor mlieka a mliečnych výrobkov prechádza v poslednom období značnými zmenami, ktoré finančná a hospodárska kríza ešte prehĺbila. Vysoké ceny vstupných nákladov a súčasný pokles dopytu po mliečnych výrobkoch spôsobili zníženie príjmov priamych producentov, avšak neodrazili sa v znížených cenách pre konečných spotrebiteľov.

Málo transparentné fungovanie spotrebiteľského reťazca teda vykazuje mnohé nesúrodosti, ktoré môžu svedčiť o existencii nečestných obchodných praktík na úkor výrobcov, ale aj na úkor domácností, ktoré sú na konci tohto reťazca.

Domnievam sa preto, že sektor mliečnych výrobkov by mal pri vytváraní cien viac zohľadňovať základné signály trhu, akými sú predovšetkým ponuka a dopyt, a upevnenie hospodárskej súťaže, vyjasnenie základných práv a povinností jednotlivých aktérov, zlepšenie ich informovanosti a zodpovednosti by tiež malo viesť k spravodlivejšiemu rozdeleniu celkových výnosov v rámci reťazca a zlepšeniu primeranej životnej úrovne poľnohospodárov chovajúcich dobytok.

  Rareş-Lucian Niculescu (PPE). - Adoptarea raportului referitor la pachetul privind laptele reprezintă un mic pas înainte în favoarea crescătorilor de animale. Contractele, întărirea puterii de negociere a producătorilor, încurajarea organizaţiilor interprofesionale, transparenţa, toate acestea sunt, în mod evident, necesare, dar trebuie să recunoaştem că ne aflăm în faţa unui progres modest, insuficient şi ale cărui rezultate concrete nu putem încă să le estimăm.

Fără a respinge nici necesitatea, nici utilitatea acestor măsuri, îmi permit să fac unele comentarii. Primul: Uniunea Europeană se pregăteşte pentru o viitoare politică agricolă comună, începând din anul 2014. În această viitoare politică, trebuie să se găsească soluţii pentru fermierii din sectorul laptelui – şi mă refer la fonduri pentru modernizare, subvenţii pentru terenurile destinate păşunatului, pentru instalarea tinerilor fermieri şi măsuri de susţinere pentru momentele de criză. De aceea, avem nevoie de o PAC finanţată în mod adecvat.

Al doilea comentariu: s-a adus în discuţie necesitatea reglementării, a unui management al ofertei. Nu cred că de asta avem nevoie, ci de o mai bună reglementare a relaţiilor de-a lungul lanţului de producţie, în toate domeniile producţiei alimentare, pentru a limita abuzurile cunoscute de toată lumea ale distribuitorilor şi comercianţilor.

  José Bové (Verts/ALE). - Monsieur le Commissaire, Monsieur le rapporteur, je voudrais d'abord féliciter M. Nicholson pour le courage qu'il a eu face au Conseil et à la Commission.

Malgré cela, je crains que ce à quoi nous avons abouti ne permette pas un équilibre entre les producteurs et les industriels. Cet accord me fait penser à cette illusion qu'on connaît, que racontent les enfants, d'un paradis où les lions végétariens mangeraient l'herbe à côté des brebis. Je n'y crois pas une seconde!

Depuis 2003, Mme Fischer Boel a tout fait pour détruire de manière idéologique les quotas laitiers. En octobre 2009, la Cour des comptes a, malgré tout, reconnu l'efficacité de ces quotas laitiers. Or, aujourd'hui, nous sommes dans une situation qui va être encore plus dramatique et nous voyons ce qui se passe actuellement au Danemark, où les exploitations les plus solides, avec l'augmentation de la production, sont toutes en situation de faillite, avec la baisse des prix de la terre de 40 %.

Voulons-nous cela au niveau européen? Je dis non! Il faut une maîtrise de la production avec la participation des pouvoirs publics.

  Jarosław Kalinowski (PPE). - Panie Przewodniczący! Pakiet mleczny ma poprawić funkcjonowanie rynku mleka w Unii po odejściu od kwotowania. Cel ten ma być osiągnięty przez wzmocnienie pozycji producentów mleka wobec zakładów przetwórczych i podmiotów skupujących. Wprowadza możliwość zbiorowych negocjacji, możliwość tworzenia organizacji międzybranżowych i ma poprawić przejrzystość.

W tym miejscu chcę jednak powiedzieć, że w praktyce bardzo często jest tak, że rzekomo lepsze rozwiązania okazują się gorszymi od obecnie istniejących. To nie system kwotowania był przyczyną kryzysu w roku 2009. Kwotowanie jest instrumentem sprawdzonym, dającym gwarancje i bezpieczeństwo producentom. W innych dziedzinach, jak w bankowości, proponujemy większy nadzór i regulacje, a w sektorze mleka zmierzamy do liberalizacji. Z pewnością nie zapewni to stabilności naszym rolnikom oraz będzie sprzyjało nadmiernej koncentracji produkcji i bankructwom wielu producentów mleka w Unii.

