  Przewodniczący. − Kolejnym punktem porządku dziennego jest debata nad:

- sprawozdaniem sporządzonym przez Mariannę Thyssen w imieniu Komisji Gospodarczej i Monetarnej w sprawie wniosku dotyczącego dyrektywy Rady w sprawie wspólnej skonsolidowanej podstawy opodatkowania osób prawnych (COM(2011)0121 - C7-0092/2011 - 2011/0058(CNS) (A7-0080/2012).

  Marianne Thyssen, Rapporteur. − Voorzitter, beste collega's, mijnheer de commissaris, morgen kunnen wij ons uitspreken vóór een gemeenschappelijke geconsolideerde heffingsgrondslag voor de vennootschapsbelasting. Hiermee voeren wij een nieuw communautair belastingkader in dat een volledig stel voorschriften bevat om de individuele resultaten te berekenen van elke vennootschap of elk bijkantoor, waar ook gevestigd in de Europese Unie.

In dit stelsel worden verlies- en winstresultaten in groepsmaatschappelijk verband geconsolideerd en wordt die geconsolideerde belastinggrondslag, wanneer hij positief is, omgeslagen over alle relevante lidstaten. De lidstaten kunnen dan op het hun toekomende deel hun eigen belastingtarief toepassen en dat gebeurt middels een systeem, waarbij de gehele administratieve afhandeling bij één enkele hoofdbelastingautoriteit gebeurt.

Met deze CCCTB maken wij het grensoverschrijdend uitbouwen van een onderneming fiscaal eenvoudiger en administratief goedkoper, wat zeker voor de KMO nieuwe perspectieven biedt. Wij maken verder de belastingheffing transparanter. Wij vermijden overbelasting en dubbele belastingheffing, maar ook manipulatie met het oog op belastingontwijking. En zonder twijfel maken wij Europa aantrekkelijker voor buitenlandse investeerders.

Collega's, ons verslag bewaart de architectuur van het uitstekend uitgewerkte voorstel van de Commissie, maar het toont meer ambitie; dat past perfect in de dubbele strijd die wij vandaag voeren en waar wij het ook de hele middag over hebben gehad.

Want als wij een relance van de economie willen, met méér concurrentiekracht, dan moeten wij bereid zijn alle barrières op de interne markt te slopen, ook die op het terrein van de directe belastingen. En als wij de schuldencrisis willen oplossen, dan moeten wij er uiteraard ook voor zorgen dat de lidstaten de belastingen kunnen innen die hen toekomen en bij dit voorstel zijn beide gebaat.

Laat hier dus niemand de crisis inroepen om alles op de lange of op de softe baan te schuiven, nee, de crisis moet onze ambitie en onze sense of urgency juist sterker maken.

Voor drie punten, collega's, vraag ik uw bijzondere aandacht: ten eerste, de optionaliteit van het stelsel. De CCCTB mag best optioneel starten, maar wij vinden wel dat, als het stelsel goed genoeg is voor optioneel gebruik, het ook goed genoeg is om het verplicht te maken. De voordelen nemen trouwens toe met het aantal gebruikers ervan. En daarom stellen wij een road map voor die het stelsel over een tijdspanne van vijf jaar geleidelijk verplicht zal maken voor alle ondernemingen, behalve voor de KMO. Voor hen willen wij eerst nog een assessment van de praktische bruikbaarheid ervan en een instrument om hen bij het gebruik te begeleiden.

Ten tweede is er de reikwijdte van de harmonisatie. Dit voorstel betreft niet de tarieven, maar enkel de belastbare basis, de grondslag waarop de belasting geheven wordt. Inzake tarifering bewaren de lidstaten hun volle soevereiniteit. Wij vragen echter wel uitdrukkelijk om die kwestie op te nemen in de herzieningsclausule, en wel zo dat men later onderzoekt of en in welke mate de belastingconcurrentie tussen de lidstaten die blijft bestaan, profijtelijk dan wel schadelijk is voor het Europa dat wij samen willen uitbouwen en dat een sociale markteconomie beoogt.

Ten derde en tot slot, Voorzitter, vinden wij dat wij vooruit moeten. Indien het de Raad niet lukt om een consensus te vinden met 27 lidstaten - en het is jammer dat de Raad hier alweer niet aanwezig is - vragen wij de Commissie om onverwijld de procedure te starten om het voorstel met nauwe samenwerking te realiseren.

  Algirdas Šemeta, Member of the Commission. − Mr President, honourable Members, I wish to thank you, and in particular Marianne Thyssen for her work on this report. I welcome the positive views from the Committee on Economic and Monetary Affairs and the Committee on the Internal Market and Consumer Protection on our proposal for a CCCTB. It was one of our flagship legislative initiatives for 2011.

A system of common rules for calculating the tax base across the EU is expected to significantly improve the business environment in the single market. It will contribute to the efforts for bringing the Union back to growth and prosperity.

I would like to address five main points in the report.

First, the Commission proposed the CCCTB as an optional system. I believe that an obligatory scheme would introduce a significant burden by obliging businesses with purely domestic activities to bear the cost of switching into another tax system.

Second, I am convinced that an apportionment mechanism based on a formula of three equally-weighted factors – sales, assets and labour – is the most appropriate solution. It creates a fair balance between the states of origin and destination. I would also say that there is no economic evidence which suggests that a weight of 10% for the sales factor is a better option.

Third, the Commission would not be opposed to the idea of setting up a forum with tasks similar to those of the Joint Transfer Pricing Forum, provided that the outcome of such an effort does not create a risk of incompatibility with the Treaty. In this regard, the reference to a ‘dispute settlement body’ with possible binding decisions could be found to conflict with the Treaty.

Fourth, the Commission has consistently made it clear that the CCCTB proposal is only meant to deal with the rules for computing the corporate tax base and should not touch upon minimum tax rates. Increasing the exemption threshold to 70% in certain anti-abuse clauses would inevitably and unnecessarily raise arguments at a political level about a minimum corporate tax rate in the EU.

