  Andreas Mavroyiannis, President-in-Office of the Council. − Mr President, honourable Members, let me start by saying that this is one of our toxic assets so I hope that you will bear with me and accept at least my commitment to do my utmost – to do together our utmost – to find a satisfactory way forward for all of us.

I am well aware that the issue of controls in and around internal borders in the Schengen area is a matter on which this Parliament has strong views and which Parliament is following very closely. I also know that many of you have questions and concerns. Specific cases concerning the reintroduction of border controls are a matter for the Commission which is responsible for overseeing the implementation of EU law. I would, however, like to make a number of points concerning recent developments in the Schengen area, including the issue of internal border controls.

At its meeting on 7 and 8 June, the Justice and Home Affairs Council discussed this matter on the basis of the Commission’s first biannual report on the functioning of the Schengen area. That discussion focused in particular on the issues of secondary movements by third country nationals within the Schengen area and of readmission and visa policy, but we also took note of the comments in the Commission report on the issue of ensuring the absence of internal border controls. I want to assure this Parliament that the Council took full account of the importance of the absence of internal border controls during its negotiation on the Schengen governance package.

In June 2011 the European Council underlined that the free movement of persons is one of the most tangible and successful achievements of European integration. The European Council called for improved cooperation within the Schengen area in order to enhance mutual trust between Member States. This is essential if we are to protect the principle of free movement.

The European Council specifically called for a strengthening of common rules through the Schengen evaluation mechanism and for the establishment of a mechanism to respond to exceptional circumstances which might put the overall functioning of Schengen cooperation at risk. In response the Commission submitted the legislative package last September which included both an amended proposal on the establishment of an evaluation and monetary mechanism and a proposal to amend the Schengen Borders Code.

As you will be aware, at its meeting on 7 and 8 June, the Council reached a political agreement on these two proposals. This followed difficult discussions within the Council as well as extensive contacts with the European Parliament. The texts as they now stand represent a clear improvement in the governance of the Schengen area. The Schengen evaluation mechanism is substantially improved, ensuring a stronger role for the Commission and a more efficient follow-up to evaluation reports and monitoring.

The Schengen Borders Code includes new provisions to address situations where Member States are not fully implementing the Schengen acquis. The proposal to amend the Schengen Borders Code is of course subject to ordinary legislative procedure. This Parliament will therefore be fully involved in deciding on the provisions which will govern the reintroduction of controls at internal borders.

As far as the Schengen evaluation mechanism proposal is concerned, the Council took the decision to change the legal basis from Article 77 to Article 70 of the Treaty on the Functioning of the European Union. I am of course well aware of the sensitivity of this decision for Parliament. I want to assure you that this decision was taken for legal reasons, even if its consequences may be felt by Members here to be political.

The Council was not in any way motivated by a wish to exclude Parliament from the process. On the contrary we want Parliament to be fully involved. That is why the Council agreed that when it consults Parliament your opinion, in all its aspects, will to the fullest extent possible be taken into consideration by the Council before the adoption of the final text.

I should also point out that the Council also agreed, again for legal reasons and as part of the overall agreement, to transfer several provisions in the Schengen evaluation mechanism proposal to the Schengen Borders Code proposal.

The Cyprus Presidency is ready to work constructively with the European Parliament on both the Schengen evaluation mechanism proposal and the Schengen Borders Code proposal. We therefore very much hope that a way can be found which will enable Parliament to reconsider its decision to suspend its work on the Schengen governance package. This would enable us to work together to reach agreement on this very important matter as soon as possible.

  Cecilia Malmström, Member of the Commission. − Mr President, let me assure you that the Commission is willing to help ‘detox’ this file if you would so like.

The possibility to travel within Schengen without being subject to border control is of course one of the most valuable rights for European citizens. It is one of the most tangible effects of European integration for citizens and it is the role of the Commission, as guardian of the Treaties, to make sure that this will still be the case. We will not hesitate to initiate infringement procedures if appropriate.

My services are currently investigating a number of possible violations of the relevant EU legislation, including the Schengen Borders Code. These cases cover both obstacles to fluid traffic flow at internal land borders and police checks that might have an effect equivalent to border controls.

From last November to April, we investigated 11 different cases involving 10 different Member States. You have highlighted in your questions here two of these cases: the German authorities’ controls on passengers on Czech buses and mobile surveillance by the Dutch authorities at their borders with Belgium and Germany. The Commission is aware of both.

In the German-Czech case, the Commission has repeatedly requested information from the German authorities on the frequency of controls and their justification. However, the information we have received so far from the German and Czech authorities has not provided sufficient details to fully assess whether the controls were equivalent to border checks and whether they are in breach of the Schengen Borders Code.

We have not let the matter rest here. In May, we asked three major Czech bus companies to assist us with more information over a longer period. We hope to have additional facts by October, which would enable us to carry out a more thorough analysis of the situation at that border. I am of course ready to come back to you and report on these results.

Regarding the Dutch mobile surveillance, there have been several recent cases in various Dutch courts, questioning whether it is compatible with the Schengen Borders Code. In addition to the decision that you have highlighted, Dutch courts have referred two similar cases to the Court of Justice of the European Union for a preliminary ruling. The basic question is whether Dutch mobile surveillance contravenes the prohibition of border checks or their equivalent laid down in the Schengen Borders Code.

The Schengen Borders Code specifies that the abolition of border controls does not affect the use of police powers under national law, as long as they do not have an effect equivalent to border checks. This is valid in particular, but not only, if these police checks do not have border control as an objective – they are based on general police information and experience – and if they are carried out in a manner clearly distinct from border checks and on the basis of spot-checks.

In both of the cases referred to the Court of Justice, the Commission’s view is that the Dutch mobile surveillance has neither the same purpose nor the same modalities as a border check. The surveillance is targeted on the fight against illegal residence and is subject to limitations, for example on the frequency of checks.

The legal analysis conducted by the Commission led to the conclusion that the Dutch mobile surveillance does not contravene the Schengen Borders Code or the case law from the Melki case. We await of course the Court of Justice ruling in this matter.

On a broader note, as I have said repeatedly, the Commission will make use of our prerogatives to keep defending the rights of citizens to travel within the Schengen area without controls. That commitment is also reflected in our proposal for a new Schengen monitoring and evaluation mechanism which included the verification of absence of controls at internal borders.

I still believe that a truly effective mechanism implies a stronger role for the Commission based on Article 77 of the Treaty on the Functioning of the European Union. I am also convinced that the political legitimacy of that proposal would benefit from the European Parliament acting as co-legislator.

From the Commission’s side we naturally reserve the right to take whatever legal action we may deem necessary to safeguard the integrity of the roles that the Treaties have defined for each of the Union’s institutions, but at this moment let us not speculate on legal action.

No final decision has been taken so let us take some time for reflection and discussion and seize the opportunity to sit down to see if we can improve the text during the Cyprus Presidency and make sure that we have a balanced, good Schengen governance that all three institutions can support. The Commission is certainly willing to do everything it can to support such an outcome.

  Manfred Weber, im Namen der PPE-Fraktion. – Herr Präsident, sehr verehrte Kommissarin, Herr Minister, liebe Kolleginnen und Kollegen! Die Schengendiskussion hat in den letzten Wochen für viele Schlagzeilen in Europa gesorgt. Deswegen ist es gut, dass wir im Europäischen Parlament heute über diesen Sachverhalt diskutieren. Ich möchte der Kommissarin zunächst die Unterstützung der EVP-Fraktion signalisieren, wenn es um die Prüfung von ganz konkreten Detailvorwürfen in der Europäischen Union geht, wenn es zu Vergehen an den europäischen Innengrenzen kommt, sollten sie ordentlich von der Kommission geprüft werden, weil wir eine starke europäische Autorität als EVP wünschen, die zukünftig den Schengenstatus überwacht.

Damit sind wir auch bei der eigentlichen Diskussion, die uns ja alle umtreibt. Der Ministerrat hat mit seiner Entscheidung zu den Schengenregeln eine Wirkung erzielt, über die er sich selbst wohl nicht im Klaren war. Denn der Rat hat nicht nur inhaltlich einen Weg eingeschlagen, den wir für bedenklich halten, er hat durch die Wahl einer neuen Rechtsgrundlage auch den Weg der Zusammenarbeit mit den Abgeordneten verlassen. Und der Rat hat seine Hand an eine der wichtigsten Errungenschaften Europas gelegt, nämlich die offenen Grenzen.

Schengen bedeutet für uns Freiheit statt Grenzen, Zusammenarbeit statt Egoismus, Miteinander statt Gegeneinander! Die Reisefreiheit in Europa hat für die Europäische Volkspartei oberste Priorität. Die Menschen, die Wirtschaft, ja ganz Europa profitiert von ihr. Wir wollen, dass die offenen Grenzen als sichtbares Merkmal europäischer Zusammenarbeit nicht unverhältnismäßig eingeschränkt werden, gerade in Zeiten, in denen wir mehr europäischen Geist brauchen.

Wir als EVP wollen, dass die Mitgliedstaaten nicht länger untereinander auskungeln, wie mit wesentlichen Rechten der Bürger umgegangen werden soll. Diese Methode ist gescheitert, die Gemeinschaftsmethode muss im Mittelpunkt stehen.

Wir als EVP wollen, dass die Entscheidungen aus den Hinterzimmern der Diplomatie herauskommen, dass die gewählten Organe, in denen die Bürgerinnen und Bürger vertreten sind, über diese neuen Rechtsgrundlagen entscheiden.

