  Rafał Trzaskowski, author. − Madam President, first of all I would like to thank all my colleagues who supported this resolution for showing solidarity.

This resolution was prompted by the decision of the Swiss authorities to re-establish quantitative limitations on the long-term residence permits granted to the citizens of eight Member States from eastern and central Europe. We are of the opinion that such measures are discriminatory since, according to the Commission’s Legal Service, there is no basis for such a differentiation as the transitional period for the safeguards has run out.

We in this House have an allergic reaction to any attempt at differentiating between EU Member States, especially if it has no grounding in the legal framework underpinning our relationship. We differ on the interpretation of the safeguards with the Swiss authorities, but this situation actually points to the deficiency in our relations, as there is no legal guarantee that mutual legal obligations will be implemented in a uniform manner.

We are of the opinion that the labour force coming from the EU has contributed to the growth of the Swiss economy, and this is actually confirmed by Swiss farmers and small and medium-sized enterprises. If that is indeed the case, there is no justification for using the safeguards, regardless of the interpretation of the protocol.

Less me stress that we do not want to be paternalistic towards our Swiss partners. I was rapporteur on how Switzerland and the other EEA countries cope with the internal market. We have shown an enormous degree of understanding of the sensitivities of our partners in the Swiss Confederation and engaged in a very positive dialogue with our friends in the Swiss Parliament.

In the resolution we reiterate certain problems that we have in our relations as regards the provision of services, for example, not because we are upset, but because we are concerned about our relationship with Switzerland. Smooth, productive and predictable relations between the EU and Switzerland that are beneficial for both sides are of the utmost priority to us all.

  Evelyne Gebhardt, Verfasserin. − Frau Präsidentin! Die gute Zusammenarbeit mit den EWR- und EFTA-Staaten liegt uns sehr am Herzen. Wir haben da eine privilegierte Beziehung, die wir auch sehr positiv weiterentwickeln möchten. Aber das bedeutet auch, dass wir uns auf beiden Seiten an die bestehenden Verträge halten, und wir haben natürlich als Europäisches Parlament, als Europäer auch darauf zu achten, dass keine Diskriminierung innerhalb der Staaten der Europäischen Union eingeführt wird, sei es über Auslegung von Vertragstexten oder in anderer Art und Weise. Deswegen verstehe ich einfach nicht das Vorgehen der Schweizer in der Anwendung der Quotenregelungen, die die Schweiz durchaus vertraglich machen darf. Was für uns nicht akzeptabel ist, ist, dass eine Unterscheidung getroffen wird zwischen den Mitgliedstaaten, zwischen den Bürgern und Bürgerinnen von acht Staaten der Europäischen Union und den anderen Staaten der Europäischen Union. Das steht im Gegensatz, im Widerspruch zum Geiste der Europäischen Union.

Wir sind alle gleich, und wir haben alle gleich behandelt zu sein. Deswegen akzeptieren wir nicht, dass hier eine Unterscheidung gemacht wird. Die Bestimmungen des Artikels 10 des Abkommens von 1999 beziehen sich auf Beschäftigte und selbständige Personen der Europäischen Gemeinschaft. Das steht in den Verträgen, und wir bitten darum, und wir müssen auch darauf bestehen, dass die Bürger der Europäischen Gemeinschaft gleich behandelt werden.

Deswegen fragen wir die Europäische Kommission, wie der Stand der Diskussionen in diesem Bereich mit der Schweiz ist. Wir bitten Sie auch darum, klarzustellen, dass wir innerhalb der Europäischen Union keine Bürger erster und zweiter Klasse haben und dass die Quotenregelung insgesamt für die Europäische Gemeinschaft gelten muss und keine Differenzierung zwischen den Bürgern gemacht werden darf.

  Sarah Ludford, author. − Mr President, I fully agree with the remarks of my colleagues from the EPP and S&D, as there is strong cross-party agreement on this matter. I, on behalf of ALDE, strongly regret that the Swiss authorities have decided to re-establish these quantitative restrictions – these quotas – on residence permits for nationals of the A8 Member States a year after the transitional restrictions expired.

I absolutely agree with Mr Trzaskowski that the decision to target these quotas only at eight Member States is discriminatory, and therefore unlawful. There is absolutely no legal basis, as Ms Gebhardt said, for any national differentiation in the existing treaties between Switzerland and the EU, and specifically in the 1999 agreement safeguard clause. I agree with Catherine Ashton’s statement that the quotas are in breach of the agreement on the free movement of persons.

There are approximately one million EU nationals in Switzerland among a total of nearly 1.8 million foreigners, but my understanding is that until last year the Swiss Government had only awarded 2 000 residence permits to nationals from the A8, so I really do not see how this is a massive problem. This is on top of the fact that it is illegal to differentiate. I am sure that Switzerland appreciates that the free movement of persons is of huge advantage to the Swiss economy, making a crucial contribution to the creation and preservation of jobs.

ALDE believes that this measure is neither economically justified by the labour market situation, nor by the number of EU citizens actually seeking residence in Switzerland. Mention has been made of the wider problems of free movement of service providers, implementation of the free market and burdens on SMEs, so I am afraid there is much to discuss with Switzerland.

  Tatjana Ždanoka, author. − Mr President, this is the second time during this Strasbourg session that we have asked why EU Member States are facing unequal treatment by third countries.

The first question, related to visa requirements, was addressed to Canada. The second, related to access to economic activity, we are putting today to our European neighbour, Switzerland, which has decided to re-establish quantitative limitations on the long-term residence permits granted to nationals of the eight EU Member States which joined the EU in 2004, including my own country, Latvia.

Our group deplores this decision taken by the Swiss authorities and demands solidarity with the Member States concerned. Are these two precedents of unequal treatment of nationals of different EU Member States an example of opportunism, or maybe a sign of a new trend? Maybe there is an underlying reason for such phenomena.

Therefore our question is addressed not only to the Swiss authorities, but first of all to ourselves. Are the EU’s own institutions and political leaders behaving in such a way that others cannot imagine introducing selective discriminatory treatment with respect to EU citizens? Maybe we ourselves are demonstrating a tendency for less solidarity and more national egoism.

