  El Presidente. − El punto siguiente en el orden del día es el debate sobre la recomendación para la segunda lectura, de la Comisión de Comercio Internacional, respecto de la Posición del Consejo en primera lectura con vistas a la adopción del Reglamento del Parlamento Europeo y del Consejo por el que se establecen disposiciones transitorias sobre los acuerdos bilaterales de inversión entre Estados miembros y terceros países (11917/1/2012 – C7-0328/2012 – 2010/0197(COD)) (Ponente: Vital Moreira) (A7-0389/2012).

  Vital Moreira, relator. − Este é um dos regulamentos mais importantes que até agora temos votado na área do comércio internacional, pois ele dá aplicação e torna efetiva uma das mais importantes inovações no Tratado de Lisboa. Com efeito, na sequência da entrada em vigor do Tratado de Lisboa, faz três anos agora, o investimento direto estrangeiro foi integrado na política comercial comum. E dado que a União tem competência exclusiva em matéria de política comercial comum, isso quer dizer que, a partir de agora, apenas a União pode legislar e adotar atos juridicamente vinculativos nesta matéria, incluindo a negociação de Tratados de proteção do investimento externo da União. Os Estados-Membros, a partir de agora, só podem fazê-lo, por si mesmos, se e quando forem autorizados pela União para esse fim.

Ora, no momento da entrada em vigor do Tratado de Lisboa, há três anos, os Estados-Membros tinham concluído numerosos acordos bilaterais de investimento com terceiros países: mais de 1.200. O principal objetivo desses acordos é, como sabem, proporcionar proteção aos investimentos feitos no estrangeiro, contra ações arbitrárias, expropriação, por exemplo, por parte dos governos dos países que recebem o investimento.

O Tratado de Lisboa não estabeleceu nenhuma disposição transitória explícita para os acordos existentes, que doravante passam a ser competência exclusiva da União. E era, por isso, necessário este regulamento para assegurar uma transição, tão suave quanto possível, de forma a reduzir a incerteza jurídica que resulta deste momento de transição quanto ao estatuto dos Tratados existentes. De acordo com este regulamento, longamente negociado com o Conselho, os acordos bilaterais negociados entre os Estados-Membros e países terceiros, antes da entrada em vigor do Tratado de Lisboa, continuam em vigor até serem substituídos por um acordo de investimento da União ou caducarem por outro modo, exceto se forem contrários ao direito da União, caso em que devem ser revistos ou cancelados pelos Estados-Membros envolvidos, por iniciativa da Comissão Europeia.

Em segundo lugar, o regulamento também legaliza os tratados bilaterais de investimento negociados pelos Estados-Membros ilegalmente depois da entrada em vigor do Tratado de Lisboa, desde que cumpram a estrita condicionalidade estabelecida no regulamento. Esse foi o preço que o Parlamento exigiu para legalizar esses acordos.

Em terceiro lugar, o presente regulamento define também as condições, estritas por acaso, em que os Estados-Membros podem ser autorizados, daqui em diante, a alterar ou a celebrar novos acordos internacionais de investimento nos casos em que a União, obviamente, não tem interesse em negociá-los ela própria.

O mais tardar daqui a dez anos, a Comissão apresentará ao Parlamento Europeu e ao Conselho um relatório sobre a sua aplicação e poder-se-á então fazer uma avaliação da situação e propor as alterações que forem necessárias. Foi longo o caminho para chegar aqui. Como relator deste dossiê, cumpre-me dizer que considero o acordo plenamente satisfatório e que os objetivos fundamentais do Parlamento Europeu foram obtidos para bem da União e para bem do interesse das nossas empresas e dos nossos investimentos.

  Karel De Gucht, Member of the Commission. − Mr President, on behalf of the Commission, I would like to convey our deep appreciation of the excellent cooperation with Parliament in achieving a satisfactory compromise on the proposed bilateral investment treaties regulation. An intensive succession of trialogues has demonstrated that the ordinary legislative procedure allows a rich and constructive dialogue, resulting in strong and high-quality legislation. I would like to thank the members of the Committee on International Trade and its Chair, Professor Moreira, for their engagement on this topic.