Die EVP wird dafür kämpfen, dass die Rechte in Europa gewahrt bleiben. Inhaltlich sehen wir keine unüberbrückbaren Hindernisse. Es geht um die Fragestellung, ob wir auch im Verfahren miteinander einen Weg finden. So, sehr geehrter Herr Minister, das muss ich Ihnen sagen, geht man in einer Familie nicht miteinander um! Das zerstört den Geist der europäischen Zusammenarbeit! Deswegen bitten wir den Rat, auf den Weg der Kooperation zurückzukehren, und – so wie Sie es heute gesagt haben – ein intensiver Kontakt ist dem Europäischen Parlament zu wenig. Wir sind Gesetzgeber, wir sind an der Entscheidung beteiligt, und deswegen bitte ich Sie: Ziehen Sie die Rechtsgrundlagenentscheidung zurück und beteiligen Sie das Parlament als gleichberechtigten Gesetzgeber!

  Sylvie Guillaume, au nom du groupe S&D. – Monsieur le Président, Mesdames et Messieurs, je me félicite de ce débat que nous continuons de nourrir aujourd'hui autour de la nouvelle gouvernance Schengen prise au sens large des propos. Il nous permet de réitérer nos préoccupations sur la préservation de ce formidable acquis communautaire que constitue la libre circulation des personnes.

Les cas d'infractions aux règles du code Schengen, évoqués à demi-mot par la Commission dans son premier bulletin de santé de Schengen, nous invitent, Madame la Commissaire, à vous demander de faire toute la clarté sur ces affaires, et vous l'avez indiqué dans votre propos initial.

Nous appelons d'abord les États à plus de transparence, une transparence qui doit faire partie d'un dispositif qui renforce la confiance mutuelle entre les États membres, et leur capacité à appliquer de manière efficace toutes les dispositions de Schengen. Mais nous devons aussi pouvoir compter sur une Commission européenne courageuse qui n'hésite pas à user de ses pouvoirs, en tant que gardienne des traités, pour s'assurer de la bonne application du droit communautaire, qui plus est lorsqu'on touche à ce droit fondamental – j'y reviens – qu'est la liberté de circulation de nos concitoyens.

Plus que jamais, les exemples évoqués – qu'il s'agisse de l'Allemagne ou des Pays-Bas, mais on pourrait rappeler des cas plus anciens comme l'Italie et la France, à la frontière de Vintimille – sont autant d'arguments invitant à plaider davantage pour la mise en place d'un mécanisme européen d'évaluation de Schengen, de nature communautaire et dans lequel le Parlement aurait tout son rôle à jouer.

La nouvelle présidence chypriote aura la lourde tâche de tenter de trouver une issue positive au conflit qui nous oppose sur ce dossier. D'ailleurs, je vous avoue, Monsieur, ne pas avoir tout à fait reconnu dans vos propos ni le déroulé, ni les résultats de nos discussions antérieures, mais sans doute est-ce une mauvaise compréhension de ma part.

Je rappelle que le système qui était appliqué dans certains domaines était un système intergouvernemental. Il n'est plus adapté à l'Union européenne telle qu'elle se construit aujourd'hui et ce, d'autant plus, si l'on souhaite pérenniser l'adhésion des peuples européens à ce projet qui nous rassemble.

Faute d'évaluation partagée des situations aux frontières, il y a fort à parier que les mêmes logiques politiciennes teintées de dérives populistes, resteront encore d'application, ce qui est tout simplement délétère pour notre démocratie européenne.

J'en termine en réaffirmant que seule la solidarité européenne et une approche communautaire nous permettraient de mieux répondre au défi posé par la fragilité structurelle de certaines frontières, fragilité qui, à l'évidence, nous inquiète tous.

  Renate Weber, on behalf of the ALDE Group. – Mr President, we have heard again and again from the Council, from the Member States, but also from you, Commissioner, that the implementation of the Schengen Agreement has been very good, almost perfect. Allow me please to at least partially disagree.

It is true that for several years no one has challenged how Member States implement the Schengen rules. Border controls have been reintroduced for limited periods of time, but no one complained. However, in the last 18 months there have been way too many attempts to apply Schengen rules in a much more personalised and dangerous manner. The joy of the Arab Spring was over-shadowed by Italy’s reaction and France’s decision to reintroduce border control.

Denmark considered that its domestic political problems could be solved by reintroducing border control as an alleged way of combating trans-border crime. For more than one year – one year – the Netherlands has had an initiative which was considered by a Dutch court as having the same effects as border controls. For several months another attempt to curtail free movement has taken place in Germany, where on a systematic basis more than 55% of Czech buses are checked. I cannot help wondering how long the Commission will keep pretending that things are OK within the Schengen governance. They are not. This is why the Commission in fact came up with a legislative package to improve it.

If the Commission continues with only half-measures, never daring to start infringement procedures, I am afraid we will wake up one morning realising that free movement no longer exists.

I am addressing you, Commissioner, because I have full confidence in your commitment to the defence of free movement. I am not addressing the Council at this stage, waiting for a better time to enlighten the Member States and make them understand what the real interests of European citizens are.

  Judith Sargentini, namens de Verts/ALE-Fractie. – Twijfelen onze nationale leiders aan het nut van vrij reizen? Zien zij niet meer welke vrijheid dat de Europeanen biedt? Zien zij ook niet meer wat de economische voordelen zijn van vrij reizen? Twijfelen onze premiers aan hun collega-premiers? Twijfelen zij aan de bereidheid van andere lidstaten om onze buitengrenzen goed te controleren en te beschermen? Het lijkt er sterk op.

Die twijfel, ja zelfs dat wantrouwen, van lidstaten onder elkaar is volgens mij symptomatisch van wat er aan de hand is in de Europese Unie. Samen staan wij sterk. Samen komen wij uit de crisis. Onze premiers stralen niet uit dat zij op samenwerken vertrouwen. Dat onderlinge wantrouwen tussen lidstaten maakt dat het Europees Parlement zegt: de controle op en de uitvoering van het vrij reizen hoort bij de Europese Commissie te liggen, want die heeft het Europees belang op het oog.

Dat vrij reizen is volgens mij een van de grootste goeden van de Europese Unie. Het verbaast mij dan ook te horen dat de Europese Commissie bij monde van mevrouw Malmström nu zegt dat het zogenaamd mobiel vreemdelingentoezicht van de Nederlandse regering mag. Ik zou zeggen: als het kwaakt als een eend en het ziet eruit als een eend, dan ís het een eend. Als u het nu toelaat, terwijl verschillende Nederlandse gerechtshoven het al hebben teruggefloten, dan ben ik ervan overtuigd dat dat binnenkort ook door het Hof in Luxemburg gebeurt.

  Timothy Kirkhope, on behalf of the ECR Group. – Mr President, once again we find ourselves debating the Schengen system and its implementation – in this case by Germany and the Netherlands, but it is becoming increasingly impossible to have a discussion on Schengen separated from a discussion on the security of borders generally. The Schengen area is not just an area administered by the EU, it is the territories and borders of individual Member States, and yet Article 4(2) of the Treaty on European Union states that national security remains the sole responsibility of each Member State.

Increasingly this House wants Member States to have less control over their borders, and concerns about this are not reactionary or short-term but a belief by states that they themselves are best placed to deal with the unique security situation that they face. Instead this debate has so far been dominated by a rather petty squabbling with other institutions. Perhaps the European Council and Member States would feel less urgency to regain powers if this Parliament acted more responsibly and understood the security pressures which we all face.

In the fight against cross-border crime we need to join together to do that, but we should not be allowing ourselves to be held to ransom on topics such as my own EU PNR proposals, which were removed from our agenda at an important moment. It is important that we should conduct our business in future in a different, more considered and balanced way.

  Cornelia Ernst, im Namen der GUE/NGL-Fraktion. – Herr Präsident! Wir sollten heute wirklich Klartext sprechen, und zu dem Klartext gehört: Wir können die Uhr nicht mehr zurückdrehen und wir wollen sie auch nicht zurückdrehen. Uns steht als Parlament das vertragliche Recht zu, in allen Fragen, die Schengen betreffen, mitzuentscheiden und nicht nur fröhlich konsultiert zu werden. Das will ich erst mal klarstellen.

Ich will auch sagen, dass dieses Gemeinschaftsrecht der Willkür politischer Freibeuter – und so will ich das bezeichnen – nicht einfach überlassen werden darf. Politisch motivierte Verletzung – auch so will ich das ausdrücken –, das Schengen-Abkommen gewissermaßen als Muskelspiel in Wahlkämpfen, ist völlig inakzeptabel und hat auch mit EU-Recht nichts zu tun. Zu diesen Problemen gehören ja nicht nur willkürliche Grenzschließungen, wie wir sie zeitweilig hatten, die natürlich gegen EU-Recht verstoßen. Dazu gehört auch die Installation von Kameras an 15 Grenzübergängen zwischen Deutschland und den Niederlanden und Belgien: Das sind auch Grenzkontrollen, was denn sonst? Und das ganze Gefasel eines deutschen Innenministers über die Wiedereinführung von Grenzkontrollen ist natürlich gefährlich, ist gefährlich nicht nur wegen der Schengen-Problematik, sondern auch, weil das die Argumente der extremen Rechten sind, nicht nur in Deutschland. Ebenso inakzeptabel ist es, dass an der deutsch-tschechischen Grenze, wo ich übrigens wohne, ständig Busse kontrolliert werden. Das ist doch nicht auszuhalten! Es werden nicht nur Busse aus Tschechien kontrolliert, sondern auch Personen, die irgendwie anders aussehen, z. B. ein bisschen dunkelhäutig sind. Auch das gehört dazu.