In my opinion, the European Parliament must restart discussions on the enforcement of a common European citizenship. The status of the EU citizen must be more than simply a derivative of Member States’ citizenship. Such a status may be a safeguard against the different treatment of possessors of European citizenship by third countries.

We know that 2013 will be the year of EU citizens – or EU citizenship – and there is a danger that the whole issue will be confined to particular problems. In my opinion, this will be the proper time to start promoting this kind of status of EU citizenship, which will grant equal treatment of EU citizens by Switzerland, Canada and any other country.

  Adam Bielan, autor. − Panie Przewodniczący! Umowa w sprawie swobodnego przepływu osób pomiędzy Unią Europejską a Szwajcarią miała na celu zagwarantowanie otwartości i wymiany gospodarczej. Pozostająca poza Wspólnotą Szwajcaria otrzymała doskonałą możliwość współpracy ze wszystkimi państwami członkowskimi. Kierowano się przy tym po obu stronach wspólnym interesem narodowym oraz dobrem obywateli. Przystępując do umowy, władze szwajcarskie miały także pełną świadomość tego, że będą następować kolejne rozszerzenia Unii, a porozumienie to nie pozwala na jakiekolwiek rozróżnienia pomiędzy jej obywatelami. Wprowadzenie ograniczenia liczby pozwoleń na pobyt stały dla obywateli ośmiu najmłodszych członków Wspólnoty dziwi tym bardziej, że przez ostatnie lata nie wyartykułowano żadnych zastrzeżeń. Również władze większości kantonów są przeciwne takiemu rozwiązaniu, argumentując, że rynek pracy nie jest zagrożony przez imigrantów.

W mojej opinii interpretacja zapisów porozumienia oraz protokołu sprzed ośmiu lat przez Szwajcarię jest niewłaściwa. Unia Europejska przystępowała do nich jako całość i jako całość winna być traktowana. Oznacza to, że Szwajcaria nie może stosować tych umów w stosunku do poszczególnych krajów, a jedynie do całej Wspólnoty. Nie może zatem blokować pozwoleń na pracę obywatelom wybranych państw członkowskich. W tym względzie cieszy mnie jednoznacznie negatywne stanowisko Komisji dotyczące tej sprawy. Powoływanie się Rady Federalnej w Bernie na przepisy przejściowe protokołu również wzbudza szereg wątpliwości. Siedmioletni okres karencji dla nowych krajów członkowskich minął bowiem przed rokiem i w tym czasie Szwajcarzy nie notyfikowali zamiaru sankcjonowania kwot.

Mając na względzie doskonałe dotychczas relacje pomiędzy Brukselą, a także Warszawą, i Bernem, dbając o dalszy ich rozwój w pożądanym kierunku, zwracam się do przedstawicieli władz Szwajcarii z prośbą o zrewidowanie swojego stanowiska oraz właściwe stosowanie porozumienia. Apeluję do instytucji europejskich o podjęcie działań na rzecz rozwiązania tego problemu, a wszystkich państwa proszę o poparcie naszego wniosku w dzisiejszym głosowaniu. Dziękuję.

  Cornelia Ernst, Verfasserin. − Herr Präsident! Wir haben es, denke ich, mit einem sehr sensiblen Thema zu tun, wenn wir über Aufenthaltsbegrenzungen sprechen, und zwar auch deshalb, weil damit rechtspopulistischen und rechtsextremen Kräften Vorschub geleistet wird. Wenn in der Schweiz gegenwärtig ein Referendum seitens der rechtspopulistischen Schweizer Volkspartei angestrengt und auch durchgeführt wird, und zwar zum Thema Ausländerquote, dann sind wir mitten im Dilemma.

Eins will ich für unsere Fraktion auch klar sagen: Weder EU-Bürger noch andere dürfen politische Verhandlungsmasse werden und Gegenstand billiger rechter Propaganda im Zuge der sogenannten Masseneinwanderung, in diesem Falle in die Schweiz.

Das Problem ist dadurch besonders stark, dass es sich um EU-Bürger handelt. Schaut man sich einmal an, wer die meisten Aufenthaltsgenehmigungen erhält – es sind zu über zwei Dritteln EU-Bürger. Im April 2012 beschlossen nun die Schweizer Behörden in vorauseilendem Gehorsam, Quoten für ganz bestimmte Länder einzuführen. Schauen wir uns das wieder an, steht es im Widerspruch: Die meisten Aufenthaltsgenehmigungen werden, wenn man sich die Zusammensetzung insgesamt anschaut, bekanntermaßen für Deutsche und Italiener erteilt und nicht gerade für Tschechen oder Polen. Der Anteil gerade von Staatsangehörigen dieser acht Länder ist wirklich relativ gering, und man beruft sich auf die 10-%-Regelung, die geradezu lächerlich ist im Vergleich zu anderen Staatsbürgern. Da sieht man wieder einmal, wie das so ist, wenn man in solchen Fragen mit Prozenten handelt. Da kommt man sehr schnell in eine große Falle, daran will ich auch erinnern.

Wenn die Schweiz sich nun auf das Abkommen mit der EU bezieht und Artikel 10 Absatz 4 anstrengt, dann ist das politisch höchst fragwürdig und kontraproduktiv. Wir sehen darin eine Verletzung der Freizügigkeitsrichtlinie und der Abkommen mit der Schweiz, und vor allem sehen wir darin eine Diskriminierung bestimmter Staatsangehöriger und bestimmter Länder. Das darf nicht sein. Wir brauchen eine einheitliche Behandlung aller EU-Bürger, auch in Bezug auf die Schweiz. Hier kann es kein Wenn und Aber geben. Quotendebatten lehnen wir daher in diesen Fragen grundsätzlich ab, weil sie ausländerfeindlichen Stimmungen tatsächlich Vorschub leisten.