I should finally mention that the review clause as suggested by the Commission (five years after the directive entered into force) can offer opportunities for improving the CCCTB scheme. Its scope is very broad. By listing the issues to be addressed, we would lose the flexibility we need to analyse the points raised in your report.

These were my main points of concern, but in general I welcome the report very much and I am looking forward to a very positive vote tomorrow.

  Olle Schmidt, föredragande av yttrande från utskottet för den inre marknaden och konsumentskydd. − Herr talman! En gemensam konsoliderad bolagsskattebas är ett viktigt första steg till bättre konkurrenskraft hos europeiska företag och en effektivare inre marknad. Det ger fler jobb, minskar företagens kostnader och avskaffar onödig byråkrati.

I IMCO-utskottets yttrande föreslog vi förändringar i kommissionens förslag. Flera av dessa har Marianne Thyssen tagit med i sina kompromisser vilket vi välkomnar.

Det gäller bland annat inrättande av ett gemensamt forum för tvistlösning, vilket även kommissionsledamot Algirdas Šemeta nämnde.

I utskottets yttrande slog vi också fast att införandet av en gemensam konsoliderad bolagsskattebas bör vara frivilligt. Det är värdefullt att ha konkurrerande skattesystem och institutionell konkurrens.

Systemet bör inte bli obligatoriskt innan man har praktiskt erfarenhet av hur det fungerar.

Jag tror att fler företag än de så kallade europabolagen är villiga att delta om systemet är frivilligt. Därför är det olyckligt att kompromissen redan nu innebär ett stegvis införande av ett obligatoriskt system.

Det kommer att göra det svårare att få fler medlemsstater att delta. Hellre morot än piska!

  Jean-Paul Gauzès, au nom du groupe PPE. – Monsieur le Président, Monsieur le Commissaire, la proposition de directive vise à mettre en place au sein de l'Union européenne une assiette commune consolidée de l'impôt sur les sociétés, dite ACCIS. Voilà maintenant depuis 2004 que l'on réfléchit sur cette question. Aujourd'hui, le Parlement, qui est saisi pour avis, souhaite, au travers du rapport de Marianne Thyssen, vous donner – en tout cas, c'est le souhait du PPE – un signal fort pour encourager la Commission à poursuivre son action dans ce domaine.

La mise en place d'une ACCIS au sein de l'Union européenne présente de nombreux avantages, tant pour les opérateurs économiques – par l'élimination des obstacles fiscaux au sein du marché intérieur –, que pour les États membres – en permettant une concurrence fiscale plus transparente et donc plus saine entre les États membres.

Le rapport qui a été voté par la commission ECON et qui a été présenté par Mme Thyssen est excellent. Après de longues négociations et en trouvant une habile synthèse pour traiter au mieux un point très délicat, celui du caractère facultatif ou optionnel du système, elle propose – et a obtenu un accord là-dessus – que le cheminement se fasse par étapes, avec un régime obligatoire dans l'immédiat pour les sociétés et les sociétés coopératives européennes, et ensuite une extension après cinq ans une fois que la Commission aura rendu un avis, et en laissant de côté le cas des PME.

Je crois, Monsieur le Commissaire, qu'il faut que la Commission soit exigeante dans ce domaine. Je sais que la proposition ne reçoit pas un franc soutien de plusieurs États membres, soit en raison d'une opposition de principe, comme celle du Royaume-Uni – opposition à toute harmonisation fiscale –, soit en raison de craintes qui seraient suscitées par la mise en œuvre de ce dispositif. C'est le cas, par exemple, de la Pologne, des Pays-Bas ou du Luxembourg. Il faut passer outre. Il est indispensable pour l'Union européenne que cette base consolidée, qui n'implique pas une harmonisation des taux, soit mise en place. C'est le sens de la démarche entreprise auprès de vous par le PPE.

  Liem Hoang Ngoc, au nom du groupe S&D. – Monsieur le Président, je tiens à remercier la rapporteure pour le volontarisme politique dont elle a su faire preuve dans ce dossier.

Nous savons tous que certains États membres jouent sur l'assiette de leur impôt sur les sociétés pour faire baisser, de manière plus ou moins cachée, leur niveau effectif d'imposition et pratiquer le dumping fiscal. C'est pour cela qu'en tant que socialistes et fédéralistes, nous soutenons depuis toujours l'idée d'aller vers plus d'harmonisation fiscale au sein de l'Union européenne. Malheureusement, en proposant une assiette consolidée qui soit seulement optionnelle, la Commission européenne ne cherchait pas à faire un premier pas en matière d'harmonisation de l'impôt sur les sociétés, mais juste à créer un instrument d'optimisation fiscale. Cela n'était pas acceptable pour notre famille politique car l'Europe à laquelle nous croyons n'est pas une Europe à la carte servant les seuls intérêts des entreprises. C'est avant tout une Europe politique et sociale construite pour tous, avec tous.

En tant que rapporteur fictif pour le groupe de l'Alliance Progressiste des Socialistes et Démocrates, je me suis battu pendant des mois pour modifier radicalement la logique du texte de la Commission, à savoir passer d'un système facultatif à un système obligatoire et introduire un niveau minimum d'imposition. Les négociations n'ont pas été faciles mais nous avons réussi à nous entendre car, au-delà de nos divergences politiques – qui sont importantes –, nous partagions tous, autour de la table, une vision ambitieuse de l'Europe.

Malgré ses réticences initiales, la rapporteure a finalement accepté le principe d'une ACCIS obligatoire pour l'ensemble des grandes entreprises de l'Union. Nous n'avons, malheureusement, pas obtenu l'instauration d'un taux plancher mais le rapport évoque clairement les problèmes posés par de trop grands écarts de taux et demande que cette question des taux soit réexaminée au moment de la révision de l'application du texte, ce à quoi nous veillerons car il s'agit pour nous d'une seconde étape indispensable.