Sagen wir es klar: Nein, das geht so nicht! Nein, das wollen wir nicht, weil das das Recht bricht und weil wir das auch politisch als Parlament nicht wollen. Deswegen kritisieren wir auch das Vorgehen des Rats in aller Schärfe. Denn das ist nicht nur Rechtsbruch, sondern auch undemokratisch. Deshalb schlage ich dem Rat vor, vier Dinge mit uns zu bereden:

Erstens: Wir sollten uns einig sein: In der Frage der Handhabung des Schengen-Abkommens darf es keine Willkür geben. Darüber möchte ich diskutieren. Zweitens: Wir wollen eine Stärkung der Freizügigkeit! Darüber wollen wir reden. Drittens: Wir wollen, dass bei Verletzungen des Schengen-Abkommens die Kommission unter Einschluss des Rats Konsequenzen zieht. Und als letztes wollen wir als Parlament vollständig in alle Belange einbezogen werden, und zwar mitentscheidend.

  Mara Bizzotto, a nome del gruppo EFD. – Signor Presidente, onorevoli colleghi, il 7 giugno, con la decisione del Consiglio di restituire agli Stati membri la possibilità di ripristinare i controlli alle frontiere è nata una nuova Europa, un'Europa coraggiosa nell'esaudire il desiderio di maggiore sicurezza dei suoi cittadini, ispirata finalmente da una più matura interpretazione del concetto di solidarietà, ricondotto alla difesa dei diritti prima di tutto dei suoi popoli.

Al Presidente Schulz, anche se non è presente, dico che questa storica decisione non rappresenta un incidente interistituzionale, ma il rispetto della volontà dei cittadini e non di quella euroburocrazia che da anni finge di non capire quello che succede veramente fuori dal palazzo di vetro. Nessun afflusso immaginario di clandestini, signor Presidente Schulz, ma un aumento degli immigrati illegali misurato da Frontex del 35% nel 2011.

Mi rammarico soltanto che le scene di isterismo politico consumata in quest'Aula la scorsa plenaria abbiano rubato tempo a un'attività più utile e costruttiva, interrogarci sul perché a difendere gli interessi dei nostri cittadini non siamo stati noi ma gli Stati membri. Se il Parlamento non troverà una sua anima e il coraggio di andare contro il buonismo e le sterili ovvietà sulle quali si barcamena da troppo tempo, continuerà ad essere gregario, e non leader nella costruzione del progetto europeo.

  Auke Zijlstra (NI). - Dat er problemen zijn als gevolg van Schengen kan hier niet vaak genoeg gezegd worden. Immers, de Eurofielen in dit Parlement zijn ziende blind en horende doof en zij willen het niet begrijpen. Schengen is de oorzaak van de massale verplaatsing van criminaliteit en overlast. Nu de lidstaten eindelijk erkennen dat deze problemen aangepakt moeten worden, verzet dit Parlement zich tegen de oplossing. Maar de grenscontroles moeten hersteld worden en de lidstaten moeten voor veiligheid zorgen.

Die grenscontroles verdwenen door naïef idealisme. Dit idealisme zorgt niet voor de gehoopte toenadering binnen Europa, maar juist voor verwijdering. Het is een splijtzwam. De keuzes die Brussel maakt, bieden geen oplossingen. Brussel kiest voor het mislukte euro-experiment en daarmee tegen de burger. Brussel kiest voor stijgende budgetten en daarmee tegen de belastingbetaler. En met Schengen kiest Brussel voor vrij verkeer van criminelen en tegen veiligheid.

Voorzitter, het Europees Parlement steunt deze verkeerde keuzes. Daarom spreek ik via de Raadsvertegenwoordiger nu de heer Van Rompuy als president van de Europese Raad aan. Hij houdt niet van vrijheid, hij houdt niet van inspraak en niet van nationale democratie, maar wel van centralisme, regelzucht en Japanse gedichten. Daarom speciaal voor hem nu een haiku.

Schengen. Reizende misdaad. De grens is overschreden. Brusselse winter.

  Carlos Coelho (PPE). - Caros Colegas, ouvindo as intervenções, com exceção de duas da extrema-direita, parece que estamos todos de acordo. Todos concordamos que a liberdade de circulação é uma das principais conquistas da União Europeia. Todos concordamos que é necessário reforçá-la. Todos consideramos que um espaço sem controlos nas fronteiras é essencial ao mercado interno e que há benefícios que daí advêm para os Estados-Membros e para os cidadãos. Todos concordamos com a necessidade de reforçar a governança de Schengen e todos concordamos até que o atual sistema de avaliação de Schengen é inadequado e que precisamos de um sistema que garanta uma aplicação transparente, eficaz e coerente de Schengen.

Então por que é que temos a necessidade de trazer aqui casos concretos? E a Comissária Malmström disse que, além daqueles que o Parlamento evocou na pergunta oral, está neste momento a investigar cerca de 11 casos diferentes. São 11 casos que provam que há violações sistemáticas da livre circulação de Schengen. São 11 casos que provam que as instituições europeias não foram capazes de os para. São 11 casos que provam que o atual sistema de avaliação de Schengen não está a ser eficaz e esta é a questão essencial.

O Presidente do Conselho disse que foram apenas razões jurídicas. Não é verdade! Começa mal a Presidência cipriota a tentar sustentar essa tese perante o Parlamento Europeu, são razões políticas, o Conselho quer continuar a cobrir a violação do Acordo de Schengen que é o que tem sistematicamente feito com o seu sistema de avaliação peer-to-peer. Nós precisamos de um verdadeiro sistema de avaliação, um sistema comunitário capitaneado pela Comissão Europeia e sujeito à votação por co-decisão entre o Conselho e o Parlamento. É assim que, na nossa opinião, defendemos Schengen, defendemos a livre circulação, defendemos essa que é uma das maiores garantias e um dos maiores sucessos da construção europeia.

  Ioan Enciu (S&D). - Dezbaterile din ultima vreme asupra Acordului Schengen s-au concentrat prea mult pe războiul interinstituţional dintre Consiliu şi Parlament, şi prea puţin pe adevărata substanţă a problemei. De aceea, cred că această dezbatere este un bun prilej de a reveni la argumente care justifică reforma profundă a spaţiului Schengen.

Din păcate, trebuie să spun că există probleme importante în sistemul Schengen actual, în principal din cauza unei tendinţe generale de re-naţionalizare a spaţiului Schengen. Această tendinţă s-a manifestat în anii trecuţi, prin deja cunoscutele cazuri de reintroducere abuzivă a controalelor la frontierele interne. Dar ceea ce este mai puţin cunoscut şi mediatizat sunt controalele mascate la frontierele interne, care sunt prezente în nu mai puţin de 11 state membre, aşa cum Comisia a arătat în raportul său bianual din luna mai, lucru confirmat şi de doamna Comisar responsabilă pentru spaţiul Schengen şi de către colegul Coelho, aici de faţă. Refuzul admiterii României şi Bulgariei este un alt exemplu al interpretării greşite a regulilor Schengen. Sper că în toamna acestui an admiterea României şi a Bulgariei va reprezenta primul pas către normalizarea situaţiei în privinţa respectării acestor reguli.

În România, chiar în momentul de faţă, parlamentul naţional şi guvernul Ponta fac eforturi pentru introducerea statului de drept şi eliminarea dictaturii prezidenţiale care s-a impus în ultimii ani. Astfel, România este pe cale să se întoarcă la normalitate, după o lungă perioadă de abuzuri şi încălcări ale democraţiei, fapt care va garanta că problemele de administraţie şi justiţie care au întârziat admiterea în spaţiul Schengen a României vor dispărea şi nu se vor mai repeta niciodată.

Uniunea Europeană are nevoie urgentă de reformarea guvernanţei Schengen, de implicarea Parlamentului European, iar Comisia trebuie să preia rolul de arbitru imparţial, atât în evaluarea aplicării acquis-ului Schengen, cât şi în măsurile de remediere a problemelor apărute, eventual.

  Sarah Ludford (ALDE). - Mr President, I would say to my domestic coalition partner, Mr Kirkhope, if he were here, that internal border controls do not play a major role in catching major criminals, or even terrorists, and nor would PNR collection on internal EU flights do that. What is needed for that purpose is not populist moves designed to impress voters that irregular migration is being curbed, but strongly cooperative intelligence-led policing.

In addition we do need better managed external borders. I speak, of course, as a Brit who does not enjoy free movement travelling between London and Brussels or Strasbourg. Indeed, on a Brussels–London Eurostar journey I have my passport checked three times at present and my ticket twice. I acknowledge there is an issue on that route because people can buy a ticket to Lille but continue to London, but please be grateful that most of you do not have to endure these checks in Schengen and please preserve internal free movement so that even we Brits can join one day.

  Jan Zahradil (ECR). - Pane předsedající, já každému členskému státu rád přiznám právo kontrolovat v oprávněných případech svoje vnější hranice z bezpečnostních důvodů. Já to respektuji, ale musí to být prováděno v odůvodněných případech a musí to být prováděno nikoliv z důvodu šikany.

Jestliže na česko-německých hranicích je každý druhý autobus přijíždějící z České republiky kontrolován, tak to prostě normální není. To odůvodněné není, protože Česká republika nepředstavuje pro Německo žádné bezpečnostní riziko, nepředstavuje žádné riziko ani z hlediska nelegální migrace a jestliže jsou kontrolovány normální turistické autobusy, tak to už se zcela vymyká mému chápaní. Já jezdím do Štrasburku z Prahy autem a vím dobře, že hned za Rozvadovem, za česko-německou hranicí, číhá německá, respektive bavorská, policie a chytá cíleně auta s cizími poznávacími značkami.