  Janez Potočnik, Member of the Commission. − Mr President, the EU-Switzerland agreement on the free movement of persons is of fundamental importance to the European Union and for the more than one million EU citizens who live and/or work in Switzerland. It is also a highly beneficial agreement for the Swiss economy and one of the factors which has helped Switzerland overcome the world economic crisis relatively swiftly. Therefore, the decision taken by the Swiss authorities to re-establish quantitative limits for nationals of eight Member States is highly regrettable in the context of very close and very good relations between the European Union and Switzerland.

As Baroness Ashton said in her statement of 18 April 2012, this decision is neither legal, nor justified by the Swiss socio-economic situation. Legally speaking, until 31 May 2014, the provisions of Article 10(4) of the agreement are applicable without distinction to nationals of all the Member States except Bulgaria and Romania, which are subject to another regime. According to the information at our disposal, it seems that the requirements for the application of quantitative restrictions under Article 10(4) of the agreement were not met, as the number of residence permits that Switzerland issued to EU citizens in the past year would not have exceeded the average of the previous three years by more than 10%. The agreement as supplemented by the protocol of 2006 permits no differentiation on grounds of nationality, either for the establishment of ceilings or for the introduction of quotas.

Regrettably, there are hardly any legal tools that the European Union can use to reverse this measure. The only mechanism provided for by the agreement for the settlement of disputes is a joint committee of representatives of the parties. In the past, unfortunately, this mechanism has proved to be ineffective. Nonetheless, the EU will bring this issue up for discussion at the joint committee meeting on 27 June this year.

Beyond the lack of an effective mechanism for the settlement of disputes, this agreement also has other shortcomings. The first is its static nature: the agreement is based on the legal situation in the EU in 1999, when it was signed, and does not take into consideration either EU legal acts or European Court of Justice case law after that date. There is provision for adaptation in the light of changing EU law only with regard to the coordination of social security systems and the recognition of professional qualifications.

It is particularly regrettable in this context that the agreement does not take account of Directive 2004/38 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, and thus, that a different legal regime applies to free movement between the EU and Switzerland.

The second shortcoming is the lack of any mechanism for monitoring Switzerland’s compliance, by contrast to arrangements in the EU or, for example, the European Economic Area. In that context, I regret to inform the House that no concrete progress has been achieved on most of the issues identified by Parliament’s resolution of 7 September 2010, in spite of almost two years of discussions with Switzerland within the joint committee, and in technical talks. The only matter on which I can report some success is the incorporation into the agreement on the free movement of persons of Directive 2005/36 on the recognition of professional qualifications, although the relevant measures have yet to enter into force.

Finally, as regards these institutional issues in particular, following the visit to Brussels in March 2012 by the Swiss President and the Federal Councillor for Foreign Affairs, the Swiss Government launched a consultation domestically. It then announced that it would make concrete proposals on institutional matters to the European Union. The Commission will analyse these proposals and deliver an opinion on them once they have been communicated officially by Switzerland.

  Andreas Schwab, im Namen der PPE-Fraktion. – Herr Präsident, liebe Kolleginnen und Kollegen! Das Ziel dieser Aussprache heute Morgen und der vorliegenden Entschließung ist es, unseren Schweizer Freunden unsere Besorgnis – insbesondere die Besorgnis des Europäischen Parlaments – darüber zum Ausdruck zu bringen, dass die Zusammenarbeit zwischen der Schweiz und der Europäischen Union auch Verpflichtungen beinhaltet, rechtliche und politische. Die politischen sind bereits angesprochen worden. Herr Kommissar, ich bin Ihnen außerordentlich dankbar, dass Sie die vielen rechtlichen Verpflichtungen angesprochen haben, die bislang im Verhältnis zur Schweiz leider nicht in befriedigender Weise wirklich kontrolliert und überwacht werden können, weil ein Gemischter Parlamentarischer Ausschuss dafür definitiv nicht ausreicht angesichts der Tatsache, dass wir so viele bilaterale Verträge mit so vielen gegenseitigen rechtlichen Verpflichtungen haben. Deswegen nehme ich Ihre Auflistung aller Schwierigkeiten dieser Situation zum Anlass, darauf hinzuweisen, dass die Kommission ja mit der Schweiz über ein Rahmenabkommen verhandelt, das diesen Gemischten Parlamentarischen Ausschuss im Prinzip durch ein wirkliches Gericht ersetzt, beispielsweise den Europäischen Gerichtshof, der am Ende tatsächlich auch rechtliche Streitfragen klären kann, und zwar im gegenseitigen Einvernehmen als neutrale Instanz.

Ich glaube, dass dies eine wichtige Botschaft der heutigen Aussprache sein muss, weil die Diskriminierung von Angehörigen der Europäischen Union zweifellos von niemandem in diesem Haus akzeptiert werden kann und wir deswegen nicht nur die Freizügigkeit der Bürgerinnen und Bürger dieser acht Mitgliedstaaten im Auge haben, sondern natürlich auch die Freizügigkeit von vielen Wirtschaftsbeteiligten, und zwar aus der Europäischen Union und der Schweiz.

  Olga Sehnalová, za skupinu S&D. – Pane předsedající, hospodářská krize, rostoucí nezaměstnanost a nejistota lidí: v tomto prostředí se dobře daří předsudkům a úvahám o vinících. Hledají se ti, kdo berou lidem práci, hledají se snadná řešení. Webové stránky zaměřené proti občanům ze střední a východní Evropy a téma, o kterém se bavíme dnes, jsou bohužel dvě strany téže mince.

Pobytové kvóty, které od května zavedla švýcarská vláda selektivně vůči občanům Evropské unie pocházejícím z osmi nových členských států, jsou v rozporu se základní evropskou myšlenkou volného pohybu osob a pracovních sil. Za principiálně zcela nepřijatelný a zcela diskriminační považuji rozdílný přístup na základě národnosti, nehledě na to, že zaměstnanci z tzv. osmičky tvoří pouze zlomek zahraniční pracovní síly ve Švýcarsku. Proto považuji za nezbytné apelovat na švýcarské úřady, aby své rozhodnutí přehodnotily a tyto diskriminační pobytové kvóty zrušily.