The reason for tabling this proposal in the first place is that the Lisbon Treaty modernised EU common commercial policy. In particular, it transferred foreign direct investment to European level and entrusted the EU with a major additional policy tool. All the institutions agreed from an early stage that a new EU investment policy had to be based on existing experience in Member States. Indeed their investment agreements concluded over the last 60 years with further states constitute a precious acquis. At the same time it was, and still is, necessary to build a genuine EU policy.

This regulation, as Professor Moreira rightly stated, is a key piece of legislation in the trade area, although not an easy one. The trialogues demonstrated that the matters covered by the regulation involved very complex legal and institutional aspects. The finalisation of the legislative process for this regulation in an early second reading would be a remarkable achievement for all of us.

The regulation ensures legal certainty for European investors. They will be able to continue benefiting from the 1 400 bilateral investment agreements currently in force, as these agreements will receive a strong legal footing under EU law. These agreements will remain in force until they are replaced by Union agreements. At the same time the regulation contains all the appropriate safeguards to ensure that these bilateral investment agreements will not create any serious obstacles to the smooth implementation of EU investment policy, which is a key priority.

The adoption by Parliament of the regulation will allow the Union and its institutions to focus on the implementation of EU investment policy, by advancing EU-wide investment negotiations to ensure a very high level of protection for all European investors on a level playing field and in full consistency with the Union’s wider trade and external policy objectives.

I therefore call upon the European Parliament to endorse the final agreement on the regulation establishing transitional arrangements for bilateral investment agreements of Member States today. It is encouraging to note almost unanimous support of the International Trade Committee in its recent vote.

  Ria Oomen-Ruijten, namens de PPE-Fractie. – Ik spreek namens mijn collega Zalewski, die eigenlijk schaduwrapporteur voor dit dossier is en die zojuist is aangekomen, maar mij toch voorrang verleent.

Collega Moreira heeft het al heel helder gezegd, sinds het Verdrag van Lissabon vallen directe buitenlandse investeringen onder de gemeenschappelijke handelspolitiek van de EU. Dat is goed zo. Dat betekent dat alleen de EU gemachtigd is om wetgevende en juridisch bindende handelingen te verrichten. Dat betekent dus dat op den duur bilaterale investeringsbeschermingovereenkomsten met derde landen door de EU worden afgesloten. Ook prima!

Maar hier zitten toch nog wat problemen aan vast. Tal van lidstaten hebben heel veel van die IBO's afgesloten. Die blijven nu bindend, dat voorziet deze verordening. Maar de vraag is of straks datgene wat de EU gaat doen van dezelfde hoge kwaliteit is als de overeenkomsten die de lidstaten met die verschillende landen hebben afgesloten.

Daarom deze oproep: zorg ervoor dat je niet de kleinste gemene delen krijgt, wanneer je nieuwe contracten afsluit, maar zorg voor een hoog niveau. Dat is verzoek één.

Verzoek twee. Wat ik mis is voldoende arbitragemogelijkheid, waarbij geschillen niet alleen door lidstaten bij het International Center of Investment Disputes aanhangig kunnen worden gemaakt, maar ook bedrijven zelf, dus in plaats van de landen, een arbitragemogelijkheid krijgen. Ik denk dat dat heel belangrijk is.

En dan nog wellicht tot slot één ding: de Commissie is nu aan het onderhandelen met Canada. De vraag is of dat akkoord dat de Commissie nu met Canada gaat sluiten wel van een dusdanig hoog niveau is dat de lidstaten er niet al te veel voor hoeven te gaan inleveren, hetgeen het geval zou kunnen zijn als je met bijvoorbeeld nog veel lastiger landen als China moet gaan overleggen.

Op deze vragen, opmerkingen, zie ik graag een antwoord van de commissaris tegemoet. Ik dank u zeer.