Já si myslím, že je to jakási byrokratická procedura, že si možná někdo dělá čárky někde na nějakém úřadě, kolik těch kontrol udělal, ale že to musí skončit. Tady musí mít rozhodující slovo Smlouvy, evropské právo musí být dodrženo tak jako v jiných případech.

  Ewald Stadler (NI). - Herr Präsident! Die Schengenregeln sind von den EU-Apologeten in den vergangenen Jahren ja gerade zu einem zentralen Dogma dieser neuen säkularen EU-Ersatzreligion gemacht worden. Nun sehen sie, dass wieder ein Dogma zusammenbricht. Minister, die noch vor zwei Jahren über Dänemark hergefallen sind, müssen heute kleinlaut zugeben, dass sie ohne zusätzliche Grenzkontrollen nicht mehr auskommen, insbesondere im Zusammenhang mit den illegalen Migrationsbewegungen an der türkisch-griechischen Grenze.

Daher begrüße ich die Beschlüsse, die die Innenminister gefasst haben. Und ich appelliere an sie, nichts zurückzunehmen, sondern darüber nachzudenken, ob sie nicht weitere Verschärfungen benötigen werden, wenn sich die wirtschaftlichen Krisensituationen weiter verschärfen, wie sich das derzeit abzeichnet. Und all jenen, die heute ignorant über die Probleme von Verbrechensopfern hinweggehen, möchte ich sagen, dass das zynisch ist im Umgang mit diesen geschädigten Bürgern.

Und einen Appell zum Schluss: Ich appelliere an Sie, keine Visaerleichterungen für die Türkei einzuführen, weil das gerade jetzt das falsche Signal an die Türkei ist! Gerade jetzt sollten wir der Türkei klarmachen, dass sie verpflichtet ist, dafür zu sorgen, dass es nicht zu massiver illegaler Einwanderung in den Schengenraum kommt!

  Ewald Stadler (NI), Antwort auf eine Frage nach dem Verfahren der blauen Karte. – Frau Kollegin, ich weiß nicht, ob Ihnen schon aufgefallen ist, dass es zwischen der Türkei und Griechenland eine Grenze gibt und dass diese Grenze seit mehreren Monaten verstärkt für illegale Migration verwendet wird, und dass dann in weiterer Folge mehrere Migrationsbewegungen von Griechenland in die Europäische Union stattfinden und dass nicht alle, die kommen, tatsächlich Flüchtlinge sind, sondern viele sogar eine kriminelle Energie mitbringen. Ob Ihnen das schon aufgefallen ist, weiß ich nicht. Vielen Bürgern, die Opfer von Kriminalität wurden, ist das aufgefallen.

  Tanja Fajon (S&D). - V Sloveniji smo prebirali naslove, ali bomo spet potovali s potnimi listi. Ljudi skrbi, ali bomo izgubili svobodo gibanja. Kriza je močno načela zaupanje naših državljanov.

Desetletja smo se trudili, da je Unija postala prostor svobode gibanja. Odločitev vlad, da iz odločanja o začasni uvedbi nadzora v schengenskem prostoru izločijo Parlament, je nesprejemljiva, ne glede na vse razlage. Kakršno koli spreminjanje evropskih meja zahteva evropsko odločanje. O tem ne more odločati peščica v dvoranah brez demokratičnega nadzora.

Kako bomo preprečili, da ne bodo vlade klonile desničarskemu populizmu? Imamo že slabe izkušnje.

Vsako leto nas več kot milijarda potuje po Uniji kot turisti. Obiskujemo prijatelje ali svojce in zato ne rabimo potnih listov. Schengen je simbol Evrope in pričakujem, da bo Komisija strogo preverjala schengenske kršitve, predsedujoči Ciper pa da bo razumel občutljivost te schengenske razprave. Smo na zelo nevarnem razpotju: na kocki je resnično zaupanje naših državljanov.

  Sophia in 't Veld (ALDE). - Ik zou eens willen reageren in de richting van mijn PVV-collega die een beetje neerbuigend zei: "Ja, dat Schengen is een beetje bedacht door idealisten". Mijn grootvader zaliger had een eenmanszaakje voor de import van kantoorartikelen en reisde elke twee weken vanuit Nederland naar Brussel en Parijs, aanvankelijk op de fiets, om zijn producten te halen. En ik vond onlangs zijn oude paspoorten die getuigen van hoe Europa eruitzag vóór Schengen. Vol met stempels, getuigen van lange wachttijden, de plicht om deviezen aan te geven, geld om te wisselen. Hij zou Schengen omarmd hebben, want het zou zijn leven zoveel makkelijker gemaakt hebben. Over idealisme gesproken.

De Europese Commissie, commissaris, moet toezien op de naleving van de Schengencode, niet alleen maar naar de letter, maar ook naar de geest. En als er elf problematische situaties in Europa zijn, dan is het duidelijk dat Schengen onder druk staat in de geest. Het is de kern van het Europese project. En als u zegt dat de situatie in Nederland niet problematisch is, dan ben ik toch verbaasd. Want het bestrijden van criminaliteit doen wij niet alleen maar in de grensstreek, mevrouw Malmström, maar dat doen wij overal in Nederland. Dus om aan te sluiten bij mijn collega van GroenLinks: als het eruitziet als grenscontroles, dan zíjn het waarschijnlijk grenscontroles.

  Marian-Jean Marinescu (PPE). - Decizia Consiliului din 8 iunie de a schimba baza legală a Regulamentului privind evaluarea spaţiului Schengen poate avea consecinţe nefaste asupra funcţionării spaţiului Schengen. Dacă dorim într-adevăr să avem un grad mai ridicat de transparenţă şi de responsabilitate democratică şi judiciară în modul în care regulile Schengen sunt implementate şi aplicate de către statele membre, atunci trebuie să revenim la tratatul de bază şi să se redemareze discuţia cu Parlamentul European. În plus, este greu de acceptat că state membre care au slăbiciuni la frontierele lor externe refuză o evaluare coordonată a mecanismului Schengen şi, în acelaşi timp, blochează accesul în zona Schengen al unor state care, în urma eforturilor depuse, au reuşit să atingă un nivel extrem de ridicat al securizării frontierelor externe.

Prin refuzul codeciziei referitor la dosarul Schengen, Consiliul intenţionează să menţină un sistem de evaluare Schengen care s-a dovedit a fi, în prezent, ineficient pentru identificarea nerespectării normelor Schengen. Aceasta înseamnă că Uniunea preferă să tolereze situaţii de control ilegal la frontierele interne sau neregularităţi la frontierele externe. Anumite state membre consideră că prin introducerea de frontiere interne vor contribui la siguranţa cetăţenilor şi la controlul influxului migrator. Din păcate este o pistă falsă. Uniunea trebuie să se concentreze pe consolidarea guvernanţei Schengen şi pe armonizarea nivelului de securizare a frontierelor externe a tuturor statelor membre.

Parlamentul European doreşte să evite o scădere a standardelor existente privind frontierele externe şi prevăzute de legislaţia europeană. O revizuire a actualelor reguli Schengen, care să conducă la o uniformizare a standardelor frontierelor externe, este necesară şi aceasta trebuie să fie legiferată şi de Parlamentul European în calitate de co-legislator.

In aller Deutlichkeit eines vorab: Die Personenfreizügigkeit in der Union ist kein nationales Recht und kann daher auch nicht allein national eingeschränkt werden. Ob Veränderungen im Schengenraum oder Verstöße gegen Schengenregeln – als einzige direkt gewählte europäische Institution muss das Europäische Parlament in allen Fragen voll beteiligt sein und mitentscheiden!

Der Hinweis auf schwerwiegende Mängel an den Außengrenzen ist bedenklich und sachlich falsch. Denn es geht nicht allein um die Kontrolle an den Grenzen, sondern um die Überforderung mancher Staaten, den Rechtsstatus jedes einzelnen Flüchtlings zeitnah zu klären und damit auch für die Flüchtlinge eine klare Perspektive zu schaffen. Diese Herausforderungen müssen wir gemeinsam als Europäer bewältigen, anstatt mit blankem Populismus die Bürger zu verunsichern. Dieses gemeinsame Handeln wäre effektiv für unsere Staaten, für unsere Bürger und auch für die Flüchtlinge. Wir brauchen nicht den Rückschritt in die Kleinstaaterei, sondern wir brauchen mehr Europa!

  Zuzana Roithová (PPE). - Pane předsedající, podali jsme další otázku Evropské komisi, protože v oblasti Schengenu a víz neplní v posledních letech svou roli strážkyně zakládajících Smluv dostatečně.

Je zarážející, že léta toleruje systematické a časté kontroly uvnitř Schengenu, kde více než polovina českých autobusů je kontrolována bavorskou policií, aniž bychom věděli proč. Týká se to také i nás poslanců, kteří jsme kontrolováni při jízdě do Štrasburku. Přes veškerá upozornění, včetně mých interpelací, jsme se nedočkali razantní reakce ze strany Evropské komise. Před rokem nizozemský ústavní soud podobné kontroly označil za porušení unijního práva. Proč Evropská komise mlčí? Proč nezahájila šetření proti zemím porušující komunitární právo?