Věřím, že racionální argumenty v jednáních nakonec převáží, a děkuji vysoké představitelce pro zahraniční věci a bezpečnostní politiku Evropské unie paní Ashtonové za první krok v tomto směru.

  Jürgen Creutzmann, im Namen der ALDE-Fraktion. – Herr Präsident, Herr Kommissar! Die Zusammenarbeit der Europäischen Union mit der Schweiz liegt mir am Herzen. Deswegen ist es wichtig, dass wir diese Dinge, die eine Zusammenarbeit stören, aufgreifen. Wir haben gehört, dass die Festlegung der Erteilung der Aufenthaltsgenehmigungen für acht europäische Mitgliedstaaten nicht mit den Verträgen übereinstimmt. Wir bedauern dieses Vorgehen der Schweizer Behörden, insbesondere vor dem Hintergrund, dass dies nur eine von vielen Maßnahmen ist, die die Umsetzung der bilateralen Abkommen zwischen der Schweiz und der Europäischen Union gefährden; der Herr Kommissar hat die Probleme aufgezeigt.

Hieraus wird ersichtlich, dass die Kommission aufgefordert ist und bleibt, im Gemischten Ausschuss die noch fehlenden Schritte zur freien Erbringung von Dienstleistungen in der Schweiz und die Verwirklichung eines Binnenmarktes zu thematisieren. Wenn es gelingen sollte, dass wir hier einen Schritt weiterkommen, dass es zwischen der Europäischen Union und der Schweiz ein Abkommen gibt, das verbindlich regelt, wenn es Streitpunkte gibt, dann ist das nur zum Wohle aller.

Der Beschluss der Schweizer Behörden ist nicht nur politisch unklug, er ist auch aus ökonomischen Gesichtspunkten unklug. Wir wissen beispielsweise, dass es sehr viele junge, qualifizierte polnische Bürger gibt, die in Zukunft durchaus die Möglichkeit hätten, in der Schweiz zu arbeiten, dort einen Beitrag zum Wohlstand zu leisten. Ich hoffe, dass die Schweiz dies überdenkt und es wieder zurücknimmt.

  Marije Cornelissen, namens de Verts/ALE-Fractie. – Als een klein wit vlekje in het hart van Europa ligt Zwitserland. Waar je als Zwitser ook heengaat - oost, west, noord, zuid - binnen een paar uur zit je altijd in de EU. Natuurlijk wil Zwitserland goede relaties met de EU: vrij handelen, vrij reizen, vrij werken, en natuurlijk wil de EU goede relaties met Zwitserland.

Daarom hebben we een verdrag om dat te regelen, maar dat verdrag schiet duidelijk tekort. Een bepaling daarin lijkt door Zwitserland misbruikt te worden om een tweedeling te maken tussen de EU-burgers die wel welkom zijn en de EU-burgers die niet welkom zijn. Dat is simpelweg discriminatie van Midden- en Oost-Europeanen, en dat is simpelweg onacceptabel.

Ik hoop dat de Commissie een manier vindt om hier korte metten mee te maken. Een onderscheid aanbrengen tussen EU-burgers accepteren wij niet. Ieder mens in onze Unie is even veel waard en heeft dezelfde fundamentele rechten. Dat is de basis van alles en dat moeten we tot het uiterste verdedigen.

  Tadeusz Cymański, w imieniu grupy EFD. – Panie Przewodniczący! U samych podstaw funkcjonowania Unii Europejskiej leży zasada swobodnego przemieszczania się osób, a także równego traktowania. Wprowadzanie przez Szwajcarię ograniczeń liczby pozwoleń na pobyt stały jest rażącym złamaniem tej zasady. Nie dopuszczamy myśli, że intencje były złe, jednak fakty są właśnie takie. Znamienną sprawą jest to, że dotyczy to państw Unii Europejskiej, które w przeszłości doświadczyły izolacji i jarzma komunizmu. Dlatego ta sprawa jest swoistym testem, czy są dwie Europy czy jedna, czy jesteśmy razem czy osobno. Wierzę głęboko w to, że Parlament Europejski da mocny argument Komisji Europejskiej z myślą o dalszych pracach i działaniach z naszymi przyjaciółmi ze Szwajcarii. Nie dopuszczamy języka konfrontacji, uważamy, że jest to sytuacja, która nie powinna się zdarzyć, i głęboko wierzymy, że w szybkim tempie zostanie rozwiązana, ponieważ w wolnej Europie taka sytuacja miejsca mieć nie powinna.

  Ioan Enciu (S&D). - Cotele de permise de muncă şi de şedere impuse de Elveţia pentru opt state din Europa Centrală şi de Est fac parte dintr-o întreagă suită de restricţii discriminatorii la care noile state membre au fost şi sunt încă supuse în mod sistematic. Nici eu nu sunt de acord cu Comisia. Modul de a abordare pe care Comisia îl adoptă întotdeauna când se discută despre discriminări la adresa statelor din Europa de Est - precum reciprocitatea vizelor, accesul în zona Schengen, site-uri discriminatorii şi multe altele - este foarte general, ceea ce nu este în regulă.

În legătură cu Elveţia, nu există niciun argument legal pentru a impune aceste restricţii doar pentru anumiţi cetăţeni europeni, din moment ce articolul 10 al acordului invocat de autorităţile elveţiene se referă la toţi cetăţenii UE, fără deosebire de naţionalitate. În plus, această restricţie este disproporţionată şi nu este justificată economic. Suntem solidari cu toate statele membre cărora li se impun restricţii de orice fel, însă vreau să subliniez că pentru cetăţenii români şi bulgari situaţia este mult mai grea. Pentru ei, în Elveţia, restricţiile de şedere şi de muncă li se vor putea aplica până în anul 2019, faţă de termenul-limită iniţial - 2014. În acelaşi timp, românii şi bulgarii au încă accesul la muncă limitat în nouă state membre, iar Spania aplică restricţii doar pentru cetăţenii români.