Je vous demande donc, mes chers collègues, de soutenir massivement le rapport de Mme Thyssen. Nous enverrons ainsi un message fort au Conseil et surtout aux citoyens qui sont les premières victimes des méfaits de la concurrence fiscale.

  Carl Haglund, on behalf of the ALDE Group. – Mr President, I would like to thank the rapporteur for a good report. Our group is also very supportive of the lines taken in the committee; this is a possibility to actually enhance the internal market and to ease the administrative burdens of companies which really want to push for cross-border activities in their field.

In general I think that the development in committee has taken this report in the right direction. We can of course debate whether it is a good decision or not to make this scheme compulsory for companies, but if we want to actually succeed, I am convinced that the voluntary scheme is not necessarily going to activate as many companies as one would hope.

The discussion about whether we should harmonise corporate taxation or not does not belong here, but the fact of the matter is that we already have the minimum and maximum type of taxation solutions, for instance in the field of value-added tax, and we should definitely consider this. But that is another report.

Last by not least, I am happy that we were able to change the way we are weighing the different ways of distributing, because having too much weight on sales is not going to give us a good result for countries that are competing within the export sector.

  Philippe Lamberts, au nom du groupe Verts/ALE. – Monsieur le Président, je crois en effet que nous sommes devant un rapport extrêmement ambitieux sur le plan politique. Je crois, Marianne, que tu as obtenu le plus qu'on pouvait obtenir si on veut une large majorité dans cette chambre.

Si nous voulons réellement mettre un terme à l'optimisation fiscale, ceci est un premier pas en matière d'impôt sur les sociétés. Il est évidemment pour nous impensable d'instaurer, de manière volontaire, un vingt-huitième régime pour l'impôt sur les sociétés à côté des vingt-sept régimes des États membres. Parce qu'évidemment, qui l'utilisera si c'est sur une base volontaire, sinon exclusivement les entreprises pour lesquelles cela signifierait un taux d'impôt effectif plus bas que si elles se référaient à leur régime national? Je crois en effet que l'idée de rendre ce régime obligatoire pour les grandes entreprises est un must et je remercie la rapporteure de l'avoir incluse dans son rapport.

Quant au Conseil qui, une fois de plus en matière fiscale, brille par son absence, je veux simplement lui dire une chose: à force de jouer au jeu de la compétition fiscale les uns avec les autres, c'est nous tous qui sommes perdants, ce sont tous les trésors publics qui sont perdants. Ce n'est pas un jeu à somme nulle, c'est un jeu à somme négative. C'est pourquoi j'espère que le message que cette Assemblée enverra demain sera entendu par le Conseil.

  Ivo Strejček, za skupinu ECR. – Pane předsedající, když debatu poslouchám, tak jsem si udělal tři, řekněme, poznámky, které minimálně členy Hospodářského a měnového výboru nepřekvapí, protože tyhle poznámky ode mě znají.

Za prvé, Evropští konzervativci jsou hluboce přesvědčeni o tom, že daňová konkurence je správná a je zdravá, a jakýkoliv pokus harmonizovat daňové sazby je pro nás nepřijatelný. Za druhé, tuto zprávu považujeme za průlom do systému přímého zdanění, neboť čistě z účetního hlediska, pokud v rovnici, ve které jsou dvě proměnné – sazba a základ – změníte jednu z proměnných, pak měníte i celkový výpočet. Čili to je cesta k průlomu. Za třetí, my trváme na tom, že tento systém musí být i dlouhodobě striktně dobrovolný, má být na jednotlivých firmách, zda-li se k tomuto systému připojí či ne. Měl bych celou řadu dalších poznámek, nicméně tyhle jsou zásadní.

  Godfrey Bloom, on behalf of the EFD Group. – Mr President, harmonised taxation is simply a ploy to enable bureaucrats to steal even more money from the wealth-creating sector. Like vampires they prey upon ordinary folk, sucking the lifeblood out of the economy – and for what? Tax-free salaries, non-contributive pension schemes, winter sunshine trips to Durban and Cancún, suicidal remote energy policies and constant rescue packages for failed banks.

Without tax competition, Europe would be bled white in pursuit of a maniacal political crusade. High tax would banish manufacturing to the Far East, the Indian subcontinent and North America. The Baltic States, Ireland and fellow entrepreneurial ex-Warsaw Pact countries would slip back into the abyss. Athens and Madrid would become Dublin and Warsaw, but I suspect that before that time, ordinary folk will have cried enough and the parasites will have to head for the hills, as well they may. For certain the Irish, I suspect, will have their own way of dealing with them when they eventually awake from their slumber.

  Theodor Dumitru Stolojan (PPE). - Mulţumesc în mod special colegei mele, doamna Thyssen, pentru efortul de a se ajunge la acest raport foarte bun. Deşi dezvoltarea integrării economice are nevoie de un sistem pentru realizarea unei baze fiscale consolidate comună pentru societăţile cu activitate în mai multe state membre, deşi prin proiectul de directivă se prevede caracterul facultativ pentru societăţile comerciale de a adera la acest sistem şi deşi fiecare stat membru are dreptul de a aplica cota de impozit pe care o doreşte la partea din baza fiscală consolidată care îi revine prin repartiţie, totuşi suntem în situaţia în care unele parlamente naţionale au trimis obiecţii invocând că este încălcat principiul subsidiarităţii, între care şi parlamentul ţării mele. De asemenea, unele guverne se opun la acest proiect de directivă.

Eu rog Comisia să trateze cu maximă atenţie, în special poziţia parlamentelor naţionale. Cred că este utilă o întâlnire cu aceste parlamente naţionale care au invocat încălcarea principiului subsidiarităţii, iar noi din Comisia pentru afaceri economice şi monetare suntem gata să participăm la acest dialog.