Druhým problémem je nefunkčnost externí dimenze Schengenu, společné vízové politiky. Řada členských států dnes čelí jednostranné vízové povinnosti ze strany třetích zemí a samy nemohou zavést reciprocitu, jelikož výlučné kompetence v této oblasti drží Komise, které je opět nečinná. Jednostranné uvalení kanadských víz pro české občany právě teď slaví smutné třetí výročí, protože Komise nebojuje za práva svých občanů. Naopak, Komise nyní bojuje proti plnoprávnému zapojení Evropského parlamentu do nařízení o vízech udělených třetími zeměmi a do dalších norem. To vše podrývá důvěru občanů v evropské instituce, které nechrání jednu ze čtyř klíčových svobod Evropské unie, svobodu pohybu.

S plnou vážností musím konstatovat, že za dnešní problémy v této oblasti plně odpovídá Evropská komise, a také vy, paní komisařko. Pověstně sklízíte, co jste sama zasela. Zasela jste sémě, které vás nepálí, ačkoliv je nestravitelné pro desítky milionů evropských občanů.

  Carmen Romero López (S&D). - Señor Presidente, pese a lo que hemos oído aquí a algunos, la movilidad interior ha sido nuestra gran conquista. Ahora se quiere presentar el control de las fronteras exteriores como una gran derrota. Interesa presentarlo como una gran derrota. El populismo que invade nuestros países contra los extranjeros se extiende ahora contra nuestros propios ciudadanos.

Antes eran delincuentes o inmigrantes aprovechados que venían a Europa queriendo robarnos el fruto de nuestro trabajo, o solicitantes de asilo que eran estafadores porque abusaban de nuestro sistema de asilo o, en realidad, eran traficantes de personas disfrazados de solicitantes de asilo. Ahora este efecto de llamada, este efecto de contagio del populismo que nos invade está ya en nuestras fronteras interiores.

Unos para otros somos aprovechados o estafadores. Ahora serán los griegos en Inglaterra. O formamos parte de las mafias organizadas cuando se detienen nuestros autobuses en fronteras que no existen y se suben policías de aduanas que no existen para ver si comerciamos con ilícitos o traficamos con personas. Todo se contagia. El cáncer que vivimos, la auténtica derrota en los diecisiete años de aplicación del Convenio de Schengen es el populismo de los partidos que gobiernan en los Estados miembros y la cobardía de los que no defienden los textos fundadores.

No podemos estar tranquilos, señora Malmström. ¿Cómo vamos a estar tranquilos? La movilidad interior no es una amenaza, es nuestra oportunidad y la movilidad con los países de nuestra vecindad será nuestra solución. ¿Hay que ordenar esta solución? Sí. ¿Lo hará el populismo? No. ¿Está el problema en la movilidad, en el deseo de aventura? Afortunadamente, no. ¿Está el problema en los que huyen de las guerras? No. Nuestra auténtica derrota está ahí cuando no hacemos frente al populismo y no ponemos soluciones.

  Γεώργιος Παπανικολάου (PPE). - Κύριε Πρόεδρε, και στο ζήτημα του χώρου Σένγκεν επιδιδόμαστε το τελευταίο διάστημα σε μια ατέρμονη ανταλλαγή ευθυνών. Κάποιες φορές λέμε ότι φταίει το κράτος που ζητάει να επιβάλει εσωτερικούς συνοριακούς ελέγχους ενώ άλλοτε ότι φταίει κάποιο άλλο κράτος όταν στα εξωτερικά σύνορα του κράτους αυτού, που είναι και εξωτερικά σύνορα της Ένωσης, δεν υπάρχει επαρκής και ασφαλής φύλαξη των συνόρων όπως προβλέπει ο χώρος Σένγκεν. Νομίζω ότι κάθε φορά που επιδιδόμαστε σε παρόμοιες κατηγορίες αποπροσανατολιζόμαστε. Όταν οι "πατέρες" της Ευρωπαϊκής Ένωσης ίδρυαν την Ένωσή μας ξεκίνησαν από μια βασική παραδοχή: φταίμε όλοι για αποτυχημένες πολιτικές. Έλεγαν ότι φταίμε όλοι μαζί, και κατέληγαν σε μια κοινή διαπίστωση. Μόνο όλοι μαζί και αλληλέγγυα μπορούμε να λύνουμε όποιο πρόβλημα παρουσιάζεται γιατί, ακριβώς, αλληλεγγύη σημαίνει ότι από κοινού αναλαμβάνουμε μια ευθύνη. Δεν σημαίνει μόνο τη συνδρομή σε κάποιον που ενδεχομένως έχει μια αδυναμία, είναι από κοινού ανάληψη ευθύνης.

Σε αυτό το πλαίσιο, λοιπόν, αντιλαμβάνεστε ότι είναι πολύ δύσκολο για όλους εμάς, αλλά και για τους πολίτες που μας παρακολουθούν, να αντιληφθούμε αυτό που συνέβη πέρυσι μεταξύ Γαλλίας και Ιταλίας ή αυτό που συμβαίνει με τους ελέγχους στα σύνορα της Γερμανίας για τα τσεχικά λεωφορεία ή στα σύνορα της Ολλανδίας με αντίστοιχες καταστάσεις. Επομένως, πώς μπορούμε να υιοθετούμε απόψεις για την Ελλάδα ότι δεν πράττει ότι αρμόζει στα εξωτερικά της σύνορα, όταν η ίδια η FRONTEX συνομολογεί ότι η χώρα αυτή από μόνη της, χωρίς τη συνδρομή των εταίρων της και χωρίς τη συνδρομή της Τουρκίας, δεν μπορεί να προχωρήσει σε ασφαλή φύλαξη των συνόρων;

Κλείνω, και παρακαλώ πολύ να δώσουμε έμφαση σε αυτό, κυρία Επίτροπε, απευθυνόμενος και σε εσάς, διότι περιμένουμε πολλά από την Επιτροπή. Τα κράτη μέλη την περίοδο αυτή, στο πλαίσιο μιας φοβικής προσέγγισης, μίλησα σχετικά με διάφορους εκπροσώπους τους, τοποθετούνται για το θέμα της αξιολόγησης και των αλλαγών που έχουμε στους κανονισμούς με την προσέγγιση ότι καλύτερα να τα χειριζόμαστε εμείς τα θέματα αυτά και να μην είμαστε περισσότεροι. Όχι, θέλουμε την κοινοτική μέθοδο, θέλουμε να έχουμε αυξημένο επίπεδο λειτουργίας του Σένγκεν, θέλουμε οι μελλοντικές γενιές να ξέρουν ότι την περίοδο αυτή απαντήσαμε περισσότερο Ευρώπη και όχι λιγότερη Ευρώπη με οπισθοδρόμηση στο εν λόγω ζήτημα.

  Wim van de Camp (PPE). - Het beginsel van het vrije verkeer van personen, goederen, diensten en kapitaal is een van de bouwstenen van de Europese Unie. Via het Verdrag van Lissabon is het Verdrag van Schengen een kernelement geworden van de Europese Unie.

In een tijd van toenemend nationalisme en zelfs populisme, maar ook in een tijd van toenemende criminaliteit en illegaliteit moeten wij het Verdrag van Schengen heel zorgvuldig bewaken en een grote vinger aan de pols houden als het gaat om de interpretatie van dat verdrag.

Persoonlijk ben ik voorstander van een ruime interpretatie van de Schengen-grenscontrole - de commissaris weet dat - maar wél onder communautair toezicht. Dat hebben wij met elkaar afgesproken en dat is een kernelement van het Europees staatsrecht. In dat opzicht ben ik ook geschrokken van het besluit van de Europese Raad van 7 en 8 juni om dat communautaire toezicht, die communautaire methode, te verlaten, respectievelijk te beperken. En ik ben blij met de toezegging van de voorzitter van de Europese Raad dat hij dat wil herstellen. Maar wij zullen hem beoordelen op zijn daden. Het Parlement, en dat ben ik met alle mensen die vóór mij hebben gesproken eens, kan op dit punt niet buiten spel worden gezet.

  Judith Sargentini (Verts/ALE), "blauwe kaart"-vraag. – Ik heb hier een brief van de Nederlandse Minister voor Vreemdelingenzaken, lid van de partij van mijnheer Van de Camp, van 3 juli 2012, die zegt dat hij per 1 augustus het mobiel vreemdelingentoezicht of het mobiel veiligheidstoezicht - ze veranderen nogal eens van naam - gaat intensiveren. Is dat de manier waarop mijnheer Van de Camp Schengen wijd zou willen interpreteren?

  Wim van de Camp (PPE), "blauwe kaart"-antwoord. – De commissaris heeft, mits ik het verkeerd begrepen heb, vanmiddag gezegd dat een eerste beoordeling van het mobiel vreemdelingentoezicht door de Europese Commissie niet in strijd is met het Verdrag van Schengen. Als dat mobiel vreemdelingentoezicht misbruikt zou worden om het vrije verkeer tussen Europese burgers te belemmeren, dan zijn wij op de verkeerde weg.

Maar als de Nederlandse minister zegt, juist vanwege die problematiek rond de illegaliteit, ik heb verantwoord mobiel vreemdelingentoezicht en ik weet ook dat er Nederlandse rechters zijn die daar moeite mee hebben, dan vind ik dat de Nederlandse minister door kan gaan, maar nogmaals, onder communautair toezicht.