  Cecilia Wikström (ALDE). - Herr talman! Det beslut som Schweiz fattade i april innebär en rejäl minskning av antalet beviljade visum per år, från 6 000 till 2 000 för medborgare från åtta av EU:s medlemsstater. Denna typ av kvoter avskaffades tidigare, som vi vet. Det är därför ett stort steg i fel riktning att nu återinföra dem. Det leder till en systematisk diskriminering som vi i EU verkligen inte välkomnar.

Sanningen är att Schweiz har haft mycket stor nytta och glädje för sin tillväxt av de cirka en miljon EU-medborgare som lever och arbetar i Schweiz. Ett land med knappt åtta miljoner medborgare behöver dessa människor för tillväxt och framgång. Nu är det så att högerpopulistiska krafter har verkat, och jag beklagar att den schweiziska regeringen har fallit till föga. Det är genant och pinsamt att man väljer ut åtta av EU:s medlemsstater att diskriminera mot. Det minsta vi kan begära är att EU:s medlemsländer behandlas lika.

  Jaroslav Paška (EFD) - Rozhodnutie švajčiarskych úradov z apríla tohto roku o zavedení množstvových kvót na počet povolení na pobyt vo Švajčiarsku pre občanov ôsmich krajín Európskej únie porušuje dohody, ktoré podpísalo Švajčiarsko s Európskou úniou v záujme využívania spoločných výhod jednotného trhu. Na uvedené opatrenie švajčiarskych úradov nemá podľa našej právnej služby švajčiarska strana nijaký právny základ, a preto je potrebné, aby Európska komisia otvorila rokovania so švajčiarskymi partnermi o porušovaní medzinárodných dohôd, najmä dohody o voľnom pohybe osôb z júna 1999. Nechce sa mi veriť, že by si švajčiarske úrady neuvedomovali možné dôsledky svojho dobrodružného konania. Veď ak by chcela švajčiarska strana spochybniť svoju zmluvnú bázu s Európskou úniou len preto, aby nemusela plniť svoje právne záväzky voči Únii, prišla by aj o výhody, ktoré jej zo spolupráce s Európskou úniou plynú. Preto som presvedčený o tom, že Komisia musí dôraznejšie pripomenúť švajčiarskym partnerom jej záväzky a samozrejme žiadať zmenu tohto nariadenia.

  Auke Zijlstra (NI). - Voorzitter, het Europees beleid van open grenzen is in toenemende mate vrij verkeer van criminelen. Ook Nederland heeft te maken met criminele Midden- en Oost-Europeanen. In Amsterdam komt ondertussen 90% van de verdachten niet uit Nederland, maar uit Polen, Roemenië, Litouwen of Bulgarije. Ik heb de Commissie gevraagd naar deze cijfers te kijken, maar de Commissie heeft dat geweigerd. Maar voor iedereen is het duidelijk dat open grenzen problemen met zich meebrengen.

Voorzitter, in 2004 heeft de Commissie staan juichen toen landen werden toegelaten die er nog niet klaar voor waren. De problemen wil de Commissie, en ook dit Parlement, niet zien. Zwitserland daarentegen ziet problemen ontstaan en handelt, en is daarmee een voorbeeld voor ons allemaal. Zwitserland is wél soeverein, Zwitserland heeft wél een betrouwbare munt, Zwitserland kent weinig corruptie en heeft, met een minarettenverbod, laten zien dat hun democratie wél werkt. De Zwitsers kunnen nog kiezen en Zwitserland kan nog opkomen voor de belangen van zijn burgers.

Ik roep de Commissie dan ook op om het besluit van Zwitserland te respecteren, de cijfers uit Amsterdam alsnog te bekijken en de problemen van de open grenzen onder ogen te zien.

  Csaba Őry (PPE). - A szerződéseket be kell tartani, ez egy régi római jogi alapelv, máig senki nem vonja kétségbe, és ez még akkor is így van, ha a válság számos országban nehéz, bonyolult helyzeteket, komoly belpolitikai vitákat eredményez. A saját országainkban is megéljük ezt, mégis egymást is folyamatosan arra szorítjuk, hogy azokat a megállapodásokat, amiket kötöttünk – legyenek belső megállapodások, vagy külső megállapodások – tartsuk be.

Ami itt történt, az nem véletlen megsértése egy szerződésnek, hanem úgy tűnik, hogy nagyon is tudatos eltérés a szerződéstől. Itt legalább három olyan pont van, ami tudatos megsértése a szerződésnek.

Nem lehet diszkriminálni a tagországok között, itt diszkriminálnak a tagországok között. Az átlagot, ugye 10%-kal meghaladó növekedés az, amikor a védelmi klauzula életbe léphet, ezt a 10%-ot a 27 tagországra kell számolni, és nem 8 tagországra vagy 4 tagországra, vagy nem csak azokra, akiket kipécézünk. Következésképpen itt is megsértik a szerződést. És harmadik megsértése a szerződésnek, hogy a megállapított kvótának fölötte kell lennie az utolsó irányadó kvótának, itt pedig pont fordítva van, alatta van annak, háromezer helyett kétezer főben határozzák meg.

Ez tehát elég komoly tudatosságra utal. És negyedszer pedig: nem volt egyeztetés, mielőtt bevezették ezeket az intézkedéseket. Ez pedig egy olyan elem, ami a jó szándékot vonja kétségbe, tehát egyetértek Busuttil kollégámmal: határozott, egyértelmű kiállást várunk az Európai Bizottságtól, és ez a svájci rendelkezés, a szerződés megsértése elfogadhatatlan.

  Tanja Fajon (S&D). - V Sloveniji, moji državi, obžalujemo odločitev Švice. Ukrep je diskriminatoren in žalosten za državo, ki je veljala za državo z demokratično tradicijo.

Razmere na trgu dela in število prišlekov iz Evropske unije tega ne upravičujejo. Sramotno je brati, da so skrajni desničarji v Švici v kampanji za referendum proti priseljencem uporabili plakat, na katerem črni delavski škornji teptajo švicarsko zastavo. Ukrep švicarske vlade je v nasprotju s tem, na kar je Švica pristala. Svoboda gibanja je glavni steber za gradnjo evropskega povezovanja.