  Josefa Andrés Barea, en nombre del Grupo S&D. – Señor Presidente, señor Comisario, como decía el ponente, esto es muy importante: son las normas del juego que establece el Tratado de Lisboa para los próximos acuerdos comerciales bilaterales; la Unión Europea va a ser la responsable de legislar o de disponer los criterios para que los Estados legislen.

Este es un Reglamento equilibrado, seguro para los Estados, que armoniza este ámbito a escala de la Unión Europea. Ha sido difícil porque los Estados se han resistido a situaciones de interferencia sobre sus propias decisiones a causa, muchas veces, de situaciones delicadas causadas por los acuerdos bilaterales. Pero, el objetivo, en concreto, es que la Unión Europea avance en materia de inversión y, por lo tanto, hay que tener seguridad jurídica en relación con las inversiones.

Con este informe hemos encontrado la pieza clave, como decía el Comisario, para garantizar y proteger los acuerdos de los Estados miembros con terceros países, armonizar las inversiones de la Unión Europea en su conjunto, y garantizar el cumplimiento, también importante, de las resoluciones de los procedimientos de arbitraje —hay que asumirlas—. Asimismo, se debe buscar en los futuros acuerdos la responsabilidad financiera.

Este Reglamento ha dado transparencia, ha dado igualdad, ha puesto en negro sobre blanco que los acuerdos no sean abusivos y que no se produzcan incumplimientos.

  Niccolò Rinaldi, a nome del gruppo ALDE. – Signor Presidente, onorevoli colleghi, signor Commissario, l'adozione di questo regolamento è un passo in avanti importante nell'affermazione di uno dei principi più innovatori del trattato di Lisbona, vale a dire la competenza esclusiva della dimensione comunitaria in materia di commercio internazionale.

Noi sosteniamo il lavoro che è stato svolto dal presidente Moreira e l'accordo trovato con il Consiglio. Non c'è niente di più patetico, e quasi anacronistico, di vedere i singoli paesi europei lottare da soli per strappare quella o quell'altra condizione commerciale favorevole solo a loro. Credo che la Commissione possa sicuramente essere più garante rispetto ai singoli Stati membri di accordi effettivamente utili. È patetico anche per le ridotte dimensioni dei nostri paesi in un sistema globale.

Il regolamento prevede una condivisione delle competenze e un margine di flessibilità, ma mette soprattutto la parola fine a quella che era diventata una cacofonia dove gli accordi bilaterali non erano solo una tutela dei propri interessi legittimi ma, a un certo punto, potevano diventare anche uno strumento di concorrenza rispetto ad altri paesi dell'Unione e tutto questo a scapito degli Stati dell'UE più piccoli e meno competitivi nella scena internazionale.

Come sempre poi molto dipende dall'effettiva attuazione di questo regolamento. La Commissione acquisisce un potere importantissimo – ne siamo contenti – e un ruolo che noi sosteniamo affinché ci sia un vero garante degli interessi europei. Tempi, autorizzazioni, notificazione, ritiro delle stesse autorizzazioni, riesame e via dicendo sono oggetto di norme che a noi sembrano equilibrate in questo accordo.

Chiedo alla Commissione un'attenzione particolare soprattutto per gli interessi e i bisogni delle piccole e medie imprese, che sono spesso penalizzate da questo tipo di accordi sugli investimenti ma che al tempo stesso sono la parte più innovativa e spesso anche quella più suscettibile di creare occupazione nei nostri paesi. Soprattutto, sarà necessario dimostrare che la tutela europea è più ambiziose e più efficace di quella dei singoli Stati membri, che appartengono però a un mondo di un'Europa frazionata che tutto sommato vogliamo vedere soltanto nel passato.

  Franziska Keller, on behalf of the Verts/ALE Group. – Mr President, I would like to thank our Chair and also the shadow rapporteurs, especially Pawel Zalewski, for their steadfastness and determination throughout this process.

We Greens are happy that the final result preserves the institutional prerogatives of Parliament in its new competences on the EU investment policy. This is a success which was seriously called into question by some forces in the Council at some points. We recognise that the regulation makes the most out of a situation which saw Council and Parliament as antagonists.