  Hubert Pirker (PPE). - Herr Präsident, Frau Kommissarin, Herr Ratspräsident! Leider müssen wir zur Kenntnis nehmen, dass es zunehmend Verletzungen des Schengen-Vertrags gibt, und wir wissen auch, dass die Außengrenzen nicht überall nach gleich hohen Standards überwacht werden. Wir wissen, dass der Rat eindeutig will, dass er selbst entscheidet, ob Grenzkontrollen für bis zu zwei Jahre wieder eingeführt werden sollen oder nicht. Das ist so, als ob bei einem Fußballspiel die Spieler selbst entscheiden, ob jemand ein Foul gemacht hat und ein Strafstoß geschossen wird oder nicht. Die Mehrheit im Europäischen Parlament will, dass die große Errungenschaft, nämlich die Reisefreiheit ohne Grenzkontrollen, nicht in Gefahr gerät, und wir werden alles dazu beitragen, dass dies nicht passiert.

Was will das Europäische Parlament? Das Europäische Parlament ist selbstverständlich dafür, dass in Notsituationen für kurze Zeit eine Grenzüberwachung eingeführt wird. Wir verlangen auch, dass bei gravierenden Mängeln eine Entscheidung getroffen wird, ob und wie lange Grenzkontrollen eingeführt werden. Das muss aber auf europäischer Ebene nach einer objektiven Überprüfung durch die Kommission erfolgen, und selbstverständlich verlangen wir auch, dass es Evaluierungsmechanismen gibt – aber eben mit einer nachfolgenden Entscheidung auf europäischer Ebene. Das Europäische Parlament – und ich bin überzeugt, die Mehrheit der hier Anwesenden – wird sich vehement dafür einsetzen, dass Reisefreiheit und Sicherheit auf Dauer für die Bürger gewährleistet bleiben – das ist mit Schengen gewährleistet – und dass nicht durch Populismus motivierte Aktionen in Zukunft durchgesetzt werden, wie das etwa bei Dänemark passiert ist.

Ich appelliere zum Abschluss an den Rat, dass er alles unternimmt, damit die Innenminister wieder auf den Weg der Vernunft und der Kooperation zurückkehren.

  Salvatore Iacolino (PPE). - Signor Presidente, onorevoli colleghi, signora Commissario, nuova Presidenza cipriota, alla quale auguriamo un buon lavoro, già dall'intervento di oggi è emersa con grande chiarezza una distanza siderale fra le posizioni del Consiglio, che ritiene la questione di Schengen della quale oggi stiamo parlando una mera questione giuridica e invece la posizione chiara e coerente della Commissione, che suggerisce di tornare in fretta alla procedura di codecisione. In effetti lo scippo c'è stato da parte del Consiglio nelle giornate del 6 e il 7 giugno appena trascorse e confidiamo in un richiamo al senso di responsabilità comune in questo caso preciso da parte del Consiglio.

Schengen è un patrimonio di civiltà, una conquista vera e propria e diremo anche irrinunciabile: 40 000 km di frontiere terrestri, quasi 800 di frontiere marittime, 25 paesi coinvolti e 400 milioni di cittadini. Non basta invocare il supposto problema della sicurezza dei cittadini per mettere in discussione quella che rimane una conquista di grandissimo valore.

Schengen, come il mercato unico, è fra le poche conquiste di questa Unione europea per la quale oggi si può dire che vi è seppure in parte una cittadinanza europea. Ci vuole maggiore cooperazione, maggiore cooperazione di polizia e giudiziaria, responsabilità, solidarietà, il Parlamento europeo vuole un'Europa aperta e integrata, dove ciascun attore faccia in pieno la sua parte ed è questa la sfida ulteriore che noi vogliamo realizzare con il concorso decisivo della Commissione e con un Consiglio che riconquisti la solidarietà dei rapporti con il Parlamento europeo.

  Jacek Protasiewicz (PPE). - Panie Przewodniczący! Pochodzę z kraju, który przystąpił do Unii Europejskiej całkiem niedawno, bo w 2004 roku. Wtedy w referendum Polacy zdecydowanie opowiedzieli się za jednością europejską, za członkowstwem w Unii Europejskiej, podobnie zresztą jak narody wszystkich innych państw, które przystępowały do Unii Europejskiej, bo większość podejmowała decyzje właśnie w drodze takiego ludowego powszechnego głosowania. W naszych krajach również dzisiaj, a w Polsce w szczególności, utrzymuje się wysoki poziom akceptacji dla Unii Europejskiej, dużo wyższy niż w państwach starej Unii. Jednym z głównych powodów, dla których tak się dzieje i dla którego wówczas w tym referendum zdecydowano o przystąpieniu do Unii Europejskiej, była perspektywa swobodnego poruszania się po całej Europie bez granic, bez paszportów, która jest urzeczywistniona przez traktat z Schengen.

Naszą rolą jako reprezentantów społeczeństwa, ludzi wybranych w bezpośrednich wyborach, jest strzec tych wartości, które są bliskie ludziom, tych spraw, na których im naprawdę w Unii Europejskiej zależy. Parlament Europejski musi być uczestnikiem wszelkich decyzji, które dotyczą przyszłości Schengen i ewentualnego przywracania wewnętrznych granic. To są sprawy, na których naszym wyborcom zależy, a naszym obowiązkiem jest strzec i bronić wartości, które są im bliskie, zaś rolą rządów jest zapewnić bezpieczeństwo bez naruszania tych elementarnych wartości, które są ważne dla obywateli Europy.

  Marco Scurria (PPE). - Signor Presidente, onorevoli colleghi, Schengen è patrimonio dell'Europa. L'abbattimento delle barriere fra gli Stati membri è stato il primo segnale di qualcosa di nuovo che si veniva a creare: non più barriere ma unità, non più controlli ma solidarietà fra Stati, non più divisi ma uniti da un'unica grande Unione. Per questo è strano svolgere questo dibattito oggi, sembra essere tornati indietro, sembra che stiamo abbandonando le basi della nostra bella Unione.

Se viene meno Schengen, viene meno l'Unione europea, ma se Schengen è così importante, va tutelato, così come si fa con ciò che si ritiene prezioso. Va tutelato da un Consiglio che pensa di scavalcare le prerogative del Parlamento, ma va tutelato anche da ciò che può mettere in discussione Schengen stesso; allora il controllo delle frontiere esterne va rafforzato con tutti gli strumenti legislativi e tecnologici che abbiamo a disposizione, perché se le nostre frontiere rischiano di diventare un colabrodo, questo automaticamente irrigidisce i nostri Stati membri che potrebbero richiedere un più stretto controllo anche tra i nostri stessi confini per evitare magari il passaggio di immigrati clandestini. Non ce lo possiamo permettere e per questo ringrazio il Commissario Malmström di tutto il lavoro e la collaborazione che metterà su questa vicenda.

  Monika Hohlmeier (PPE). - Herr Präsident, liebe Kolleginnen und Kollegen! Ich halte Schengen für eine der größten Errungenschaften, die es in der Europäischen Union gibt, weiß andererseits aber auch, dass die Grenzen eines Landes für unsere Mitgliedstaaten immer ein sehr sensibles Thema sind und auch bleiben werden. Ich bin mir bewusst, dass die Probleme, die es zwischen den Mitgliedstaaten gibt in Bezug auf Schengen, nicht einfach ignoriert werden können. Und es existieren verschiedene Probleme. Und durch Ignorieren macht man die Probleme nicht besser und man löst sie auch nicht besser.

Ich lebe an der Grenze zu Tschechien, und es würde bei uns niemand auf die Idee kommen, die Grenze nur deshalb wieder schließen zu wollen, weil wir Probleme haben. Aber ich bitte auch die Kommission in diesem Bereich dann um Unterstützung und nicht um Einschränkung und Zurechtweisung. Die Schleierfahndung ist verankert worden, weil wir die Sicherheit gewährleisten wollen bei gleichzeitiger Reisefreiheit. Wenn wir die Schleierfahndung mit Erfolg durchführen, nämlich da – gerade auch an den Grenzen zu Tschechien –, wo der ein oder andere Drogenhändler nicht nur in wenigen Fällen, sondern in vielen Fällen versucht, sich Übergang zu verschaffen, dann halte ich es für gut, wenn sich der deutsche und der tschechische Innenminister zusammensetzen, um die Probleme, die an der Grenze bestehen, gemeinsam zu lösen. Da sollte die Kommission nicht regulierend einwirken, sondern positiv unterstützend einwirken.

Wir wollen die Populisten in die Schranken weisen, aber die wahren Probleme miteinander lösen! Deshalb bitte ich auch den Rat, gemeinsam mit dem Parlament nach einer Lösung zu suchen, damit wir die Schengen-Dossiers erfolgreich verabschieden können, sodass wir Reisefreiheit haben und gleichzeitig die Sicherheit der Bürgerinnen und Bürger gewährleisten.

  Pier Antonio Panzeri (S&D). - Signor Presidente, onorevoli colleghi, signor Commissario, la scelta compiuta il 7 giugno dal Consiglio in realtà non riguarda solo la politica interna europea, ma come si può immaginare ha un impatto anche esterno all'Europa. Tutti qui hanno affermato che la libera circolazione delle persone è una delle più grandi conquiste europee in un'Europa che sa riconoscersi. Viceversa, la sua limitazione rappresenta e descrive in realtà un senso di sfiducia che si vuole distillare tra i paesi europei, nell'opinione pubblica europea e che rischia di distruggere il progetto europeo.

Da tempo chiediamo un'innovativa e moderna governance europea della questione migratoria. Le cose che state facendo, invece, rinazionalizzano la politica dell'immigrazione. Fate fare un passo indietro ai diritti e alle libertà, ma c'è un secondo versante sul quale queste scelte rischiano di avere un riflesso negativo e mostrano una certa schizofrenia dell'azione europea nelle sue diverse politiche.