  Antolín Sánchez Presedo (S&D). - Señor Presidente, se ha dicho que el ámbito fiscal es la asignatura pendiente en la integración europea. Progresar en esta asignatura pendiente es necesario para consolidar los logros alcanzados, para afrontar los desafíos actuales y para tener una gobernanza económica creíble. Para hacerlo con plena legitimidad democrática, se necesitará, además, que el Parlamento no tenga un carácter meramente consultivo.

La existencia de una base consolidada imponible común en el impuesto de sociedades es un paso largamente esperado, una iniciativa imprescindible para combatir la competencia fiscal dañina, para eliminar el arbitraje fiscal y atribuir con equidad los beneficios y las pérdidas de las sociedades del mismo grupo localizadas en distintos Estados miembros. Su implantación puede contribuir a la transparencia que posibilitará la comparabilidad del esfuerzo fiscal, a la simplificación que reducirá costes burocráticos y de gestión derivados de la disparidad de legislaciones, y, además, ofrecerá un terreno de juego equilibrado para que los recursos se puedan utilizar de modo más equitativo y más justo. Todo ello sirve al objetivo de promover el crecimiento y el empleo sostenible.

La propuesta de la Comisión aportaba una mayor coherencia fiscal en un ámbito en el que existen ya iniciativas bilaterales pero, sin embargo, ofrecía un régimen opcional, ofreciendo también una consolidación a la carta para las compañías nacionales.

El compromiso alcanzado en la Comisión de Asuntos Económicos y Monetarios es satisfactorio porque ofrece una senda de obligatoriedad gradual y, al mismo tiempo, contempla la posibilidad de una revisión que incluya el análisis de tipos mínimos. Por eso, lo apoyo calurosamente.

  Antolín Sánchez Presedo (S&D), respuesta a una pregunta de tarjeta azul. – No comparto esa experiencia. Creo que los países europeos –y Europa es un modelo claro que ofrece los mejores resultados– no son precisamente los que tienen una participación más baja en materia fiscal.

Pero, en todo caso, es evidente que existe una competencia fiscal dañina y que iniciativas como la que se presenta lo que pueden es contribuir a reducirla y a eliminarla, y que en materia fiscal se debe intensificar la cooperación y la solidaridad en el ámbito de la Unión Europea.

  Derk Jan Eppink (ECR). - De verschillen tussen de EU-lidstaten inzake vennootschapsbelasting zijn groot, of het nu over tarieven gaat of over opbrengsten. Daarom kiest de Commissie voor harmonisering via de achterdeur.

Een uniforme heffingsgrondslag voor vennootschapsbelasting heeft voordelen. Bedrijven betalen belasting op een goedkopere en meer eenvoudige manier. Wie uiteindelijk de belastinginkomsten krijgt is niet hun zaak. Dat is de zaak van de lidstaat en daar knelt het schoentje. Wanneer lidstaten vennootschapsbelasting innen van bedrijven die in meerdere landen van de EU actief zijn, moeten zij de opbrengst onderling verdelen. De verdeelsleutel die de Commissie hiervoor bedacht heeft is nadelig voor competitieve en exporterende landen. Zij worden fiscaal gestraft en verliezen inkomsten uit de vennootschapsbelasting.

Het verslag van mevrouw Thyssen vermeldt nu al expliciet de oplossing die binnenkort aan deze landen zal worden voorgelegd, nl. minimumtarieven voor de vennootschapsbelasting, terwijl wij geen grondig onderzoek hebben gedaan naar de fiscale effecten van de verdeelsleutel die de Commissie voorstelt.

Daarom zeg ik: daar ga ik niet in mee en ik denk dat een groot deel van de Raad het met mij eens is.

  Diogo Feio (PPE). - As questões relativas à tributação são sempre polémicas quando discutidas a nível europeu. Não é por acaso que o Tratado de Lisboa prevê, em relação ao seu grosso, uma regra de unanimidade. Não é também por acaso que é sobre a tributação indireta que mais têm existido previsões a nível europeu mas, tratando-se de questões de impostos, estamos a discutir o funcionamento do mercado interno, o funcionamento do conceito de soberania e também os recursos próprios do orçamento comunitário.

Sobre essas matérias o Parlamento tem assumido uma posição muito clara, sempre tendo em atenção o necessário equilíbrio entre estas determinações e a manutenção da carga fiscal sobre os cidadãos e sobre as empresas.

O Parlamento já por várias vezes se referiu à necessidade de impostos de natureza comunitária. A harmonização das regras contabilísticas, desde logo para a tributação das empresas, e também aqui através do extraordinário relatório da senhora Thyssen que tratou das matérias da neutralidade fiscal, da vertente voluntária, da simplificação para as empresas e da menor burocracia, das normas anti-abuso e da menor evasão. A partir de agora, a bola está do lado do Conselho. Esperamos que esta crise seja também uma oportunidade em que se defende o mercado interno e em que se defendem as empresas.

  George Sabin Cutaş (S&D). - Raportul pe care îl vom vota mâine este un semnal puternic pentru guvernele statelor membre în favoarea introducerii unui cadru de taxare al companiilor la nivel european. Este o cerinţă pe care Parlamentul a înaintat-o în mai multe rânduri, aceasta constituind un pas pentru definitivarea pieţei interne europene şi pentru integrarea economică a statelor membre.

Nu trebuie să uităm că numeroase companii îşi desfăşoară azi activitatea în mai multe state ale Uniunii. Reprezentând un sistem comun de reguli în domeniu, baza fiscală consolidată comună a societăţilor va reduce în mod semnificativ costurile administrative ale companiilor şi va creşte transparenţa, Uniunea urmând să devină practic un loc mai atractiv pentru investitori. Comisia Europeană estimează o reducere anuală cu 700 de milioane de euro a costurilor relative conformării cu legislaţia şi, de asemenea, diminuarea numărului de cazuri de evaziune fiscală. În acest context susţin prezenta propunere şi consider necesare pe viitor atât aplicarea sistemului la întreprinderile mici şi mijlocii, cât şi introducerea unui nivel minim de taxare la scară europeană. Îmi exprim, de asemenea, speranţa ca propunerea Parlamentului să fie pe deplin luată în considerare de către Consiliul de miniştri.