However, the regulation fails to deliver on its key purpose, that is to phase out, in an orderly manner, all existing bilateral investment treaties of the Member States in a clear timeframe of transition. It leaves the door open for an eternal dual system. We might have Member States’ BITs remaining with us for our lifetime and there is no certainty that one day Member States’ BITs will be a definite thing of the past.

In substance the BITs legislation remains unsatisfactory with regard to its original purpose, that is to guarantee that BITs are from now on a transitional agreement on the way to a common EU investment policy. Therefore we Greens are against this legislation.

  Jaroslav Paška, za skupinu EFD. – Odovzdanie kompetencií členských štátov v oblasti spoločnej obchodnej politiky do rúk európskych inštitúcií si vynúti rozsiahle administratívne opatrenia ako na úrovni Európskej únie, tak aj na úrovni členských štátov a ich obchodných partnerov.

Stovky bilaterálnych investičných dohôd, ktoré v minulosti uzavreli členské štáty podľa rôznych právnych režimov, bude potrebné postupne konvertovať do právneho systému Európskej únie tak, aby nedošlo k zmenám v právach jednotlivých zmluvných strán. Renegociácie bilaterálnych investičných dohôd rozpracovaných či uzavretých v minulosti medzi členskými štátmi a tretími krajinami nemôžu prebiehať bez priamej participácie pôvodných zmluvných strán, a preto bude nevyhnutné pri tomto procese zvoliť vhodnú procedúru v súlade so znením Zmluvy o fungovaní Európskej únie. Pritom bude potrebné brať ohľad aj na skutočnosť, že pri renegociáciách sa bude zaobchádzať s informáciami, ktoré sa definujú ako dôverné, a preto musíme zabezpečiť primeranú diskrétnosť spracovania citlivých údajov aj v nových podmienkach.

Jednou z možností ako organizačne aj technicky zvládnuť komplikovaný proces prevedenia bilaterálnych investičných dohôd pod gesciu Európskej únie je aj v pozícii Rady deklarovaný prenos kompetencií vykonávacích právomocí na Európsku komisiu v zmysle nariadenia č. 182/2011. Vzhľadom na rozsiahlosť a náročnosť tohto procesu však musí byť celý systém práce a koordinácie veľmi precízne pripravený a spracovaný.

  Hans-Peter Martin (NI). - Herr Präsident! MAI hieß das Kürzel, das in den 90er-Jahren des vergangenen Jahrhunderts Hunderttausende besorgte Bürger auf die Straße gebracht hat. Multilateral Agreement on Investments – es war damals so gesehen worden, dass es die großen Konzerne weltweit gegen jede Form von dringend notwendigen Eingriffen seitens damals noch souveräner Nationalstaaten absichert und sie schützt. Jede Form von Verstaatlichung hätte es unmöglich gemacht, Arbeitnehmerrechte hätte es beschränkt.

An dessen Stelle ist – aus Wahrnehmung verschiedenster Historiker und Ökonomen – die zu schnelle Erweiterung der Europäischen Union getreten, weil man gesagt hat, nachdem es durch Bürgerwiderstand auf der Straße gescheitert ist, wenigstens da wollen wir Sicherheit haben, wenigstens da sollen die großen Konzerne ganz abgesichert agieren können.

Parallel dazu haben sich diese ganzen Abkommen bilateral entwickelt. Jetzt soll das zusammengefasst werden. Im Prinzip, wenn man so wie ich ein glühender Pro-Europäer ist, aber sehr kritisch gegenüber dieser extrem wachsenden Umverteilung innerhalb der der Europäischen Union, ist es sehr sinnvoll, dass man es abstützt.

Doch die Fragen sind: Wie werden dann tatsächlich KMU geschützt? Wie sieht es mit Patenten aus? Wie verhalten wir uns gegenüber den afrikanischen Staaten? Wäre es nicht viel sinnvoller, bei solchen Abkommen zwischen tatsächlichen Entwicklungsländern und den Schwellenländern, wo wir den Schutz brauchen würden, zu differenzieren?