Abbiamo insieme deciso che uno dei pilastri della nuova politica di vicinato è la mobilità, elemento centrale del nuovo approccio europeo, ad esempio verso un'area in cambiamento come quella del Mediterraneo. Che messaggio mandiamo a questi paesi, se non quello di una sfiducia e di una non credibilità?

  Lena Kolarska-Bobińska (PPE). - Chciałam prosić panią Malmström o ogłoszenie programu „Zero tolerancji dla łamania Schengen”. To, co obserwujemy od półtora roku, to jest powolne podmywanie tych ustaleń i tego, co stanowi kamień węgielny Unii. Różne kraje pod różnymi pretekstami zaczynają wprowadzać czasowe, chwilowe, ukryte, jawne kontrole, a my koncentrujemy się przede wszystkim na unii fiskalnej, mówimy o euro, kryzysie, unii bankowej i nie przykładamy – moim zdaniem – dostatecznej wagi do tych kolejnych kroków poczynionych przez różne kraje. Tak że bardzo proszę o program „Zero tolerancji dla łamania”, bo tylko w ten sposób możemy zapobiec kolejnej erozji systemu Schengen.

  Franziska Keller (Verts/ALE). - Herr Präsident! Die Fälle von unverhältnismäßigen Grenzkontrollen, die das Parlament in seiner Anfrage auflistet, zeigen auch, warum der Rat das Parlament bei Schengen eigentlich außen vor lassen will. Der Rat will nämlich weiterhin die Reisefreiheit untergraben, ohne dass das Parlament an der Beschlussfassung beteiligt wird, ohne irgendeine Form von parlamentarischer Kontrolle, ohne irgendeine Form von Öffentlichkeit. Kein Wunder also, dass Sie sich lieber abseits von unbequemen Fragen in Hinterzimmern auf die Schulter klopfen. Kein Wunder, dass die deutsche Regierung eine Evaluierung der Binnengrenzen ganz ausschließen will und somit gar nicht schauen will, wie sehr die Reisefreiheit eingeschränkt wird. Schengen gehört aber nicht den Regierungen, sondern den Menschen in Europa und gehört somit auch in das Europäische Parlament.

  Monika Flašíková Beňová (S&D) - Zavedenie schengenského priestoru patrí podľa obyvateľov členských štátov Európskej únie medzi náš najväčší úspech. Až 62% občanov členských štátov Európskej únie sa vyslovilo v prieskume, že to považuje za najväčší spoločný európsky úspech a benefit.

A práve teraz, v čase keď potrebujeme ukázať našim občanom, že sme pripravení na hlbšiu spoluprácu, že hlbšia spolupráca Európsku úniu posilní a posunie nás ďalej dopredu, práve teraz prichádza Rada s návrhom, ktorý je pre nás absolútne neakceptovateľný.

Kontroly, ktoré bude možné zaviesť na obdobie šiestich mesiacov a ešte ich navyše aj obnovovať tak, že budú môcť trvať až 2 roky, sú pre nás jednoducho neprijateľné. Nemôžeme s týmto rozhodnutím súhlasiť. Navyše si myslíme, že je to kontraproduktívne, keďže ide o priamy útok na záruky voľného cestovania a slobody pohybu.

A už len záverom podotknem, že stále viac a viac a častejšie sa opakuje, že Rada robí takéto rozhodnutia bez spolupráce s Európskym parlamentom, bez toho aby spolupracovala dobre aj s Európskou komisiou.

Pani komisárka, spojme sa spolu – Parlament a Komisia – a nastavme Rade zrkadlo!

  Norica Nicolai (ALDE). - Salut această dezbatere şi o consider utilă din două raţiuni: pentru că ea este o dezbatere despre raporturile instituţionale între cele trei instituţii europene şi este pentru prima dată când Consiliul îşi permite să ignore una dintre instituţiile care are legitimitatea necesară de a răspunde aspiraţiilor şi verificărilor cetăţenilor europeni. Consiliul trebuie să înţeleagă că Parlamentul este unica instituţie europeană care are o legitimitate democratică sporită. Noi suntem aleşi aici de votul popular şi reprezentăm interesele cetăţenilor europeni. Interesul cetăţenilor europeni este mai multă coeziune, mai multă coeziune înseamnă mai mult spaţiu şi mai multă libertate de mişcare.

Nu cred că, dacă avem guverne incapabile să dea soluţii adecvate la criză şi apelează la măsuri populiste, trebuie să ne întoarcem la feudalism care, nici măcar în perioada feudală, nu a fost propriu Europei, pentru că libertatea de mişcare este un dat, nu a fost construită de Uniunea Europeană. Cetăţeanul european a înţeles foarte clar că acest lucru este ceea ce-l uneşte cultural şi civilizaţional.

  Franz Obermayr (NI). - Herr Präsident! Wir müssen einfach zur Kenntnis nehmen, dass der Wegfall der Grenzkontrollen nicht nur Annehmlichkeiten gebracht hat, wie zugegebener Weise den bequemen Reiseverkehr. Vielmehr erleichtern natürlich diese offenen Grenzen die illegale Zuwanderung, internationale kriminelle Organisationen haben ein leichtes Spiel, europaweit zu agieren. Die unerwünschten Nebenwirkungen kennen Sie alle: aufgebrochene Wohnungen, ausgeräumte Häuser, gestohlene Autos, reger Menschenhandel – aber wir realisieren sie leider in diesem Haus zu wenig. Verschärft hat sich die Lage durch die durchlässige türkisch-griechische Grenze: Allein 2011 sind 300000 Illegale in die Europäische Union gekommen. Vor diesem Hintergrund war es höchste Zeit, dass hier von den Innenministern gehandelt wurde, und ich verstehe die hysterischen Aufschreie in diesem Haus durchaus nicht.

Nun zur Frau Kommissarin: Frau Kommissarin Malmström, wenn Sie vor diesem Hintergrund – 300000 illegale Einwanderer allein aus Südosteuropa – behaupten, dass Flüchtlingsströme in Europa keinesfalls eine Bedrohung der öffentlichen Sicherheit darstellen, dann weiß ich nicht, wo Sie leben und mit welchen Bürgern Sie Kontakt haben. Aber ich lade Sie herzlich ein: Kommen Sie in die Regionen, in mein Heimatland Österreich. Dort werden Sie Bürger kennenlernen, die betroffen sind, die alles andere als Populisten sind, die aber Sorgen und zwar berechtigte Sorgen haben.

  Andreas Mavroyiannis, President-in-Office of the Council. − Mr President, it is a difficult discussion. I hope that nobody really questions the intentions of the Cyprus Presidency.

The Council firmly believes that the new arrangements for Schengen governance, which are already in place, provide a solid basis for ensuring greater oversight of developments in the Schengen area, including by the European Parliament. Please allow me in this intervention to limit myself to the issue at hand and not comment on external borders, although we all know that the two questions are interlinked.

The Council very much wants the Parliament to be involved in the ongoing process on the legislative aspects of the new Schengen governance arrangements. That includes not only the proposal for amending the Schengen Borders Code, which remains – as many of you very rightly mentioned – subject to the ordinary legislative procedure (codecision) but also the Schengen evaluation mechanism proposal. And in saying this I really weigh my words.

My plea to all of you is that we at least agree now to define, confine and circumscribe the disagreement that indeed exists between the European Parliament and the Council to one question, and that is the question of evaluation.

The honourable rapporteur, Mr Coelho, will allow me to say and to insist that there is also a fundamentally legal question and, please do not get me wrong, I am not doing away with the political sensitivities and political aspects of this. But when it comes to evaluation there is an issue on whether, under the Treaty, evaluation remains a peer review or whether it is a competence which has been transferred to the Community level. And somewhere there is agreement there. We should not have a very passionate debate on this – let us talk and let us find a way forward! But please do not consider that it is about lowering existing standards and guarantees.

The Council is already publicly committed to ensuring that the view of the European Parliament will, to the fullest extent possible, be taken into consideration in all its aspects before the adoption of the final text.

We have, of course, also taken very good note of all the comments and, I assure you, all the criticisms you addressed to the Council and be assured that we do not take it badly and we will convey the ‘heat’ we received to the Council and to the Member States.

Based on this, we will try our utmost to find a satisfactory way forward and we hope that we can come to a mutually satisfactory understanding as to how that can be given a practical expression, thus enabling work on these proposals to be brought to a successful conclusion in the very near future.

Let me conclude by saying that we remain as committed as all of you to preserving and strengthening the free movement of persons, as one of the most tangible and successful achievements of European integration.

We firmly believe in a European Union as a space of freedom, including the fundamental issue of freedom of movement, to which Schengen makes an outstanding contribution.

Of course we will fully respect the Treaty and the framework of the Treaty, but we of course stand ready to discuss, and see what improvements we can bring.

  Cecilia Malmström, Member of the Commission. − Mr President, as part of strengthening the Schengen governance, the Commission also proposed that we would have regular discussions on the state of play – the health check – of Schengen. This would be an opportunity to discuss among Ministers the shortcomings and challenges of Schengen on a regular basis. It would take place twice a year based on a report issued by the Commission. The first debate took place last June, and I immediately sent the report to the European Parliament as well, and I am of course willing to discuss with you how we can involve the European Parliament even more in those discussions.