  Ashley Fox (ECR). - Mr President, at this time of crisis Parliament should bring forward proposals that assist growth and job creation, and instead we have a proposal to harmonise the corporate tax base. This is a very bad idea. Tax competition is good. It keeps governments honest. It stops them taking too much money from the productive sector of our economy, and we in the EU should aim to keep corporate taxes as low as possible. This is a backdoor step to try and ratchet corporate taxes up. This proposal also treads on the powers of the nation states. We should remember in this place that it is for the nation states to decide what taxes to levy on their citizens. Long may that remain so.

  Krišjānis Kariņš (PPE). - Godājamais priekšsēdētāja kungs, kolēģi! Manuprāt, Eiropā viens no galvenajiem uzdevumiem mums šobrīd ir nodrošināt ekonomisko izaugsmi. Es zinu vismaz vienu Eiropas politiķi, kurš ar savām iniciatīvām faktiski cer pilnībā iznīcināt ekonomisko izaugsmi, piedāvājot 75 % nodokļu likmi. Šī likumdošanas iniciatīva, manuprāt, iet pretējā virzienā. Tā tieši veicinātu ekonomisko izaugsmi, nevis to kavētu.

Kāda ir situācija? Šobrīd Eiropā jebkuram uzņēmumam, darbojoties vairākās dalībvalstīs, katrā dalībvalstī ir jārēķinās ar citu nodokļu sistēmu. Tas ir laiks, tā ir nauda, tās ir izmaksas. Ar šo likumdošanas iniciatīvu tas viss tiktu vienkāršots, un uzņēmumiem būtu iespēja rēķināties tikai ar vienas valsts nodokļu sistēmu, kur šī dalībvalsts, ja būtu maksājami nodokļi, attiecīgi pēc formulas sadalītu to naudu arī pa citām dalībvalstīm, kurās uzņēmums izvērš savu uzņēmējdarbību. Tātad, kolēģi, mums nevajag iet tajā virzienā, kas kavētu uzņēmējdarbības attīstību, kas kavētu ekonomisko izaugsmi. Mums vajag iet tajā virzienā, darīt visu, ko mēs varam, lai veicinātu ekonomisko izaugsmi Eiropas Savienībā. Šī likumdošanas iniciatīva tieši ir viena no tām, kas šo mērķi arī palīdzētu sasniegt.   Edvard Kožušník (ECR). - Pane předsedající, pane komisaři, chci zdůraznit, že problematika daní spadá výlučně do kompetence členských států. Proto mě velmi znepokojují pokusy o prosazení konsolidovaného základu daně.

Na jednu stranu předložený návrh operuje argumenty, že konsolidace základu daně z příjmu sníží administrativní zátěž podniků. Bohužel ale opomíjí fakt, že společný základ daně by nutně musel být v některých zemích širší, než je současný stav. Tím se v těchto zemích nepřímo zvýší daňová zátěž, aniž by došlo ke zvýšení nominálních daňových sazeb. Předložený návrh představuje dračí vejce, kterým se Komise snaží prolomit daňovou suverenitu členských států. A plíživým způsobem zahajuje harmonizaci daňových sazeb.

To vše přichází v době, kdy Evropu obchází strašidlo stagflace. Namísto toho, abychom se snažili podpořit konkurenci i mezi jednotlivými státy Unie, snažíme se pak touto plíživou daňovou harmonizací konkurenci spíše udusit.

  Zuzana Roithová (PPE). - Jako stínová zpravodajka skupiny Křesťanských demokratů ve Výboru pro vnitřní trh a ochranu spotřebitelů jsem prosadila úpravu, která měla zaručit fiskální neutralitu směrnice. Není možné, aby v době krize mohla např. Belgie mít vyšší odvody do státního rozpočtu na úkor jiných, např. České republiky. Formulace Hospodářského a měnového výboru to neřeší věcně, ale politickou deklarací. Věřím však, že ji Rada bude respektovat.

Vítám, že Hospodářský a měnový výbor převzal naše návrhy, pokud jde o boj proti daňovým únikům, přísnější pravidla pro daňové ráje, zjednodušení administrativy pro přeshraničně působící společnosti, flexibilitu při mimosoudním řešení sporů, a že zůstala volitelnost tohoto osmadvacátého režimu pro malé a střední podniky. Podporuji navíc zavedení jednotného daňového formuláře a děkuji za to. Jsem velmi ráda, že neprošly návrhy na zavedení minimální sazby daní, a naopak, že je jednoznačně potvrzena daňová suverenita států, včetně výše daňových sazeb, a tím tedy zásady daňové soutěže.

Nepovažuji za šťastné, že jednotlivé požadavky, co vše by měl obsahovat budoucí přezkum této směrnice, jsou tolik obecné. Ale tento společný konsolidovaný základ daně velmi podporuji. Pro podnikatele bude směrnice v tomto znění nepochybně velkým přínosem. Přála bych českým podnikatelům, aby si mohli zvolit tento čitelný a stabilní evropský systém. V Radě však lze očekávat vetování návrhu, takže pokračování asi bude jen v rámci posílené spolupráce a platit bude jen v některých zemích. Doufám, že pro další země, včetně České republiky, bude evropský systém alespoň příkladem, co a jak je rozumné započítávat do daňového základu, aby to podnikatele neodrazovalo odvádět u nás daně.

  Gay Mitchell (PPE). - Mr President, I would like to thank my colleague, Marianne Thyssen, for her work on this report, although I have concerns about the report itself.

While my country, Ireland, has constructively engaged in the CCCTB process to ensure that all the arguments are looked at closely, I would like to stress two issues of EU law. One: the Treaty requires unanimity in matters of taxation policy, and two: the principle of subsidiarity allows Member States to keep taxation within national legislation. My main concern is that this is transgressing national competence.