Ich bin unglücklich über das, was da vorgelegt wird, und die Entwicklung, die es nimmt. Ich denke, es ist der falsche Weg. Und ich würde mir sehr wünschen, dass die Europäische Union sich aus einem anderen Selbstverständnis heraus um Absicherung von Institutionen kümmert als nur unter dem Gedanken des Absicherns der Großkonzerne.

  Paweł Zalewski (PPE). - Panie Przewodniczący! Regulacja, którą przyjmiemy jutro na posiedzeniu plenarnym, jest niezwykle istotna dlatego, że pokazuje, w jaki sposób ten bardzo ważny artykuł traktatu lizbońskiego dotyczący wspólnej polityki inwestycyjnej będzie mógł być zrealizowany w praktyce. Chciałem podziękować serdecznie wszystkim kolegom, którzy współpracowali po stronie Parlamentu Europejskiego, po stronie socjalistów, liberałów, Zielonych, ECR-u nad tą dyrektywą – panu Moreirze, panu De Guchtowi, którego zespół przedstawił bardzo interesującą koncepcję. Rzeczywiście jest tak, iż Zieloni zaprezentowali bardzo daleko idącą wspólnotową regulację, która jednoznacznie przesuwa ciężar zabezpieczenia interesu inwestorów europejskich na stronę Unii Europejskiej. Negocjacje z Radą pokazały, że nie jest to możliwe.

Niemniej jednak ta regulacja, nad którą jutro będziemy głosowali, jest także regulacją wspólnotową. Może nie tak daleko idącą, jak chcieli nasi koledzy z partii Zielonych, ale wydaje mi się, że gwarantującą najważniejsze elementy. Po pierwsze, system ochrony inwestorów europejskich będzie wspólny, nie będzie podziału na tych, którzy są lepiej chronieni i tych, którzy są gorzej chronieni. A wiadomo, że niektóre kraje wykorzystują te różnice w ochronie dla różnego rodzaju nacisków politycznych.

Po drugie, wiadomo w jaki sposób – to znaczy do momentu, w którym nie powstanie ogólny europejski system – te europejskie umowy będą działały. Ważne jest to, żeby te europejskie umowy zostały jak najszybciej wynegocjowane – tu wielka rola Komisji, pana komisarza De Guchta – i jestem przekonany, że wkrótce – chociażby w przyszłym roku, mam nadzieję, że pierwszą umową taką będzie umowa kanadyjska – będziemy mieli pierwsze umowy wspólnotowe. To jest niezwykle ważne, aby w tym momencie Unii Europejskiej, w którym myślimy o osobie, myślimy o takich bardzo indywidualnych interesach, ten interes wspólnotowy poprzez tę regulację był...

  Gianluca Susta (S&D). - Signor Presidente, onorevoli colleghi, mi auguro che domani il Parlamento europeo possa esprimere un voto favorevole su questo regolamento che rappresenta una pagina importante verso l'attuazione piena del trattato di Lisbona nella politica commerciale. Grazie quindi all'iniziativa legislativa della Commissione e grazie soprattutto al collega Vital Moreira che l'ha portata fino qua.

È un'iniziativa sicuramente importante perché dà attuazione al trattato, supera la frammentazione nel campo della politica commerciale sugli investimenti e soprattutto, come ricordava anche il collega Rinaldi, evita e supera un dumping interno tra i 27 paesi – tra poco 28 – dell'Unione europea su materie così importanti come gli investimenti commerciali, che sono uno strumento essenziale per la competitività. Si tratta quindi di un accordo che garantisce una certezza legale agli investimenti effettuati prima del passaggio di competenze al trattato di Lisbona e che disciplina anche la fase transitoria, e rappresenta quindi un aspetto molto significativo e importante sulla politica commerciale.