In that report we identified 11 cases that we had been investigating for the last six months. Some of them could very well lead to infringement proceedings but, as I tried to explain on the two cases that you brought up in your oral questions, it is sometimes very difficult to get information and that is why we are now working very hard with Germany and the Czech Republic, including with the Czech bus companies, to see if we can get more information, so they have enough evidence to really bring the issue forward. Moreover, we are also issuing guidelines to the Member States, the first concerning travel documents, because of the background of the discussion between France and Italy on the travel documents of Tunisians, and we are also in regular contact with the Member States to see if there are other issues where we would need guidelines.

So, Ms Weber, everything is not shiny and rosy in Schengen. There are problems, and it is because of this that we proposed a strengthening of the evaluation mechanism, so that we would have the possibility of identifying possible shortcomings very early on and working with the member countries, using all the tools that we have at our disposal to hopefully remedy the shortcomings at our borders.

Mr President-in-Office, that is why we proposed to move from a peer-to-peer-based review to a Commission-led review. It is not because the Commission needs more powers per se, it is because we need an independent European-based system so that we can make sure that we have a compulsory action plan by the relevant Member States and that we can also avoid possible domestic pressures – populism, etc. – which could lead to a reinstallation of internal borders that is not in line with the acquis. That would imply a change of the legal base, also involving the European Parliament.

We maintain that view from the Commission side. Schengen is a European achievement, and that is why we need a European-based governance of Schengen. I hope that after the well-deserved summer break for everybody, we can sit together and see whether there is a way to find a good solution that all institutions can approve.

  Elena Băsescu (PPE), în scris. Pentru cetatenii europeni, libertatea de miscare face parte dintre principalele beneficii concrete generate de integrarea europeana. In acelasi timp, ea consolideaza constructia unui spatiu unic de libertate, de securitate si de justitie. Orice decizie de limitare a acestui drept trebuie sa fie bine justificata, sa fie luata in urma unei analize atente si sa aiba un caracter strict limitat in timp si exceptional. Este nevoie de criterii si conditii clare de aplicare pentru situatiile in care pot fi facute controale la frontierele interne, iar Parlamentul are dreptul sa fie implicat indeaproape in elaborarea si supervizarea lor. Intarzierea nejustificata a aderarii Romaniei la Schengen creeaza deja o discriminare de facto pentru milioane de cetateni europeni. Daca, in plus, se vor practica in mod abuziv controale la frontierele interne, una dintre bazele constructiei europene va fi amenintata. Fac apel la toti liderii europeni sa nu cedeze tentatiilor populiste si sa apere libertatea de miscare. Totodata, cer Comisiei sa monitorizeze indeaproape respectarea acquis-ului Schengen de catre statele membre si sa ia atitudine prompt in cazul oricarui abuz. Nu in ultimul rand, solicit ca in luna septembrie sa se adopte o decizie clara, cu un calendar precis de aderare la Schengen pentru Romania.

  Sebastian Valentin Bodu (PPE), în scris. – Crearea spaţiului Schengen ocupă un loc important în procesul consolidării şi întăririi Uniunii Europene. Acest spaţiu a adus beneficii tuturor statelor membre, atât de ordin economic, care ţin de libera circulaţie a bunurilor între frontierele interne, cât şi pentru cetăţenii europeni, care pot călători liber, fără să mai fie verificaţi de fiecare dată când trec o graniţă internă.

Datorită acţiunilor unor politicieni oportunişti, mânaţi de dorinţa lor de a atrage voturi populiste, sistemului Schengen a fost atacat în mod repetat, prin folosirea lui ca un fel de ţap ispăşitor în vederea creşterii capitalului electoral. Acelaşi lucru se poate observa şi în cazul Bulgariei şi României unde, deşi acestea au îndeplinit toate criteriile necesare pentru a intra în spaţiul Schengen, decizia finală încă se lasă aşteptată.

  Kinga Gál (PPE), írásban. – A mai napon ismét arról a "közösségi hímes tojásról" folyik a vita, amely az európai polgárok szemében az EU legfontosabb vívmánya, nem beszélve a fiatalokról, akiknek közel 90%-a teszi le voksát a szabad mozgás fontossága mellett - egy az Európai Ifjúsági Parlament által készített felmérés alapján. Ezen közösségi vívmány héját kezdi repeszteni az a gyakorlat, amelyet régi tagországok alkalmaznak, amikor egyre rendszeresebben ellenőrzik az új tagállamokból érkező utazókat, autóbuszokat. A gazdasági és pénzügyi válság kellős közepén, amikor a közösségi bizalomra egyre égetőbb szükség lenne, egyes tagállamok a bizalmatlanságot erősítik ezzel. Ami pedig a rendszer alapjait rezgeti meg. Ugyanezt a bizalomvesztést tapasztaltuk a Tanács június eleji döntésékor is. Ezért felkérem a Tanácsot, hogy tegyen meg mindent annak érdekében, hogy a Parlament és a Tanács között kialakult patthelyzetből minél hamarabb továbbléphessünk, együtt fejleszthessük a schengeni kormányzást. Továbbá azért, hogy szeptemberben bizalommal fogadhassuk a két csatlakozásra váró tagországot, Romániát és Bulgáriát a Schengeni térségben.

Στην έκθεση της Κομισιόν ια την ορθή λειτουργία της Συνθήκης Σένγκεν αναφέρεται ότι το 75% των παράνομων μεταναστών που συνελήφθησαν στη Ζώνη Σένγκεν εισήλθαν σε αυτήν μέσω της ελληνοτουρκικής μεθορίου. Το θέμα της λαθρομετανάστευσης θα πρέπει να αντιμετωπιστεί συνολικά σε Ευρωπαϊκό επίπεδο και είναι απαραίτητο να ληφθούν ιδιαίτερα μέτρα για τα Κράτη-Μέλη που συνιστούν τα σύνορα της ΕΕ καθώς αυτά δέχονται και την μεγαλύτερη πίεση σε μια δύσκολη περίοδο οικονομικής κρίσης. Θεωρώ ότι είναι απαραίτητη η αναθεώρηση και επανεξέταση της Συνθήκης Δουβλίνο ΙΙ που θέτει δυσανάλογα βάρη ως προς το θέμα της διαχείρισης της λαθρομετανάστευσης στις χώρες εισόδου των λαθρομεταναστών. Η δε επαναφορά των ελέγχων στα εσωτερικά σύνορα της Ζώνης που προτείνουν η Κομισιόν και το Συμβούλιο Δικαιοσύνης και Εσωτερικών Υποθέσεων της Ε.Ε. στην πραγματικότητα δεν αντιμετωπίζει το πρόβλημα ενώ αναδεικνύει την πολιτική απομόνωση μεμονωμένων Κρατών-Μελών

  Joanna Katarzyna Skrzydlewska (PPE), na piśmie. Porozumienie z Schengen, zawarte 27 lat temu to jedno z kluczowych i najbardziej odczuwalnych przez mieszkańców UE osiągnięć całej naszej Wspólnoty. Łatwość podroży jest dla obywateli naszego kontynentu niezwykle ważna i bardzo doceniana. Z tego względu nie należy w żadnym wypadku ograniczać prawa swobodnego przemieszczania się osób, ani wprowadzać wyjątków od jego przestrzegania. Nie należy również w dyskusji na temat dalszych losów porozumienia pomijać zdania Parlamentu Europejskiego, który reprezentuje obywateli Europy - mieszkańców, którzy w 62% oceniają Porozumienie z Schengen, jako największe osiągnięcie Unii Europejskiej. Nie możemy niszczyć ducha wspólnoty, szczególnie w okresie kryzysu poczucia jedności europejskiej. Otwarte granice to symbol, którego powinniśmy strzec. Przypadek kontroli drogowych na granicy holendersko – belgijskiej oraz czeskich autobusów na granicy niemieckiej stanowi najlepszy przykład, że potrzebujemy zaawansowania i pogłębiania prac nad dalszym rozwojem przepisów dot. strefy Schengen. Działania te powinny być realizowane we współudziale wszystkich instytucji Unii Europejskiej. W związku z tym Rada powinna powrócić na drogę współpracy z eurodeputowanymi oraz Komisją Europejską w sprawie rozporządzenia o nowym mechanizmie oceny Schengen. Według mnie to jedyny sposób zapewnienia prawidłowego funkcjonowania strefy Schengen oraz respektowania praw obywateli w tym zakresie.

  Josef Weidenholzer (S&D), schriftlich. – Die Reisefreiheit ist eine der wesentlichen Errungenschaften Europas, ebenso wie die Gemeinsame Währung, der Euro. Beides wird laufend kurzfristigen Interessen geopfert. Solche Politik bringt weder den von den Populisten gewünschten Erfolg, noch schafft sie die zu lösenden Probleme aus der Welt. Dennoch setzt sich immer mehr dieses Praxis einer symbolischen Politik durch, die Handlungsbereitschaft suggeriert und auf eine wirkliche Lösung der Probleme verzichtet. Seit Jahren sind die europäischen Innenminister unfähig, sich auf eine gerechte Verteilung der Flüchtlinge zu einigen, Europa versagt in der Nachbarschaftspolitik und zieht sich aus der Entwicklungszusammenarbeit zurück. Diese elementaren Fragen sind aber vorrangig zu lösen, sonst wird auch Schengen nicht wirklich funktionieren. Eine Aussetzung des Schengenmechanismus kann daher die Probleme nicht lösen. Wenn überhaupt, darf diese nur in extremen Ausnahmefällen erfolgen. Diese eventuelle Entscheidung darf daher auf keinen Fall von populistischen Einflüssen beeinflusst sein. Sie hat auf europäischer Ebene, unter Beteiligung des Europäischen Parlaments zu erfolgen.