  Andrew Henry William Brons (NI). - (opening words lost as microphone switched off) ...to oppose EU legislation in general and the CAP in particular. However in an area of current EU competence we would reluctantly support a measure that was unambiguously in the interest of a sector of the UK economy. To oppose it because we are opposed to EU membership would be to betray the interests of our fellow-nationals.

Nearly all UK milk producers already have written contracts, although it must be said that they do not generally meet the standards stipulated in this milk package. Dairy farmers do need to be able to cooperate on a sufficient scale to confront the cartel of milk buyers, to which they sell their milk, without fear of investigation by the competition authorities. The gap between farm-gate prices and retail prices must be narrowed. We are concerned about the abolition of milk quotas, which might lead to the competitive dumping of milk from one Member State to another.

The recommendation for improving transparency is limited to collating the volume of raw milk delivered to dairies. The UK is already more advanced in the collation of such market information.

Szeretném én is üdvözölni képviselő kollégám jelentését, annál is inkább, mivel az általa megfogalmazott és a Mezőgazdasági és Vidékfejlesztési Bizottság által támogatott módosító javaslatok úgy tűnik, figyelembe veszik az új tagállamok tejtermelőinek érdekeit is. Egyetértek azzal az állítással, hogy az európai tejágazat nagy átalakuláson fog átmenni a 2015-ös kvótamegszüntetés után. Szeretném kihangsúlyozni, hogy Európa keleti felében az ezzel járó megrázkódtatások hatványozottan fognak jelentkezni. Ebben az összefüggésben arra hívnám fel a Bizottság és a Parlament figyelmét, hogy ezen országokban talán erőteljesebben lehetne ösztönözni a termelői szervezetek létrehozatalát, mivel a termelők sokszor teljesen kiszolgáltatott helyzetben tárgyalnak a felvásárlókkal. Ez pedig nem szolgálja a közös mezőgazdasági politika céljainak teljesülését.

  Ana Miranda (Verts/ALE). - Señor Presidente, la reforma propuesta por la Comisión no va a solucionar la situación dramática de muchos ganaderos y ganaderas europeos, como en el caso de mi país, Galicia, porque la producción continúa concentrándose en grandes explotaciones industrializadas que provocan un enorme desastre social, medioambiental y territorial.

En algunos casos, incluso, las pasadas reformas agrarias, en concreto en el sector de la leche, han dado lugar a una modernización en el sector, a la que, en estos momentos, con la bajada de los precios de la leche, tampoco puede hacer frente. Se necesitaría una interprofesional lechera que sea obligatoria en cada Estado miembro, en la que se concentren organizaciones profesionales agrícolas, la industria lechera, las cooperativas, la distribución y los consumidores.

Las administraciones públicas deben apoyar a estos grupos lácteos, concentrados y, desde luego, mucho más amplios que la imagen de un simple contrato entre grandes empresas.

  Dacian Cioloş, membre de la Commission. − Monsieur le Président, quelques remarques suite au débat qui a eu lieu sur cette proposition.

Certains d'entre vous ont souligné le fait que le quota laitier est éliminé et qu'il faut le maintenir. Je souhaite vous rappeler que la crise laitière de 2009 est survenue alors qu'on avait encore les quotas. Cela montre donc que le système de quotas actuellement en place n'est plus une solution dans les conditions actuelles du marché. Voilà pourquoi le Conseil a décidé, en 2008, de renoncer à ce système. Il n'est donc plus question là de la Commission. C'est un règlement du Conseil qui entérine déjà cette décision.

Je suis bien conscient aussi que ce paquet laitier ne va peut-être pas résoudre tous les problèmes du secteur laitier, mais nous avons voulu agir rapidement. M. Dantin a dit qu'il n'était pas d'accord avec moi sur le terme "rapidement". Moi, je considère que c'est quand même rapidement compte tenu du fait que le groupe de haut niveau a présenté ses conclusions au printemps 2010. La Commission a présenté ses propositions législatives, après toute la procédure interne à la Commission en automne, à la fin de l'année 2010 en tout cas. Nous voilà au début de l'année 2012 et nous sommes en mesure, après une procédure de codécision, d'arriver à la fin de ce processus.

Or, déjà dans ce paquet "lait", la Commission a proposé, et j'ai pris l'engagement de venir avec un rapport d'étape en 2014, de faire à nouveau l'analyse de l'état du secteur et du marché laitier avant l'expiration du quota laitier en 2015, et d'examiner, sur la base de ce rapport et de cette analyse de la situation du marché, s'il est nécessaire de présenter éventuellement des propositions complémentaires.