  Andreas Mölzer (NI). - Herr Präsident! Aus den Freundschafts-, Handels- und Schifffahrtsverträgen früherer Jahrhunderte und Jahrzehnte hat sich wegen der Mehrgleisigkeit von Investitionsschutzabkommen, regionalen Wirtschaftsabkommen und internationalen Übereinkommen bekanntlich ein wirklich unübersichtliches System entwickelt. In diesem Wirrwarr klagen manche Staaten über unzumutbare Einschränkungen ihres regulatorischen Spielraums. In einer Zeit, in der der Umsatz mancher Unternehmen das Bruttonationaleinkommen ganzer Länder übersteigt und in der transnationale Konzerne oft zu Lasten der nationalen Ökonomie wachsen, dürften sie damit nicht ganz Unrecht haben. Dies auch angesichts der Doppelfunktion von Juristen oder Richtern im Rahmen der Investitionsschutzklagen.

In diesem Zusammenhang muss die EU klar agieren, um nicht die eigene, mit Milliarden geförderte Entwicklungspolitik zu konterkarieren. Immerhin hat die Kombination aus Deregulierung, Investitionsliberalisierung, Exportgarantien und bilateralen Investitionsschutzabkommen für Entwicklungsländer bekanntlich massive Konsequenzen, und es gilt eine Lösung für Fälle zu finden, in denen einem EU-Staat ein Vertragverletzungsverfahren droht, wenn die Verpflichtung aus einem Investitionsschutzschiedsspruch mit EU-Recht unvereinbar ist.

Einer Lösung bedarf es auch hinsichtlich der Unklarheiten, die sich aus der mit dem Vertrag von Lissabon erfolgten Übertragung der Kompetenz ausländischer Direktinvestitionen auf die EU ergeben.

Diese Punkte sind meines Erachtens zu klären, bevor die EU mit China ein Investitionsschutzabkommen abschließt.

  Silvia-Adriana Ţicău (S&D). - Salutăm poziţia în primă lectură a Consiliului în vederea adoptării Regulamentului de stabilire a unor dispoziţii tranzitorii privind acordurile bilaterale de investiţii încheiate între state membre şi ţări terţe.

Înainte de intrarea în vigoare a Tratatului de la Lisabona, statele membre au negociat şi semnat acorduri de investiţii cu state terţe. Statele membre au încheiat peste 1 000 de astfel de acorduri bilaterale, care se referă, parţial sau în totalitate, la investiţii străine directe. După Tratatul de la Lisabona, investiţiile străine directe au devenit o competenţă exclusivă a Uniunii Europene şi o parte integrantă a politicii comerciale a Uniunii.

Prezenta propunere de regulament stabileşte un cadru şi condiţii în care statele membre să fie autorizate să deschidă negocieri cu o ţară terţă pentru a modifica un acord bilateral de investiţii existent. Acest cadru va permite statelor membre să negocieze şi să încheie, în anumite condiţii stabilite în prezenta propunere, un nou acord bilateral de investiţii cu ţări terţe.

  Franz Obermayr (NI). - Herr Präsident! Mit dem Vertrag von Lissabon gehören ausländische Direktinvestitionen zur gemeinsamen Handelspolitik, und demnach hat die EU ausschließliche Zuständigkeit. Und die Mitgliedstaaten dürfen nur mehr Abkommen abschließen, wenn sie von der Union ermächtigt werden.

Abgesehen davon, dass hier die Kompetenzen der Mitgliedstaaten massiv eingeschränkt werden, gibt es auch Probleme mit der Rechtssicherheit, denn bestehende Abkommen der Mitgliedstaaten bleiben nach dem Völkerrecht immerhin bindend.

Das heißt, es ist daher wichtig, dass besonders für Investoren aus der Union die höchsten Schutzstandards gelten müssen. Wenn Schutzstandards in einem Abkommen eines Mitgliedstaates höher sind als in einem Abkommen der Union, dann sollten jedenfalls die höheren Schutzstandards Anwendung finden.

  Karel De Gucht, Member of the Commission. − Mr President, let me just briefly react to a couple of remarks which have been made during this debate – a debate which demonstrated, I believe, that there is general support for the proposal we have been making and which, through the negotiations in the trialogue under the chairmanship of Professor Moreira, has resulted in the text which has now been submitted to you.