While the report does not specifically call for the harmonisation of tax rates (albeit Amendment 10 comes close), the introduction of common rules across all Member States for the calculation of the tax base of companies is nonetheless, in my view, a matter for the Member States.

About ten of the amendments go too far. Furthermore, we are block-voting, so few choices are available. I also want to point out that I do not believe that it is necessary for us to seek another report on the merits of taxation as a form of competition. I believe former Commissioner Monti has dealt with that very well.

Lastly, Rule 38a (1) of Parliament’s Rules of Procedure on the examination of respect for the principle of subsidiarity states that ‘during the examination of a proposal for a legislative act, Parliament shall pay particular attention to respect for the principles of subsidiarity and proportionality’. I do not believe we have done so on this occasion. These are my reservations.

  Надежда Нейнски (PPE). - Уважаеми колеги, аз съм против предложението консолидираната корпоративна основа да бъде направена задължителна за всички компании. Това би нарушило принципа на субсидиарност, защото създава негативни ефекти върху някои национални икономики, в това число България, която разчита на конкурентното си предимство да привлича инвеститори на базата на опростени данъчни правила и ниски данъчни ставки.

Разбира се, разбираема е идеята за консолидирана данъчна основа като мярка за завършване на единния пазар, което ще подпомага развиването на международен бизнес, ще намалява административната тежест и спестява време и средства за разучаване на 27 различни данъчни системи. Смятам обаче, че тази идея трябва да остане доброволна, защото оставя решението за включването или невключването в нея в ръцете на корпоративните данъкоплатци.

Най-добре бихме разбрали дали системата е успешна извън теоретичните постановки, които изброих, ако доброволният принцип се прегърне от бизнеса. Задължителността на тази регулация рискува да убие конкуренцията.

  Petri Sarvamaa (PPE). - Mr President, I will say two things, one very realistic and one extremely idealistic. The realistic thing is that we have to praise Marianne Thyssen for doing something finally to take us from talk to action. I think every cloud has a silver lining and here I see such a case, where economic crises have led us from talk to action. This CCCTB is a chance to stimulate businesses and at least do something about Europe’s competitiveness collectively. But then, idealistically speaking – and I know we are maybe 100 years from this – I would like to see this as the first step towards harmonising much more. This act does not have anything to do with harmonising the tax rates but perhaps one day it will be seen as the first step towards that. It is not realistic in today’s Europe and in today’s situation, and to many ears I know it sounds naïve, but idealism is basically what we are here for.

  Monika Flašíková Beňová (S&D). - Návrh jednotného súboru pravidiel určovania základu dane pre podnikateľov obsahuje nepochybne viacero pozitívnych aspektov. Navrhované pravidlá zvýšia konkurencieschopnosť Európskej únie, stimulujú hospodársky rast a rovnako aj tvorbu pracovných miest. Únia by sa zároveň stala príťažlivejšia aj pre ďalších zahraničných podnikateľov. Chcela by som tiež zdôrazniť, že dôležitým aspektom alebo pozitívnym aspektom musí byť aj riešenie problematiky únikov do daňových rajov. V súčasnej dobe hospodárskej krízy a jej výrazných dopadov, najmä na sociálne najslabšie skupiny obyvateľov nemôžeme predsa dopustiť, aby nadnárodné európske korporácie presúvali svoje zisky do krajín s minimálnym daňovým zaťažením a úniky takýchto finančných zdrojov navyše výrazne oslabia naše štátne rozpočty. Dôsledné zdaňovanie výrazne pomôže oslabeným ekonomikám členských štátov a to môže veľmi pozitívne ovplyvniť aj ich sociálnu politiku. Daňová harmonizácia však bude účinná iba vtedy, ak CCCTB vstúpi do platnosti vo všetkých členských štátoch Európskej únie.

  Andrew Henry William Brons (NI). - Mr President, if pushing for greater political and economic integration and harmonisation were a criminal offence, the EU would be pulled in as the first and only suspect. Its fingerprints would be all over the scene of the crime. However, more charitably, we can see it as a repeated nervous tic or obsessive-compulsive disorder.

A demand for a common consolidated tax base can be seen simply as a different example of the same tic, another obsessive desire for greater political integration. This morning, it was integration by coordination of the social security system; in the early evening, it is integration by a common corporate tax base; later this evening, the target for integration will be taxation on electricity and energy products.

Do these people dream about greater political and economic integration? When they are invited to parties – if they are – and see an attractive member of the opposite sex – or the same sex, if you prefer – do they try to sweep them off their feet with coded references to political and economic integration, possibly coupled with an unpleasant leer? I only ask out of curiosity.

  Algirdas Šemeta, Member of the Commission. − Mr President, honourable Members, I would like to thank you for the views you expressed during this debate. Your strong support and constructive approach in this area is an important signal for the Member States.

As you may know, the technical work in the Council progresses. Discussions are now focused on how to calculate the tax base. The Presidency hopes to have a progress report on the CCCTB for the May ECOFIN. I believe that your approach points in the right direction for the future of corporate taxation in the Union. We need to sustain the political momentum towards a competitive and robust pan-European tax regime for the benefit of our companies and in order to attract foreign investments in the EU through a simple and efficient tax system covering the entire single market.

I take note of your call in the report – and repeated by many of you today – to make the CCCTB compulsory five years from its adoption. As I have already mentioned, the Commission is well aware of the burden that this would involve for companies that do not wish to operate cross-border. The review clause would nonetheless help us to assess the system as proposed within five years. This review may well cover the success of optionality.

I also take note of the request of Mr Stolojan to meet with national parliaments that have expressed doubts in respect of the principle of subsidiarity. I can reassure you that every visit I pay to a Member State includes a meeting with the national parliament wherever possible. Romania will not be an exception.

The rapporteur and some Members have raised the issue of enhanced cooperation. The initiative to launch an enhanced cooperation lies exclusively in the hands of the Member States. I therefore do not find it appropriate to speculate on this issue now. The Commission will therefore express its views on this matter when it is required to, according to the Treaties.