Vsi državljani Unije imamo enake pravice. Ne smemo dovoliti ustrahovanja Evropejcev, kakršnemu smo bili priča tudi na Nizozemskem in v Belgiji. Jasno moramo obsoditi skrajno populistično in nacionalistično retoriko in se boriti proti vsem oblikam diskriminacije. Širjenje sovražnih idej je sredi finančne, gospodarske in socialne krize še posebej nevarno.

Pričakujem, da bo švicarska vlada svojo odločitev še enkrat temeljito premislila, če ne pričakujem jasne ukrepe Evropske komisije, zakaj ne odpoved drugih pogodb s Švico na notranjem trgu.

  Róża Gräfin von Thun und Hohenstein (PPE). - Panie Przewodniczący! Jak widać, dyskusja dotycząca wprowadzenia kwot dla obywateli niektórych państw Unii Europejskiej na pobyt w Szwajcarii budzi ogromnie żywą dyskusję. Cieszy mnie to, że w tej dyskusji biorą udział obywatele z różnych krajów – posłowie z krajów, które były członkami, założycielami Unii Europejskiej i krajów, które do Unii Europejskiej dopiero dołączyły. W tej dyskusji, z prawa na lewo, z lewa na prawo, ze wszystkich partii, między którymi na co dzień spieramy się bardzo ostro i mamy bardzo różne opinie, tym razem wszyscy się zgadzamy i wszyscy żywo popieramy projekt rezolucji posła Trzaskowskiego i innych. Dzisiaj zyskuje ona tak szerokie poparcie, dlatego że zdajemy sobie sprawę z tego, że im bliżej współpracujemy, im bardziej otwieramy się jedni na drugich, tym bardziej wszyscy zyskujemy.

Unia Europejska charakteryzuje się formułą „win-win”, czyli jeden zyskuje i drugi zyskuje. Mam wrażenie, że obywatele Szwajcarii również zdają sobie z tego sprawę. Przecież głosowali w referendum za Schengen w 2005 r. oraz za swobodnym przepływem osób w 2009 r. Obydwie te decyzje zyskały szerokie poparcie społeczne. Dlaczego teraz ta decyzja administracyjna miałaby naszych przyjaciół, zaprzyjaźniony i bliski kraj – Szwajcarię, odsuwać od nas i przeszkadzać w korzystaniu z „win-win”? Dziękuję.

  Radvilė Morkūnaitė-Mikulėnienė (PPE). - Džiaugiuosi, kad šiandieną šitą atvejį svarstome Europos Parlamente ir diskutuojame. Europos Sąjungos ir Šveicarijos susitarimuose nėra numatyta galimybė skirstyti Europos Sąjungos piliečius į skirtingas kategorijas pagal jų priklausomybę vienai ar kitai Europos Sąjungos valstybei narei. Šis Šveicarijos sprendimas negali būti motyvuojamas visuomenės spaudimu, kadangi patys šveicarai dar 2009 m. referendumu išreiškė savo pritarimą laisvam darbuotojų judėjimui į Europos Sąjungą ir iš jos (abipusiam judėjimui). Neseniai plenarinėje sesijoje piktinomės Olandijos politikų remiamu tinklapiu, diskriminuojančiu migrantus iš Vidurio ir Rytų Europos, kurie, esą, atima darbo vietas, tačiau jie skundžiami ne vien tiktai dėl to, bet ir dėl ne vietoje pastatytos mašinos ar triukšmo vėlai vakare. Tendencijos labai neramina, ir ekonominio sunkmečio laiku bandoma ieškoti atpirkimo ožių, kuriais tampa kitokie. Visgi tikiuosi, kad Europos Sąjunga ir Šveicarija drauge išspręs kylančius iššūkius normalaus dialogo būdu.

  Monika Flašíková Beňová (S&D). - Dňa 18. apríla švajčiarska vláda oznámila, že sa jednostranne rozhodla opätovne zaviesť prisťahovalecké kvóty pre občanov ôsmich krajín Európskej únie vrátane mojej krajiny – Slovenskej republiky. Navyše vláda uviedla, že program pred jeho vypršaním v apríli 2013 ešte prehodnotí a zváži jeho predĺženie aj na ďalší rok. Švajčiarska vláda tým porušuje bilaterálnu dohodu medzi Švajčiarskou konfederáciou a Európskou úniou v zmenách protokolu z roku 2004. Tento krok je diskriminačný, pričom zákaz diskriminácie medzi občanmi Európskej únie je ustanovený aj v článku 21 hlava 3 Charty základných práv Európskej únie. Novinky v prisťahovaleckej politike Švajčiarska navyše nie sú odôvodnené ani ekonomicky, ani situáciou na pracovnom trhu, ani počtom migrantov z Únie. Ďalším negatívnym aspektom rozhodnutia je, že dotknuté krajiny neboli o tomto opatrení vopred informované. Švajčiarsko nemôže jednostranne využívať výhody spolupráce s Úniou a pritom brániť občanom Únie využívať výhody švajčiarskej ekonomiky. Chcem sa poďakovať kolegom zo štátov, ktorých sa to netýka, za solidárny postoj a za podporu.

  Pat the Cope Gallagher (ALDE). - Mr President, I would like to interject in my capacity as Chair of the European Parliament delegation with responsibility for Switzerland. Speaking in a personal capacity, I am concerned by this resolution, which seems to go beyond the issue of residence permits. The resolution was drafted without consultation with our delegation or, indeed, with the Swiss mission to the EU. Perhaps this is the norm, which I believe should be changed. We should have some input.

While I do not have sufficient time to address each aspect of the resolution, I understand that there are some issues which require clarification. I would sincerely hope that this resolution will not tarnish the good relationship between the EU and Switzerland, our fourth-largest trading partner. The next EU-Swiss inter-parliamentary meeting will take place in Berne on 16 July, at which we would hope to have a full and constructive discussion with our Swiss counterparts of the delegation on all aspects of the resolution, and I also understand that the issue will be raised in the Joint Committee of the Free Movement of Persons Agreement (FMPA) on 27 June.