Certains d'entre vous ont souligné le problème des coopératives. Comme M. Nicholson l'a dit, les coopératives sont traitées de manière particulière parce qu'on ne leur impose pas des éléments de la proposition qui ne les visent pas directement. Les coopératives en soi sont une solution que le producteur individuel n'avait pas parce que, dans ce cadre, les producteurs se retrouvent eux-mêmes également les maîtres de la partie de transformation.

Sur la question de ce qu'on appelle l'atterrissage en douceur, c'est-à-dire l'élimination des quotas laitiers par étapes. Là aussi, certains d'entre vous ont fait remarquer que la Commission ne faisait pas son travail et qu'elle ne voulait pas présenter d'autres propositions. Or, ce sont toujours des agriculteurs, et même certains d'entre vous, qui disent qu'une certaine stabilité est nécessaire parfois pour pouvoir se projeter un peu sur le moyen terme. Concernant ce système d'atterrissage en douceur, d'augmentation par étapes des quotas jusqu'à leur élimination en 2015, le Conseil a pris une décision en 2008. Il n'y a donc pas de raison maintenant pour que la Commission vienne bouleverser, quelques années après seulement, une décision prise par le Conseil.

S'agissant de la transparence de la chaîne alimentaire et du rapport de négociation entre les producteurs, les transformateurs et la grande distribution, je vous rappelle que la Commission a créé un forum sur la chaîne alimentaire, qui travaille actuellement sur toutes ces questions. La Commission a décidé de ne pas intervenir par une réglementation avant d'écouter les acteurs de la chaîne alimentaire et avant de laisser les acteurs discuter et venir avec des propositions, afin de ne pas réglementer plus quand les problèmes peuvent être réglés autrement. À la dernière réunion de ce forum de la chaîne alimentaire, la Commission a clairement souligné qu'au mois de juin de cette année, le point serait fait sur les travaux de ce forum et notamment sur les propositions formulées par les acteurs de la chaîne alimentaire. Sur cette base, la Commission viendra devant vous et devant le Conseil avec un rapport et, si nécessaire, avec des propositions dans cette direction.

Encore une fois, je souhaite vous remercier, et tout particulièrement M. Nicholson, pour les efforts déployés en vue de conclure ces travaux de négociation et d'être en mesure aujourd'hui d'adopter ces propositions de la Commission.

  James Nicholson, rapporteur. − Mr President, first of all I would like to thank all those who took part in the debate: those who were very constructive and those who were less constructive. I take all the points of view on board, but I think I can simply say we have got the best deal that was possible at the time.

Milk quotas have been with us for thirty years. They have done a tremendous job throughout the whole of the European Union during that time, and let us hope that this new package will do an even better job. That is what my hope would be.

I share the concerns of those who come from disadvantaged areas and from mountainous regions; those are the areas which I think could be seriously affected by this move. It is for that reason we have enshrined in this report that the Commission will report by 2018. I will bring to the next coordinators’ meeting of the Committee on Agriculture and Rural Development the proposal that next year the Committee on Agriculture will consider doing an own-initiative report on the effects of milk quotas going away and maybe hurting those particular areas.


Can I also deal with one other point and that is the ‘soft landing’ part raised by Mairead McGuinness and Esther De Lange. I had two amendments – one from each of them – that I kept to the very last moment, and I can assure them that if I could have done anything about it I would. However, it was not within the realms of the possible. One of the difficulties when you make a piece of legislation is that you cannot put everything into legislation, and that is something this House has got to get used to as we go into the reform package.

Can I leave you with one particular appeal: we have set out here the rules for the producer and for the processer, but the elephant in the room is not here and we have no law over him and that is the retailer. Until we deal in this House with the retailer there will be problems not just for milk but for other areas.

Can I also leave with this appeal to the producers and to the processers: to work together, to cooperate and give strength between you. Then I believe there will be a good future for the dairy sector throughout the whole of Europe.

  Arkadiusz Tomasz Bratkowski (PPE), na piśmie. – W związku z decyzją Rady Unii Europejskiej o zakończeniu kwotowania produkcji mleka pragnę podkreślić swoje stanowisko co do konieczności utrzymania systemu jego kwotowania po 2015 r. Instrument ten spełnił swoją rolę już w przeszłości, stabilizując podaż i popyt na rynku mleka, tym samym gwarantując zbyt funkcjonującym na rynku producentom. Coroczne zwiększanie krajowych kwot mlecznych w konsekwencji pomogłoby w przygotowaniu sektora na brak ograniczeń w zakresie produkcji mleka. W tym kontekście Polska jest przygotowana na taką sytuację zarówno od strony organizacyjnej, jak i potencjału produkcyjnego.