Again, I wish to thank you, honourable Members of the European Parliament, for your broad support in moving forward with this initiative. I am convinced that this is the only comprehensive solution for tackling cross- border tax obstacles in the area of corporate taxation. I personally feel reassured and willing to pick up on the strong encouragement to progress in this area, for which I thank you.

  Marianne Thyssen, Rapporteur. − Ik dank alle sprekers uiteraard voor hun opmerkingen. Collega's, ik wil toch dit nog even zeggen.

Belangrijke hervormingen komen vaak tot stand in perioden van crisis en ik denk dat wij de actuele crisis, zowel de economische crisis als de crisis van de overheidsfinanciën, nu moeten aangrijpen om voort te werken aan dit dossier.

Het is een dossier dat wij morgen kunnen afronden in dit Parlement, wat ons deel van het werk betreft, waar wij herhaaldelijk in het verleden om gevraagd hebben, waar de Europese Commissie meer dan tien jaar aan heeft gewerkt. En laten wij niet vergeten dat dit onderwerp in vrijwel elke conclusie van de laatste Europese toppen aan bod is gekomen, dat ook de Europese Raad en de toppen van de Eurozone zich herhaaldelijk vóór de CCCTB hebben uitgesproken, dus laten wij hoopvol blijven.

Voorzitter, het is zo dat wij hier een stuk van de interne markt afwerken. De logica van diegenen die plots vinden dat de interne markt niet meer staat voor groei en banen kan ik niet volgen. Hier maken wij echt een hinder van de interne markt ongedaan en ik denk dat dat de groei en het scheppen van banen wél dient; een goede reden dus om ermee verder te gaan.

Tot slot, collega's, heb ik met plezier mijn naam gezet onder dat verslag. Ik ben overtuigd van de juistheid van elke keuze die in dit verslag gemaakt wordt, en dat komt omdat wij constructief samengewerkt hebben en omdat wij heel goed over de fractiegrenzen heen naar elkaar geluisterd hebben. Hier zijn natuurlijk een aantal andere klemtonen gelegd. Wij hebben ook hier en daar andere uitgangspunten. Maar wij hebben getoond wat wij samen kunnen bereiken.

Ik hoop dat wij morgen een even grote eensgezindheid hebben en dat wij op die manier de ambitie van de Raad toch nog een beetje kunnen opvijzelen. Want nogmaals, als die Raad consequent is met zichzelf, als de ministers van de Ecofin consequent zijn met hun regeringsleiders en staatshoofden, dan moeten zij zich hierover positief uitlaten. Kunnen zij dit niet met 27 - wat ik nog altijd hoop - dan met minder, maar ik hoop dat het lukt met 27.

  Jiří Havel (S&D), písemně. – Efektivní daňový systém je důležitou součástí fungování vnitřního trhu, jež patří ke klíčovým pilířům konkurenceschopnosti EU. Z tohoto důvodu je diskuse o společném konsolidovaném základu daně z příjmů právnických osob (CCCTB) krok správným směrem, zejména s ohledem na probíhající ekonomické problémy v EU. Vítám proto záměr Komise sjednotit CCCTB v rámci EU, což zapadá do stávajícího procesu tvorby nové koncepce daňových systémů, je v souladu s posunem k ekologičtějšímu růstu více podporujícímu zdanění, a tudíž podporuje cíle strategie Evropa 2020. Chtěl bych připomenout, že relevantní daňové výnosy budou alokovány jednotlivým členským zemím na základě jasně definovaného mechanismu – na základě parametrů zaměstnanost, aktiva a tržby –, jenž byl citlivě nastaven na základě politického konsensu, jehož projednávání trvalo více než deset let. Z tohoto důvodu doufám, že plánované hodnocení dopadů CCCTB po pěti letech od nabytí jeho účinnosti bude pozitivní a že bude sloužit jako příklad dobré praxe i v zemích mimo EU. Celkově lze konstatovat, že předkládaná zpráva kolegyně Thyssenové představuje podrobnou analýzu dané problematiky, odkazuje na relevantní legislativu a obsahuje též i adekvátní doporučení v oblasti CCCTB, a proto ji doporučuji schválit v navrhovaném znění.

  Jim Higgins (PPE), in writing. – I intend to vote against this report. The governments of the Netherlands, Bulgaria, Ireland, UK, Malta, Sweden, Poland, Romania and Slovakia all raised concerns regarding the Commission CCCTB proposal. Unfortunately the majority of 18 Member States was not reached in order to require the Commission to re-examine their proposal. The argument in favour of this report is that the level of the tax rate will remain a decision for national parliaments. The objective of the report is to enhance the system of taxation of companies, not to harmonise tax rates. It is respectfully submitted that harmonisation of the tax base and the tax base rules is a form of harmonisation. The report explicitly underlines that CCCTB only concerns the tax base, not corporate tax rates. However, it does not exclude that, in the future, further steps may be taken towards tax rate harmonisation. I strongly oppose Amendment 10 which outlines that, although the harmonisation of tax rates is not at issue now, we must not entirely exclude the possibility for the future. This only serves to further aggravate subsidiary concerns already espoused by Member States.

  Ian Hudghton (Verts/ALE), in writing. The Commission have assured us that it is not their intention to harmonise rates of corporate tax across Europe. Nevertheless, this proposal represents the EU encroaching on an area which properly lies within the competence of individual Member States. This raises questions not just of subsidiarity but, more fundamentally, of national sovereignty as the Dáil Éireann and others have noted. These problems are compounded by calls in this House for harmonised tax rates in the future. Such calls only serve to turn our citizens against the EU. The ability to set tax rates must remain one of the fiscal tools available to each independent Member State.