  Indrek Tarand (Verts/ALE). - Mr President, I have one proposal to make, although though I doubt that the Rules of Procedure give me the right to make it.

I would call on the rapporteurs to ask for the postponement of this vote today, in order to give the delegation mentioned by Mr Gallagher the time and opportunity to negotiate, and to convey our concerns to the Swiss authorities about the unfortunate decisions, of a discriminatory nature, which they have taken. If the delegation comes back without being able to convince our Swiss colleagues – in other words, if it is a complete failure – we can follow up with the tough resolution which has been debated today.

  Andrew Henry William Brons (NI). - Mr President, Switzerland is a sovereign state and has had the sense to avoid becoming a member of the EU Soviet. I make no unfavourable judgment about the general populations of Eastern Europe; however, the differences in wage rates between the East and the West have had the effect of attracting large numbers from East to West, to the economic and social disruption of both.

Switzerland has a particularly high GDP per capita. Why? Possibly because it is outside the EU. In 2009, nearly a quarter of the Swiss population consisted of immigrants, and 31% had an immigrant background. How overwhelmed does Switzerland have to become before it is permitted to act? The EU is a playground bully and a control freak. Not content with bullying its own members into submission, it also wants to bully everybody else. All Member States and non-member states should stand up to the bullying and retake control over their own borders, regardless of treaty obligations.

  Janez Potočnik, Member of the Commission. − Mr President, I think it is right to start by saying that Switzerland is one of our partners and a sincere friend. We should never forget that and we should nurture the relationship. I have my own experience from international negotiations in an environmental area, where we have extremely good cooperation. They are also truly a globally respected partner.

But this is an important issue we are discussing today and it deserves a clear, united and straightforward approach and reaction. The Commission attaches great importance to the solution of the institutional issues which affect our relations with Switzerland and in several areas which are related to the internal market. As I have already mentioned, we will certainly open this issue in the joint committee in a few weeks.

The scarce and inefficient means of contesting the re-establishment of quotas, or the so-called flanking measures, and having them revoked show that such institutional issues are not only theoretical or a matter of principle but, on the contrary, they have very practical implications for the rights and legitimate interests of citizens and economic operators.

Just to give two short concrete clarifications on points mentioned by Members. The guillotine clause referred to by Mr Busuttil applies in the case of the termination of one of the agreements. So we have no intention of proposing the denunciation of the agreement. This would be even more detrimental for the European Union and also for our citizens. On the questions, even if we in the Commission bring into play any measure related to the existing agreements or the ongoing negotiations, this issue clearly underlines once more the inadequacy of our current agreement.

The Commission will keep this, as well as other issues, under consideration when examining whether it is opportune to start new negotiations or conclude ongoing ones. Also the Council, in its conclusions of December 2010 on the relations with EFTA countries, indicated that, ‘in assessing the balance of interests in concluding additional agreements, it will have in mind the need to ensure parallel progress in all areas of cooperation, including those areas which cause difficulties to EU companies and citizens’.

To conclude, yes, we have a problem and, yes, we are working on solving it. I would like to thank honourable Members for raising these questions. Of course the Commission counts on Parliament’s support in the forthcoming discussions with regard to Switzerland.

Mir erschließt sich aber nicht, wie Sie vorgehen beim Aufrufen zu catch-the-Eye. Ich war zum Beispiel vom Beginn der Aussprachen an da und habe mich sofort, als der Bericht aufgerufen wurde, zu Wort gemeldet, bin aber nicht drangekommen. Andere sind drangekommen. Könnten Sie Ihr Prinzip erläutern, um dem Prinzip der Transparenz gerecht zu werden?

  Der Präsident. − Das mache ich sehr gerne, Herr Kollege. Zum einen haben Sie vielleicht verfolgt, dass ich diese Aussprache nicht von Anfang an präsidiert habe. Insofern bedaure ich, dass mir entgangen ist, dass Sie tatsächlich die Disziplin hatten, von vornherein da zu sein. Die Geschäftsordnung selbst sieht vor, dass, wenn wir fünf Minuten „Catch the eye“ haben, fünf Redner vorgesehen sind. Es ist grundsätzlich dem Präsidenten überlassen, wie er das macht. Alle acht Kollegen der EVP, die sich gemeldet haben, kenne ich nicht. Ich habe tatsächlich dann aus dem Mittelfeld ausgewählt. Ich habe eine Dame ausgewählt, weil die anderen Fraktionen Herren hatten, um auch die Geschlechter ausgewogen repräsentiert zu sehen. Ich weiß nicht, ob meine Antwort Sie befriedigt, aber nach irgendetwas muss ich entscheiden. Bei acht EVP-Mitgliedern, die sich gemeldet haben, war es zugegebenermaßen eine Wahl, die nicht darauf bezogen war, wer hier wie lange saß. Das ist mir, da ich zu Beginn der Debatte nicht dabei war, sondern erst später den Vorsitz übernommen habe, auch nicht bewusst gewesen. Ich kann Ihnen aber hiermit zusichern, dass ich das für das nächste Mal – insbesondere in Ihrem Fall – berücksichtigen werde. Denn wenn man schon die Disziplin hat, einer Debatte vom Anfang bis zum Ende beizuwohnen, sollte man auch die Möglichkeit haben, sich zu äußern. Dafür, dass das in Ihrem Fall nicht zum Tragen kam, entschuldige ich mich.