Jednak na podstawie doświadczeń z 2008 r. wciąż pozostają obawy co do powtórnego załamania popytu na rynku mleka i związanego z tym braku zbytu nadwyżek jego produktów. Ponadto chciałbym przypomnieć, że termin zniesienia kwot mlecznych był już w przeszłości z wielu względów przesuwany. W związku z tym, mając na względzie sytuację rolników oraz wolę zapewnienia im gwarancji działania w stosunkowo stabilnej rzeczywistości, mam nadzieję, iż coraz więcej państw przyłączy się do stanowiska, które reprezentuję.

  Robert Dušek (S&D), písemně. – Návrh nařízení o smluvních vztazích v odvětví mléka a mléčných výrobků reaguje na složitou situaci na trhu s mlékem, kolísání cen a nekalé praktiky při vyjednávání o výkupních cenách mléka od zemědělců. Aby se zajistil udržitelný rozvoj výroby mléka a aby bylo možné producentům zaručit přiměřenou obživu, je nezbytné podniknout na unijní úrovni takové kroky, které zajistí spravedlivější rozdělení zisku v rámci dodavatelského řetězce. Zemědělství je nejstrategičtější odvětví v EU vůbec, je bezpodmínečně nutné hledat a také nalézat možnosti podpory. Pokud naši zemědělci nebudou mít dostačující obživu, zemědělskou činnost ukončí a my všichni budeme závislí na dodávkách potravin ze světa. S ohledem na budoucí potravinovou nedostatečnost ve světě je to ten největší hazard, který si EU nesmí dovolit. Producentům mléka navrhujeme sjednocovat se do velkých celků a družstev. Připomínám, že podobné velkostatky jsme úspěšně posledních 20 let v zemích střední a východní Evropy likvidovali. A drobného svobodného zemědělce přitom představovali jako úspěšný model západu. Nedomnívám se, že nějaké minimální smluvní závazky mezi producenty mléka a mlékárnami pomohou situaci vyřešit. Zvažme možnosti stanovení minimálních výkupních cen syrového mléka v rámci celé EU, a to zvlášť pro zimní a letní období. Neobávejme se tohoto rázného kroku vpřed!

  Jim Higgins (PPE), in writing. – I supported this report, which strengthens the bargaining power of dairy farmers by allowing farmers to negotiate collectively their contract terms with dairies, including the price. This report also allows us to outline once again the dire need for a soft landing for dairy farmers ahead of the lifting of milk quotas in 2015. I am calling for a flexible approach to the quotas and the application of pan-EU quotas. In the last two years Ireland narrowly avoided the imposition of fines. The last thing we want to do is fine progressive dairy farmers who are planning for expansion, growth and investment post-2015. The EU as a whole was 5 % under quota in 2011; punishing productive countries simply does not make sense at a time when the EU has a milk deficit of 7 %.

  Csaba Sándor Tabajdi (S&D), írásban. – A termelőket a létminimum szélére sodró 2008-2009-es tejválság nem ismétlődhet meg. Két évvel ezelőtt a magyar boltok polcain lévő dobozonként 109 forintos tejet 9 forintos áron vásárolták fel a Tejterméktanács adatai alapján. A jelentés arra is figyelemmel van, hogy a termelői szervezetek ne kerülhessenek monopol pozícióba sem nemzeti, sem európai szintéren. A felvásárlási árak féléves rögzítése hozzájárul a termelőket sújtó áringadozások kiküszöböléséhez. Ez elengedhetetlen lépés a tejkvóta rendszer 2015-ös megszűnése előtt. Sajnálatosnak tartom, hogy a Bizottság és a Tanács nem egyezett bele a szerződéses kapcsolatok kötelezővé tételébe. Annak ellenére, hogy 1 millió hektárnyi legelő áll rendelkezésre magyar tejágazat mégsem versenyképes a Kárpát-medence klimatikus adottságainak köszönhetően. A csapadékeloszlás miatt a lengyel-, a szlovák- vagy német tej sokkal gazdaságosabban termelhető, ezért lenne lényegbevágó a magyar gazdák számára a szerződéses kapcsolatok szabályozása. A magas takarmányárak, valamint a Fidesz intézkedései következtében megnövekedett adóterhek, munkabérek és járulékok következtében a jelenlegi kereskedelmi "átadási árszinten" nem lehet tisztességesen megélni. Ismét meg kellene győzni a magyar embereket az összefogás szükségességéről. A szövetkezeti forma nem az ördögtől való találmány, Nyugat-Európa számos országában évtizedes hagyományai vannak. A gazdák így védhetik érdekeiket a feldolgozó iparral és a szupermarketekkel szemben. Bízom benne, hogy a magyar kormány önkéntesen vállalja az uniós jogban előírtakat.