Предложението, което обсъждаме днес, цели да създаде механизъм за обща консолидирана данъчна основа за облагане с корпоративен данък. С тази директива, обаче, ЕС няма да постигне увеличаване на конкурентоспособността, а тъкмо напротив – ще лиши Съюза от конкурентните предимства на разнообразието от данъчни правила и ставки. Някои страни ще спечелят, а други ще загубят от въвеждането на тази обща база, но едно е сигурно: крайният резултат ще бъде загуба на конкурентоспособност за Съюза като цяло и отлив на чуждестранни инвестиции към трети страни с по-благоприятни данъчни условия.

Европа има нужда от данъчна конкуренция, ако иска да бъде привлекателна за чуждестранните инвеститори. Въвеждането на обща консолидирана данъчна основа в целия ЕС ще лиши отделните държави членки от техните важни конкурентни предимства, а в дългосрочен план ще доведе до механично изравняване на данъчните ставки вследствие на намаляването на приходите в някои от тях. ЕС трябва да подходи внимателно и да съсредоточи своите усилия върху намаляване на административната тежест и подобряване на бизнес средата. Отключването на пълния потенциал на единния пазар е ключът за икономически растеж и създаване на нови работни места.

Nikt nie ma wątpliwości jak ważne w czasach kryzysu są rozwiązania, które przyczyniają się do poprawy wzrostu gospodarczego oraz powstawania miejsc pracy w Europie. Pomysł wprowadzenia wspólnych europejskich przepisów służących obliczeniu podstawy opodatkowania przedsiębiorstw działających na terenie Unii Europejskiej jest rozwiązaniem, które niewątpliwie przyczyniłoby się do poprawy konkurencyjności rynku europejskiego, zmniejszenia obciążeń administracyjnych oraz kosztów związanych z przestrzeganiem różnych krajowych reżimów podatkowych.

Niestety projekt dyrektywy ws. wspólnej skonsolidowanej podstawy opodatkowania, obok dobrych i słusznych rozwiązań, wprowadza także zapisy, na które, szczególnie w czasach kryzysu, nie powinniśmy się zgodzić. Takim pomysłem jest umożliwienie konsolidacji zysków i strat w ramach grupy przedsiębiorstw, co spowoduje spadek dochodów podatkowych w wielu państwach członkowskich i podzieli Europę na kraje „wygrane" oraz „przegrane". Rozwiązanie to zbyt daleko ingeruje w systemy podatkowe państw członkowskich, a ewentualna rekompensata strat poprzez podwyższenie stawek podatkowych zagraża konkurencji podatkowej na rynku wewnętrznym. Zamiast tworzyć przepisy, które zaprzeczają zasadzie solidarności i faworyzują niektóre państwa członkowskie, powinniśmy raczej zachęcać kraje do jak najszybszego określenia wspólnej podstawy opodatkowania, do czego część państw członkowskich zobowiązała się w ramach paktu „Euro Plus". Jest to jeden z neutralnych pod względem dochodów sposobów zapewniających spójność krajowych systemów podatkowych, z jednoczesnym poszanowaniem krajowych strategii podatkowych.

  Vladimír Maňka (S&D), písomne. – Cieľom návrhu vytvoriť spoločný systém výpočtu základu dane pre podniky, ktoré vyvíjajú svoju činnosť v EÚ, je výrazne zmenšiť administratívnu záťaž, náklady na dodržiavanie právnych predpisov a právnu neistotu, ktorým podniky v EÚ v súčasnosti čelia. Podniky musia pri určovaní svojich zdaniteľných ziskov dodržiavať 27 rôznych vnútroštátnych systémov. Navrhovaný spoločný konsolidovaný základ dane z príjmov právnických osôb znamená, že podniky by pri podávaní svojich daňových priznaní mohli využívať výhody systému „jednotného kontaktného miesta“ a mohli by konsolidovať všetky svoje zisky a straty, ktoré im vzniknú na celom území EÚ. Členské štáty by si ponechali svoju úplnú právomoc pri určovaní sadzieb dane z príjmov právnických osôb. Tento systém každoročne podnikom na celom území EÚ ušetrí stovky miliónov EUR na nákladoch na dodržiavanie právnych predpisov. Okrem toho podnikom s ambíciami expandovať za hranice vznikne výhoda v podobe úspor do výšky až 1 miliardy EUR. Systém pomôže vytvoriť nové pracovné miesta, pomôže v boji proti daňovým únikom, bude priaznivý pre celosvetovú konkurencieschopnosť EÚ a zvýši atraktívnosť EÚ na trhu pre zahraničných investorov.

  Sławomir Witold Nitras (PPE), na piśmie. – Projekt stworzenia jednej podstawy opodatkowanie podatkiem CIT w całej Unii Europejskiej jest przedsięwzięciem ambitnym i potrzebnym. Ambitnym z tego względu, że prawodawstwa krajów UE dotyczące tego podatku znacznie różnią się od siebie nie tylko technicznie, ale również poziomem szczegółowości i priorytetów gospodarczych danych krajów odzwierciedlonych w tym podatku. Jest to przedsięwzięcie potrzebne, gdyż pozwoli na znaczne oszczędności w działalności transgranicznej firm oraz ułatwi im działalność.

Niemniej jednak, pomysł wprowadzenia konsolidacji przychodów nie jest już jednoznacznie pozytywny. Przynajmniej nie dla wszystkich krajów. Formuła podziału sprawia, że pojawia się grupa państw „wygranych i przegranych", czyli tych, których dochody budżetowe wzrosną i tych, których dochody spadną po wprowadzeniu tego rozwiązania. Dlatego też niesłychanie trudno będzie wypracować kompromis, który satysfakcjonowałby wszystkie strony, a i po jego osiągnięciu może negatywnie wpływać na relacje między państwami.

Dlatego też uważam, że stworzenie jednolitej bazy podatkowej powinno być priorytetem, a pomysł konsolidacji powinien zostać porzucony. Byłoby to znacznie korzystniejsze rozwiązanie gdyż przyspieszyłoby proces budowania wspólnego rynku bez zbędnych opóźnień, szczególnie w kontekście faktu, że istnieje szeroki konsensus, w postaci paktu Euro Plus, aby takie działanie przedsięwziąć.