  Danuta Jazłowiecka (PPE), na piśmie. – Decyzja szwajcarskiego rządu o wprowadzeniu ograniczeń liczby pozwoleń na pobyt stały dla obywateli ośmiu krajów Europy Środkowej i Wschodniej jest szczególnie niepokojąca w kontekście dyskryminacyjnych zachowań, jakie spotkały obywateli tej części Europy chociażby w aHolandii. W ostatnim czasie bezpodstawnie dzieli się obywateli pcpaństw członkowskich Unii Europejskiej na „„lepszych” i „gorszych”, co może mieć bardzo niebezpieczne konsekwencje w przyszłości. Obywatele Polski, Litwy, Łotwy, Estonii, Słowenii, Słowacji, Czech oraz Węgier stanowią zaledwie mały procent populacji obywateli Unii Europejskiej przebywających na stale i pracujących w Szwajcarii. Trudno jest więc zrozumieć decyzję rządu szwajcarskiego, podjętą rzekomo w celu ochrony krajowego rynku pracy. Dodatkowo bulwersujący jest fakt, iż decyzja ta wydaje się być nielegalna – zgodnie z porozumieniem pomiędzy Szwajcarią a Wspólnotą ograniczenie w dostępie do rynku pracy może zostać wprowadzonetylko i wyłącznie w odniesieniu do wszystkich obywateli UE. Szwajcaria bez ograniczeń korzysta z praw, jakie zapewnia jej uczestnictwo w Europejskim Obszarze Gospodarczym. Eksport Szwajcarii do krajów UE-10 w 2010 r. wyniósł ponad 4 biliony eeuro, co stanowi równowartość eksportu do Chin. W tej sytuacji mamy prawo wymagać wzajemności ze strony Szwajcarii w kontaktach gospodarczych. Zwracamy się do Komisji Europejskiej z apelem o pilne podjęcie działań w celu wyjaśnienia zaistniałej sytuacji.

  Tunne Kelam (PPE), in writing. – I am Estonian. I am citizen of the EU. My country joined the European Union believing that it would be treated equally and would fully enjoy all of the same rights enjoyed by European citizens. Since the 2004 enlargement, the peoples of the ten post-communist countries have had to face several hurdles in their progress towards real equality – often accompanied by humiliations – such as: delays in opening up the job market, restrictive measures on business making, etc.

As a member of EFTA, Switzerland has signed the Free Movement of Persons Agreement, which guarantees all EU citizens equal rights on the Swiss labour and business market. Introducing restrictive measures and quotas for nationals of some EU member states has to be assessed as a discriminatory measure. Clearly, it cannot be derived from Article 10 of the 1999 agreement. Quotas should be established for all EU nationals or for no one; they are not supposed be used in a selective way based on nationality. There are some alarming trends in today's Europe: hate websites in the Netherlands and Belgium, and new Swiss laws which result in the practical marginalisation of citizens originating from post-communist EU Member States. I call on the Commission to unconditionally condemn such acts and, if necessary, to apply the necessary sanctions.

  Jacek Protasiewicz (PPE), na piśmie. – Decyzja rządu Szwajcarii o przywróceniu kwot ilościowych na pewne kategorie pozwoleń na stały pobyt wydawanych obywatelom ośmiu nowych państw członkowskich UE – Czech, Estonii, Litwy, Łotwy, Polski, Słowenii, Słowacji i Węgier – wprowadza nieakceptowalne i niesprawiedliwe rozróżnienie wśród obywateli UE ze względu na ich narodowość, przez co jest dyskryminująca, sprzeczna z europejskimi wartościami i prawem. Parlament Europejski, jak niedawno w przypadku portalu internetowego PVV w Holandii, zawsze zajmuje zdecydowane stanowisko przeciwko łamaniu podstawowych zasad, na których opiera się UE – jedną z nich jest zasada zakazu dyskryminacji ze względu na narodowość. Dlatego w pełni zgadzam się z oceną Wysokiej Przedstawiciel Catherine Ashton, że ta decyzja narusza porozumienie o swobodnym przepływie osób, które nie pozwala na wprowadzanie jakichkolwiek rozróżnień pomiędzy obywatelami UE. Zgodnie z porozumieniem obywatele Szwajcarii mogą swobodnie poruszać się po terytorium UE, ale takie same prawa muszą również zostać zapewnione wszystkim obywatelom Unii na terytorium Szwajcarii. Szwajcaria zawarła porozumienie z Unią i teraz powinna się z niego wywiązać. Jeśli rząd Szwajcarii uzna to za konieczne, może nałożyć kwoty, ale muszą one dotyczyć wszystkich obywateli Unii bez wyjątku, ponieważ w UE nie ma obywateli pierwszej i drugiej kategorii, i wszyscy obywatele Unii powinni być traktowani tak samo.

  Tadeusz Zwiefka (PPE), na piśmie. – Jestem zaniepokojony, że w przeciągu ostatnich kilku miesięcy po raz kolejny zabieramy głos w kwestii tak podstawowej jak swoboda przemieszczania się i pobytu, tym bardziej że dyskusja ta odbywa się w kontekście krajów wysoko rozwiniętych o głębokiej tradycji demokratycznej. Decyzja Szwajcarii o tymczasowym wprowadzeniu kwot na pozwolenia na pracę dla pracowników pochodzących z wybranych państw członkowskich UE jest po prostu w sposób jawny niezgodna z istniejącymi porozumieniami pomiędzy UE a Konfederacją Szwajcarską. Zapisane w art. 9 TUE obywatelstwo UE stanowi więź prawną łączącą każdą osobę fizyczną, która posiada obywatelstwo państwa członkowskiego, z Unią Europejską. Wynikają z niego zarówno obowiązki, jak i prawa, wśród nich najważniejsze – swoboda przepływu osób. U podstaw obywatelstwa europejskiego leży przecież zasada równego traktowania poszczególnych obywateli bez względu na narodowość. Głosowana dziś rezolucja w sposób konstruktywny, otwierający pole do dyskusji i współpracy oddaje nasz pogląd na decyzję podjętą przez Radę Narodową Konfederacji Szwajcarskiej. Rzeczą najważniejszą jest bowiem, abyśmy pamiętali, że Unia Europejska została stworzona dla dobra obywateli. A zatem ich wolność i swoboda są jednymi z głównych elementów prac, jakimi instytucje Unii Europejskiej powinny się zajmować. Dlatego my jako posłowie do Parlamentu Europejskiego mamy obowiązek wyraźne podkreślić naszą dezaprobatę wobec prób wprowadzania mechanizmów dyskryminujących obywateli Unii Europejskiej.