There was a question by Mrs Oomen-Ruijten asking whether there will be the same high level of protection as is found now in a number of bilateral investment treaties? Yes of course; I believe that the prime aim of what we have to do in the future is to make sure that every Member State receives exactly the same high level of protection as is now only reserved for a couple of countries.

That is what you see when you look at the 1 400 treaties: you can see that there are a number of countries that are extremely well protected and in many cases this also has to do with the size of that Member State. Now what I see as the Commission’s duty is to make sure that every Member State, even the smallest one, receives exactly the same high level of protection as is now reserved only for a couple of countries.

Secondly, is this going to create a kind of eternal system? I do not believe so and let me give you two answers. First, we have been asking for a number of mandates to negotiate investment treaties with Singapore, with Canada and with India, and we have had no problem obtaining them from the Council – after discussion of course, as is right and proper. But they have entrusted to us to negotiate this on behalf of the European Union.

Now regarding the phasing-out: will it be an eternal system? No, precisely because Member States are going to insist more and more that these bilateral investment treaties become European investment treaties, because that is how they will get the same protection. So it is the Member States themselves who are going to insist that we make Europe-wide agreements out of the existing bilateral investment treaties.

That, I think, is the logic which lies in this regulation and that is also why the Commission has agreed to walk away from its initial proposal of limiting the phasing-out to a certain number of years. It was not realistic; Member States did not like it at all so it was not possible to have a regulation on that basis. But having thought this over, I believe it is much more likely that the dynamic will be of the Member States wanting to have the same kind of protection that will bring us to a system – it will take some years of course – which is identical for all Member States, and that is what I believe the Commission should be aiming at.

  El Presidente. − Señor Comisario, es muy gratificante para los diputados, para este Presidente y seguro que también para el ponente encontrarnos con un Comisario que conoce el tema del que está hablando y que no viene exclusivamente a leer un papel que se le ha preparado.

Creo que es algo que todos apreciamos y es importante que usted tenga conciencia de la estima que nos merece el hecho de que quien es nuestro interlocutor tenga realmente un conocimiento muy profundo del tema que estamos debatiendo. Ello nos obliga a todos a ser mejores.

  Vital Moreira, relator. − Senhor Presidente, permita-me que me associe ao elogio da seriedade e responsabilidade do Comissário De Gucht. É por isso, seguramente, que ele até agora raramente perdeu uma iniciativa no Parlamento Europeu, com exceção do malogrado acordo ACTA.

Sr. Presidente, Sr. Comissário, Srs. deputados, este é um feliz termo para uma negociação que foi tudo menos fácil. Os Estados-Membros demoraram a convencer-se, primeiro, de que o investimento direto estrangeiro passou a ser uma competência exclusiva da União, segundo, de que os tratados existentes bilaterais só poderiam manter-se em vigor se não fossem um obstáculo ao desenvolvimento da política de investimento da União e, terceiro, de que há um inestimável valor acrescentado numa política comum de comércio externo em vez de uma política fragmentada entre os 27 Estados-Membros da União.

Ao chegarmos aqui, no final desta difícil negociação, importa sublinhar o empenhamento, a seriedade e a responsabilidade das três instituições. Não teria sido possível sem a contribuição da Presidência polaca do Conselho, que iniciou as negociações, e da Presidência dinamarquesa, que as concluiu, e sem a intermediação da Comissão, sem cuja contribuição dificilmente poderíamos ter chegado a um acordo. Permitam-me, aqui, lembrar o protagonismo do Vice-Diretor-Geral João Aguiar Machado, que foi inexcedível na sua tentativa de encontrar soluções satisfatórias entre o Conselho e o Parlamento Europeu, e, finalmente, dos meus colegas relatores-sombra, em especial a Pavel Zalewski, que não regatearam o seu empenhamento na obtenção de um acordo por mais difícil que ele parecesse no início. Por isso, peço a esta Câmara que adote este regulamento com largo apoio. É um passo enorme que damos em direção a uma maior integração da política do comércio externo e da política de investimento externo da União. A partir de agora, a União será mais estreita, an ever closer Union, também aqui no domínio do comércio externo e do investimento externo.
